Theis v. Yuba County Sheriff's Department The Plaintiffs allege that their cat, named Pizza, was unlawfully euthanized at Yuba County Animal Care Services shelter in Olivehurst, California on or about February 9, 2018. Pizza went missing on or about February 9, 2018 and Plaintiffs found out later that same day that a neighbor had found the cat and brought it to the Yuba County animal shelter. The Plaintiffs attempted to contact the shelter, but it had already closed for the evening. The next morning around 9:30 a.m., the Plaintiffs arrived at the shelter and learned that Pizza had been euthanized as early as 5:00 p.m. the night before. Defendant Barnhill, the shelter’s supervising officer, informed the Plaintiff’s that Pizza had been injured, however, the neighbor who brought the cat to the shelter without knowing it was the Plaintiffs’ described Pizza as looking healthy. The Plaintiffs contend that Pizza’s euthanization falls within an ongoing pattern and practice of abuse and failure to follow state and federal law. Plaintiffs filed their original complaint on October 1, 2018. The Defendants removed the case to federal court. Plaintiff’s asserted four claims in their First Amended Complaint: (1) the failure to perform mandatory duties in violation of California Government Code section 815.6, (2) petition for a writ of mandate under California Code of Civil Procedure section 1085, (3) violation of the plaintiff’s Fourteenth Amendment substantive due process rights under 42 U.S.C. section 1983, (4) negligence under California common law. The Defendants moved to dismiss Plaintiff’s First Amended Complaint and alleged that the Plaintiff’s did not plead facts sufficient to show that Barnhill engaged in unlawful conduct or to establish a substantive or procedural due process violation. The Court, however, granted the Plaintiffs leave to amend their complaint as to the section 1983 claim. The Court declined to assert supplemental jurisdiction over the state law claims, which were the Plaintiff’s first, second, and fourth claims since the Plaintiff’s had conceded that their federal claim by requesting to amend their complaint. As a result, the Court reviewed remaining claims to determine whether they may be included in any amended complaint or whether leave to amend would be futile. The Court determined that granting Plaintiff’s leave to file a second amended complaint would not be futile on all of their claims except for the petition for writ of mandate claim. California’s Civil Procedure Code section 1085 does not apply to federal courts and, therefore, the Plaintiff’s leave to amend this claim would be futile. Ultimately, the Court ordered Plaintiff’s third cause of action for violations of their Fourteenth Amendment substantive and procedural due process rights be dismissed with leave to amend, the Plaintiff’s state law claims in their first, second, and fourth causes of action be dismissed with leave to amend to the extent consistent with the order, and denied the Defendant's motions to strike Plaintiffs' punitive damages claim. Plaintiffs were required to file a second amended complaint within 21 days of the date the order was filed if they wished to amend their complaint.
Thomas v. Stenberg


While driving his motorcycle down a private road that had easement access, the plaintiff was injured by a charging cow. Arguing the defendant had a duty to warn of the presence of an unconfined and inherently dangerous animal, the plaintiff brought a negligence and a premise liability suit against the defendant. Upon appeal, the court held that the plaintiff had failed to prove that the defendant was negligent and that the defendant was strictly liable for the cow's actions; the court, therefore, ruled in favor of the defendant.

VIVA! International Voice for Animals, et al v. Adidas Promotional Retail Operations, Inc., et al In this California case, plaintiffs sued defendants for injunctive and declaratory relief, claiming that defendants import the kangaroo leather in violation of section Penal Code section 653o—and thus are committing an unlawful business practice (Bus. & Prof. Code, § 17200 et seq.). Section 653o bans the import of products made from certain animals, including kangaroos into California. Defendants import and sell in California markets athletic shoes made from kangaroo leather. Defendants moved for summary judgment, arguing that section 653o is preempted by federal law under the doctrine of conflict preemption. The trial court agreed and granted the motion. The appellate court also agreed, finding that the statute as applied to defendants in this case conflicts with federal law and with substantial federal objectives of persuading Australian federal and state governments to impose kangaroo population management programs, in exchange for allowing the importation of kangaroo products. The accompanying regulations set forth a comprehensive national policy for the protection of endangered species such as the three kangaroo species involved in this case. Application of section 653o would stand as an obstacle to the accomplishment and execution of the objectives of Congress if applied to the defendants.
Viva! v. Adidas
Viva, an animal protective organization, filed action against Adidas shoe retailer alleging that it was violating a state statute banning the import of products made from Australian kangaroo hide into California. On cross motions for summary judgment, the original court sided with Adidas,

on the ground that state statute was preempted by federal Endangered Species Act of 1973.  The appeals court affirmed, however the California Superior Court reversed, holding that the state statute was not preempted by federal law. 

Wells v. Brown


In this California case, damages were assessed beyond the purchase price of a dog involved in a hit and run case where the defendant negligently ran over and killed a 15 month old pure-bred Waeimaraner. After the defendant ran over the dog, he shot the dog and buried it. The next morning he contacted the veterinarian listed on the collar, as well as the owner of the dog. The court upheld the jury verdict of $1,500 since the purchase price was determined to not reflect the market value at the time of the dog’s death.

William v. Orange County Animal Control


This involves a case where owners challenge validity of euthanasia order for "dangerous" dog. "Boo," a bullmastiff (large breed of dog), knocked down a child who had walked into his (the dog's) yard. The child accused dog of biting him. The Orange County Animal Control Department ordered that Boo be euthanized as a "vicious" and "dangerous" animal. The owners filed a Writ of Mandamus to delay the killing of the dog until their challenge could be heard in court.

Wright v. Fish and Game Commission (unpublished)


The California Court of Appeal upheld the state's Fish and Game Commission’s ferret ban against an equal protection challenge from a ferret owner. The owner argued that the ban discriminated between ferret owners and owners of other companion animals. However, the court found a rational relation between the ban and concerns about wildlife and human health (from attacks and from rabies).

Wysotski v. Air Canada


Airline mishandled shipment of pet cat, the container was damaged and cat escaped. Complaint on negligence and other grounds for $2.5 million in damages.

Young v. California Fish and Game Commission Kele Young operated a wildlife preserve called Magic Jungle. Young received her first permit from the California Department of Fish and Wildlife (the Department) in 1990 which was renewed each year thereafter. On August 8, 2013, Young filed her restricted species permit renewal application. On the application, Young stated that she was exempt from payment of the permit fee, application fee, and the inspection fee. Young’s permit was set to expire on November 9, 2013. The Department notified Young on July 14, 2014 that her renewal application was incomplete because the fee had not been paid. The Department agreed to waive the $56.14 permit fee and the $56.65 application fee, but the Department stated that she still had to pay the $227.91 inspection fee. Young was given 30 days to pay the fee. The Department ultimately denied Young’s renewal application. Young appealed to the Commission. The Commission found for the Department. Young then sought a writ of mandate to require the Department to perform its duty to determine whether justified reasons existed to grant or deny Young’s request for a waiver of certain restricted species permitting fees. The trial court denied Young’s writ and this appeal followed. Young failed to support many of her arguments by reference to the record or legal authority, therefore, the only issues that were reviewed were whether the Wildlife Agencies could refuse to waive the inspection fee without consideration of the justified reasons or whether it was in the best interests of the public to waive the fee and if reversal was warranted due to the trial court failing to issue a statement of decision. The Court of Appeals found that no statement of decision was required by the trial court because a statement of decision is only required as to issues of fact and the trial court stated that it was only deciding issues of law and that there was no dispute as to the facts. As for the inspection fee, the Court found that the regulations specifically provided for a waiver of the permit fee but did not contain any other language that would allow for a waiver of the inspection fee. The permit fee was separate from the inspection fee and nothing in the regulations entitled her to a waiver of the inspection fee nor granted the Department the authority to waive such fee. The Court affirmed the trial court’s order denying the petition for writ of mandate.
Yuzon v. Collins


In this California case, a dog bite victim sued a landlord, alleging premises liability in landlord's failure to guard or warn against tenants' dangerous dog.  On appeal from an order of summary judgment in favor of the landlords, the Court of Appeal held that the landlord owed no duty of care, as he had no actual knowledge of dog's dangerous propensities and an expert witness's declaration that the landlord should have known of the dog's vicious propensities was insufficient to warrant reconsideration of summary judgment ruling.  The landlord's knowledge that tenants may have a dog because it is allowed through a provision in the lease is insufficient to impute liability where the landlord has no knowledge of any previous attacks or incidents.
