Any property interest, whether tangible or intangible, that was acquired through the commission of any of the crimes listed in subdivision (a) of Section 597.5 or subdivision (b) of Section 597b shall be subject to forfeiture, including both personal and real property, profits, proceeds, and the instrumentalities acquired, accumulated, or used by cockfighting or dogfighting participants, organizers, transporters of animals and equipment, breeders and trainers of fighting birds or fighting dogs, and persons who steal or illegally obtain dogs or other animals for fighting, including bait and sparring animals. Defendant appealed a conviction for cruelty to animals after several dogs that appeared malnourished and emaciated with no visible food or water nearby were found on Defendant’s property by a police officer and an Animal Control officer.  The Court of Appeals of Texas, Houston, 14th District confirmed the conviction, finding that Defendant waived any error with respect to her motion to suppress evidence by affirmatively stating at trial that Defendant had “no objection” to the admission of evidence. Finally, the Court’s denial of Defendant’s request to show evidence of Defendant’s past practice and routine of caring for stray animals and nursing them to health did not deprive Defendant of a complete defense.

Liberty Humane Soc., Inc. v. Jacobs Not Reported in A.2d, 2008 WL 2491961 (N.J.Super.A.D.) This case concerns the authority of the Department of Health to revoke certifications of animal control officers who willfully contravened the state law on impounding dogs.   The court found that “[s] ince the Department acknowledged that it is charged with revoking certifications of animal control off icers when those officers pose ‘ a threat to the health and safety’ of the community, it should follow that allegations of officers willfully and illegally taking a dog from its owner and falsifying records to claim it a stray so as to expose it to adoption by another or euthanasia calls for the Department to take action. It would be both arbitrary and capricious for the Department to ignore its duty to determine if revocation of certification is required. Case
AUTO 1928 de 2022 AUTO 1928 de 2022 In Colombia, municipalities are not allowed to prohibit bullfighting. It is a power reserved for Congress. Bogota attempted to regulate the practice through ordinance 767 in 2020. Since the city was not allowed to prohibit bullfights, it regulated them by prohibiting the use of sharp objects and killing of the bulls in the ring. In addition, they required that 30% of the publicity of the event be focused on educating the public on the suffering of bulls. It imposed a 20% tax and decreased the number of annual bullfights allowed from 8 to 4. During this time, no bids were sent to use "Plaza Santamaria" (Bogota's bullfighting stadium) because owners and sponsors of this practice did not agree with such requirements. Thus, Plaza Santamaria did not hold any bullfights since 2020. In December 2022, the Constitutional Court ordered the city to refrain from taking any action conducing to the violation of decision T-296 of 2013 and ordered the opening of Plaza Santamaria “to allow bullfights to take place in the usual conditions as an expression of cultural diversity and social pluralism,” effectively ordering the city to do what’s necessary for the comeback of bullfighting to the capital. In this Georgia case, the plaintiff was injured from being bitten by defendants' dog who was chained to the bed of their pickup truck while the defendants were inside an adjacent restaurant. The plaintiff sued defendants, claiming that they failed to warn her of their dog's dangerous propensities and that they committed negligence per se by violating the state's strict liability statute (OCGA § 51-2-7) and the Hall County Animal Control Ordinance. A jury found in favor of the defendants. The court found that the evidence was therefore more than sufficient to support the jury's conclusion that defendants' dog was “under restraint” for purposes of the ordinance. Further, there was no evidence that the owners had knowledge of the dog's vicious propensity. Affirmed.
