In 1974, the Colorado Department of Health adopted certain regulations, the conceded effect of which is to prohibit importation of pets for resale from states whose licensing laws and regulations for commercial pet dealers are not as stringent as those of Colorado. The regulations exempt from this prohibition persons who import pets not for resale and exclusively for breeding purposes or for personal use. After the regulations were upheld by the Denver district court, the plaintiffs, who are commercial pet importers, brought this appeal. The court found these arguments to be unpersuasive and, accordingly, affirmed the judgment of the trial court.
WI - Breeder - Chapter ATCP 16. Dog Sellers and Dog Facility Operators. This set of administrative regulations from Wisconsin covers the conditions under which dogs must be kept by dog breeders (defined as any person who sells at least 25 dogs from more than 3 litters) and dog dealers. Dog sellers and dog facility operators are required to be licensed under the section. Per ATCP 16.18, a person licensed under this chapter may not transfer a dog to the buyer unless the dog is at least 7 weeks old, the dog is accompanied by its dam, or the department approves the transfer in writing. Minimum standards of care are outlined for licensees for dogs kept indoors or outdoors.
WI - Breed - 95.13. Misrepresenting breed of domestic animal Under this Wisconsin statute, no person may sell any domestic animal or represent that such domestic animal is a pure bred animal, if the animal is not registered or entitled to be registered, in any pure breed registry for that breed.

WA - Leasing - 63.10.070. Dog or cat ownership contracts In 2019, Washington enacted legislation prohibiting the sale of a dog or cat through an installment agreement. This resulted in three different new laws corresponding to different types of sales agreements. Essentially, a contract or retail installment contract entered into on or after July 28, 2019, to transfer ownership of a live dog or cat in which ownership is contingent upon the making of payments over a period of time subsequent to the transfer of possession of the live dog or cat is void and unenforceable.
VT- Pet Sales - Rule 308 Part III Sale of Cat and Dogs These regulations detail the disclosures a pet dealer must make to a consumer at the time of sale of a cat or a dog pursuant to 20 V.S.A § 4302. According to the regulations, the consumer, at the time of sale, must be provided a copy of the Consumer Right-To-Know form, the Cat or Dog Request for Restitution form, the Consumer's Rights under 20 V.S.A. § 4302(a),(e) and § 4303, and the applicable state laws regarding rabies and licensing.

Precisely, the following regulations include: provisions regarding registration and licensing periods; government inspections; and specific instructions for the housing and care of cats and dogs.

Ordinances; penalties (pet shops) This Virginia statute provides that the governing body of any county, city or town may, by local ordinance, require a person operating a pet shop or operating as a dealer in companion animals to obtain a permit. It further outlines the specific requirements the ordinance may provide, including record-keeping and penalties.

Releasing agencies other than pounds or animal shelters; confinement and disposition of companion ani This Virginia statute outlines the requirements for releasing agencies other than pounds or animal shelters. Included in the provisions are recordkeeping requirements, a requirement that each agency receives a signed statement from each of its directors, operators, staff, or animal caregivers specifying that each individual has never been convicted of animal cruelty, neglect, or abandonment, and owner notice provisions.
VA - Impound - § 3.2-6545. Regulation of sale of animals procured from animal shelters This Virginia statute provides that any city, county or town which supports an animal shelter may by ordinance provide that no person who acquires an animal from a shelter shall be able to sell such animal within a period of six months from the time the animal is acquired from the shelter. Violation of such an ordinance shall constitute a misdemeanor.
