Winingham v. Anheuser-Busch, Inc. 859 F.Supp. 1019 (1994)

Ostrich owners sued to recover actual and exemplary damages, attorney fees, costs and interests for gross negligence after an airship flew over their property at  low altitude, which frightened interfered with the ostriches’ breeding. The District Court held that: (1) allegations of fright and temporary loss of libido failed to allege compensable injury absent proof of physical injury; and (2) owners were not entitled to recover speculative value of unborn offspring; and (3) absent actual damages, exemplary damages could not be awarded.

Powell v. Johnson 855 F.Supp.2d 871 (D. Minn. 2012) While searching for a person involved in a shooting, a police officer happened upon the plaintiff’s home and noticed the garage door and opening to the backyard were open. Upon finding nothing suspicious, he began to leave the area. The plaintiff’s dog caught sight of the officer and began walking toward him, eventually running towards him, the officer claimed. The officer then pulled out his service revolver and fired one shot, killing the dog instantly. The plaintiff claimed, inter alia, violations of his Fourth and Fourteenth Amendment rights, intentional infliction of emotional distress, and negligent hiring and supervision on the part of the officer and municipality. The court held that the plaintiff did not meet his burden in defeating the officer’s qualified immunity, as the officer’s account of the incident constituted a reasonable seizure.
Powell v. Johnson 855 F. Supp. 2d 871, 877 (D. Minn. 2012) Blu, a pit bull was shot in the head and killed after Officer Johnson entered the pit bull’s yard. The Plaintiffs, who were owners of Blu, filed a complaint asserting a: violation of the Fourth and Fourteenth Amendments by shooting and killing Blu (Count I); violation of Plaintiffs' constitutional rights due to the City's failure to adequately hire, train, and supervise Johnson (Count II); intentional infliction of emotional distress (Count III); negligent hiring, supervision, and retention of Johnson (Count IV); vicarious liability (Count V); and trespass and conversion (Count VI). The Defendants, Officer Johnson and the City of Minneapolis, filed a Motion for Summary Judgment. The court held that the Motion would be granted in part. The court reasoned that Blu was property, rather than a person, for Fourth Amendment purposes and the officer's shooting and killing of Blu constituted a “seizure.” However, the court concluded that Officer Johnson was entitled to qualified immunity on Plaintiffs' Fourth Amendment claim. The court reasoned that it was not unreasonable for the Officer to perceive a threat to his safety when the large pit bull jogged up behind him. The court also held that The Motion for summary judgment was granted as to the remaining claims because the evidence in the record, failed to establish a constitutional violation by Defendants.
New Mexico Department of Game and Fish v. United States Department of the Interior 854 F.3d 1236 (10th Cir. 2017) Defendant, The United States Fish and Wildlife Service (“FWS”) released two Mexican gray wolf pups on federal land in New Mexico without a permit. Their goal was to increase the recovery of the wolf population more rapidly. The Plaintiff, New Mexico Department of Game and Fish ("Department") brought action against FWS and the United States Department of Interior. The Department requested declaratory and injunctive relief to prohibit FWS from releasing more Mexican gray wolves within New Mexico’s borders. Other wildlife organizations and various states also intervened as Defendants. The United States District Court for the District of New Mexico, entered an order granting the Department a preliminary injunction. The Defendants appealed. The United States Court of Appeals, Tenth Circuit, reversed and remanded. The Court held that: (1) the Department failed to establish a significant risk of irreparable injury to its wildlife management efforts, and (2) the Department failed to establish a significant risk of irreparable injury to New Mexico’s sovereignty.
Revock v. Cowpet Bay West Condominium Association 853 F.3d 96 (3d Cir. 2017) Homeowners brought action against thier condominium association and other homeowners, claiming that the association failed to provide a reasonable accommodation for homeowners' disability in the form of emotional support animals, and that the other homeowners interfered with the fair exercise of their fair housing rights, in violation of the Fair Housing Act (FHA). The Court of Appeals held that: 1) Fair Housing Act claims survive the death of a party; 2) issue of fact as to whether association reviewed homeowners' paperwork for an emotional support animal precluded summary judgment on claims association failed to make a reasonable accommodation under the Fair Housing Act; 3) issue of fact as to whether association reviewed homeowners' paperwork for an emotional support animal precluded summary judgment on Fair Housing Act interference claims; 4) issue of fact as to whether neighbor's comments about homeowners were sufficiently severe or pervasive so as to interfere with homeowners' Fair Housing Act rights precluded summary judgment on Fair Housing Act interference claims; and 5) issue of fact as to whether neighbor's blog posts about homeowners were sufficiently severe or pervasive so as to interfere with homeowners' Fair Housing Act rights precluded summary judgment on Fair Housing Act interference claims. Reversed in part, vacated in part, and remanded.
N.Y. Pet Welfare Ass'n, Inc. v. City of N.Y. 850 F.3d 79 (2d Cir. 2017)

In 2015, New York City enacted a group of laws aimed at dealing with problems associated with the companion animal business in the city by regulating the sale of dogs and cats in pet shops. On the day the laws were to go into effect, the New York Pet Welfare Association (NYPWA) filed suit challenging two of the laws. The first law, the “Sourcing Law,” required that pet shops sell only animals acquired from breeders holding a Class A license issued under the federal Animal Welfare Act (AWA). The second law law, the “Spay/Neuter Law,” required that pet shops sterilize each animal before releasing it to a consumer. NYPWA argued that the Sourcing Law violated the “dormant” Commerce Clause and is preempted by the AWA, and that the Spay/Neuter Law is preempted by New York law. The district court dismissed NYPWA’s complaint and the 2nd Circuit Court of Appeals affirmed the district court’s decision. First, the 2nd Circuit determined that the Sourcing Law did not violate the Commerce Clause because it did not discriminate against interstate commerce. The 2nd Circuit found that the Sourcing Law may make it difficult for certain out of state breeders to sell to city shops, but so long as breeders from other states are allowed to sell in the city, then it is not considered to be discriminatory. Also, the 2nd Circuit found that NYPWA was unable to show that any incidental burden that the Sourcing Law placed on out of state breeders was excessive and therefore the law passed under the Pike Balancing test. Lastly, the 2nd Circuit determined that the Spay/Neuter Law was not preempted by New York Law because NYPWA failed to identify a single New York statute or case that suggests that the new law would be preempted in any way. As a result, the 2nd Circuit affirmed the district court’s ruling.

Missouri ex rel. Koster v. Harris 847 F.3d 646 (9th Cir. 2017) After California passed Proposition 2 to mandate more humane housing standards for egg laying hens, the state then passed Assembly Bill 1437 to extend the applicability of Proposition 2’s standards to out of state egg producers. In response, six states, Missouri, Nebraska, Oklahoma, Alabama, Kentucky, and Iowa, filed suit against the Attorney General of California seeking to block enforcement of the regulations before they went into effect. The states asserted parens patriae standing on behalf of the egg producers within their borders that would face increasing production costs as a result of compliance with the requirements of Proposition 2 and Assembly Bill 1437. The district court dismissed the case with prejudice, finding that plaintiffs lacked standing. On appeal, the court found that plaintiffs failed to establish an interest apart from those of private egg producers within their borders, and acknowledged that those private egg producers could file a claim themselves. The allegations about the potential economic impact of the regulations were also found to be speculative, since the regulations had not yet gone into effect. Lastly, the court held that the regulations themselves are nondiscriminatory, since they apply to in state egg producers as well. However, because plaintiffs could file an amended complaint after the regulations go into effect that may be sufficient to establish standing, the case was dismissed without prejudice.
U.S. v. Rioseco 845 F.2d 299 (11th Cir. 1988)

After defendant was found fishing in the Cay Sal Bank area of the Bahamas, Coast Guard officers informed appellant that possession of a Bahamian fishing license was necessary to fish in those waters and that failure to possess such a license would render such fishing a contravention of the United States Lacey Act.  On appeal, defendant contended that the Lacey Act is unconstitutional in that it incorporates foreign law, thereby delegating legislative power to foreign governments.  The court found that the Lacey Act which prohibited the possession or importation of fish and wildlife taken in violation of foreign laws, was not an improper delegation of legislative power simply by its reference to foreign law.

Gluckman v. American Airlines, Inc. 844 F.Supp. (151 S.D.N.Y., 1994)

Plaintiff sued American Airlines for emotional distress damages, inter alia , after his dog suffered a fatal heatstroke while being transported in the cargo hold of defendant's airliner (the temperature reached 140 degrees Fahrenheit in violation of the airline's cargo hold guidelines).  Plaintiff relied on the state case of Brousseau v. Rosenthal  and Corso v. Crawford Dog and Cat Hosp., Inc  in support of his negligent infliction of emotional distress claim.  The court observed that none of the decisions cited by plaintiff, including Corso, recognize an independent cause of action for loss of companionship, but rather, they provide a means for assessing the "intrinsic" value of the lost pet when the market value cannot be determined.  As a result, the court rejected plaintiff's claim for loss of companionship as well as pain and suffering without any prior authority that established the validity of such claims. 

Front Range Equine Rescue v. Vilsack 844 F.3d 1230, 1235 (10th Cir. 2017)

Between 2006 and 2011, Congress prevented commercial equine slaughter by prohibiting the use of funds for inspection of equine slaughterhouses.  In 2012, Congress lifted the ban on funding and the Food Safety Inspection Service  (FSIS) , which is a branch of the United States Department of Agriculture (USDA), issued grants of inspection to two commercial equine slaughter facilities: Valley Meat Company, LLC and Responsible Transportation, LLC. Plaintiffs, Front Range Equine Rescue, the Humane Society of the United States, and several other individuals and organizations (collectively, “Front Range”) sued officials of the USDA (“Federal Defendants”). Plaintiffs were seeking a declaration that the grants of inspection violated the National Environmental Policy Act and requested that the court set aside the grants of inspection.  The United States District Court for the District of New Mexico,  granted Front Range's motion for a temporary restraining order (TRO), which prohibited the Federal Defendants from sending inspectors to the equine slaughterhouses  or providing equine inspection services to them. The district court also ordered Front Range to post injunction bonds for Valley Meat and for Responsible Transportation and denied Front Range's request for a permanent injunction. Front Range appealed but the appeal was dismissed as moot. However, Valley Meat and Responsible Transportation then filed a motion in the district court to recover the injunction bonds. The motion was denied. Valley Meat then appealed the denial of damages on the injunction bond.  The United States Court of Appeals, Tenth affirmed the district court and held that Valley Meat was not entitled to recover. The Appeals Court reasoned that even if Valley Meat suffered damages, it cannot recover against the bond unless it first showed wrongful enjoinment. Valley Meat failed to do so and therefore could not collect damages.

Tilikum ex rel. People for the Ethical Treatment of Animals, Inc. v. Sea World Parks & Entertainment, Inc. 842 F.Supp.2d 1259 (S.D.Cal.,2012)

Plaintiffs sued aquarium for declaratory and injunctive relief seeking a declaration that wild-captured orcas were being held in violation of the Thirteenth Amendment’s prohibition on slavery and involuntary servitude. The court dismissed the action, holding that Plaintiffs had no standing because the Thirteenth Amendment only applies to humans, and therefore, the court lacked subject matter jurisdiction.

Humane Soc. of the U.S. v. Hodel 840 F.2d 45 (C.A.D.C.,1988)

In this appeal, the Humane Society of the United States (HSUS) challenged a series of actions by the Fish and Wildlife Service to allow hunting on some of America's national wildlife refuges. The District Court held that HSUS failed to satisfy the Supreme Court's requirements for associational standing because the 'recreational' interest of Society members was not germane to the group's self-described mission of insuring the humane treatment of animals and other wildlife. The Court of Appeals reversed the district court's finding that the Humane Society had no standing to challenge the hunt openings, and remanded the action to allow HSUS to pursue its challenge to the introduction of hunting. This Court did affirm the district court's finding on the merits that the Wildlife Service complied with NEPA when it permitted hunting at the Chincoteague preserve. Affirmed in part and reversed in part.

U.S. v. Brigham Oil and Gas, L.P. 840 F. Supp. 2d 1202, 1203 (D.N.D. 2012), appeal dismissed (Apr. 18, 2012) The Government charged Brigham Oil & Gas, L.P.with “taking” (killing) two migratory birds found dead near one of its reserve pits. But, the Court found that the use of reserve pits in commercial oil development is legal, commercially-useful activity that stands outside the reach of the federal Migratory Bird Treaty Act. Therefore, the Court held that the oil and gas companies' use of reserve pits did not violate Migratory Bird Treaty Act's prohibition against taking of protected birds, since death or injury was not intentional, and grated the defendant's motion to dismiss.
U.S. v. Paluch (unpublished) 84 Fed. Appx. 740 (9th Cir. 2003)

The court first concluded that venue was proper for the smuggling charges and the conspiracy charge. Turning to the convictions, the court found that his convictions of felony conspiracy and smuggling were supported by sufficient evidence. The court rejected his argument that the general smuggling law was inapplicable to the acts for which he was convicted because Congress had separately criminalized this conduct as a misdemeanor under the Endangered Species Act.

Kokechik Fishermen's Association v. Secretary of Commerce 839 F.2d 795 (1988)

The Secretary of Commerce issued a regulation authorizing appellant salmon federation to take a fixed number of porpoise in connection to commercial fishing for salmon.  Appellee commercial fishermen opposed the permit.  The federation sought review of a judgment which preliminarily enjoined the Secretary from issuing the permit.

Sammons v. C.I.R. 838 F.2d 330 (9th Cir. 1988)

In a tax proceeding, the Commissioner argues that defendant should be disallowed a charitable deduction for donating several artifacts containing eagle parts to a museum because it will frustrate the purpose behind the BGEPA.  The court disagrees, finding it unlikely that such an allowance will encourage others to procure eagle artifacts for the sole purpose of obtaining a tax deduction.  Further, the court disagrees with the Commissioner that Sammons acquired illegal title to the artifacts, finding Sammons had sufficient ownership interest in the eagle artifacts for donation.  For further discussion on commerce in eagle parts under the BGEPA, see Detailed Discussion of Eagle Act.

Sykes v. Cook Cty. Circuit Court Prob. Div. 837 F.3d 736 (7th Cir. 2016), reh'g and suggestion for reh'g en banc denied (Oct. 27, 2016) This case dealt with the plaintiff's denial of the use of her service dog while in a courtroom to present a motion. After the denial, the plaintiff filed an Americans with Disabilities Act (ADA) action, alleging that there was a violation for denial of reasonable accommodations under the ADA. The district court dismissed the action for lack of jurisdiction, because as a federal court, it was barred from hearing the claim under the Rooker–Feldman doctrine. The Court of Appeals agreed, and held that as a federal court, it was barred from hearing the claim under the Rooker–Feldman doctrine, which prevents lower federal courts from exercising jurisdiction over cases brought by state court losers challenging state court judgments rendered before the district court proceedings commenced. Additionally, the district court held that it should exercise Younger abstention because the proceeding was ongoing and because the plaintiff had an adequate opportunity to raise her federal claims about her dog in state court, but the Court of Appeals held that "Younger is now a moot question because there is no ongoing state proceeding for [the Court of Appeals] to disturb." As a result, the district court's dismissal for lack of subject matter jurisdiction was AFFIRMED.
Citizens to End Animal Suffering and Exploitation v. The New England Aquarium 836 F. Supp. 45 (1993)

The primary issue addressed by the court was whether a dolphin, named Kama, had standing under the MMPA. The court found the MMPA does not authorize suits brought by animals; it only authorizes suits brought by persons. The court would not impute to Congress or the President the intention to provide standing to a marine mammal without a clear statement in the statute.

U.S. v. Miranda 835 F.2d 830 (11th Cir. 1988)

Jesus Ismael Miranda with his company, J.M. Seafood, Inc., and Mario Gonzalez with his company, Mario Seafood Company, were convicted of conspiring in Florida to sell undersized spiny lobster tails, also known as "shorts."  The case was ultimately dismissed without prejudice because of a violation of the Speedy Trial Act.  The court did find sufficient evidence that defendant and his company conspired to sell undersized spiny lobster tails where an undercover agent found sufficient connections in the form of conversations and business dealing between defendant and co-defendant Gonzales.

U.S. v. Proceeds from Sale of Approximately 15,538 Panulirus Argus Lobster Tails 834 F. Supp. 385 (S.D. Fla. 1993)

This case arose out of the seizure of some 15,538 lobster tails of the species Panulirus argus, more commonly known as "spiny lobster," imported into the United States by the Claimant Lista Enterprises Seafood, Inc. from the Turks and Caicos Islands, a British territory in the Caribbean.  The court held the government had probable cause to seize the lobster tails based on the weight criteria established under Turks and Caicos law.  Under the Lacey Act, anyone who "knowingly" imports fish or wildlife taken in violation of foreign law may be assessed a penalty of $10,000 per violation, where "knowingly" refers to situations where the violator knew or should have known that the wildlife was taken in violation of law.

Sak v. City of Aurelia, Iowa 832 F.Supp.2d 1026 (N.D.Iowa,2011)

After suffering a disabling stroke, a retired police officer’s pit bull mix was trained to become a service dog. However, the town where the retired police officer resided had a Breed Specific ordinance that prohibited pit bulls. The retired police officer and his wife brought this suit against the city alleging that the ordinance violated his rights under Americans with Disabilities Act (ADA), and also sought a preliminary injunction to enjoin the city from enforcing the ordinance. The officer’s preliminary injunction was granted after the court found: 1) the officer was likely to succeed on merits of ADA claim; 2) the officer would suffer irreparable harm absent injunction; 3) the balance of equities was in favor of injunctive relief; 4) and the national public interest in enforcement of ADA trumped more local public interest in public health and safety reflected in ordinance.

Neita v. City of Chicago 830 F.3d 494 (7th Cir. 2016) Vaughn Neita brought this suit for damages under 42 U.S.C. § 1983 and Illinois law, alleging false arrest and illegal searches in violation of the Fourth Amendment arising from an animal cruelty arrest. He was ultimately found not guilty on all counts by an Illinois judge. In 2012, Neita owned a dog-grooming business and rescue shelter. He brought two dogs to the Chicago Department of Animal Care and Control because one dog had attacked another dog in Neita's care and another dog had become ill after whelping a litter of puppies. When Neita arrived with the dogs, an animal control employee contacted police officers who then arrested Neita and searched his business premises, resulting in 13 counts of animal cruelty. With regard to this § 1983 action and Illinois state claims, while Neita amended his complaint twice, it was ultimately dismissed with prejudice for failure to adequately plead any constitutional violation. This appeal then followed. The Seventh Circuit held that to prevail on a false arrest claim under § 1983, a plaintiff must show that there was no probable cause for his or her arrest. Neita arrived at Animal Control to surrender two dogs that showed no signs of abuse or neglect without evidence that he mistreated either dog. Those statements in the amended complaint are sufficient to permit a false arrest claim to proceed. As to the claim of illegal searches, the court found that a plausible claim for false arrest also allowed his claim for an illegal search incident to his arrest to move forward. The dismissal of Neita's claims was reversed and remanded for further proceedings.
Robinson v. Pezzat 83 F.Supp.3d 258 (D.D.C. 2015) While executing a search warrant at the plaintiff’s home, a police officer shot and killed the plaintiff’s thirteen-year-old dog. Accounts differed as to whether the dog bit the officer before shooting or whether the bite was a result of the shooting. The plaintiff filed suit against the police officer and municipality and alleged, inter alia, violations of her constitutional rights, several common law torts, and intentional infliction of emotional distress. The court was not swayed by the plaintiff’s “uncorroborated version of events” and granted summary judgment in favor of the defendants. The court held that the plaintiff had not met her burden to defeat either the individual police officer’s or the municipality’s immunity. This case is under appeal as of September 15, 2015.
United States v. Hess 829 F.3d 700 (8th Cir. 2016) This case stems from a United States Fish and Wildlife Service's investigation into illegal trafficking of rhinoceros horns and ivory called "Operation Crash." Defendant James Hess, a taxidermist in Maquoketa, Iowa, agreed to sell a pair of lack rhinoceros horns in 2011 to another individual involved in the trafficking operation. As a result of his role, he was charged with one count of Lacey Act Trafficking for knowingly engaging in conduct involving the sale and purchase of wildlife with a market value exceeding $350 that was transported and sold in violation of the Endangered Species Act. Hess was ultimately sentenced to 27 months in prison followed by three years of supervised release. On appeal, Hess first argued that the District Court made an “unsustainable finding on the record presented” when it stated that Hess "helped establish a market for these black rhino horns, and that is a serious offense against the planet." Because Hess failed to object at sentencing, this issue was reviewed for plain error. This court found no plain error, as the record supported the statement that Hess' action contributed to furthering a market for black rhinoceros horns. As to defendant's argument that his sentence was unreasonable, the court found that he failed to overcome the presumption of reasonableness in his bottom of the guidelines sentencing range. The judgment of the district court was affirmed.
Gallick v. Barto 828 F.Supp. 1168 (M.D.Pa.,1993)

In this Pennsylvania case, the parents of a 7-month old child sued the landlords of tenants who owned a ferret that bit the child on the face causing injury. The court stated that the resolution of this motion for summary judgment depended first on whether the ferret is deemed a wild animal. In ruling that the ferret is indeed a wild animal, the court noted that ferrets have been known to return to a feral state upon escaping and people have kept ferrets as house pets only in recent years. In Pennsylvania, the general rule is that a landlord out of possession is not liable for injuries caused by animals kept by tenants when the tenant has exclusive control of the premises except where the landlord has knowledge of the presence of the dangerous animal and where he or she has the right to control or remove the animal by retaking possession of the premises. The court found that since a ferret is a wild animal, the landlords were aware of the presence of the ferret, and plaintiffs may be able to prove that the landlords had the ability to exercise control over the premises prior to the incident, the landlords may be held liable under a theory of negligence. The motion for summary judgment was denied.

Mayfield v. Bethards 826 F.3d 1252 (10th Cir. 2016) In this case, plaintiffs sued defendant, Officer Bethards, for unlawfully killing their pet dog Majka. Plaintiffs' dogs were lying in plaintiffs' unfenced front yard when the officers entered the yard and then followed the dogs to the back of the house, eventually killing one of the dogs. The plaintiffs argued that by unlawfully killing their dog, Officer Bethards violated their constitutional rights under the Fourth Amendment by entering the property without a warrant with the intention of killing the dogs. Officer Bethards moved to have the complaint dismissed for a failure to state a claim and the court denied this motion. Specifically, Officer Bethards argued that this was not a violation of the Fourth Amendment because the Fourth Amendment only applies to “effects,” which does not include dogs. The court disagreed, finding that Fourth Amendment protection for pet dogs is a clearly established right. Ultimately, the court held that the plaintiffs asserted facts sufficient to show a violation of their clearly established Fourth Amendment rights and the district court's order denying Deputy Bethards's motion to dismiss was affirmed.
North American Meat Institute v. Becerra 825 F. App'x 518 (9th Cir. 2020) The North American Meat Institute (NAMI) brought suit in federal district court to challenge the constitutionality of California’s Proposition 12 brought suit in federal district court to challenge the constitutionality of California’s Proposition 12 (which forbids the sale of pork meat and eggs in California from producers that do not comply with its animal housing standards). NAMI alleged that Proposition 12 violated the dormant commerce clause by improperly regulating economic activity outside of California’s boundaries and substantially burdening interstate commerce. Plaintiffs acknowledged that Proposition 12 was not facially discriminatory, and that Proposition 12 did not have a discriminatory purpose, because there was a lack of evidence that the state had protectionist intent when enacting Proposition 12. The district court dismissed the case, and the court of appeals affirmed the judgment of the lower court.
Becker v. Elfreich 821 F.3d 920 (7th Cir. 2016) Appellant, Officer Zachary Elfreich, went to the home of Appellee Jamie Becker in order to execute an arrest warrant. When Becker did not surrender right away, Officer Elfreich allowed his police dog to find and attack Becker. Upon seeing Becker, Officer Elfreich pulled him down three steps of the home staircase, and placed his knee on Becker’s back while allowing the dog to continue to bite him. Becker sued the city of Evansville and Officer Elfreich under 42 U.S.C. § 1983, alleging that the officer used excessive force in arresting him in violation of his Fourth Amendment rights. The district court denied Officer Elfreich's motion for summary judgment and the officer appealed. The Court of Appeals, Seventh Circuit, held that: first, under the totality of the circumstances, the force used by the officer post-surrender of Becker was not reasonable. Second, a police dog's use of the “bite and hold” technique is not per se deadly force. Third, Becker, was a nonresisting (or at most passively resisting) suspect when Officer Elfreich saw him near the bottom of the staircase and the officer should not have used significant force on him. Based on these factors, the officer was not entitled to qualified immunity and a reasonable jury could find such force was excessive. The lower court decision to deny Officer Elfreich's motion for summary judgment was affirmed.
Castillo Condominium Ass'n v. U.S. Dept. of Housing and Urban Development 821 F.3d 92 (1st Cir. 2016) In 2010, the Castillo Condominium Association learned that Carlo Giménez Bianco (Giménez), a condominium resident, was keeping a dog on the premises and warned him that he would be fined unless he removed the dog. Giménez, who suffered from anxiety and depression, advised the board of directors that he planned to keep his emotional support dog and that he was entitled to do so under federal law. As a result of the conflict, Giménez was forced to vacate and sell his unit and he filed a complaint of disability discrimination with the Department of Housing and Urban Development (HUD). HUD filed a charge of discrimination against the Association under the Fair Housing Act. An administrative law judge (ALJ) concluded that the Association had not violated the Act because Giménez failed to prove by a preponderance of the evidence that he suffered from a mental impairment. The ALJ’s decision was appealed to the Secretary, who found that Gimenez suffered from a cognizable disability. The Court of Appeals, First Circuit, held that substantial evidence supported the Secretary's finding that the Association's refusal to allow Gimenez to keep an emotional support dog in his condominium unit as a reasonable accommodation for his disability violated the Fair Housing Act. The Association’s petition for review was denied and the Secretary’s cross petition was granted.
Terranova v. United States Dep't of Agric. 820 F. App'x 279 (5th Cir. 2020) Petitioners seek review of a decision and order of the USDA/APHIS determining that they violated various provisions of the Animal Welfare Act (“AWA”) and its implementing regulations, imposing civil penalties, and revoking the exhibitor license granted to Terranova Enterprises, Inc. Petitioners were licensees who provide wild animals like tigers and monkeys for movies, circuses, and other entertainment. In 2015 and 2016, APHIS filed complaints against petitioners that they willfully violated multiple provisions of the AWA and knowingly violated a cease and desist order issued in 2011 to avoid future violations of the AWA. After consolidating the complaints, the Administrative Law Judge ("ALJ") found that petitioners willfully committed four violations, so the ALJ issued a cease and desist order, suspended petitioners' license for 30 days, and assessed a $10,000 penalty and an $11,550 civil penalty for failing to obey the prior cease and desist order. On appeal by both parties to the Judicial Officer of the USDA, petitioners' exhibitor license was revoked and the penalties were increased to $35,000 and $14,850, respectively. On appeal here to the Fifth Circuit, petitioners claim that the determinations of the Judicial Officer were not supported by substantial evidence and that she abused her discretion in revoking their exhibitor license. This court found there was sufficient evidence to support the violations, including failing to allow APHIS officials to conduct compliance investigations and inspections, faulty tiger enclosures, insufficient distance/barriers between tigers and the public, failure to make an environmental enrichment plan, and failings involving tiger enclosure and protection from inclement weather, among other things. With regard to petitioners' claim that the Judicial Officer abused her discretion in revoking the exhibitor license, this court court found that petitioners committed more than one willful violation of the AWA so revocation was not unwarranted or without justification. The court concluded that the USDA Secretary’s order was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law, and that it was supported by substantial evidence. Therefore, the court denied the petition for review.
Hoctor v. Dept of Agriculture 82 F.3d 165 (7th Cir. 1996)

A dealer raised exotic animals (mainly big cats), and USDA ordered that the dangerous ones be fenced, with fencing being a minimum of eight-feet high.   However, the animal housing standard only required that the fencing be sturdy enough to prevent the animals from escaping.   The eight-foot rule established by USDA was considered arbitrary, and it did not have to be followed.    

Lowry v. City of San Diego 818 F.3d 840 (9th Cir. Apr. 1, 2016) Plaintiff in this case filed suit against the City of San Diego after she was attacked and bit by one of the police dogs. Lowry alleged that the City’s policy of training its police dogs to “bite and hold” individuals resulted in a violation of her Fourth Amendment rights against unreasonable seizures. The court remanded the case back to the lower court, holding that a reasonable jury could find that the use of the police dog against Lowry was an intrusion on her Fourth Amendment rights. The court maintained that the officers had reason to believe that letting the dog into Lowry’s office “off-lead” had the potential of creating severe harm. The court also noted that Lowry was not attempting to evade or resist arrest and therefore letting the dog “off-lead” may not have been reasonable. Reversed and remanded for further proceedings.
Robinson v. Pezzat 818 F.3d 1 (D.C. Cir. 2016) Plaintiff filed suit against two police officers and the District of Columbia after the officers shot and killed her dog while executing a warrant to search her home. She brought a § 1983 claim, alleging that the officers seized her property in violation of the Fourth Amendment. The Court of Appeals reversed the District Court’s ruling for summary judgment, holding that a jury could find in favor of the plaintiff based on her witness testimony that the dog was lying down when it was first shot. Additionally, the court maintained summary judgment for the second police officer, McLeod, who shot and killed the dog after it bit Officer Pezzat and charged forward.
U.S. v. Zarauskas 814 F.3d 509 (1st Cir. 2016) Defendant was found guilty by a jury of illegally importing narwhal tusks under several federal laws, including the Lacey Act, the Endangered Species Act, and the Marine Mammal Protection Act, among others. On appeal, defendant contends that the district court erred by allowing and failing to cure statements by the prosecutor that allegedly violated defendant's Fifth Amendment protections. Prior to being charged, defendant met with FWS and Canadian agents where he did not proclaim his innocence when questioned on the tusks. In the process of showing inconsistency in defendant's statements, the prosecutor pointed out defendant's failure to state his innocence with the federal agents, which defendant claimed improperly burdened him at trial. Other arguments by defendant also pointed to error by the prosecution during direct examination and rebuttal argument with respect to defendant's silence during interviews with agents. The appellate court found the errors to be harmless or in response to defendant's attorney's statements. Finally, as a matter of first impression, the court found that Treasury Enforcement Communications System (TECS) reports logging date, time, and location of border crossing and license plate of the vehicle were admissible hearsay. The convictions were affirmed.
Friends of Animals v. Clay 811 F.3d 94 (2d Cir. 2016) Friends of Animals (“FOA”) appeals an order of the United States District Court for the Eastern District of New York granting summary judgment in favor of defendants-appellees William Clay in his official capacity as a Deputy Administrator in the Department of Agriculture-APHIS and the FWS. FOA challenged FWS's issuance of a “depredation permit” to the Port Authority of New York and New Jersey authorizing the emergency “take” of migratory birds that threaten to interfere with aircraft at JFK Airport. FOA argues that FWS's own regulations unambiguously prohibit it from issuing such a permit and that the permit should therefore be set aside as the product of agency action that was “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.” The District Court granted summary judgment for defendant FWS. On appeal, this court affirmed that ruling. FOA pointed out that the "emergency take" regulation at 50 C.F.R. § 21.41 does not authorize FWS to issue a permit that allows the emergency take of a migratory bird irrespective of its species, but instead requires a "species-specific" inquiry. However, this court disagreed, finding that "§ 21.41 does not place Port Authority officials in the untenable position of having to choose between violating federal law and deliberately ignoring serious threats to human safety." Further, the court found the specific requirements in § 21.41 concern only applicants seeking a permit and not the FWS itself. In this situation, the court found the 2014 permit's emergency-take provision satisfied § 21.41. The District Court's order was affirmed.
Crowder v. Kitagawa 81 F.3d 1480 (C.A.9 Hawai‘i,1996)

The plaintiffs in this case were a class of visually-impaired persons who use guide dogs. Plaintiffs sought exemption from Hawaii's imposition of a 120-day quarantine on carnivorous animals entering the state (which necessarily included their guide dogs). Specifically, they contend Hawaii's quarantine, designed to prevent the importation of rabies, violates the Americans with Disabilities Act (ADA),and their constitutional rights of travel, equal protection and substantive due process. On appeal of summary judgment, this Court held that without reasonable modifications to its quarantine requirement for the benefit of visually-impaired individuals who rely on guide dogs, Hawaii's quarantine requirement effectively prevents such persons from enjoying the benefits of state services and activities in violation of the ADA. The district court's issuance of summary judgment in favor of Hawaii, was reversed and the case was remanded to the district court for further proceedings.

Friends of Animals v. Ashe 808 F.3d 900 (D.C. Cir. 2015) Friends of Animals, a non-profit animal advocacy organization, filed suit against the U.S. Fish & Wildlife Service ("the Service") in 2013, after the Service issued no initial or final determinations for 39 species of sturgeon the organization petitioned as endangered or threatened. The Endangered Species Act (ESA) requires that the Service must make a determination within 90 days for an initial determination or 12 months for a final determination after a petition is received from an interested party. However, there is also a provision in the ESA that the plaintiff must give the Service 60-days notice before filing suit. The District Court held that Friends of Animals did not give the Service adequate notice before filing suit and dismissed the complaint. On appeal, this court agreed, finding that Friends of Animals "did not wait until after the issuance of the positive initial determinations to provide 60 days' notice of the allegedly overdue final determinations." In dicta, the Court noted that "[t]he Service's approach may not be the most efficient," but the deadlines are mandatory in the statutes. Thus, its suit to compel the final determination on the listings was barred and the judgment of the District Court was affirmed.
Northern Arapahoe Tribe v. Hodel 808 F.2d 741 (10th Cir. 1987)

After the Secretary of the Interior promulgated regulations establishing a game code regulating hunting on the reservation, the Arapahoe Tribe of Wyoming sued the Secretary and other federal officials, seeking declaratory and injunctive relief to prevent enforcement of the regulations.  At issue, was  a concern over the declining big game populations on the reservation and surrounding areas due to an unusually harsh winter and over-hunting.  The Court of Appeals held that the government had the right to enact the game code because the rights of two tribes overlapped with regard to a limited resource, and the "[g]overnment's right extends to preventing overuse by the Arapahoe of their shared right when that overuse endangers the resource and threatens to divest the Shoshone of their right."  Where there exists a risk of extinction, the government may enact interim game code measures to prevent the threat when the tribes fail to enact their own game codes. 

Defenders of Wildlife v. Hall 807 F.Supp.2d 972 (D.Mont., 2011)

Several wildlife organizations filed suit to challenge the FWS's Final Rule delisting the gray wolf Northern Rocky Mountain distinct population segment.  The case was put on hold pending the outcome of several other legal battles regarding the wolf's status on the Endangered Species List, during which gray wolf protections were reinstated.  Then, after Congress passed the 2011 fiscal year budget which contained a provision requiring the FWS to delist the Northern Rocky Mountain DPS, the court dismissed the case for lack of jurisdiction.

Perfect Puppy, Inc. v. City of E. Providence, R.I. 807 F.3d 415 (1st Cir. 2015) Perfect Puppy signed a lease with a building located in the city of East Providence on April 26, 2014. Perfect Puppy intended to use the building to sell puppies and was given a “Pet Shop” license by the state of Rhode Island. On June 3, 2014, East Providence passed an ordinance banning dog and cat sales and as a result, Perfect Puppy filed suit against the city for a “facial-taking.” A “facial-taking” is when “an ordinance’s mere enactment amounts to a taking.” On appeal, the court held that it did not have jurisdiction over Perfect Puppy’s facial-taking claim because Perfect Puppy needed to file suit for compensation against the city and get rejected before the issue could be determined by this court. As a result, the court remanded the case back to the state court to be decided.
U.S. v. Stenberg 803 F.2d 422 (9th Cir. 1986), superceded by statute in U.S. v. Atkinson, 966 F.2d 1270 (9th Cir. 1992)

These three cases arose out of an undercover investigation by the United States Fish and Wildlife Service (FWS) into the illegal taking and sale of wildlife in interstate commerce, where defendants were engaged in the guiding and hunting business wherein customers would pay for illegal big game hunts.  The court denied defendants' defense of outrageous government conduct and entrapment.  It also held that the Lacey Act clearly notifies individuals that participation in prohibited transactions involving wildlife with a market value greater than $350 subjects them to felony prosecutions, thus defeating defendants' challenge of vagueness to the statute.  Notably, the court reversed convictions on the fact that the provision of guiding services or providing a hunting permit does not constitute the sale of wildlife for purposes of the Lacey Act (this was amended in 1988 to include guide services, which overturned this decision.  See U.S. v. Atkinson, 966 F.2d 1270 (9th Cir. 1992). 

Schor v. North Braddock Borough 801 F.Supp.2d 369 (W.D. Pa. 2011) The plaintiff’s dog jumped her fence and after encountering a couple of friendly people in the neighborhood, was confronted by two police officers. At the same time the officers arrived, the plaintiff and her sister arrived at the scene. The plaintiff’s sister yelled to the officer, “that’s our dog,” and while displaying no signs of aggression, with her owner 10-15 feet away, an officer shot the dog four times, killing her. The officer had previous similar encounters with dogs, having shot another dog approximately six months prior to this event. In evaluating the immunity of the police officer, the court held that the plaintiff failed to establish an exception to immunity under the Pennsylvania Subdivision Tort Claims Act. However, the court denied the defendants’ motion to dismiss the plaintiff’s Fourth Amendment claims.
U.S. v. CITGO Petroleum Corp. 801 F.3d 477 (5th Cir. 2015) CITGO was convicted of multiple violations of the Clean Air Act and its regulations, and the Migratory Bird Treaty Act of 1918 (“MBTA”). CITGO urged the 5th Circuit to reverse the Clean Air Act convictions because the district court erroneously instructed the jury about the scope of a regulation concerning “oil-water separators.” CITGO also contended that the MBTA convictions were infirm because the district court misinterpreted the statute as covering unintentional bird kills. The 5th Circuit agreed with both contentions, holding that CITGO's equalization tanks and air floatation device were not oil-water separators under the Clean Air Act's regulations and that “taking” migratory birds involved only “conduct intentionally directed at birds, such as hunting and trapping, not commercial activity that unintentionally and indirectly caused migratory bird deaths. The district court’s decision was reversed and remanded with instructions.
Schor v. N. Braddock Borough 801 F. Supp. 2d 369 (W.D. Pa. 2011) Sadie, a six (6) year old pit bull and family pet was shot and killed by the Defendant Officer Wittlinger. The Plaintiff, Sadie’s owner, filed a twelve count complaint alleging four § 1983 claims under federal law against all Defendants including the borough, police department, board of supervisors, police chief, and Officer Wittlinger. The remaining eight counts alleged claims solely against the officer. The Defendants' filed a partial motion to dismiss for failure to state a claim. The Court granted the dismissal of claims against the board, police chief, and officer in their official capacities. The court also dismissed the Plaintiff’s state negligence claims. However, the court did not dismiss claims brought against Police Chief Bazzone and Officer Wittlinger in their individual capacities. The court reasoned that the facts pled by the Plaintiff were sufficient to show that Chief Bazzone may have acted with deliberate indifference by not disciplining Officer Wittlinger after a prior dog shooting incident, and maintained a custom within the Police Department that it was proper to shoot a pet dog wandering the streets. The court also denied the motion to dismiss Plaintiff’s fourth amendment rights claim. The court reasoned that the facts pled by the Plaintiff were sufficient to state a claim for violation of her Fourth Amendment rights because the plaintiff had a possessory interest in her dog Sadie as “property” and the officer used excessive force while seizing the Plaintiff’s property.
Levine v. National Railroad Passenger Corporation 80 F. Supp. 3d 29 (D.D.C. 2015) This action arose from plaintiff’s experience of bringing her service dog on Amtrak trains. Plaintiff brought claims on her own behalf and on behalf of a putative class of other disabled passengers against Amtrak pursuant to the Americans with Disabilities Act, the Rehabilitation Act of 1973, and the District of Columbia Human Rights Act. Each claim related to Amtrak′s alleged practice of storing luggage in its train's “mobility aid” seating areas. Amtrak argued, amongst other things, that plaintiff lacked Article III Constitutional Standing because she had not suffered an injury in fact. The district court agreed and granted Amtrak′s motion to dismiss. The case was dismissed in its entirety.
Animal Legal Defense Fund v. Reynolds 8 F.4th 781 (8th Cir. 2021) This appeal centers around an Iowa statute called the “Agricultural Production Facility Fraud" law that prohibited accessing agricultural production facilities by false pretenses and making false statements as part of an employment application to an agricultural production facility. Animal rights organizations filed a § 1983 action against state and county officials contending the law violated the the First Amendment free speech clause. The district court ruled that both provisions are unconstitutional and entered an injunction against enforcement of the entire statute. Here, the Eighth Circuit affirmed in part and reversed in part. The court found both the Access Provision and the Employment Provision constitute direct regulations of speech. However, the court held the conclude that the Access Provision's prohibition on assuming false pretenses to obtain access to an agricultural production facility is consistent with the First Amendment. In contrast, the Employment Provision did not survive strict scrutiny because is proscribes speech that is protected by the First Amendment and was not narrowly tailored. The court affirmed the district court's grant of summary judgment for the plaintiffs on Iowa Code § 717A.3A(1)(b), reversed the judgment declaring unconstitutional § 717A.3A(1)(a), vacated the injunction against enforcement of § 717A.3A(1)(a), (2), and (3), and remanded for further proceedings.
Animal Legal Def. Fund v. Vaught 8 F.4th 714 (8th Cir. 2021) Several animal advocacy organizations filed a complaint against the Vaughts and Peco Foods, Inc. seeking an order that would prevent defendants from bringing a civil suit under Ark. Code Ann. § 16-118-113 (colloquially known as Arkansas' "ag gag" law). The statute at issue provides a civil cause of action for unauthorized access to protected properties described under the law. Plaintiffs claim that the statute violates their right to free speech under the First Amendment by chilling them from engaging in activities protected under the First Amendment. In particular, the plaintiffs have "specific and definite plans" to investigate the defendants' chicken slaughterhouses and pig farms by sending undercover investigators to seek employment with defendants and collect information in an effort to support their mission to "reform[] animal agriculture." The district court found that plaintiffs failed to establish Article III standing to sue, finding that the injury at hand was too speculative. On appeal here, the court noted found that plaintiffs established the three primary elements of standing from the Lujan case ("(1) an injury in fact, (2) a causal relationship between the injury and the challenged conduct, and (3) that a favorable decision will likely redress the injury."). First, but for the statute, plaintiffs allege that they would engage in the protected constitutional conduct. Second, the plaintiffs adequately outlined their intention to engage in a course of conduct that is proscribed by the statute. Finally, the court found a credible threat of enforcement that was objectively reasonable. This is bolstered by the fact plaintiffs have successfully engaged in the conduct at other facilities in the past. While defendants contend that there is no credible threat that they would enforce the statute because these organizations would not find entry to their facilities worthwhile. However, plaintiffs presented allegations that indeed they would be interested in documenting the plaintiffs' operations because of the conditions of pigs in "nearly immovable quarters" and the use of controversial methods of slaughter. The court was equally unpersuaded by defendants' claims that there is no injury in fact since plaintiffs are not poised to publish any information gathered from their facilities. Additionally, plaintiffs sent letters to defendants asking them to waive their rights to sue and neither defendant responded. Thus, the complaint sufficiently established a case or controversy. The lower court judgment was reversed and the case was remanded.
Animal Protection Institute of America v. Mosbacher 799 F.Supp 173 (D.C. 1992)

Wildlife protection organizations, including the API, brought action against Secretary of Commerce to challenge permits for importing false killer whales and belugas for public display. Zoo association and aquarium seeking the whales intervened.  The District Court the whale watchers had standing and the permits were not abuse of discretion.

IPPL v. Institute for Behavioral Research, Inc. 799 F.2d 934 (1986)

Private individuals and organizations brought action seeking to be named guardians of medical research animals seized from organization whose chief was convicted of state animal cruelty statute violations. The United States District Court for the District of Maryland, John R. Hargrove, J., dismissed action, and individuals and organizations appealed. The Court of Appeals, Wilkinson, Circuit Judge, held that: (1) individuals and organizations lacked standing to bring action, and (2) Animal Welfare Act did not confer private cause of action. Mountain States Legal Foundation v. Hodel 799 F.2d 1423 (10th Cir. 1986)

Horses protected by the Wild Free-Roaming Horse and Burro Act are not instruments of the federal government, and therefore incursions by wild horses onto private land do not constitute a Fifth Amendment taking requiring just compensation.
