In response, the Kentucky Board of Agriculture passed Administrative Regulation 302 21:030 in 2014 to provide additional standards and authorized practices for the keeping of livestock for beef and veal. AU - Pest Plants and Animals Act 2005 (ACT) Pest Plants and Animals Act 2005

The Pest Plants and Animals Act 2005 (Pest Act) creates a system to identify and control potential pest plants and animals in the ACT. It provides a strategic framework for pest management. The objects of the Pest Act are to protect the Australian Capital Territories land and aquatic resources from threats posed by pest plants and animals by identifying, declaring and then managing pest plants and animals.

U.S. v. Stevens 533 F.3d 218, 2008 WL 2779529 (C.A.3 (Pa.),2008) Note that certiorari was granted in 2009 by --- S.Ct. ----, 2009 WL 1034613 (U.S. Apr 20, 2009). In this case, the Third Circuit held that 18 U.S.C. § 48, the federal law that criminalizes depictions of animal cruelty, is an unconstitutional infringement on free speech rights guaranteed by the First Amendment. The defendant in this case was convicted after investigators arranged to buy three dogfighting videos from defendant in sting operation.  Because the statute addresses a content-based regulation on speech, the court considered whether the statute survived a strict scrutiny test. The majority was unwilling to extend the rationale of Ferber outside of child pornography without direction from the Supreme Court.  The majority found that the conduct at issue in § 48 does not give rise to a sufficient compelling interest. American Society For Prevention of Cruelty to Animals v. Ringling Brothers and Barnum & Bailey Circus 246 F.R.D. 39 (D.D.C.,2007) 2007 WL 3101818 (D.D.C.)

In this case, the court considered the parties’ respective motions for reconsideration. On August 23, 2007, the Court granted summary judgment to defendant as to elephants subject to a captive-bred wildlife (“CBW”) permit and denied summary judgment as to elephants for which defendant claimed a “pre-Act” exemption. Defendant has filed a motion for reconsideration challenging the Court's decision regarding the “pre-Act” elephants and plaintiff has filed a motion for reconsideration challenging the Court's decision regarding the CBW permit elephants. Defendant’s motion was granted in part as to the standing of plaintiff, Tom Rider. The court held that Rider’s standing is now limited to those six elephants to which he became “emotionally attached.” Notably, the court ended its opinion with a “hint to the wise” that the court will not tolerate any further filings inconsistent with FRCP.

Case
CO - Wildlife - Ley 2111 Ley 2111 Ley 2111, 2021, is the law for environmental crimes. The focus is to protect the national ecosystems and the nation’s natural patrimony. This law creates new crimes and strengthens existing ones concerning national wildlife by imposing up to 12 years (60-135 months) of prison and monetary fines of 40,000 minimum wages for illegal trafficking. More specifically, with regards to wildlife, the law punishes “those who traffic, acquire, export or trade without authorization from the competent authority or in violation of existing regulations, specimens, products or parts of aquatic, wild fauna or exotic wild species.” The new crimes created under this law are deforestation, its promotion and financing; wildlife trafficking; the financing of the invasion of areas of special ecological importance; and the financing and illegal appropriation of vacant lands belonging to the nation. The sanctions for the crimes of damage to natural resources and ecocide, illegal hunting and fishing, the illegal use of renewable natural resources, and environmental contamination were strengthened. FL - Liens, veterinary - 713.655. Liens for professional services of veterinarians West's F. S. A. § 713.655 FL ST § 713.655 This section comprises Florida's veterinary lien law. A lien exists in favor of any veterinarian who renders professional services to an animal at the request of the owner of the animal, the owner's agent, or a bailee, lessee, or custodian of the animal, for the unpaid portion of the fees for such professional services. The lien remains valid and enforceable for a period of 1 year from the date the professional services were rendered, and such lien is to be enforced in the manner provided for the enforcement of other liens on personal property in this state. Australia - Animal Welfare - (Broiler Chickens: Fully Housed) Code of Welfare 2003 Code of Welfare No. 1 This code applies to all persons responsible for the welfare of broiler chickens in controlled environment broiler production systems. The pre-hatched chick that is in the last half of development is also covered by this code. In controlled environment broiler production systems, broiler chickens are kept in enclosed housing and are reliant on human management for all their daily requirements. The rearing of broiler chickens, if it is to be done well, requires both experience and the observance of high standards. Unless that work is done well, the welfare of the birds cannot be adequately protected. This code is intended to encourage all those responsible for its implementation to adopt the highest standard of husbandry, care and handling, to equal or exceed the minimum standards. Administrative

Dogs that annoy or bite animals or birds AS § 03.55.030 AK ST § 03.55.030 This Alaska statute provides that any dog that habitually annoys any wild deer, reindeer, sheep, cattle, horse, or other animal or bird either domestic or wild, or evinces a disposition which makes it likely that it will without provocation bite an animal or fowl, may be lawfully killed by any person when it is found at large. The owner or keeper of the dog, if known or reasonably identifiable, shall be notified and given reasonable opportunity to restrain the dog before it is lawful to kill it. Statute
