Madero v. Luffey 439 F. Supp. 3d 493 (W.D. Pa. 2020), clarified on denial of reconsideration, No. 2:19-CV-700, 2020 WL 9815453 (W.D. Pa. Mar. 13, 2020) Ronald Madero allegedly took care of abandoned cats in his neighborhood by giving them food, shelter, and occasional medical care. Madero lived in a duplex in which his son owned both halves of the building. A neighbor contacted Animal Care and Control (ACC) and complained about abandoned kittens in front of her residence. On or about June 15, 2017, Officer Christine Luffey of the Pittsburgh Police Department arrived at Madero’s residence with a non-officer volunteer, Mary Kay Gentert. Officer Luffey requested to inspect the inside of both sides of the duplex. Madero refused and Luffey claimed she had a search warrant. Madero believed that Gentert was present to assist with spay and neuter services for the cats and consented to allow Gentert to inspect the premises while Luffey waited outside. Gentert took photographs inside. Some time afterwards, Luffey executed a search warrant. Madero asserted that the information gathered and photographs taken by Gentert were used to obtain the search warrant. A total of forty-two cats were seized. Madero asserts that after the cats were seized the cats were left for hours on the hot concrete in direct sunlight with no water and that snare catch poles were used to strangle the cats and force them into carriers or traps. Madero further asserted that the cats were not provided with veterinary care for several weeks and were kept in small cages in a windowless room. Some of the cats were ultimately euthanized. On August 7, 2017, Officer Luffey filed a criminal complaint against Madero accusing him of five counts of misdemeanor cruelty to animals and thirty-seven summary counts of cruelty to animals. Madero pled nolo contendere to twenty counts of disorderly conduct and was sentenced to ninety days of probation for each count with all twenty sentences to run consecutively. Madero filed a complaint asserting various causes of action under 42 U.S.C. 1983 and state law alleging illegal search and wrongful seizure of the cats against Officer Luffey, Homeless Cat Management Team (“HCMT”), Provident, and Humane Animal Rescue (“HAR”). The defendants each filed Motions to Dismiss. Madero pled that the cats were abandoned or stray cats, however, he also pled that the cats were his property and evidenced this by pleading that he fed the cats and provided shelter as well as veterinary care. The Court found that Madero pled sufficient facts to support ownership of the cats to afford him the standing to maintain his claims under section 1983 and common law. The Court held that Madero pled a plausible claim against Luffey on all counts of his complaint. Madero alleged that Officer Luffey violated his Fourth Amendment rights by lying about having a search warrant and securing consent by threatening to bust his door down. As for Madero’s state law claims, the court dismissed his negligent misrepresentation claim against Luffey as well as his claims for concerted tortious conduct. Madero failed to plead a threshold color of state law claim against the HAR defendants. There can be no violation of constitutional rights without state action. Madero’s claims for conversion and trespass to chattel against the HAR defendants were also dismissed. All claims against Provident were dismissed, however, Madero’s claim against HCMT for conspiracy was able to proceed. The Court ultimately denied in part and granted in part Officer Luffey’s Motion to Dismiss, Granted HAR’s Motion to Dismiss, and denied in part and granted in part HCMT’s and Provident’s Motion to Dismiss.
Turtle Island Restoration Project v. U.S. Department of Commerce 438 F.3d 937 (9th Cir. 2006)

Environmental Groups sued the National Fisheries Service (NMFS) and the United States Department of Commerce for making regulations which allowed swordfish longline fishing along the Hawaii coast, alleging violations of the National Environmental Policy Act (NEPA), the Migratory Bird Treaty Act (MBTA), and the Endangered Species Act (ESA). The Court found that because the regulations were made under the Magnuson-Stevens Fishery Conservation and Management Act of 1976 (Magnuson Act), and because that Act had a 30-day time limit for when challenges to regulations could be made, the environmental groups has not brought their challenge to the regulations in time.

Just Puppies, Inc. v. Frosh 438 F. Supp. 3d 448 (D. Md. 2020), vacated and remanded, No. 20-1631, 2021 WL 4452349 (4th Cir. Apr. 29, 2021) The State of Maryland passed a “No More Puppy-Mill Pups Act” which went into effect January 1, 2020. The Act prohibits retail pet stores in Maryland from offering for sale or otherwise transferring or disposing of cats or dogs. Four pet stores, a dog breeder, and a dog broker filed suit against Brian Frosh, the Attorney General of Maryland, the Consumer Protection Division of the Office of the Maryland Attorney General (CPD), the Maryland House Economic Matters Committee, and the Maryland State Senate Finance Committee seeking an injunction prohibiting enforcement of the Act as well as a declaration that it is unconstitutional under the Commerce Clause and the Equal Protection Clause of the United States Constitution. The Defendants were all entitled to sovereign immunity under the Eleventh Amendment, unless an exception were to apply. Under the Ex parte Young exception “private citizens may sue state officials in their official capacities in federal court to obtain prospective relief from ongoing violations of federal law.” The CPD and Committee Defendants were not State officials and, therefore, they did not fall within the Ex parte Young exception. The Ex parte Young exception, however, applied to Mr. Frosh as he was the Attorney General of Maryland since he had some connection with the enforcement of the Act. In Counts I, II, and III, the Plaintiffs alleged that the Puppy-Mill Act violated the Constitution's Commerce Clause. The Court found that the Plaintiffs failed to plausibly allege that the Act discriminated against out-of-state breeders and brokers in its text, in its effect, or in its purpose. Count IV alleged that the Puppy-Mill Act was preempted by the AWA. The Court found that prohibiting Maryland pet stores from selling dogs or cats had no effect on the operation of the AWA. The Puppy-Mill Act's impact on pet stores did not clash with the AWA, because pet stores were explicitly exempt from the AWA. Count V alleged that the Puppy-Mill Act deprived Plaintiffs of their constitutional right to the equal protection of law, in violation of the Fourteenth Amendment to the Constitution. The Court found no merit in this argument. Count VI asserted that the Act created a monopoly prohibited by Article 41 of the Maryland Declaration of Rights. The Court found that the Puppy-Mill Act did not constitute an exclusive right to sell cats and dog in Maryland. Although the Act prohibited brick and mortar stores from participating in the sale of cats and dogs, consumers still had a plethora of choices when seeking to obtain a pet, including rescue shelters, animal control units, USDA licensed breeders and brokers, and unregulated hobby breeders. The Court ultimately dismissed all claims against the CPD and the Committee Defendants and allowed the claims against Brian Frosh to proceed.
Szabla v. City of Brooklyn Park, MN 437 F.3d 1289 (8th Cir. 2006)

After an 8th Circuit decision to affirm the district court's summary judgment against Szabla and to reverse the district court’s grant of summary judgment for the City of Brooklyn Park, the City of Brooklyn Park filed a petition requesting a hearing en blanc. The 8th Circuit granted the petition, but limited the en blanc hearing to the issues raised in the city’s petition.  In all other respects, however, the Szabla v. City of Brooklyn Park, Mn., 429 F.3d 1168 (8th Cir. 2005) panel opinion and judgment were reinstated. Szabla v. City of Brooklyn Park, Minnesota, 486 F.3d 385 (8th Cir. 2007).

Monell v. Department of Social Services 436 US 658 (1978)

Female employees of the Department of Social Services and the Board of Education of the City of New York brought an action challenging the policies of those bodies in requiring pregnant employees to take unpaid leaves of absence before those leaves were required for medical reasons.  The decision of this case addresses issues of immunity.

U.S. v. Winddancer 435 F.Supp.2d 687 (M.D.Tenn., 2006)

This matter comes before the court on a Motion to Dismiss the Indictment filed by the defendant. The defendant, Ed Winddancer, was indicted on six counts relating to possessing and bartering eagle feathers and feathers plucked from other migratory birds. Winddancer did not have standing to challenge the manner in which the MBTA has been administered against him, because applying for a permit under the MBTA would not have been clearly futile. With regard to the BGEPA, the court found that defendant showed that the BGEPA substantially burdens his ability to possess eagle feathers. However, the court found that he did not show that his desire to possess the feathers arises from a sincere religious belief. Further, the court found that the government indeed has a compelling interest in protecting the bald and golden eagle, especially since there is no reasonable forensic method by which law enforcement can determine if a bird was accidentally or intentionally killed, killed a hundred years ago, or killed yesterday.

Turner v. Ferguson 432 F. Supp. 3d 876 (E.D. Wis. 2020) On March 5, 2017 Lori turner was attacked by her neighbor’s (“Arndt”) dog which required her to receive 11 staples to close the wound on her scalp. She also suffered bites on her shoulder and wrist that would later require surgery. Pursuant to local regulations, the neighbor’s dog was quarantined for a ten-day period. Lori mentioned to officers that the City of Gelndale had recently enacted an ordinance that allowed for an officer to declare a dog vicious which then required the owner of the dog to adhere to certain requirements like securing the dog in a kennel when it was outdoors and maintaining liability insurance for dog bites. On March 14, 2017, Officer Ruppel issued a citation to Ardnt under a Glendale ordinance for damage caused by dogs, however, he did not declare the dog vicious under the vicious-dog ordinance. Officer Ruppel reasoned during deposition that he chose not to do so because he considered Ardnt grabbing the dog by the neck and Lori walking up and petting the dog (prior to Ardnt’s action) provocation. Lori filed suit against the officers she interacted with over the course of the next year claiming that the officers denied her equal protection of the law by refusing to declare Arndt’s dog vicious and by failing to protect her from loose dogs in the neighborhood. Lori had repeatedly contacted the police department over the course of a year about how she did not like the outcome of her dog bite case and about loose dogs in the neighborhood. Lori specifically alleged that the officers treated her with animus. The Court ultimately found that the evidence in the record did not support a class-of-one equal protection claim. Officer Ruppel’s decision to not declare Ardnt’s dog vicious was supported by a rational basis. Additionally, no evidence existed that suggested that the Glendale police department intentionally and irrationally treated Lori’s complaints about loose dogs in the neighborhood differently than it treated similar complaints by other citizens. The Defendant’s motion for summary judgment was granted.
United States v. Bowman 43 S.Ct. 39 (1922)

This case involves a conspiracy charge to defraud a corporation in which the United States was a stockholder.  The Fifth Circuit Court of Appeals in United States v. Mitchell referred to this Supreme Court case when it found that the nature of the MMPA does not compel its application to foreign territories.

IN RE: DONALD STUMBO, D/B/A STUMBO FARMS 43 Agric. Dec. 1079 (U.S.D.A.)

Imposition of $4,000 civil penalty was appropriate under 7 USCS § 2149(b) where respondent committed numerous, serious violations of Animal Welfare Act, respondent handled large number of animals, and violations continued after respondent was advised in writing of violations and given opportunity to correct them.

Szabla v. City of Brooklyn Park, Mn. 429 F.3d 1168 (8th Cir., 2005)

A homeless man was mistaken for the driver of a crashed car while sleeping in a public park and was bitten by a police dog.  The homeless man brought claims under Section 1983 claiming his Fourth Amendment rights had been violated.  The trial court granted summary judgment in favor of the police department and city, but the Court of Appeals remanded the issue of excessive force. Rehearing en Banc Granted in Part, Opinion Vacated in Part by Szabla v. City of Brooklyn Park, MN , 429 F.3d 1289 (8th Cir., 2006).

Fund for Animals, Inc. v. Hogan 428 F.3d 1059 (D.C. Cir. 2005)

The Fund for Animals petitioned the US Fish and Wildlife Service (FWS) to list as endangered the trumpeter swans living in Wyoming, Montana, and Idaho.  The Fish and Wildlife Service denied the petition without giving a good explanation why, so the Fund for Animals sued.  The court found that because the Fish and Wildlife Service had subsequently provided a letter finding that the swans were not "markedly separated from other populations" and were part of the Rocky Mountain population, which was growing in numbers, the FWS had provided a sufficient explanation and the case against it was therefore moot. 

Reichley v. Pennsylvania Dept. of Agriculture 427 F.3d 236 (Pa. 2005)

Poultry Producers brought claims against the Pennsylvania Department of Agriculture for deprivation of their property without adequate due process in response to an outbreak of avian influenza. The United States District Court for the Middle District of Pennsylvania, granted defendants' motion for summary judgment and the Court of Appeals affirmed, reasoning there was no due process deprivation by failing to issue notice and an opportunity for a hearing before the quarantine and depopulation of the producers' flocks.

Reichley v. Pennsylvania Dept. of Agriculture 427 F.3d 236 (3rd Cir. 2005)

Kleppe v. New Mexico 426 U.S. 529 (1976)

The state of New Mexico challenged the constitutionality of the Wild Free-Roaming Horses and Burros Act after they were ordered by the U.S. government to recover several wild horses they had rounded up from public lands within their state and sold at auction in violation of the WFRHBA.  The Supreme Court upheld the Act, finding it to be a valid exercise of federal power under the Article IV Property Clause of, which gave Congress the power to protect wildlife on state lands, state law notwithstanding. 

PETA v. Tri-State Zoological Park 424 F. Supp. 3d 404 (D. Md. 2019), aff'd, 843 F. App'x 493 (4th Cir. 2021) PETA brought this action against defendants Tri-State Zoological Park of Western Maryland, Inc., Animal Park, Care & Rescue, Inc., and Robert Candy (collectively, “Tri-State”). Prior to this lawsuit, Tri-State was home to two lemurs, five tigers, and two lions which are all protected under the Endangered Species Act (“ESA”). More than half of the protected species housed at Tri-State died. PETA alleged violations of the ESA. PETA contended that the animals were subjected to harm and harassment and that Tri-State committed a “take” as defined by the ESA as a result of unsanitary living conditions, poor diets, and inadequate shelter and enrichment. The district court found that PETA had standing to bring suit. The court also found that each of the respective animals had been subjected to a take under the ESA. The court ultimately held that it would enter a separate order declaring that the Defendants violated the ESA by unlawfully taking the remaining big cats and maintaining possession of them. The Court permanently enjoined the Defendants from ever owning or possessing any endangered or threatened species and terminated the Defendants’ ownership and possessory rights to the animals. The Defendants’ motion to stay was denied.
Defenders of Wildlife v. U.S. Environmental Protection Agency 420 F.3d 946 (9th Cir. 2005)

 

Several public interest groups brought actions challenging Environmental Protection Agency's (EPA) decision to transfer Clean Water Act (CWA) pollution permitting program for Arizona to that State.  Under federal law, a state may take over the Clean Water Act pollution permitting program in its state from the federal Environmental Protection Agency (EPA) if it applies to do so and meets the applicable standards.  When deciding whether to transfer permitting authority, the Fish and Wildlife Service issued, and the EPA relied on, a Biological Opinion premised on the proposition that the EPA lacked the authority to take into account the impact of that decision on endangered species and their habitat.  The plaintiffs in this case challenge the EPA's transfer decision, particularly its reliance on the Biological Opinion's proposition regarding the EPA's limited authority.  The court held that the EPA did have the authority to consider jeopardy to listed species in making the transfer decision, and erred in determining otherwise. For that reason among others, the EPA's decision was arbitrary and capricious. Accordingly, the court granted the petition and remanded to the EPA.

U.S. v. Kapp 419 F.3d 666 (2005, 7th Cir.(Ill.))

A jury convicted William Kapp for multiple violations of the Endangered Species Act and the Lacey Act connected with the killing of, and trafficking in, endangered tigers and leopards and their meat, hides, and other parts. On appeal, Kapp claims he is entitled to a new trial because the evidence at trial was insufficient to support the jury's verdict and the district court erroneously admitted certain evidence. Kapp also argues that the manner in which he was sentenced violated the Sixth Amendment. The court concluded that there was sufficient evidence to support the jury's verdict on all counts, and the district court did not err in its evidentiary ruling.  His conviction was, therefore, affirmed, but a limited remand was ordered to determine whether Kapp should be resentenced .

Stanko v. Maher 419 F.3d 1107 (10th Cir. 2005) A livestock owner and drover sued the Wyoming state brand inspector, alleging that inspector violated his state and federal constitutional rights in making warrantless seizure of five head of livestock, and that inspector abused his office in violation of state constitution. Plaintiff Rudy Stanko, proceeding pro se, appealed from the district court's order granting summary judgment to defendant Jim Maher.  The appellate court affirmed the entry of summary judgment in favor of Mr. Maher, holding that the warrantless search of cattle did not violate Fourth Amendment and the inspector did not violate the Fourth Amendment by making warrantless seizure of cattle as estrays.  Further, the procedure provided under Wyoming brand inspection statutes prior to seizure of cattle deemed to be estrays satisfied due process requirements.
Ranchers Cattleman Action Legal Fund United Stockgrowers of America v. U.S. Dept. of Agriculture 415 F.3d 1078 (9th Cir. 2005)

The court was presented with the question of whether the district court erred in issuing a preliminary injunction prohibiting the implementation of a regulation of the United States Department of Agriculture ("USDA") permitting the resumption of the importation of Canadian cattle into the United States.  The court concluded that it did and therefore reversed the district court. 

Committee for Humane Legislation v. Richardson 414 F. Supp. 297 (1976)

At issue in this case are the statutory limitations on the authority of the Secretary of Commerce to adopt regulations, pursuant to the MMPA, that provide for the issuance of permits for the "taking" of dolphins incidental to commercial fishing activities.

United States v. 144,774 Pounds Of Blue King Crab 410 F.3d 1131 (9th Cir. Wash., 2005)

An importer of 144,774 pounds of cooked, frozen blue king crab was charged with violating the Lacey Act for taking the crab in violation of Russian fishing regulations.  The crab is subject to forfeiture under the Lacey Act on a strict liability basis, but the importer asserted an "innocent owner" defense.  The trial court denied the owner's defense and the Court of Appeals affirmed, reasoning if the crab was illegally taken under Russian law then it is considered contraband for Lacey Act purposes regardless of its status under U.S. law.

New Mexico State Game Commission v. Udall 410 F.2d 1197 (C.A.N.M. 1969)

The State of New Mexico filed an suit to prevent the U.S. Secretary of the Interior from killing deer in the Carlsbad Caverns National Park that were overbrowsing vegetation and posing a threat to the park's ecology without first having obtained the necessary state permit.  The Court held that the Secretary has the authority to kill the deer to protect the park property, and it is immaterial that the United States does not have exclusive jurisdiction over the lands within Carlsbad Caverns National Park as it has constitutional authority in the form of supervisory powers to manage national parks.  To New Mexico and the other states involved in an amicus capacity in the suit, the real concern was over the federal encroachment into state management of fish and game, particularly in those states where much of the land is under federal control.

Natural Resources Defense Council, Inc. v. National Marine Fisheries Service 409 F.Supp.2d 379 (S.D.N.Y.2006)

The Natural Resources Defense Council sought material from the National Marine Fisheries Service about an incident of mass stranding of whales under the Freedom of Information Act because the Council thought it had to do with navy sonar use. The Service did not want to release the materials, saying they were protected from disclosure because they were discussions of agency decision-making. The court required disclosure of most of the materials because purely factual matters are not protected from disclosure.

Nichols v. Lowe's Home Center, Inc. 407 F.Supp.2d 979 (S.D.Ill.,2006)

A customer brought an action against Lowe's home improvement store to recover for injury sustained when a "wild bird" flew into the back of her head while she was shopping in the gardening area.  The plaintiff argued that the defendant did not exercise reasonable care in making the premises safe and that the defendant did not warn customers that the birds were a dangerous condition on the premises.  In granting the owner's motion for summary judgment, the court held that the store owner did not owe customer a duty under Illinois law to protect her from wild bird attack since attack was not reasonably foreseeable.  Further, the store owner was not the "owner" or "keeper" of a "wild bird" within meaning of Illinois Animal Control Act.

Wall v. City of Brookfield 406 F.3d 458 (7th Cir. 2005)

A dog that was constantly in violation of local leash ordinances was held as a stray by the town.  The owner of the dog brought a section 1983 action claiming deprivation of the dog's companionship without due process and the trial court held in favor of the town.  The Court of Appeals affirmed reasoning that only a post-deprivation hearing was necessary under the statute (which defendant could have received had she filed a petition with the court).

Sierra Club v. Morton 405 U.S. 727 (U.S.Cal. 1972)

The Petitioner, the Sierra Club, brought this action for a declaratory judgment and an injunction to restrain federal officials from approving an extensive skiing development in the Mineral King Valley in the Sequoia National Forest. The Sierra Club did not allege that the challenged development would affect the club or its members in their activities, but rather argued that the project would adversely change the area's aesthetics and ecology. The District Court granted a preliminary injunction. The Court of Appeals reversed, holding that the club lacked standing and had not shown irreparable injury. On grant of certiorari, the Supreme Court held that the Sierra Club, which asserted a only special interest in conservation of natural game refuges and forests, lacked standing under Administrative Procedure Act to maintain the action because it could not demonstrate that its members would be affected in any of their activities or pastimes by the proposed project.

Scott v. Jackson County 403 F.Supp.2d 999 (D.Or.,2005)

On July 22, 2003, plaintiff filed suit alleging violations of her constitutional rights under 42 U.S.C. § 1983, various state common law claims, and violation of the Oregon Property Protection Act (plaintiff's neighbor complained to animal control in May 2001 after hearing the rabbits "screaming and dying"). Plaintiff's claims arise from the seizure of over 400 rabbits from her property, and the subsequent adoption and/or euthanasia of these rabbits. Defendants move for summary judgment on grounds of qualified immunity, failure to allege the proper defendant, and failure to provide notice under the Oregon Tort Claims Act. In granting defendants' motion for summary judgment, the Court found that even if the officers' entry and seizure of plaintiff's property was unlawful, they reasonably believed their actions to be lawful, therefore affording them qualified immunity protection. Further, the court found no taking occurred where the rabbits were euthanized and/or adopted out as part of a initial criminal forfeiture action.

Slavin v. US 403 F.3d 522 (8th Cir. 2005)

Plaintiff challenged the constitutionality of the Animal Welfare Act after it created a regulation that prohibited the interstate or foreign commerce transport of birds that would be used in fighting ventures.   She argued that the regulators did not consider whether fighting ventures were legal in the state where the birds were being transported to.   However, the regulation was considered constitutional since under terms of section 2156(b), only the foreign and interstate transport of the birds was prohibited.  

McClendon v. Story County Sheriff's Office 403 F.3d 510 (8th Cir. 2005)

A farmer was neglecting her horses and the entire herd confiscated by animal control officers.  The farmer brought a section 1983 claim against the animal control officers for acting outside of the scope of their warrant by removing more than just the sick horses.  The Court of Appeals affirmed the trial court in part, holding the animal control officers were entitled to qualified immunity and seizure of all the horses was not unreasonable or outside the scope of the warrant. 

San Jose Charter of Hells Angels Motorcycle Club v. City of San Jose 402 F.3d 962 (C.A.9 (Cal.),2005)

In this civil rights action under 42 U.S.C. § 1983, Defendants-Appellants, seven San Jose City Police Officers and Deputy Sheriff Linderman, appeal from an order of the district court denying in part their motions for qualified immunity. This action arises out of the simultaneous execution of search warrants at the residences of members of the Hells Angels, and at the Hells Angels clubhouse on January 21, 1998. While executing search warrants at two plaintiffs' residences, the officers shot a total of three dogs. This court held that the shooting of the dogs at the Vieira and Souza residences was an unreasonable seizure, and an unreasonable execution of the search warrants, in violation of the Fourth Amendment. Exigent circumstances did not exist at either residence, as the officers had a week to consider the options and tactics available for an encounter with the dogs. The unlawfulness of the officers' conduct would have been apparent to a reasonable officer at the time the officers planned for serving the search warrants.

Ocean Advocates v. United States Army Corps of Engineers 402 F.3d 846 (9th Cir., 2005)

An environmental group brought an action against the U.S. Army Corps Engineers and BP for violating both the National Environmental Policy Act and the Marine Mammal Protection Act.  Defendants counter-claimed that the environmental group lacked standing  and that the claim was barred by laches.  The Court of Appeals affirmed the denial of defendants' motion for summary judgment, reversed summary judgment against the environmental group, and remanded the case for consideration of the environmental group's request for injunctive relief.  

Missouri v. Holland 40 S.Ct. 382 (1920)

This was a bill in equity brought by the State of Missouri to prevent a game warden of the United States from attempting to enforce the Migratory Bird Treaty Act of July 3, 1918, c. 128, 40 Stat. 755, and the regulations made by the Secretary of Agriculture in pursuance of the same. The ground of the bill is that the statute is an unconstitutional interference with the rights reserved to the States by the Tenth Amendment.  While the court recognized the states' province to act in traditional matters of fish and game, the migratory nature of wild birds makes them the proper subject of treaty.  As noted by the Court, "[t]he subject matter is only transitorily within the State and has no permanent habitat therein."  The Court found the treaty was a proper exercise of constitutional authority where a national interest was implicated (i.e., "the protectors of our forests and our crops") and could only be protected by national action in concert with another power.

Gaetjens v. City of Loves Park 4 F.4th 487 (7th Cir. 2021), reh'g denied (Aug. 12, 2021) Plaintiff Gaetjens filed a § 1983 action against city, county, and various local government officials alleging that her Fourth Amendment rights were violated after officials entered and condemned her home and seized her 37 cats. Plaintiff was in the hospital at the time. Gaetjens lived in Loves Park, Illinois and bred cats in her home. On December 4, 2014, she visited her doctor and was told to go to the hospital because of high blood pressure. Later that day, the doctor could not locate Gaetjens, so she phoned Rosalie Eads (Gaetjens' neighbor who was listed as her emergency contact) to ask for help finding her. Eads called Gaetjens and knocked on her front door but got no response. The next day the neighbor could still not locate Gaetjens so Eads phoned the police from concern that Gaetjens might be experiencing a medical emergency. When police arrived, they asked Eads for Gaetjens key and entered the house. Intense odors of feces, urine, and a possibly decomposing body forced police back out of the home. The police called the fire department so that the home could be entered with breathing devices. While police did not find Gaetjens, they did find 37 cats. The house was ultimately condemned and animal control were able to impound the cats (except for four that died during or after impoundment). As it turns out, Gaetjens was at the hospital during this whole process. After learning of the impoundment, Gaetjens filed the instant action. The district court granted summary judgment to defendants. On appeal here, the Seventh Circuit considered whether the warrantless entry into Gaetjens home was reasonable based on exigent circumstances. Relying on a recent SCOTUS case that found absence from regular church service or a repeated failure to answer a phone call supported an emergency exception for a warrant, the Court noted that the "litany of concerning circumstances" in the case at bar "more than provided" a reasonable basis for entry. As to Plaintiff's challenge to the condemnation, the court also found it too was supported by the expertise of officials at the scene. As to the confiscation of the cats, the court noted that previous cases support the warrantless seizure of animals when officials reasonably believe the animals to be in imminent danger. The court found the imminent danger to be plain due to condemnation order on the house from noxious fumes. While the use of the "cat grabber" did lead to an unfortunate death of one cat, the overall seizure tactics were necessary and reasonable. Thus, the Court affirmed the judgment of the district court.
Nebraska Beef, Ltd. v. United States Department of Agriculture 398 F.3d 1080 (8th Cir. 2005)

Eight Circuit Court of Appeals decided not to allow Nebraska Beef to pursue a Bivens remedy --remedy allows a party to recover damages when federal officials violate a person's constitutional rights when Congress has not provided an adequate remedy-- after the United States Department of Agriculture (USDA) allegedly breached a mutual consent decision agreed upon after the USDA issued Noncompliance Records for perceived regulatory violations.

Nat. Res. Def. Council, Inc. v. U.S. Dep't of the Interior 397 F. Supp. 3d 430 (S.D.N.Y. 2019) This case centers on the Trump Administration's new interpretation of incidental takings under the Migratory Bird Treaty Act (MBTA). In December 2017, the Principal Deputy Solicitor of the U.S. Department of the Interior (DOI) issued a memorandum that countered almost 50 years of the agency’s interpretation of “takings” and “killings” under the MBTA (the "Jorjani Opinion"). According to the DOI in that opinion, the MBTA does not prohibit incidental takes or kills because the statute applies only to activities specifically aimed at birds. Environmental interest groups and various states brought three now-consolidated actions to vacate the memorandum and subsequent guidance issued in reliance on the memorandum. Both parties moved for summary judgment. In essence, the question before the court is whether DOI’s interpretation of the MBTA must be set aside as contrary to law under the Administrative Procedure Act (APA) or upheld as a valid exercise of agency authority. The court first observed that, from the early 1970s until 2017, the DOI interpreted the MBTA to prohibit incidental takes and kills, imposing liability for activities and hazards that led to the deaths of protected birds, irrespective of whether the activities targeted birds or were intended to take or kill birds. To conserve migratory birds and ensure compliance with the MBTA’s prohibition on “incidental take,” the DOI's Fish & Wildlife Service (FWS) used a range of strategies: sending companies notice of the risks their facilities and equipment posed to migratory birds; issuing industry guidance; informally negotiating remediation efforts; and issuing permits authorizing takes. In fact, the court noted that the agency prioritized a cooperative approach with industry over enforcement actions. In 2015, the DOI formalized this approach by undergoing a rulemaking process regulating incidental take. In early 2017, the DOI's Solicitor then issued a memorandum that reaffirmed the long-standing interpretation that the MBTA prohibited incidental take that became known as the "Tomkins Opinion." Once presidential administrations changed and Tomkins departed, the new Principal Deputy Solicitor issued a new memorandum that stated any agency comments, recommendations, or actions not be based on the principle that the MBTA prohibited incidental take (the Jorjani Opinion). This triggered the instant lawsuits by conservation organizations and several states. On July 31, 2019, the lower court found that the plaintiffs sufficiently demonstrated standing and denied the DOI's motion to dismiss. On appeal here, this court first noted that both parties agree with longstanding precedent that the MBTA's misdemeanor provision creates strict liability. In contrast, the Jorjani Opinion contends that the criminal penalty provisions under the MBTA is limited to only acts directed at birds and those activities whose purpose is to "render an animal subject to human control" like hunting or capturing. In reviewing the Jorjani Opinion under the lessened deference standard afforded by administrative law, this court found the DOI overstated the any conflicts in interpretation of the MBTA among circuit courts (a "dramatized representation"). In addition, the court found the Jorjani Opinion "is a recent and sudden departure from long-held agency positions backed by over forty years of consistent enforcement practices." The court found the Jorjani Opinion was an unpersuasive interpretation of the MBTA's unambiguous prohibition on the killing of birds and is contrary to the plain language of the law itself. Such an interpretation runs contrary to legislative history, decades of enforcement practices by the DOI, and caselaw. Because the agency's action was held unlawful under the APA, the court found the only appropriate remedy was vacatur. Thus, Plaintiffs’ motions for summary judgment were granted, and Interior’s motion was denied.
Bogart v. Chapell 396 F.3d 548 (4th Cir., 2005)

A woman was housing hundreds of animals in her residential home, the animals were seized and more than two hundred of them were euthanized.  The woman brought a section 1983 claim against the county sheriff's department and human society.  The trial court granted defendants summary judgment and the Court of Appeals affirmed holding no viable due process claim existed arising from the euthanization. 

Padilla v. Stringer 395 F.Supp. 495 (1974) Plaintiff employee brought a suit of discrimination against the Albuquerque Rio Grande Zoo under 28 U.S.C.A. § 1343(4) and 42 U.S.C.A. §§ 1983, 2000e et seq.
Forest Guardians v. Veneman 392 F.Supp.2d 1082 (D.Ariz.,2005)

District Court held that United States Forest Service could issue permits that allow cattle on lands near waterways where spikedace and loach minnows live, both species are listed as "threatened" species, even though this grazing could delay their recovery.

Dehart v. Town of Austin 39 F.3d 718 (7th Cir. 1994)

The breeder was in the business of buying, breeding, raising, and selling of exotic and wild animals. The town passed an ordinance making it unlawful to keep certain wild animals, and the breeder filed suit challenging the constitutionality of a local ordinance.  On appeal, the court affirmed the grant of summary judgment in favor of the town because: (1) the ordinance was not preempted by the Animal Welfare Act; (2) the ordinance was not an impermissible attempt to regulate interstate commerce in violation of the Commerce Clause; and (3) the town did not deprive him of his property interest in his federal and state licenses without due process.

IN RE MARSHALL RESEARCH ANIMALS, INC. 39 Agric. Dec. 359 (1980)

In this order, the court held that Respondent shall cease and desist from transporting live animals in primary enclosures which are not sufficiently large to insure that each animal contained therein has sufficient space to turn about freely in a standing position using normal body movement, to stand and sit erect, and to lie in a natural position, which spatial requirements are contained in the regulations issued pursuant to the Act. (9 CFR 3.12(c)).

Kuba v. 1-A Agr. Ass'n 387 F.3d 850 (9th Cir., 2004)

Activist sued a state-created agricultural association under 42 USC § 1983 to challenge a rule that limited demonstrations to “free expression zones” outside a state-owned performance facility. The Court of Appeals held that the association was not entitled to Eleventh Amendment immunity. It held that the parking lots and walkways were public fora, and thus time, place and manner restrictions on speech had to be content-neutral and narrowly tailored to serve an important government interest. The Court held that the state did not have a significant interest in restricting protestors to these zones. The rule was not narrowly tailored enough to promote the association's interest in preventing traffic congestion, and restricted more speech than was necessary. Therefore, the rule unduly infringed free speech on its face.

National Wildlife Federation v. Norton 386 F.Supp.2d 553 (D. Vt. 2005)

Conservation groups brought action against Final Rule promulgated by the U.S. Fish and Wildlife Service to reclassify the gray wolf from endangered to threatened in most of the United States.  The Rule created Eastern and Western Distinct Population segment and simultaneously downlisted them from endangered to threatened under the Endangered Species Act [ESA].  The Final Rule deviated significantly from the Proposed Rule and thus failed to provide adequate notice and opportunity for comment to the public, and the court also found the Final Rule an arbitrary and capricious application of the ESA.

City of Sausalito v. O'Neill 386 F.3d 1186 (9th Cir. 2004)

A City sought to prevent the National Park Service from implementing a development plan in a nearby recreational area claiming the Park service had violated various environmental statutes.  The trial court held the City did not have standing to assert most of its claims and lost on the merits of the remaining claims.  The Court of Appeals held the City did have standing to assert all of its claims, but lost on the merits of all its claims except those under the Coastal Zone Management Act and the Marine Mammal Protection Act. 

Cetacean Community v. Bush 386 F.3d 1169 (9th Cir. 2004)

In this case, the court was asked to decide whether the world's cetaceans have standing to bring suit in their own name under the Endangered Species Act, the Marine Mammal Protection Act, the National Environmental Protection Act, and the Administrative Procedure Act.  The Cetaceans challenge the United States Navy's use of Surveillance Towed Array Sensor System Low Frequency Active Sonar ("SURTASS LFAS") during wartime or heightened threat conditions.  In finding that the Cetaceans lacked standing, the court here agreed with the district court in Citizens to End Animal Suffering & Exploitation, Inc., that "[i]f Congress and the President intended to take the extraordinary step of authorizing animals as well as people and legal entities to sue, they could, and should, have said so plainly." 836 F.Supp. at 49.  In the absence of any such statement in the ESA, the MMPA, or NEPA, or the APA, the court concluded that the Cetaceans do not have statutory standing to sue.

U.S. v. Hetzel 385 F.Supp. 1311 (D. Mo. 1974)

Defendant finds a decaying eagle carcass on a wildlife preserve.  He then removes the legs and talons of the eagle to bring to a Boy Scout function.  The court reverses his conviction (and $1.00 fine) finding that he did not possess the requisite intent.  The court determines that a conviction under the BGEPA demands a specific intent.  For further discussion on intent under the BGEPA see  Detailed Discussion of Eagle Act.

Natural Resources Defense Council v. Rodgers 381 F.Supp.2d 1212 (2005, E.D.Cal.)

An environmental organization brought an action against United States Bureau of Reclamation, the National Marine Fisheries Service, and the Fish and Wildlife Service, alleging that agencies failed to examine critical issues in biological opinions (BiOps) before executing water contracts for delivery of California Water Project water to irrigation and water districts. On a cross motion for summary judgment, the District Court held that the agencies failed to conduct adequate adverse modification analyses, failed to conduct adequate jeopardy analyses, and that the conduct of BOR in relying on the issued BiOps was arbitrary and capricious.

UFO Chuting of Hawaii, Inc. v. Young 380 F.Supp.2d 1166 (2005, D.Hawai'i)

Some parasail operators brought an action against state officials challenging validity of a state law that banned parasailing in navigable waters. Defendants argued that the court's order should be reconsidered in light of an intervening change in federal law that they say allows for the seasonal parasailing ban.  After vacation of summary judgment in favor of operators, 2005 WL 1910497, the state moved for relieve from final judgment.  The District Court held that the federal law permitting Hawaii to enforce state laws regulating recreational vessels for purpose of conserving and managing humpback whales did not violate separation of powers doctrine, and federal law did not violate Equal Protection Clause.

U.S. v. Tierney (Unpublished) 38 Fed. Appx. 424 (9th Cir. 2002) (unpub.)

The district court did not err by denying the defendant's proposed entrapment instruction and that Nev. Admin. Code 504.471 is not unconstitutionally vague. He did not present evidence to support his position on either element. Rather than indicating government inducement or lack of predisposition, the evidence showed that the government merely provided the defendant with an opportunity to sell what he was already ready and willing to sell. The court also found the meaning of "wildlife" under Nevada law was not unconstitutionally vague.

Florida Marine Contractors v. Williams 378 F.Supp.2d 1353 (M.D. Fla., 2005)

The Florida Marine Contractors Association applied for permits to build recreational docks on Florida's inland waterways.  The permit requests were denied due to danger to the West Indian Manatees that live in the waterways.  The Florida Marine Contractors Association challenged the U.S. Fish and Wildlife Service's permit denials on the basis that the Marine Mammal Protection Act does not apply to residential docks.  Summary judgment was granted in favor of the U.S. Fish and Wildlife Service. 

Gifford Pinchot Task Force v. U.S. 378 F.3d 1059 (9th Cir. 2004)

This is a record review case in which the Appellants, an assortment of environmental organizations, challenge six biological opinions (BiOps) issued by the United States Fish and Wildlife Service pursuant to the Endangered Species Act (ESA).  The BiOps in question allowed for timber harvests in specified Northwest forests and also authorized incidental "takes" of the Northern spotted owl, a threatened species under the ESA.  With regard to appellants' challenge of the jeopardy analysis under the ESA, the court concluded that the jeopardy analysis conducted by the FWS in the six BiOps at issue in this case was permissible and within the agency's discretion.  However, the critical habitat analysis in the six BiOps was fatally flawed because it relied on an unlawful regulatory definition of "adverse modification."  The Court reversed the judgment of the district court and remanded the case to the district court to grant summary judgment to the Petitioners on the critical habitat inquiry.
