MS - Initiatives - HCR 30, Establish the Right to Hunt, Fish and Harvest Wildlife as a Constitutional Right HCR 30 (2014) This 2014 proposed legislative referendum would establish the right to hunt and fish in the state. "Section 12A. The people have the right to hunt, fish and harvest wildlife, including by the use of traditional methods, subject only to laws and regulations that promote wildlife conservation and management and that preserve the future of hunting and fishing, as the Legislature may prescribe by general law. Public hunting and fishing shall be a preferred means of managing and controlling wildlife. This section may not be construed to modify any provision of law relating to trespass, property rights, the regulation of commercial activities or the maintenance of levees pursuant to Article 11." DE - Rabies - Subchapter I. Rabies Control in Animal and Human Populations 3 Del.C. § 8201 - 8213 DE ST TI 3 § 8201 - 8213 The purpose of this chapter is to control and suppress the spread of rabies among the domestic and wild animal populations of Delaware. Any person owning a dog 6 months of age or older in this State shall have that dog vaccinated against rabies by a veterinarian. Any person owning a cat 6 months of age or older in this State shall have the cat vaccinated against rabies by a veterinarian. Any person owning a ferret 6 months of age or older in this State shall have the ferret vaccinated against rabies by a veterinarian. Statute
Macho v. Mahowald 374 N.W.2d 312 (Minn.App.,1985)

In this Minnesota case, a rider brought an action for personal injuries suffered after the defendant-owner's horse bolted while the rider was mounting the horse. The lower court entered judgment notwithstanding the verdict for the owner. The rider appealed. The Court of Appeals held that evidence showing that the horse had previously bolted was sufficient to create an issue for the jury as to whether the horse had a propensity to be dangerous. Further, with regard to whether the owner was negligent in allowing the rider to mount without properly adjusting the saddle equipment, the court found that the jury could have properly found both parties were negligent in failing to adjust the stirrups.

Argentina - Racing - Ley 27330, Dog Racing law Ley 27330 This law prohibits dog racing of any breed in the entire territory. Organization, promotion, and facilitation of a dog race are punishable by imprisonment of not less than 3 months and not more than 4 years. Together with fines that can go from 4,000 Argentinian pesos to $80,000. Statute

Appeal of a conviction in district court for cruelty to animals.  Defendant was convicted of cruelty to animals after having been found to have recklessly caused and allowed his dog to kill two cats, and he appealed. The Court of Appeals held that forfeiture of defendant's dog was an impermissible condition of probation.

Douglas Furbee, et al. v. Gregory L. Wilson, et. al. 144 N.E.3d 801 (Ind. Ct. App. 2020) Shelly Linder lived in an apartment complex with a no-pet policy. Linder asked if she could have an emotional-support animal and provided a letter from a licensed family and marriage therapist, which stated that Linder had a disability and required an emotional-support animal to help alleviate her symptoms. The letter did not identify a specific disability and the landlord subsequently requested more information from Linder. Linder did not provide any additional information and instead brought her cat into her apartment as her emotional-support animal. The landlord charged Linder a fine after discovering the cat on the premises and gave her seven days in which to remove the cat. Linder failed to comply which led to Linder’s eviction. The Indiana Civil Rights Commission filed a complaint against the landlord on behalf of Linder in Delaware Circuit Court alleging that the landlord failed to accommodate her request for an emotional-support animal in turn violating the Indiana Fair Housing Act. The trial court denied summary judgment for the landlord and this appeal followed. The landlord conceded that Linder was disabled and requested a reasonable accommodation, however, the landlord argued that it was not given enough information from which to “meaningfully” review Linder’s request. The Delaware Court of Appeals agreed that the Landlord did not have sufficient information to meaningfully review Linder’s request and because Linder did not inform the Landlord about her disability and her need for the cat, she was acting in bad faith. The Court ultimately reversed and remanded the case to the trial court. Case
AK - Initiatives - Ballot Measure 1 (voter wildlife initatives) Ballot Measure 1 (2000) This Alaska ballot measure would change the Alaska Constitution so that voters could not use the initiative process to make laws that permit, regulate, or prohibit taking or transporting wildlife, or prescribe seasons or methods for taking wildlife. US - Pets and Housing - Subpart C. Pet Ownership for the Elderly or Persons with Disabilities 24 C.F.R. § 5.300 to .327 This subpart implements section 227 of the Housing and Urban Rural Recovery Act of 1983 (12 U.S.C. 1701r-1) as it pertains to projects for the elderly or persons with disabilities under: (1) the housing programs administered by the Assistant Secretary for Housing - Federal Housing Commissioner; (2) projects assisted under the programs contained in chapter VIII of this title 24; and (3) the public housing program. The rule specifically states that it does not apply to assistance or service animals. The rule states that, except as otherwise provided, no project owner that manages a project for the elderly or disabled may restrict or discriminate against any person by reason of the person's ownership or presence of a common household pet in the person's dwelling unit. A "common household pet," is defined as "[a] domesticated animal, such as a dog, cat, bird, rodent (including a rabbit), fish, or turtle, that is traditionally kept in the home for pleasure rather than for commercial purposes" (excluding reptiles with exception of turtles). Notice of the allowance must be provided to tenants and tenants must be given the ability to access to pet rules. The project owner must establish reasonable rules to govern the keeping of pets.

State v. Brown 771 N.W.2d 267 (N.D.,2009) 2009 WL 2506287 (N.D.), 2009 ND 150

In this North Dakota case, the defendant appeals from a criminal judgment finding she violated the Cass County Animal Control Ordinance after her neighbors reported her barking dogs. In her first appeal ground, Brown contended that the Ordinance constituted an unconstitutional delegation of power. The court disagreed, finding that Cass County adopted a home rule charter and thus had the power to create criminal penalties for violations of ordinances. Brown next argued that the legislature “has statutorily prohibited the county from attempting to regulate dogs as public nuisances.” Since the state has defined certain “dog activities” that constitute a public nuisance, the county is precluded from declaring any other dog-related activity a public nuisance according to defendant. The court found that this broad interpretation would preclude action by the county if the state has exercised any authority and would virtually eliminate the county's authority granted by home-rule authority. The court also rejected Brown’s argument that the Ordinance is unconstitutionally vague. The Ordinance provides that an animal that “barks ... in an excessive or continuous manner” is a public nuisance. The court held that its holding in   Kilkenny, 2007 ND 44, ¶¶ 20-25, 729 N.W.2d 120, is controlling here, where the words excessive, continuous, or untimely have a common understanding and are not vague.
