Dilorenzo v. Costco Wholesale Corp. 515 F.Supp.2d 1187 (W.D.Wash.) 2007 WL 2852380 (W.D.Wash.)

Plaintiff is a disabled individual who suffers from a variety of ailments arising after her service in the armed forces. Plaintiff's claims arise from interactions with Costco store employees on two separate shopping trips with her service dog. Store employees inquired as to what task the dog performed and objected to the dog being carried in plaintiff's arms around the store. Plaintiff brings her claims under the Washington Law Against Discrimination (WLAD) and the federal Americans with Disabilities Act (ADA). The court found that Defendant's employees did not exceed the boundaries of a permissible inquiry under the ADA with regard to her service dog, where they never asked Plaintiff to state her disability or demanded proof of special training.

Douglas Furbee, et al. v. Gregory L. Wilson, et. al. 144 N.E.3d 801 (Ind. Ct. App. 2020) Shelly Linder lived in an apartment complex with a no-pet policy. Linder asked if she could have an emotional-support animal and provided a letter from a licensed family and marriage therapist, which stated that Linder had a disability and required an emotional-support animal to help alleviate her symptoms. The letter did not identify a specific disability and the landlord subsequently requested more information from Linder. Linder did not provide any additional information and instead brought her cat into her apartment as her emotional-support animal. The landlord charged Linder a fine after discovering the cat on the premises and gave her seven days in which to remove the cat. Linder failed to comply which led to Linder’s eviction. The Indiana Civil Rights Commission filed a complaint against the landlord on behalf of Linder in Delaware Circuit Court alleging that the landlord failed to accommodate her request for an emotional-support animal in turn violating the Indiana Fair Housing Act. The trial court denied summary judgment for the landlord and this appeal followed. The landlord conceded that Linder was disabled and requested a reasonable accommodation, however, the landlord argued that it was not given enough information from which to “meaningfully” review Linder’s request. The Delaware Court of Appeals agreed that the Landlord did not have sufficient information to meaningfully review Linder’s request and because Linder did not inform the Landlord about her disability and her need for the cat, she was acting in bad faith. The Court ultimately reversed and remanded the case to the trial court. Case
Fair Housing of the Dakotas, Inc. v. Goldmark Property Management, Inc. 78 F.Supp.2d 1028 (D.N.D. 2011) 42 NDLR P 280, 66 A.L.R. Fed. 2d 687 Plaintiffs bring this action against Goldmark Property Management alleging discrimination on the basis of disability in violation of the Fair Housing Act. The alleged discriminatory policy is a mandatory application fee, non-refundable deposit, and monthly charge that Goldmark imposes on tenants with disabilities who reside with a non-specially trained assistance animal (i.e. a companion pet). These same fees are waived for tenants with disabilities who reside with a trained assistance animal (i.e. a seeing eye dog). The FHA encompasses all types of assistance animals regardless of training; therefore, Goldmark's policy implicates the FHA. Further, Plaintiffs have met their burden of establishing a prima face case of discrimination and have presented sufficient evidence to create genuine issues for trial on the questions of the necessity and reasonableness of the requested accommodation and whether Goldmark's alleged objective for the policy is permissible under the FHA and not pretextual. Therefore, Goldmark's motion for summary judgment is granted in part and denied in part. It is granted as to Plaintiffs' claim of disparate treatment because no proof was offered of a discriminatory intent. It is denied as to Plaintiffs' claims of disparate impact and failure to make a reasonable accommodation. Case
Fry v. Napoleon Community Schools 137 S.Ct. 743 (U.S., 2017) 2017 WL 685533 (U.S., 2017)

The Individuals with Disabilities Education Act (IDEA) offers federal funds to States in exchange for “free appropriate public education” (FAPE) to children with certain disabilities. The Act also establishes formal administrative procedures for resolving disputes between parents and schools. When trained service dog, Wonder, attempted to join Plaintiff E.F. in kindergarten, officials at Ezra Eby Elementary School refused. Plaintiff E.F. is a child with severe cerebral palsy; Wonder assists her with various daily life activities. E.F.'s parents, Plaintiffs Stacy and Brent Fry, removed E.F. from the school and filed a complaint with the Department of Education's Office for Civil Rights (OCR). The Plaintiffs claimed that the exclusion of E.F.'s service dog violated her rights under Title II of the Americans with Disabilities Act (ADA) and § 504 of the Rehabilitation Act. OCR agreed, and school officials invited E.F. to return to the school. Yet, the Plaintiffs filed suit in federal court against the Defendants, Ezra Eby's local and regional school districts, and the principal, (collectively, the school districts). In the federal suit, Plaintiffs alleged that the Defendants violated Title II and § 504 and sought declaratory and monetary relief. The Defendant school districts filed a motion to dismiss. The United States District Court for the Eastern District of Michigan granted the motion. The Plaintiffs appealed to the United States Court of Appeals for the Sixth Circuit where the District Court's motion to dismiss was affirmed. Certiorari was granted. The Supreme Court of the United States vacated and remanded. The Supreme Court held that, on remand, the Appeals Court should: (1) establish whether (or to what extent) the plaintiff parents invoked the IDEA's dispute resolution process before bringing this suit; and (2) decide whether Plaintiffs' actions reveal that the gravamen of their complaint is indeed the denial of FAPE. The court reasoned that Exhaustion of the IDEA's administrative procedures is unnecessary where the gravamen of the Plaintiffs' suit is something other than the denial of the IDEA's core guarantee of a FAPE.

Giardiello v. Marcus, Errico, Emmer & Brooks, P.C. 261 F. Supp. 3d 86 (D. Mass. 2017) 2017 WL 3610478 (D. Mass. Aug. 18, 2017) This case dealt with a condo owner and his son who lived in a condo and relied on a service dog for treatment of PTSD. The Plaintiffs filed suit against the condo trust, Board of Trustees, Board members, and others, alleging violation of the Fair Housing Act (FHA) by not allowing the Plaintiffs to keep the dog in their condo unit. The father attempted to communicate with the Trustees about a reasonable accommodation for the service dog, but was met with silence from the Trustees. After the dog had already moved into the condo, the Board sent correspondence stating that fines would be assessed if the dog was not removed after a certain date. After complications with securing the requisite medical info, the dog was ultimately allowed to say, but fines had accrued. The Court held that 1) plaintiffs stated claim that defendants violated FHA; 2) owner was an aggrieved person under the FHA, and thus owner had standing to bring claim; 3) district court would decline to dismiss claim on exhaustion grounds; and 4) under Massachusetts law, claims against attorney and law firm were barred by the litigation privilege. Thus, the court the Court denied the Board and Trust's motion to dismiss and granted Attorney Gaines and the Law Firm's motion to dismiss. Case
Gill Terrace Ret. Apartments, Inc. v. Johnson 2017 VT 88, 177 A.3d 1087 (Vt. 2017) 2017 VT 88 (Vt. Oct. 6, 2017), 2017 WL 4453007 (Vt. Oct. 6, 2017) This is an appeal of a trial court's ruling in favor of a landlord finding that the tenant violated two material terms of her residential rental agreement. One of the material violations involved the keeping of a pet in violation of a no-pets policy. The facts show that the dog, "Dutchess," initially came to the tenant's apartment in 2009 with the tenant's son. While the dog never attacked another person or pet, it did display aggressive behavior, including lunging, baring her teeth, and rearing up on her hind legs. Other tenants expressed fear of Dutchess. After the son moved out in 2013, the dog stayed, and, in 2014, the landlord sent tenant a letter indicating the keeping of the dog was a violation of the lease. Two months after that notice, an informal meeting was held and tenant then claimed the dog as a reasonable accommodation for her disability. The landlord's attorney sent paperwork to effectuate this request, which the tenant said she never received. Months later, the landlord served the tenant with an eviction action to which tenant responded with a request to keep her dog as a reasonable accommodation. The request to keep a pet as a reasonable accommodation was granted shortly thereafter by landlord; however, the landlord did not approve of Dutchess as the specific animal due to concerns of behavior and hostility toward other residents. At an eviction hearing in June of 2016, the landlord's request to terminate the tenant's lease was granted by the court, which concluded that the reasonable accommodation for an assistance animal did not extend to Dutchess. On appeal, the Vermont Supreme Court noted that a request for an assistance animal as a reasonable accommodation may be denied if "the specific assistance animal in question poses a direct threat to the health or safety of others." While there was no dispute in this case that the tenant has a disability-related need for an ESA, there was credible evidence that supported the lower court's decision that Dutchess posed a threat and/or would cause substantial physical damage to the property. This included testimony from other tenants and tenant's own statements that she might not be able to control Dutchess. The court stated: "[l]ike the trial court, we acknowledge tenant's attachment to Dutchess and her need for an emotional support animal, but the court properly weighed the evidence regarding Dutchess's aggressive behavior against landlord's concerns for the safety and wellbeing of the other residents." The court concluded that the lower court did not err in affirming landlord's denial of tenant's reasonable accommodation request. Case
Green v. Housing Authority of Clackamas County 994 F.Supp. 1253 (D. Oregon, 1998) Plaintiffs were tenants of a county housing authority and alleged that the housing authority violated the Americans with Disabilities Act, the Federal Fair Housing Amendments Act, and Section 504 of the Rehabilitation Act, by failing to reasonably accommodate their request for a waiver of a "no pets" policy to allow for a hearing assistance animal in the rental unit to reasonably accommodate a hearing disability. The housing authority argued that the dog was not a reasonable accommodation for the tenant's specific disability because the dog was not certified as a hearing assistance animal. The court granted plaintiff's motion for summary judgment, holding that the housing authority violated the federal statutes when it required proof from the tenants that the dog had received hearing assistance training. Guenther v. Walnut Grove Hillside Condominium Regime No. 3, Inc. 961 N.W.2d 825 (Neb., 2021) 309 Neb. 655 (Neb., 2021) Plaintiff Christine Guenther appeals her dismissal of her complaint for declaratory judgment against her condominium complex. Guenther contended that Walnut Grove refused to make a reasonable accommodation under the federal Fair Housing Act and the Nebraska Fair Housing Act (collectively FHA), by denying her request to secure her daughter's emotional support dogs through construction of a fence in a common area. In 2018, Guenther made a request to Walnut Grove to construct a fence through part of the common area behind her condominium so that her dogs can safely spend time outside. Guenther stated that she made this request because she witnessed (via sounds) her first emotional support animal killed by either another dog or a car shortly after she moved in. However, Walnut Grove denied Guenther's request, contending that it lacked the authority to divide or partition the "common elements" of the property. As a result, Guenther filed a complaint in the district court for Douglas County seeking a declaration that Walnut Grove refused a reasonable accommodation under the FHA. A trial was held and the lower court dismissed Guenther's complaint, holding that Guenther's daughter did not suffer from a physical or mental impairment which substantially limits one or more of her major life activities and that therefore, Guenther failed to show that N.G. is a handicapped person. Additionally, the court held that Guenther failed to prove that her requested accommodation is necessary to afford the daughter an equal opportunity to use and enjoy the home. On appeal to the Nebraska Supreme Court, the court found the case boiled down to whether Guenther "carried her burden of proving her request to build a fence in Walnut Grove's common area (1) is reasonable and (2) necessary (3) to afford a handicapped person the equal opportunity to use and enjoy a dwelling." As to the factors, the court found that while it is undisputed that the daughter suffered from mental health disorders that were benefited by the interaction with the family dogs, there was insufficient proof that a fence was necessary. In fact, testimony revealed that the daughter freely enjoyed the use of the animals while at Walnut Grove. The fence was not a necessary part of Guenther's ability to use and enjoy the dwelling. Further, Guenther failed to prove that the alternatives proposed by Walnut Grove would not have been effective. Because Guenther failed to meet her burden to prove that construction of the fence is necessary, her claim for refusal of a reasonable accommodation under the FHA failed the judgment was affirmed. Hoffmann v. Marion County, Tex. 592 F. App'x 256 (5th Cir. 2014) 2014 WL 6306580 Plaintiffs operated a derelict-animal “sanctuary” on their ten-acre property in Marion County, Texas, where they held over one hundred exotic animals, including six tigers, several leopards, and a puma. Plaintiffs were arrested and charged with animal cruelty and forfeited the animals. Afterward, plaintiffs sued many of those involved in the events under a cornucopia of legal theories, all of which the district court eventually rejected. On appeal, plaintiffs argued Marion County and the individual defendants violated their Fourth Amendment rights by illegally searching their property and seizing the animals. The court held, however, that government officials may enter the open fields without a warrant, as the defendants did here, because “an open field is neither a house nor an effect, and, therefore, the government's intrusion upon the open fields is not one of those unreasonable searches proscribed by the text of the Fourth Amendment.” One plaintiff further alleged violation of the Americans with Disabilities Act; however, the court dismissed this claim because the plaintiff failed to allege how he was excluded from a government benefit or effective service as a result of not having an interpreter during the investigation or arrest. The other claims were either dismissed for lack of jurisdiction, not being properly appealed, or not stating a proper cause of action. The district court’s grant of summary judgment was therefore affirmed. Case
Hollendale Apartments & Health Club, LLC v. Bonesteel --- N.Y.S.3d ---- , 2019 WL 2031263 (N.Y. App. Div., 2019) 2019 N.Y. Slip Op. 03718 The Plaintiff owns and operates an apartment complex with a policy that prohibits defendants from keeping a dog on the premises. The Defendant, Bonesteel, began renting an apartment at Plaintiff's complex in 2011 under a one-year lease. Defendant continued to renew his one-year lease for additional one-year terms until 2014. Defendant's therapist sent a letter to the Plaintiff requesting an exception to the no dog policy so that the Defendant could have an emotional support animal. The Plaintiff denied the request but stated that it would allow a bird or cat or an early termination of Defendant's lease. The Plaintiff filed an action seeking a judgment declaring that the Plaintiff's refusal to permit the Defendant to have an emotional support dog was not in violation of the Fair Housing Act (FHA) and the Human Rights Law (HRL). The Plaintiff subsequently reduced the Defendant's lease renewal term to three months. The Defendant filed counterclaims on grounds of discrimination. The Supreme Court of New York also granted a motion allowing the Attorney General to intervene. The Attorney General asserted counterclaims on similar grounds to those raised by the Defendant. After a nonjury trial, the trial court issued a judgment that the Plaintiff's actions did not violate the FHA and the HRL. The Defendant then appealed. On appeal, the Supreme Court addressed the question of whether the Plaintiff's claims were justiciable even though the matter was not raised by the parties. Since the Plaintiff had already denied the Defendant's request for an exception to the policy when it filed the action and no harm to the Plaintiff occurred or was impending, it was essentially asking the Court to issue an advisory opinion which is not an exercise of judicial function. Therefore, the Court dismissed the Plaintiff's declaratory judgment. The Court then considered the Defendant's counterclaims since concrete injuries were alleged. The only two arguments addressed were whether the Defendant actually had a qualifying disability within the meaning of the FHA and the HRL and whether the accommodation requested was necessary to afford the Defendant an equal opportunity to use and enjoy his dwelling. The Court concluded that the Defendant met his burden to establish that he is disabled within the meaning of the FHA and HRL. The Court also found that the Defendant "offered sufficient evidence that having an emotional support dog would affirmatively enhance his quality of life by ameliorating the effects of his disability, and thus demonstrated necessity within the meaning of the FHA and the HRL." Lastly, the Court found that the Plaintiff retaliated against the Defendant by reducing his lease renewal terms to three months. Accordingly, Defendant was entitled to judgment in his favor on the retaliation counterclaims. Case
