Animal Legal Defense Fund v. Reynolds 297 F.Supp.3d 901 (S.D. Iowa, 2018) Plaintiffs, a collection of local and national non-profit organizations brought this action alleging that Iowa Code § 717A.3A, which criminalizes agrigcultural facility fraud by either obtaining access to an agricultural facility on false pretenses or making a false statement or false representation in regard to the application or agreement to be employed by an agricultural facility, impeded their ability to advocate for their respective causes. Some of the non-profit organizations listed as plaintiffs, engaged in undercover investigations where investigators serve as employees at argricultural facilities to gather information about the inner workings of slaughterhouses and other facilities. The plaintiffs alleged that the Iowa statute was unconstitutional on its face becuase it violated the First Amendment and the Equal Protection Clause of the Fourteenth Amendment. The Discrict Court determined that the plaintiffs have standing to make their claim and have an injury sufficient to suppor their standing. The defendants sought a motion to dismiss. The District Court ultimately denied the motion to dismiss with respect to the First Amendment claim and granted the motion to dismiss with respect to the Equal Protection claim.
Animal Legal Defense Fund v. Reynolds 297 F.Supp.3d 901 (S.D. Iowa Feb. 27, 2018) In 2012, Iowa passed a statute (Iowa code § 717A.3A) that criminalized gaining access to agricultural facilities under false pretenses and making a false representation on a job application for those facilities. Plaintiffs in this case (animal rights groups including the Animal Legal Defense Fund and PETA) brought suit alleging that the statute was unconstitutional and sought to enjoin the Defendants (governor of Iowa) from enforcing it. Their complaint alleged that the statute violates the First Amendment as discrimination on the basis of content, the Equal Protection Clause of the Fourteenth Amendment by targeting animals rights groups, and violates the Due Process Clause of the Fourteenth Amendment by burdening the freedom of speech. This case decides the Defendants’ motion to dismiss the Plaintiffs’ complaint based on lack of standing and failure to state a claim because the outlawed conduct is not protected by the First Amendment as false statements and is rationally related to the legitimate government interest of protecting private property, thereby not violating the Fourteenth Amendment. The court denies Defendants' motion with respect to the First Amendment, concluding that Plaintiffs have plausibly alleged the intent to suppress their message because of their viewpoint. However, the court grants the motion to dismiss for the claim of a Fourteenth Amendment violation because the statute in fact serves a legitimate government purpose in protecting private property.
U.S. v. Smith 29 F.3d 270 (7th Cir. 1994)

Defendant was convicted of possessing Bald Eagle feathers in violation of Migratory Bird Treaty Act (MBTA) after receiving the feathers in the mail from a friend to complete a craft project.  On appeal, defendant challenged her conviction, alleging that she did not possess the requisite knowledge and that the act itself was vague as to the level of intent, or scienter .  The court affirmed defendant's conviction finding that the evidence established that defendant knowingly possessed eagle feathers in violation of MBTA, the conviction did not amount to punishment of wholly passive conduct contrary to defendant's suggestion, and that MBTA was not vague nor overbroad with regard to intent.  For further discussion on the intersection of the MBTA and the Eagle Act, see Detailed Discussion of the Eagle Act .

Buffalo Field Campaign v. Zinke 289 F.Supp.3d 103 (D.D.C. Jan. 31, 2018) Plaintiffs Buffalo Field Campaign and other environmental groups petitioned the Fish and Wildlife Service ("Service") to add the Yellowstone bison population to the federal endangered species list. After the Service made a threshold “90–day” determination that Buffalo Field's petition failed to present sufficient scientific evidence that listing the bison may be warranted, Buffalo Field brought suit under the Administrative Procedure Act, alleging that the Service's determination was arbitrary and capricious. The United States District Court for the District of Columbia ruled that the Service applied an improper standard when evaluating Buffalo Field's petition, granted Buffalo Field's motion for summary judgment, denied the Service's cross-motion, and remanded the case for the agency to conduct a new 90–day finding using the proper standard. In particular, the court observed that the Service "simply picked a side in an ongoing debate in the scientific community," thereby in inappropriately heightening the standard of evaluation for a 90-day petition. Because of that, the court agreed with the Service that remand is the appropriate remedy as opposed to to directing the Service to begin a 12-month review.
Born Free USA v. Norton 278 F. Supp 2d 5 (D.D.C. 2003)

The zoo sought to import wild elephants from a foreign country, but advocates contended that the officials did not follow CITES properly for the import. The court held that the advocates failed to show a likelihood of success to warrant preliminary injunctive relief, since no overall detriment to the species was shown.

Lacy v. U.S. 278 F. App'x 616 (6th Cir. 2008)

The owner of a horse tried to enter his horse into the 64th Annual Tennessee Walking Horse National Celebration. Upon closer inspection of the horse, experts determined the horse was "sore," meaning the horse had an injury to or sensitization of its legs that induced a high stepping gait for which Tennessee Walkers are known. While the horse's owner contended that the soreness occurred as a result of  the West Nile Virus, he was eventually convicted with a violation of the Horse Protection Act, (15 U.S.C. §§ 1821-1831). This Court affirmed Lacy's conviction, finding that that substantial evidence supported the JO's conclusion that Lacy failed to rebut the statutory presumption of soreness.

U.S. v. Fountain 277 F.3d 714 (5th Cir. 2001)

Roosevelt Fountain, Sr. ("Fountain") and his daughter, Shirley Fountain Ellison ("Ellison") operated an oyster fishing business in Cameron Parish, Louisiana, called Fountain Seafood, Inc., where their convictions arose from the manner in which they operated the business (i.e., tagging violations, taking of oysters from closed areas, taking of excess limits of oysters, and licensing violations).  The indictment further contended that the appellants worked to accomplish this goal by creating false records relating to their oyster sales.  The court held that it was not error for no instruction on the term "willfully," since the false record provision refers to "knowingly" as the mens rea requirement.  Further, the court held that "materiality" is also not a provision of the Lacey Act's false records provision.

U.S. v. Kornwolf 276 F.3d 1014 (8th Cir. 2002)

Defendant sells a headdress containing golden eagle feathers obtained before 1962 to an undercover officer.  Court finds this case directly controlled by Andrus v. Daskalea v. Washington Humane Soc. 275 F.R.D. 346 (D.C., 2011)

Pet owners sued after their pets were seized, detained, injured, or destroyed by the Humane Society. Pet owners’ attempts to certify a class failed because the claims were not typical. The members of the proposed class allegedly suffered a wide range of deprivations, were provided with different kinds of notice, and claimed distinct injuries. The class certification motion was also denied because the proposed members sought individualized monetary relief.

Hill v. Norton 275 F.3d 98 (D.C. Cir. 2001)

The Migratory Bird Treaty Act ("MBTA"), 16 U.S.C. §§ 703-712 (2000), extends protection to all birds covered by four migratory bird treaties, which, in relevant part, define migratory birds to include the family Anatidae (which includes the mute swan).  Under the authority, delegated by Congress the Secretary of the Interior has published lists of protected migratory birds.  The instant case arose when appellant Joyce Hill filed a law suit pro se in District Court claiming that the Secretary's regulation violated the MBTA in excluding mute swans from the List of Migratory Birds promulgated at 50 C.F.R. § 10.13 (2000). The District Court rejected Hill's claim and granted summary judgment in favor of the Secretary.  In reversing the the District Court's decision, the court found that the Secretary pointed to nothing in the statute, applicable treaties, or administrative record that justified the exclusion of mute swans from the List of Migratory Birds.  It also ordered the Secretary's List of Migratory Birds, codified at 50 C.F.R. § 10.13, insofar as the list excludes mute swans, to be vacated.  This case more or less set the stage for the revisions to the MBTA in 2004 by Congress's passing of the MBTRA.

Supreme Beef Processors, Inc. v. U.S. Dept. of Agriculture 275 F.3d 432 (C.A.5 (Tex.),2001)

The Fifth Circuit United States Court of Appeals affirmed the district court's decision that the Federal Meat Inspection Act focuses on the processes used by a manufacturer and not the product itself, and that the presence of Salmonella bacteria in the meat does not necessarily make a product "adulterated" because the act of the cooking meat normally destroys the bacteria.

Brown v. Muhlenberg Tp. 269 F.3d 205 (3rd Cir. 2001)

Pet owners were unreasonably deprived of their Fourth Amendment rights to their pet by police officer. Pennsylvania Court would recognize a claim for intentional infliction of emotional distress based upon the killing of a pet.

Access Now, Inc. v. Town of Jasper, Tennessee 268 F.Supp.2d 973, 26 NDLR P 107 (E.D.Tenn.,2003) Plaintiffs Access Now, Inc. and Pamela Kitchens, acting as parent and legal guardian on behalf of her minor daughter Tiffany brought this action for declaratory judgment and injunctive relief against defendant Town of Jasper, Tennessee under the ADA after the town denied her request to keep a keep miniature horse as service animal at her residence. The town's ordinance at issue provided that no person shall keep an enumerated animal within 1000 feet of any residence without a permit from the health officer. The Jasper Municipal Court held a hearing and determined that the keeping of the horse was in violation of the code and ordered it removed from the property. On appeal, this Court found that while the plaintiffs contended that the horse helped Tiffany in standing, walking, and maintaining her balance, Tiffany does not have a disability as defined by the ADA and does not have a genuine need to use the horse as a service animal. Further, the Court found that the horse was not a service animal within the meaning of 28 C.F.R. § 36.104 because the animal was not used in the capacity of a service animal and instead was a companion or pet to Tiffany. The plaintiffs' complaint was dismissed with prejudice.
Dubner v.City and County of San Francisco 266 F.3d 959

Photographer brought § 1983 claim and several state law claims against city, police officers, and chief of police alleging unlawful arrest. The Court of Appeals, D.W. Nelson, Circuit Judge, held that: (1) photographer established prima facie case of her unlawful arrest by police officers at animal rights demonstration; (2) police lacked probable to cause to arrest photographer for trespassing under California law; (3) police lacked probable cause to arrest photographer under California's unlawful assembly statute; and (4) police chief could be held liable in his individual capacity.

Alternative Research & Dev. Found. v. Veneman 262 F.3d 406 (D.C. Cir. 2001)

An animal rights foundation sought to have the definition of “animal” amended, so that birds, mice and rats used for research would not be excluded.   USDA agreed to consider the animal rights foundation petition to have the definition amended, and agreed to do so in reasonable amount of time.   The National Association for Biomedical Research (NABR), a biomedical research group that used birds, mice and rats in its research, attempted to intervene and prevent USDA from considering the petition.   However, NABR was prohibited from doing so because there was no showing that preventing intervention would result in its interests not being violated.

Giardiello v. Marcus, Errico, Emmer & Brooks, P.C. 261 F. Supp. 3d 86 (D. Mass. 2017) This case dealt with a condo owner and his son who lived in a condo and relied on a service dog for treatment of PTSD. The Plaintiffs filed suit against the condo trust, Board of Trustees, Board members, and others, alleging violation of the Fair Housing Act (FHA) by not allowing the Plaintiffs to keep the dog in their condo unit. The father attempted to communicate with the Trustees about a reasonable accommodation for the service dog, but was met with silence from the Trustees. After the dog had already moved into the condo, the Board sent correspondence stating that fines would be assessed if the dog was not removed after a certain date. After complications with securing the requisite medical info, the dog was ultimately allowed to say, but fines had accrued. The Court held that 1) plaintiffs stated claim that defendants violated FHA; 2) owner was an aggrieved person under the FHA, and thus owner had standing to bring claim; 3) district court would decline to dismiss claim on exhaustion grounds; and 4) under Massachusetts law, claims against attorney and law firm were barred by the litigation privilege. Thus, the court the Court denied the Board and Trust's motion to dismiss and granted Attorney Gaines and the Law Firm's motion to dismiss.
United States v. Hardman 260 F.3d 1199 (10th Cir. 2001)

This is an order vacating the opinions issued in Wilgus , Saenz , and Hardman .  The Tenth Circuit requested the attorneys in the above cases to brief the issues outlined by the court.  For further discussion regarding religious challenges to the BGEPA, see Detailed Discussion of Eagle Act .

U.S. v. Crutchfield 26 F.3d 1098 (11th Cir. 1994)

The court reversed the district court's judgment of convictions against defendants for the illegal importation and the intent to sell iguanas in the United States because of prosecutorial misconduct. The court held that the prosecutor wasted valuable money in pursuing irrelevant testimony, and improperly questioned defendants and their witnesses after repeated warnings from the district court judge.

Haberman v. United States 26 Cl. Ct. 1405 (1992)

The U.S. Claims Court upheld its jurisdiction over an action brought by individuals who had their Private Maintenance and Care Agreements (PMCA) revoked by the Bureau of Land Management and their adopted wild horses repossessed when the agency learned that the individuals intended to sell the horses to slaughter once they obtained full legal title to them under the Wild and Free-Roaming Horse and Burro Act.  The court found that the PMCA agreement constituted a contract between the government and the adopter, and thus that the Claims Court had jurisdiction to hear the case. Though the court noted that individual adopters would have to overcome the suggestion that they violated the terms of the PMCA by intending to sell the horses to slaughter.   

U.S. v. Street 257 F.3d 869 (8th Cir.2001)

The court held that the "second or subsequent conviction" component of the BGEPA applies to separate convictions charged in a single indictment.  For further discussion on the enhanced penalty provision of the BGEPA, see Detailed Discussion of Eagle Act.

Brower v. Evans 257 F.3d 1058 (2001)

The district court held that the Secretary's Initial Finding, triggering a change in the dolphin-safe label standard, was not in accordance with the law and constituted an abuse of discretion because the Secretary failed to (1) obtain and consider preliminary data from the congressionally mandated stress studies and (2) apply the proper legal standard to the available scientific information. We affirm.

Earth Island Inst. v. Evans 256 F. Supp. 2d 1064 (N.D. Cal. 2003) Plaintiff, groups seeking to protect animals, sought to enjoin implementation of a final finding of defendant, the Secretary of Commerce and his Assistant Administrator of Fisheries, that the encirclement of dolphins with purse seine nets was not having an adverse impact on dolphin stocks as arbitrary, capricious, and an abuse of discretion. The court granted the groups' motion for preliminary injunction, enjoined the Secretary from taking any action to allow any tuna product to be labeled as "dolphin safe" that was harvested using purse seine nets, pending final disposition of the groups' action, and defined what "dolphin safe" would continue to mean.
U.S. v. Oliver 255 F.3d 588 (8th Cir. 2001)

Despite delays in receiving eagle parts through the federal permit process, the court rules the BGEPA does not violate the Religious Freedom Restoration Act.  There is nothing so peculiar about defendant's situation to allow a one-man exception.  For further discussion on religious challenges to the BGEPA by Native Americans, see Detailed Discussion of Eagle Act .

Pedersen v. Benson 255 F.2d 524 (C.A.D.C. 1958)

In the matter of Pedersen v. Benson , an importer had a permit to import five giraffes from Kenya, three of which were sold and released to public zoos after the requisite quarantine period.  The other two were bought by ‘Africa USA,’ but not released.  One of them had a heart attack and died.  Plaintiff’s filed suit to have the other one they purchased released.  The permits, issued by APHIS, were issued under the further understanding that all the giraffes would be consigned to an approved zoological park (Africa USA is a privately-owned zoo).  The Court found no basis to uphold the government’s claim that a government officer may impose an ad hoc system of licensure upon any citizen, or upon any one group, i.e. private zoos, as opposed to another.  Here, the importation was specifically permitted for all five animals, and any one animal was just as much a potential carrier of hoof and mouth disease as this particular giraffe.  Therefore, this matter was dismissed for failure to state a cognizable claim. 

U.S. v. McDougall 25 F.Supp.2d 85 (N.D.N.Y. 1998)

Defendants Goodfriend and Benney, commercial fishermen licensed pursuant to the New York State Department of Environmental Conservation ("DEC"), are charged with catching and failing to return substantial quantities of eel and walleye from Lake Ontario and New York waters in violation of  New York law that prohibits commerce in these fish because of health and conservation concerns.  Aware of the ban prohibiting the sale of eel and walleye taken from these waters, Goodfriend and Benney subsequently sold the eel and walleye to a host of fish wholesalers and retailers, located within and outside New York.  Defendant truck driver's alleged filing of false Canadian customs forms relating to eel and walleye he was transporting from the U.S. to his Canadian employer were violations of the Lacey Act, regardless of whether these acts violated Canadian law.

Coffey v. Bureau of Land Mgmt. 249 F.Supp.3d 488 (D.D.C. Apr. 20, 2017) As the court here states, "Plaintiff Debbie Coffey knows a great deal about wild horses and burros—and how those animals are treated by the federal Bureau of Land Management—but she wants to learn more." As such, Plaintiff, a hose welfare advocate, filed a Freedom of Information Act (FOIA) request to the BLM to obtain communications between its officials and private citizens, namely those with long-term holding contracts, involved in the Wild Horse and Burro Program. In conjunction with her request, the BLM charged plaintiff $1,680 in processing fees, but ultimately refunded her the fees a year and half later because it failed to meet FOIA statutory response deadlines. On appeal, Coffey filed a FOIA suit and both sides moved for summary judgment. Plaintiff first argues that the BLM violated FOIA when it failed to give her interest on her processing fees. The court, however, found that awarding interest here would violate the longstanding "no-interest rule," where there was no congressional intent to award interest in such cases. As to plaintiff's argument that BLM's search for records was inadequate, the court agreed with plaintiff that the words and phrases used by BLM were too limiting to meet plaintiff's request and were thus unreasonable. The court held that BLM must choose a different set of search terms (including those suggested by plaintiff) and conduct the FOIA search again. However, the court found that plaintiff's additional contentions that: (1) the search terms were too vague; (2) the database and software needed to be identified; and (3) BLM needed to also include phone records in its search to be without merit. The parties' motions for summary judgment were granted in part and denied in part.
Cetacean Cmty. v. President of the United States 249 F. Supp. 2d 1206 (D.C. Hawaii, 2003) Plaintiff, a community of whales, dolphins, and porpoises, sued Defendants, the President of the United States and the United States Secretary of Defense, alleging violations of the (NEPA), the (APA), the (ESA), and the (MMPA).  The Plaintffs were concerned with the United States Navy's development and use of a low frequency active sonar (LFAS) system. The community alleged a failure to comply with statutory requirements with respect to LFAS use during threat and warfare conditions.
American Society For Prevention of Cruelty to Animals v. Ringling Brothers and Barnum & Bailey Circus 246 F.R.D. 39 (D.D.C.,2007)

In this case, the court considered the parties’ respective motions for reconsideration. On August 23, 2007, the Court granted summary judgment to defendant as to elephants subject to a captive-bred wildlife (“CBW”) permit and denied summary judgment as to elephants for which defendant claimed a “pre-Act” exemption. Defendant has filed a motion for reconsideration challenging the Court's decision regarding the “pre-Act” elephants and plaintiff has filed a motion for reconsideration challenging the Court's decision regarding the CBW permit elephants. Defendant’s motion was granted in part as to the standing of plaintiff, Tom Rider. The court held that Rider’s standing is now limited to those six elephants to which he became “emotionally attached.” Notably, the court ended its opinion with a “hint to the wise” that the court will not tolerate any further filings inconsistent with FRCP.

U.S. v. Gardner 244 F.3d 784 (10th Cir. 2001)

Defendant first argues that the district court lacked jurisdiction because the government failed to plead and prove two essential jurisdictional elements for a 16 U.S.C. § 3372(a)(1) violation--namely, that Mr. Gardner was not an Indian and that the crime affected interstate commerce.  The court found the non- Indian status of the defendant is not an essential element of jurisdiction for a 16 U.S.C. § 3372 violation.  It is only necessary to plead and prove an interstate commerce nexus where § 3372(a)(2) is implicated.  The Court reverses because the jury instructions did not sufficiently instruct the jury as to how it should consider uncorroborated accomplice testimony.

U.S. v. Santillan 243 F.3d 1125 (9th Cir. 2001)

Santillan was prosecuted under the Lacey Act for bringing ten baby parrots across the border from Tijuana. His appeal raises, among other issues, a significant question about the mens rea needed under the Lacey Act.  The court held that the Lacey Act does not require knowledge of the particular law violated by the possession or predicate act, as long as the defendant knows of its unlawfulness.

Smithfield Foods, Inc. v. Miller 241 F.Supp.2d 978 (S.D.Iowa,2003)

The Court struck down an Iowa law that banned certain producers from owning or controlling livestock in Iowa based on the Dormant Commerce Clause.

Center for Biological Diversity v. Norton 240 F.Supp.2d 1090 (D.Ariz. 2003)

This lawsuit arises out of the Fish and Wildlife Service's ("FWS") designation of approximately 30% of the critical habitat originally proposed for the Mexican spotted owl (Strix occidentalis lucida ) under the Endangered Species Act ("ESA").  In analyzing the FWS's decision under both the standard of review for the APA and the deference afforded by the Chevron standard, the court found that the FWS's interpretation of "critical habitat" was "nonsensical."  It is not determinative whether the habitat requires special management, but, pursuant to the ESA, it is whether the habitat is "essential to the conservation of the species" and special management of that habitat is possibly necessary.   Thus, defendant's interpretation of the ESA received no deference by the court and the court found defendant's application of the ESA unlawful, as Defendant and FWS have been repeatedly told by federal courts that the existence of other habitat protections does not relieve Defendant from designating critical habitat.  The court found that the FWS's Final Rule violated both the ESA and the APA in implementing its regulations.

U.S. v. Lewis 240 F.3d 866 (10th Cir. 2001)

A jury convicted defendant of one count of violating the Lacey Act, 16 U.S.C.S. §§ 3371-3378. The jury found that defendant had violated Oklahoma law by capturing wild elk, holding them captive, and organizing at least one commercial elk hunt, without a license for those activities. The court affirmed. Violation of a state hunting law was an adequate basis for a Lacey Act prosecution. There was sufficient evidence to prove that the Oklahoma statute regarding commercial hunting licenses applied to defendant, and that defendant had knowledge of the statute's requirements.

U.S. v. Martinelli 240 F. Supp. 365 (N.D. Cal. 1965)

Court held the 1962 version of the BGEPA mandates a jury trial where defendant requests one, despite the fact it constitutes a "petty offense."  For further discussion of criminal prosecutions under the BGEPA, see Detailed Discussion of Eagle Act.

Defenders of Wildlife v. Norton 239 F.Supp.2d 9 (D.D.C. 2002)

Plaintiffs, twelve conservation organizations and one individual involved in Lynx conservation efforts, challenge a final decision by the USFWS declaring the Lynx in the contiguous United States to be a "threatened," rather than "endangered," species under the Endangered Species Act.  Plaintiffs allege that the designation of the Lynx as threatened is "arbitrary, capricious, and an abuse of discretion, or otherwise not in accordance with law," in violation of § 706(2)(A) of the Administrative Procedure Act and that the Service has violated the ESA by failing to designate "critical habitat" for the Lynx as required by that statute.  The Court granted summary judgment for the plaintiffs, finding that the FWS's conclusion that, "[c]ollectively, the Northeast, Great Lakes, and Southern Rockies do not constitute a significant portion of the range of the DPS," (three of the Lynx's four regions) were collectively not a significant portion of its range was counterintuitive and contrary to the plain meaning of the ESA phrase "significant portion of its range."  With regard to the FWS's failure to designate critical habitat, the excessive delays experienced by the FWS ran completely counter to the mandate of the ESA and were without proper justification. 

U.S. v. Fejes 232 F.3d 696 (9th Cir. 2000)

The jury found that Fejes sold caribou in violation of the Lacey Act by providing guide services to two hunters that took the caribou in violation of Alaska law.  The court held that a "sale" of wildlife for purposes of 16 U.S.C. § 3373(d)(1)(B) encompasses not only the agreement to provide guide or outfitting services, but also the actual provision of such services.  Further, defendant was not entitled to instruction regarding alleged state law requirement that he transport illegally taken caribou because the evidence at trial unquestionably showed that he sold caribou in interstate commerce.

Friends of Animals v. The United States Bureau of Land Management 232 F. Supp. 3d 53 (D.D.C. 2017)

Friends of Animals, an animal welfare organization, filed suit for a preliminary injunction against the Bureau of Land Management (BLM). Friends of Animals filed suit after the BLM started organizing a new “gather” which is a a term used for the removal of wild horses. The BLM planned to “gather” wild horses from a range in Utah and the Friends of Animals challenged the decision on three grounds: (1) the decision to gather was not grounded on any National Environmental Policy Act (NEPA) document such as a environmental assessment (EA); the BLM failed to honor its previous commitment to include new EAs for any new gathers; and (3) the gather violates the Wild Horses Act on the basis that the BLM failed to make a excess population determination before authorizing the gather.

The court reviewed the three claims separately and determined that Friends of Animals’ challenges to the gather were not likely to succeed and there was not a sufficient irreparable harm to warrant a preliminary injunction. First, the court found that under NEPA, an agency is able to rely on a previous EA so long as “new circumstances, new information or changes in the action or its impacts not previously analyzed [do not] result in significantly different environmental effects.” The court found that previous EAs were sufficient because they had assessed an “essentially similar” capture method. Additionally, the court determined that although BLM had previously agreed to provide new EAs for any new gathers, the BLM was not legally required to do, so the Friends of Animals argument regarding this issue would not succeed. Lastly, the court found that the BLM had not violated the Wild Horses Act because the BLM had in fact conducted an excess population determination.

Lastly, the court analyzed whether or not the gather created an irreparable harm that would warrant a preliminary injunction. The court found that there was not sufficient evidence to prove any irreparable harm. As a result, the court denied the preliminary injunction and held in favor of the BLM.

American Bird Conservancy v. Harvey 232 F. Supp. 3d 292 (E.D.N.Y. 2017)

Plaintiff, American Bird Conservancy, is a non-profit organization that was dedicated to the conservation of the Piping Plover (a threatened species) in this case. The individual Plaintiffs, David A. Krauss and Susan Scioli were also members of the organization, who observed Piping Plovers at Jones Beach, in New York State for many years. The Plaintiffs brought an action against Defendant Rose Harvey, the Commissioner of the New York State “Parks Office”. The Plaintiffs asserted that the Commissioner failed to act while members of the public routinely fed, built shelters, and cared for the feral cats on Jones Beach. As the cat colonies flourished, the Piping Plover population decreased due to attacks by the cats. The Plaintiffs contended that by failing to take measures to decrease the feral cat population, the Commissioner was allowing the cats to prey on the Piping Plover, in violation of the federal Endangered Species Act (ESA). The Commissioner moved to dismiss the complaint. The District Court, held that: (1) the affidavit and documentary evidence provided by the Alley Cat Allies (ACA) organization was outside the scope of permissible supporting materials for the motion to dismiss. (2)The Plaintiffs had standing to bring action alleging violation of the Endangered Species Act. The Commissioners motion to dismiss was denied.

Natural Resources Defense Council v. Evans 232 F. Supp. 2d 1003 (N.D. Cal. 2002)

Plaintiffs, various environmental organizations and a concerned individual, sought a preliminary injunction against federal officials to prevent the United States Navy's peacetime use of a low frequency sonar system for training, testing and routine operations. The defendants temporarily enjoined from deploying Low Frequency Active Sonar until a carefully tailored preliminary injunction can be issued which would permit the use of Low Frequency Active Sonar for testing and training in a variety of ocean conditions, but would provide additional safeguards to reduce the risk to marine mammals and endangered species.

Amons v. District of Columbia 231 F. Supp 2d. 109 (D.D.C. 2002)

Plaintiff filed a Section 1983 action against D.C. police officers alleging, inter alia , intentional infliction of emotional distress for the unprovoked shooting of his dog inside his home.  The court found that the officers lacked probable cause for the warrantless entry into his home to make the arrest, the arresting officer made "an egregiously unlawful arrest," and the officers were unreasonable in shooting plaintiff's dog without provocation.

Animal Legal Defense Fund, Inc. v. Espy 23 F.3d 496 (C.A.D.C.,1994)
In this case, animal welfare groups and two individuals challenged the regulation promulgated by Department of Agriculture that failed to include birds, rats, and mice as “animals” within meaning of Federal Laboratory Animal Welfare Act (FLAWA). The United States District Court for the District of Columbia, denied defendant's motion to dismiss, and subsequently granted plaintiffs' motion for summary judgment. Defendant appealed. The Court of Appeals held that plaintiffs could not demonstrate both constitutional standing to sue and statutory right to judicial review under the APA. The Court vacated the district court's judgment and remanded the case with directions to dismiss.
Institute of Marine Mammal Studies v. National Marine Fisheries Service 23 F. Supp. 3d 705 (S.D. Miss. 2014), appeal dismissed (Feb. 27, 2015) The Institute of Marine Mammal Studies (IMMS) brought action against the National Marine Fisheries Service (NMFS) and others, alleging that NMFS regulations did not properly implement the Marine Mammal Protection Act (MMPA), and that the NMFS was improperly administering placement list for rehabilitated sea lions that could not be reintroduced into the wild. Parties cross-moved for summary judgment. After considering the parties' arguments, the administrative record, and the relevant law, the District Court found that the IMMS lacked standing to bring its claim that NMFS regulations did not properly implement the Marine Mammal Protect Act ("MMPA"). Further, the Court found that it lacked subject matter jurisdiction of IMMS' claims that the NMFS was improperly administering a placement list for non-releasable sea lions. However, the Court found it may review the claims concerning the permit allowing IMMS to "take" sea lions. The Court found that a term included in IMMS' permit improperly delegated federal authority to third parties. The permit was therefore remanded to the agency for reconsideration. Each summary judgment motion was granted in part and denied in part.
Steiner v. U.S. 229 F.2d 745 (9th Cir. 1956)

Defendants were charged with knowingly and willfully, with intent to defraud the United States, smuggling and clandestinely introducing into the United States merchandise, namely, psittacine birds, which should have been invoiced; by fraudulently and knowingly importing merchandise and by knowingly receiving, concealing and facilitating the transportation and concealment of such merchandise after importation, knowing the same to have been imported into the United States contrary to law.  Appellants contend that the birds mentioned in count 1 were not merchandise, within the meaning of 18 U.S.C.A. § 545. The court found there was no merit in this contention.  Further, this importation subjected defendants to the felony provision of the Lacey Act and defendants were properly sentenced under the felony conspiracy portion of the Act.

Bone v. Vill. Club, Inc. 223 F.Supp. 3d 1203 (M.D. Fla. 2016) This case dealt with a woman's request to have her emotional-support dog live with her before purchasing land in a mobile home community, known as Brookhaven. Prior to purchasing her lot, the plaintiff allegedly received permission from the president of Brookhaven's board of directors to keep her dog, even though the plaintiff was purchasing a lot in the "no pet" section of Brookhaven. The plaintiff provided the president of the board with the documentation requested, and the president told plaintiff she had been approved by the board to have her dog. Approximately one year after plaintiff purchased her lot, Brookhaven's attorney sent a letter requesting that plaintiff remove her dog, citing Brookhaven's policies disallowing her dog. After several letters sent back and forth between plaintiff's attorney and Brookhaven's attorney concerning requirements of the Fair Housing Act and the party's respective actions, both parties cross-moved for summary judgement. The court held that 1) genuine issue of material fact existed as to whether tenant had an actual disability; 2) landlord was not prejudiced by tenant's untimely disclosure of expert report; 3) genuine issue of material fact existed as to whether landlord constructively denied tenant an accommodation; and 4) genuine issue of material fact existed as to whether landlord retaliated against tenant for requesting a disability accommodation. As a result, all motions for summary judgement were denied.
Gibson v. Babbitt 223 F.3d 1256 (11th Cir. 2000)

Defendant, a Native American, challenged the constitutionality of the limitation of eagle parts through the permit system to members of federally recognized tribes.  The limitation under the federal eagle permit system to federally recognized Indian tribes does not violate RFRA because the government has a compelling interest in protecting a species in demise and fulfilling pre-existing trust obligations to federally-recognized tribes in light of the limited supply of eagle parts.  For further discussion on free exercise challenges under the BGEPA, see Detailed Discussion of Eagle Act.

Hansen v. U.S. Dept. of Agriculture 221 F.3d 1342 (8th Cir. 2000) Judie Hansen petitions for review of a final decision of the Secretary of the United States Department of Agriculture. Because the 8th Circuit has no jurisdiction over the matter, the petition is dismissed.
Milburn v. City of Lebanon 221 F. Supp. 3d 1217 (D. Or. 2016)

Plaintiff Milburn was acquitted of misdemeanor animal abuse on appeal, but a Lebanon police officer removed Milburns’ dog from her possession. While the appeal was pending, the Defendant, City of Lebanon, gave the dog to an animal shelter. The dog was later adopted by a new owner. The Linn County Circuit Court ordered the City to return the dog to Milburn after the acquittal but the Defendant City failed to comply. Milburn then brought this action pursuant to 42 U.S.C. §§ 1981 and 1983 against the City of Lebanon. The City moved for dismissal for failure to state a claim, and the United States District Court, for the District of Oregon, granted that motion while giving leave for Milburn to amend her complaint. In the Amended Complaint, Milburn contended that the City’s refusal to return her dog pursuant to the state court order deprived her of property without due process of law, in violation of the Fourteenth Amendment. Milburn also asserted a violation of her procedural due process rights. The United States District Court, for the District of Oregon, reasoned that while Milburn alleged a state-law property interest in her dog, she failed to allege that the Defendant City deprived her of that interest without adequate process. Milburn also did not allege state remedies to be inadequate. Those two omissions in combination were fatal to Miburn's procedural due process claim. Also, Milburn's assertion that the court issued an order and that the City did not comply with, is an attack on the result of the procedure. The court reasoned that attacking the result instead of the process of a procedure does not state a procedural due process claim. Milburn’s procedural due process claim was then dismissed. The Court also held that it did not have jurisdiction over Milburn’s injunctive relief claim. Therefore, Milburn's request for injunctive relief was dismissed with prejudice. However, the court held that Milburn could seek monetary damages. While Defendant City’s second motion to dismiss was granted, Milburn was granted leave to amend her complaint within 90 days with regard to her claim for actual and compensatory damages.

 

U.S. v. Hayashi 22 F.3d 859 (1993)

Appellant challenged the decision of the United States District Court for the District of Hawaii, which convicted him of taking a marine mammal in violation of the MMPA.  The court reversed appellant's conviction for taking a marine mammal under the MMPA.  It held that the MMPA and the regulations implementing the act did not make it a crime to take reasonable steps to deter porpoises from eating fish or bait off a fisherman's line. 

U.S. v. Bronx Reptiles, Inc. 217 F.3d 82 (2nd Cir. 2000)

After defendant received a shipment of dead frogs, he was convicted of violating a portion of the Lacey Act, 18 U.S.C.S. § 42(c), which made it a misdemeanor to knowingly cause or permit any wild animal to be transported to the United States under inhumane or unhealthful conditions. Defendant appealed, and judgment was reversed and remanded with instructions to enter a judgment of not guilty. The government failed to meet its burden to prove not only that the defendant knowingly caused or permitted the transportation to the United States of a wild animal, but also that the defendant knew the conditions under which the frogs was transported were "inhumane or unhealthful."

Safari Club International v. Jewell 213 F. Supp. 3d 48 (D.D.C. 2016) Safari Club International and the National Rifle Association filed suit challenging the federal government’s suspension of imports of trophies from elephants sport-hunted in Zimbabwe. In April of 2014, the U.S. Fish and Wildlife Service (“the Service”) suspended imports of trophies from elephants on the basis that the Service could no longer make the finding required under its regulations “that the killing of the animal whose trophy is intended for import would enhance survival of the species.” Safari Club asserted four main arguments against the Service’s suspension of imports: (1) the agency violated APA rulemaking requirements by not providing for notice and comment; (2) the agency applied prohibited guidelines and the wrong standard in making its findings; (3) the agency failed to overcome a statutory presumption in Section 9(c)(a) of the Endangered Species Act; and (4) the agency violated the APA by failing to explain why it maintained the enhancement finding requirement in the Special Rule after the requirement was eliminated from the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The court reviewed Safari International’s arguments and granted summary judgment only with respect to the argument that the Service had failed to publish notice of the changed Zimbabwe enhancement finding in the Federal Register until May 12, 2014. The court dismissed the remaining arguments put forth by Safari International and granted summary judgment in favor of the Service. The court found that the Service had violated its commitment to publish any notice of a change in the Federal Register before the change can take effect. The Service violated this commitment by publishing notice of the suspension of imports of trophies in the Federal Register on May 12, 2014 but making the effective date of the suspension April 4, 2014. For this reason, the court found that the effective date of the suspension must be changed to May 12, 2014. With respect to Safari International’s other arguments, the court found that Safari International was unable to meet its burden and held in favor of the Service.
