Rule v. Fort Dodge Animal Health, Inc. 604 F.Supp.2d 288 (D.Mass.,2009)

The plaintiff brought this action against Defendants Fort Dodge Animal Health, Inc. and Wyeth Corporation, seeking economic damages suffered from the purchase and injection of her dog with ProHeart® 6 to prevent heartworm. The complaint alleged products liability/failure to warn, breach of implied warranty of merchantability, and violation of state deceptive business practices, among others. In 2004, defendants recalled ProHeart® 6 in response to a request by FDA due to reported adverse reactions. This Court found that Massachusetts law follows the traditional “economic loss rule,” where such losses are not recoverable in in tort and strict liability actions where there has been no personal injury or property damage. Here, the plaintiff was barred from recovering because she has not alleged any personal injury or property damage under her products liability claim. Further, plaintiff failed to show that defendants' deceptive act caused some injury and compsensable loss. Defendants' motion to dismiss was granted.

Arizona Cattle Growers' Association v. Salazar 606 F.3d 1160, (C.A.9 (Ariz.),2010)

Arizona Cattle Growers’ Association (Plaintiff) challenged Fish and Wildlife Service's (Defendant) designation of critical habitat for Mexican spotted owls under the Endangered Species Act. The issues were whether Defendant impermissibly included unoccupied areas as critical habitat, and whether Defendant impermissibly employed the baseline approach in its economic analysis. The Court held that 1) Defendant did not designate unoccupied areas as critical habitat because “occupied” areas included areas where the species was likely to be present, and 2) that Defendant properly applied the baseline approach because the economic impact of listing a species as endangered was not intended to be included in the economic analysis of the critical habitat designation.

Pruett v. Arizona 606 F.Supp.2d 1065 (D.Ariz.,2009)

A diabetic woman in Arizona attempted to keep a chimpanzee as an assistance animal in spite of the state’s ape ban. Despite the state’s ban, the diabetic woman imported a chimpanzee with the intention of keeping him as a service animal, claiming that she was entitled to do so under the Federal Americans with Disabilities Act of 1990 (ADA). In September of 2007, the chimpanzee’s owner sued the State of Arizona, the Game and Fish Commission, and the Director of the Game and Fish Department in federal court claiming that they had violated her rights under the federal disability laws. According to the plaintiff, the ADA requires the state to make “reasonable accommodations” for disabled individuals; and in her case this meant the state must waive its ban on possessing “restricted” apes so that she can keep a chimpanzee in her home as a service animal. The District Court found that the plaintiff’s chimpanzee is “unnecessary” and “inadequate” to meet her disability-related needs and the animal is not a “reasonable” accommodation under the ADA because he threatens the health and safety of the community.

Center for Biological Diversity v. Kempthorne 607 F.Supp.2d 1078 (D.Ariz.,2009)

Cross motions for summary judgment on Plaintiffs’ claim against Defendants, the Secretary of the Interior and the U.S. Fish and Wildlife Service, alleging that the Secretary’s failure to designate critical habitat and prepare a recovery plan for the jaguar was unlawful under the ESA.   The United States District Court, D. Arizona granted Plaintiffs’ motion in part and denied Plaintiffs’ motion in part, finding that Defendants’ determination that designation of a critical habitat would not be prudent must be set aside because it did not appear to be based on the best scientific evidence available as required by the ESA, and that Defendants’ determination not to prepare a recovery plan must also be set aside and remanded for further consideration because the determination was inconsistent with Defendants’ own policy guidance and long-standing practice concerning the distinction between foreign and domestic species.

Defenders of Wildlife v. Tuggle 607 F.Supp.2d 1095 (D.Ariz.,2009)

In this case, the Plaintiffs, WildEarth Guardians and the Rewilding Institute (Guardians) and the Defenders of Wildlife (Defenders) challenged procedures for wolf control actions as part of the Mexican wolf reintroduction project within the Blue Range Recovery Area (BRWRA) by the United States Fish and Wildlife Service (USFWS). Plaintiffs claims centered on NEPA and ESA violations based on USFWS' adoption of a Memorandum of Understanding in 2003(MOU) and issuance of Standard Operating Procedure 13 (SOP). USFWS filed motions to dismiss these claims for lack of jurisdiction because they argued that neither the MOU nor SOP 13 was a final agency action. Here, the rights and responsibilities of the interested parties were spelled out in the 2003 MOU and SOP 13, similar to if USFWS had issued an interpretive rule covering wolf control measures. Thus, the Court found that the 2003 MOU and SOP 13 "mark the consummation of the agency's decisionmaking process in respect to wolf control measures." The Court also found that the plaintiffs presented duplicate claims under the ESA and APA. USFWS's motion to dismiss was also denied as were the duplicative claims.

American Horse Protection Assoc. v. Andrus 608 F.2d 811 (9th Cir. 1979)

The court stated that the Secretary’s decision to remove 3,500 to 7,000 wild horses in order to maintain the horse population at a permanent level might qualify as “major” federal action and thus require an EIS before removal could occur.    While the secretary has wide discretion under the WFRHBA, he has no discretion regarding compliance with NEPA.  The court also held that  the exercise of jurisdiction by two courts over public lands created no threat of conflicting decisions on range utilization, because the courts only determined whether the land use decision was an informed one.

Humane Society of U.S. v. U.S. Postal Service 609 F.Supp.2d 85 (D.D.C.,2009)

The question in this case centers on whether a response from the United States Postal Service (USPS) to the Humane Society of the United States (HSUS) qualifies as a "final agency action" for purposes of judicial reviewability under the APA. At issue is the HSUS's petition to the USPS to declare a monthly periodical entitled The Feathered Warriror unmailable under the AWA. While the USPS has been broadly exempted from judicial review under the APA, there are exceptions, which include “proceedings concerning the mailability of matter." While the term "proceedings" is largely undefined in the Act, the Court held that it would not limit the term to the post hoc meaning ascribed by the USPS that limits it to only "formal" proceedings. Despite finding that the actions taken by the USPS were indeed judicially reviewable, the court remanded the matter because, after the Humane Society initiated this lawsuit, Congress amended § 2156 of the Animal Welfare Act again, further defining issue of nonmailable animal fighting material.

Marine Wonderland & Animal Welfare Park, Ltd., v. Kreps 610 F.2d 947 (1979)

The facts of this case deal with an Canadian amusement park that had dolphins in its possession en route to Canada when it was forced to land  in the United States.  In this case, the court found that the National Oceanic and Atmospheric Administration ("NOAA"), which is the agency charged with the administration of the MMPA, must be accorded first opportunity to interpret the meaning of "importation."  The NOAA, as fact-finder and record-builder, is best suited to determine legal and factual determinations. 

U.S. v. Apollo Energies, Inc. 611 F.3d 679 (C.A.10 (Kan.), 2010)

Appellants, Apollo Energies, Inc. and Dale Walker, were charged with violating the Migratory Bird Treaty Act after an agent with the USFWS discovered dead migratory birds lodged in each appellant's "heater-treater," a piece of equipment used in the course of appellants' Kansas oil drilling businesses, on several occasions. At trial, both Apollo and Walker were convicted of  misdemeanor violations for "taking" or "possessing" migratory birds. On appeal, Apollo and Walker contested that (1) the MBTA is not a strict liability crime or, (2) if it is a strict liability crime, the MBTA is unconstitutional as applied to their conduct. Bound by a previous holding that found misdemeanor violations of the MBTA are strict liability crimes, the court concluded that the MBTA includes no mens rea requirement. As to Appellants' second contention challenging the constitutionality of the Act, the court concluded that while the Act is not unconstitutionally vague, "the MBTA requires a defendant to proximately cause the statute's violation for the statute to pass constitutional muster.

Forest Guardians v. U.S. Fish and Wildlife Service 611 F.3d 692 (C.A.10 (N.M.), 2010)

Appellant, Forest Guardians, contend on appeal that the U.S. Fish and Wildlife Service violated section 10(j) of the ESA by releasing captive-bred Falcons within an area not wholly separated geographically from an already-existing Falcon population. Forest Guardians aver that the FWS violated the NEPA by deciding to release the captive-bred Falcons before taking the requisite "hard look" at the environmental impact of its decision. Regarding Forest Guardians’ challenge of section 10(j) of the ESA, the court held that the FWS’s release of the captive-bred Falcons did not violate the Act. Forest Guardians’ contention that New Mexico, the location of the experimental release, already quartered an existing population was unpersuasive. The court further rejected Forest Guardian’s second contention that the FWS violated the NEPA by failing to adequately review its proposed action.

U.S. v. Molt 615 F.2d 141 (3rd Cir. 1980) Defendant was convicted in the United States District Court for the Eastern District of Pennsylvania of knowingly importing Fijian reptiles contrary to the Tariff Act and of conspiring to commit such offense. On appeal, the Court of Appeals held that the evidence was sufficient to sustain finding of knowing importation and of receiving and concealing illegally imported reptiles.
Modesto Irr. Dist. v. Gutierrez 619 F.3d 1024 (C.A.9 (Cal.), 2010)

Plaintiffs, Modesto Irrigation District and other irrigation and water districts, contended that, in listing the steelhead—a type of Pacific salmon—as "threatened" under the ESA, the National Marine Fisheries Service violated both the ESA and APA. More specifically, Plaintiffs averred that listing the steelhead as a distinct species under the ESA violated the Act because the steelhead and rainbow trout interbreed. The Ninth Circuit disagreed and affirmed the ruling of the District Court. The court noted that while the steelhead and rainbow trout do interbreed, Congress, in enacting the ESA, did not intend to create a rigid limitation on an agency’s discretion to define the "statutorily undefined concept" of a "distinct population segment" ("DPS").

Western Watersheds Project v. Kraayenbrink 620 F.3d 1187 (C.A.9 (Idaho). 2010)

Plaintiff environmental advocacy organization sued the Bureau of Land Management (BLM) for revisions to nationwide grazing regulations for federal lands, arguing that the revisions violated the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Federal Land Policy and Management Act (FLPMA). The Court of Appeals held that BLM violated NEPA by failing to take a “hard look” at the environmental consequences of the proposed changes, and violated the ESA by failing to consult with Fish and Wildlife Service (FWS) before approving the revisions. Opinion Amended and Superseded on Denial of Rehearing en banc by: Western Watersheds Project v. Kraayenbrink, 632 F.3d 472 (9th Cir., 2010).

U.S. v. Fryberg 622 F.2d 1010 (9th Cir. 1980)

The court finds that the legislative history and surrounding circumstances of the BGEPA evinces a congressional intent to restrict treaty-based rights to hunt eagles.  The court aligns itself with Judge Lay's dissent in U.S. v. White to hold that the BGEPA abrogated Indian hunting rights related to eagles.  For further discussion on the abrogation of Indian treaty rights under the BGEPA, see Detailed Discussion of Eagle Act.

Hopson v. Kreps 622 F.2d 1375 (9th Cir. 1980)

Action brought on behalf of Alaskan Eskimos which challenged the validity of the Department of Commerce regulations adopted pursuant to IWC Act. Plaintiffs claim is the the Commission exceeded its jurisdiction under the Convention when it eliminated the native subsistence exemption for Alaskan Eskimos. The Court reverses and remands the districts courts dismissal of the action.

Zimmerman v. Wolff 622 F.Supp.2d 240 (E.D. Pa. 2008) Plaintiff initiated this action against defendant in his official capacity as Secretary of the Pennsylvania Department of Agriculture, asking the Court to enjoin defendant from seizing plaintiff's dogs and from preventing him from operating his dog kennel under his federal license. Plaintiff simultaneously filed a motion for a temporary restraining order and a preliminary injunction. The State moved for dismissal due to lack of subject matter jurisdiction. Since the Animal Welfare Act did not create a private cause of action, the district court dismissed the claim for lack of subject matter jurisdiction. Plaintiff’s constitutional claims were also dismissed because the court lacked subject matter jurisdiction over constitutional claims brought against state actors directly. Plaintiff’s motions were therefore denied and defendant’s motion was granted. The court went on to address whether it would be appropriate to grant plaintiff leave to amend his complaint to bring the Commerce and Supremacy clause claims under 42 U.S.C. § 1983 and found that it would be futile for both.
Animal Welfare Institute v. Martin 623 F.3d 19 (C.A.1 (Me.), 2010).

Animal welfare organizations sued the State of Maine under the Endangered Species Act (ESA) to stop the authorization of trapping activity that affected Canada lynx. The Court of Appeals held that such organizations had standing to sue, but that the District Court did not err in its refusal to grant a permanent injunction banning foothold traps or other relief.

United States v. Hughes 626 F.2d 619 (9th Cir. 1980)

The defendant had adopted 109 wild horses through the federal Adopt-a-Horse program, whereby excess wild horses were adopted out to private individuals under the stipulation that the horses would be treated humanely and not used for commercial purposes.  The defendant was charged under the criminal provisions of the Wild Free-Roaming Horses and Burros Act and with conversion of government property after he sold a number of the adopted horses to slaughter.  At trial, the defendant argued that he could not be found guilty of conversion because the federal government did not have a property interest in the horses, as the power to regulate wild horses on public lands does not equate to an ownership interest in the horses by the federal government.  The court held that, regardless of whether the WFRHBA intended to create an ownership interest in wild horses, the government has a property interest in wild horses that it has captured, corralled, and loaned out.  

Humane Soc. of U.S. v. Locke 626 F.3d 1040 (C.A.9 (Or.),2010)

The National Marine Fisheries Service (NMFS) authorized several states to kill California sea lions under section 120 of the Marine Mammal Protection Act (MMPA), which allows the intentional lethal taking of individually identifiable pinnipeds. Plaintiffs filed action for declaratory and injunctive relief against Defendants. The Court held that NMFS 1) did not adequately explain its finding that sea lions were having a “significant negative impact” on the decline or recovery of listed salmonid populations; and 2) NMFS did not adequately explain why a California sea lion predation rate of 1 percent would have a significant negative impact on the decline or recovery of these salmonid populations. Therefore, the agency's action was “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.” under the Administrative Procedure Act.

Animal Legal Defense Fund Boston, Inc. v. Provimi Veal Corp. 626 F.Supp. 278 (D.Mass.,1986)

District Court found that federal law preempts Massachusetts's consumer protection statute that requires retailers to inform consumers of relevant information, the disclosure of which may have influenced the buyer or prospective buyer not to enter into the transaction. The District Court also held that the Animal Legal Defense Fund could not enforce a cruelty to animals claim because it involves criminal statutes that only public prosecutors and legislatively-sanctioned groups may enforce.

Friends of Animals v. Salazar 626 F.Supp.2d 102 (D.D.C.,2009) Plaintiffs brought an action against the Department of Interior and the Fish and Wildlife Service of the Department of Interior (“Defendants”) alleging that Defendants unlawfully promulgated a rule (the “Rule”) under the Endangered Species Act (“ESA”) exempting three endangered antelope species from the import, take and other prohibitions under the ESA.   On the parties’ cross motions for summary judgment, the United States District Court, District of Columbia granted Defendants’ motion in part and denied Defendants’ motion in part, finding Plaintiffs lack representational standing with respect to wild antelope and antelope in captivity, but have organizational standing under Section 10(c) of the ESA.   The Court granted Plaintiffs motion with respect to their Section 10(c) claim, finding that the promulgated rule violates Section 10(c) of the ESA.
In re Polar Bear Endangered Species Act Listing and § 4(d) Rule Litigation 627 F.Supp.2d 16 (D.D.C.,2009)

Plaintiffs Safari Club International and Safari Club International Foundation brought this action under the APA challenging the FWS's legal determination that the listing of the Polar Bear as "threatened" under the Endangered Species Act was a final agency action. At issue here is defendants' Motion for Judgment on the Pleadings on the grounds that plaintiffs fail to challenge a final agency action as required for judicial review under the APA. Alternatively, defendants argue that the plaintiffs lack standing to bring this action. This Court found that the action challenged by SCI and SCIF is final agency action for purposes of judicial review pursuant to the APA. On the issue of standing, defendants argue that plaintiffs' suit must be dismissed for lack of standing because plaintiffs have not alleged facts to establish that they have suffered an injury-in-fact. The court disagreed, finding that the plaintiffs have sufficiently pleaded that the “procedures in question” threaten a “concrete interest" - an interest in conservation that is impacted by the import ban. Defendants Motion for Judgment on the Pleadings was denied.

Gregory v. City of Vallejo, et al. 63 F.Supp.3d 1171 (E.D. Cal. 2014) In this case, the plaintiff’s dog was shot by a police officer who was responding to the plaintiff’s call for police assistance in investigating a bank fraud matter. Upon arrival at the home, the officer entered the low-fenced front yard and two of the plaintiff’s dogs approached. The officer, the only eyewitness to the encounter, then shot and killed one of the plaintiff’s dogs. The plaintiff filed suit against the officer and municipality, and alleged, inter alia, violations of her Fourth Amendment rights, intentional infliction of emotional distress, and violations of state statutes. The court held that enough factual issues were disputed to deny the defendants’ motion for summary judgment, specifically that there was a genuine dispute as to whether the killing of the dog was reasonable.
U.S. v. Hackman 630 F.3d 1078 (8th Cir. 2011) Defendants appealed sentences arising out of a Missouri-based dog-fighting conspiracy. Each man pleaded guilty to conspiring to engage in animal fighting ventures in violation of 18 U.S.C. § 371, and one Defendant additionally pleaded guilty to engaging in animal fighting ventures in violation of 7 U.S.C. § 2156. When sentencing each defendant, the district court applied an upward departure provision found in the application notes to United States Sentencing Guidelines (USSG or Guidelines). Each appellant argued that his relevant conduct was not sufficiently cruel to warrant the upward departure. The 8th Circuit found, however, that the district court had properly considered conduct that was legally relevant to Defendants' sentencing under the Guidelines. The court also found that Defendants' conduct amounted to more than just possessing fighting pit bulls. Defendants bred, raised, trained, sold, and fought them knowing that the dogs would be allowed, if not required, to fight until severely injured or dead. Thus, the ordinary cruelty inherent in dog fighting justifies base offense level, while the extraordinary cruelty of Defendants' crimes separately justified the upward departure. The district court's judgment was affirmed.
U.S. v. Molt 631 F.2d 258 (3rd Cir. 1980)

The court affirmed a judgment of sentence entered following defendant's conditional plea of guilty to smuggling and to violating the Lacey Act. The court held that the district court properly denied defendant's Speedy Trial Act motion where defendant incorrectly computed the number of excludable days. Therefore, the court concluded that more than 120 non-excludable days did not elapse between the indictment and the trial.

U.S. v. Bengis 631 F.3d 33 (2nd Cir. 2011)

After two applications to seek compensation for South Africa were denied, the United States appealed the two orders and the 2nd Circuit held that South Africa (1) had a property interest in rock lobsters unlawfully harvested from its waters and (2) was a victim under the MVRA and VWPA. The 2nd Circuit therefore held that restitution was owed to South Africa and the case was remanded for the district court to calculate restitution.

U.S. v. Abeyta 632 F. Supp. 1301 (D.N.M. 1986)

Defendant, an Indian who resided on a reservation charged with the possession of golden eagle parts under the BGEPA, challenged the indictment as a violation of treaty rights and an unconstitutional burden on his exercise of religion.  In an unusual decision, the court found that the BGEPA placed an unconstitutional burden on defendant's exercise of religion, where the golden eagle was not threatened in New Mexico and permits to kill depredating eagles had previously been issued.  The court also held that the treaty at issue granted special religious accommodations to the tribe, thereby preserving a treaty right to harvest eagles for religious needs.  For further discussion on religious challenges to the BGEPA by Native Americans, see Detailed Discussion of Eagle Act .

Western Watersheds Project v. Kraayenbrink 632 F.3d 472 (9th Cir., 2011)

Plaintiff environmental advocacy organization sued the Bureau of Land Management (BLM) for revisions to nationwide grazing regulations for federal lands. Plaintiff argued that the 2006 Regulations violated the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Federal Land Policy and Management Act (FLPMA). The Court of Appeals found for the plaintiff, holding that BLM violated NEPA by failing to take a “hard look” at the environmental consequences of the proposed regulatory changes. BLM also violated the ESA by failing to consult with Fish and Wildlife Service (FWS) before approving the revisions. The FLPMA claim was remanded.

Citizens for Better Forestry v. U.S. Dept. of Agriculture 632 F.Supp.2d 968 (N.D.Cal.,2009)

Plaintiffs Citizens for Better Forestry brought an action against Defendant U.S. Department of Agriculture alleging failure to adhere to certain procedures required by NEPA and the ESA after Defendant promulgated regulations governing the development of management plans for forests within the National Forest System upon preparation of an allegedly insufficient Environmental Impact Statement and without preparation of a Biological Assessment or consultation with the Fisheries and Wildlife Service or the National Marine Fisheries Service. On parties’ cross motions, the United States District Court granted Plaintiffs’ motion for summary judgment and denied Defendant’s motion for summary judgment, finding that Plaintiffs had standing, that Defendant did not comply with its requirements under the NEPA because the Environmental Impact Statement prepared by Defendant did not adequately evaluate the environmental impacts of the proposed regulations, and that Defendant did not comply with its requirements under the ESA because Defendant did not prepare an adequate Biological Assessment.

Humane Soc. of Rochester and Monroe County for Prevention of Cruelty to Animals, Inc. v. Lyng 633 F.Supp. 480 (W.D.N.Y.,1986)

Court decided that the type of branding mandated by Secretary of Agriculture constitutes cruelty to animals because other less painful and equally effective alternatives exist and therefore freed dairy farmers to use other branding methods like freeze branding.

U.S. v. 3,210 crusted sides of Caiman crocodilus yacare 636 F.Supp. 1281 (S.D. Fla. 1986)

The plaintiff, the United States of America, seeks forfeiture of the defendant, 10,870 crusted sides of Caiman crocodilus yacare, an endangered species of wildlife (hides) transported from Bolivia to the U.S. in violation of the Lacey Act, among other statutes.  The court found that the testimony concerning the shrinkage of the crocodile hides during tanning did not meet the buren of the claimed owners showing by a preponderance of the evidence that the hides, which were shipped from Bolivia under the size limit imposed by Bolivian law, were not subject to the forfeiture provisions of the Lacey Act, 16 U.S.C. § 3374(a)(1) (1985).  The provision of the Lacey Act at issue prohibits the interstate or foreign commerce of any wildlife taken in violation of any foreign law. 

U.S. v. Wilgus 638 F.3d 1274 (C.A.10 (Utah), 2011)

Defendant Wilgus, while not a member of a federally-recognized Native American tribe, but a sincere adherent to Native American faiths, was found in possession of 137 eagle feathers during a routine traffic stop, contrary to the Bald and Golden Eagle Protection Act (BGEPA). This case was initially remanded to District Court to determine whether government's scheme to protect eagle-feathers was the least restrictive means of furthering its compelling interests in protecting eagles and Native American religions, as required by the Religious Freedom Restoration Act (RFRA) of 1993. The United States District Court for the District of Utah, 606 F.Supp.2d 1308, held that the scheme violated the RFRA and the Government appealed here. The Court of Appeals found that the government's existing scheme for issuing eagle feather possession permits and enforcing the Eagle Act is the least restrictive means of forwarding the government's compelling interests.

Ctr. for Biological Diversity v. Haaland 639 F. Supp. 3d 1355 (Ct. Int'l Trade 2023) A small porpoise called the vaquita is on the verge of extinction, largely due to gillnet fishing of the totoaba fish that commonly traps and kills vaquitas as well. This fishing takes place in waters in Mexico’s territory, where the last few vaquitas live. In 2020, under the Marine Mammal Protection Act (MMPA), the United States banned the importation from Mexico of seafood products caught with gillnets inside the vaquita’s range. The Center for Biological Diversity, the Animal Welfare Institute, and the Natural Resources Defense Council, Inc. (Plaintiffs) brought this lawsuit in 2022 against the Secretary of the U.S. Department of the Interior Deb Haaland and the U.S. Department of the Interior (Defendants). Plaintiffs argue that Defendants caused an unlawful delay responding to a 2014 letter requesting that Secretary of the Interior certify the embargo against Mexico in order to curb the fishing of the totoaba, as doing otherwise diminished the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) by furthering the extinction of the vaquita. Plaintiffs also requested an order enjoining defendants from further delay in responding to the petition to certify Mexico, and costs and attorneys’ fees associated with the lawsuit. After settlement negotiations took place, parties reached a conditional settlement, and Secretary Haaland certified to the President that the fishing of totoaba by Mexican nationals and related killing of vaquita diminishes the effectiveness of CITES. It remains unclear whether Mexico has made progress in implementing the plan to save the vaquita, whether CITES is being implemented effectively by Mexico, and whether the President will act on the Secretary’s certification. After confirming that the Secretary of the Interior certified Mexico pursuant to the settlement agreement, parties entered into a voluntary dismissal and the court dismissed the lawsuit.
Palila v. Hawaii Dep't of Land & Natural Resources 639 F.2d 495 (9th Cir. 1981)

The action alleged that defendants, Hawaii Department of Land and Natural Resources and chairman, violated the Endangered Species Act by maintaining feral sheep and goats in an endangered bird's critical habitat. Defendant had maintained feral sheep and goats within the critical habitat of the endangered palila bird. The practice degraded the bird's habitat. The court upheld summary judgment for the plaintiff, finding that maintenance of the herd constituted a taking under the Act.

Colorado Wild Horse and Burro Coalition, Inc. v. Salazar 639 F.Supp.2d 87 (D.D.C.,2009)

In this action, the plaintiffs (associations organized to protect wild horses and one equine veterinarian) challenged the decision of the BLM to remove all the wild horses from the West Douglas Herd Area in Colorado. Plaintiffs argued that the BLM's decision violated the Wild Free-Roaming Horses and Burros Act. Defendants countered that BLM's decision was a reasonable exercise of BLM's discretion and was thus entitled to Chevron deference. This Court held that BLM's decision to remove the West Douglas Herd exceeded the scope of authority that Congress delegated to it in the Wild Horse Act.

In Defense of Animals v. U.S. Dept. of Interior 648 F.3d 1012 (C.A.9 (Cal.),2011)

Plaintiff animal non-profits filed a Motion for a Temporary Restraining Order and/or Preliminary Injunction to stop the government from rounding up, destroying, and auctioning off wild horses and burros in the Twin Peaks Herd Management Area. Plaintiffs alleged that the government's actions violated the Wild Free–Roaming Horses and Burros Act and the National Environmental Policy Act. However, the initial phase of the plan sought to be enjoined (the roundup) had taken place. The court held that the interlocutory appeal from the denial of a preliminary injunction was moot because the roundup had already taken place.

U.S. v. Thirty-Eight Golden Eagles 649 F.Supp. 269 (D. Nev. 1986)

Defendant appeals a civil forfeiture action under the BGEPA.  In applying the three-part Callahan test to defendant's free exercise claim, the court holds that while defendant's religious exercise is substantially burdened, the government has a compelling interest in protecting a rare species and effectuates this interest in the least restrictive means.  The court declines to consider defendant's free exercise challenge to the permit process, as defendant failed to apply for a permit and thus lacks standing.  For further discussion on religious challenges to the BGEPA by Native Americans, see Detailed Discussion of Eagle Act .

Schmidt, d/b/a Top of the Ozark Auction 65 Agric. Dec. 60 (U.S.D.A. Feb. 10, 2006) The Animal and Plant Health Inspection Service (APHIS), United States Department of Agriculture instituted a disciplinary proceeding alleging that Jerome Schmidt, a veterinarian, willfully violated the regulations and standards promulgated under the Animal Welfare Act. The alleged violations were based upon ten inspections conducted by a USDA inspector of Schmidt’s Top of the Ozark Auction facility where he conducted dog auctions. The 36 alleged violations centered on housing standards, structural soundness, soundness and security of the enclosures, house keeping and sanitation, trash on the premises, sufficiency of the lighting, the adequacy of the Schmidt’s insect and rodent control program, and interference and refusal of access to a USDA inspector. The Court found that the frequent inspections of Schmidt’s auction facility were inconsistent with and not based upon an objective risk-based assessment. None of the inspections, with the potential exception of one, conformed to the requirements of established Agency guidelines or policy. The inspector’s findings were exaggerated, biased, and unsupported by sufficient credible objective evidence of non-compliance. The egregious behavior of the inspector tainted the inspection results and, therefore, were precluded from being used for the purposes of an enforcement action. The Court ultimately dismissed the complaint against Schmidt and directed the Administrator of APHIS to take appropriate action to insure that the published polices and procedures of the Department are followed by APHIS personnel in future inspections.
Whiteaker v. City of Southgate 651 F. Supp. 3d 893 (E.D. Mich. 2023) The plaintiff (“Whiteaker”) filed this action against Defendant, the City of Southgate, Michigan for violations of the Fair Housing Act (“FHA”) and Michigan's Persons with Disabilities Civil Rights Act (“PDCRA”). Specifically, Whiteaker contends that the City violated the FHA by denying Whiteaker's request for an exemption from City Ordinance 610.13, which prohibits City residents from maintaining chickens (or other typical farm animals) on their property. The events underlying this action began after Whiteaker moved to Southgate in early March 2021. On March 24, 2021, Whiteaker was issued a citation by the City for a violation of Ordinance 610.13. Whiteaker appeared in district court to defend himself, claiming he had a right to keep the chickens under Michigan's Right to Farm Act. However, it turned out the Right to Farm law was inapplicable because Whiteaker's chicken coop was within 250 feet of a dwelling. Thus, Whiteaker was issued a second citation in May and was denied a permit to keep the chickens by the city. Since Whiteaker was a longtime sufferer of depression and anxiety, he sought a waiver from the ordinance as a reasonable accommodation for his disability and presented a letter from his mental health provider as support. Again, his request was denied by the City. In the instant motion for summary judgement by the City, the court examined the "reasonableness" of Whiteaker's request for a reasonable accommodation under the FHA. The court found that the balancing test required under the FHA, to wit, weighing Whiteaker's disability-related need to keep the chickens as a source of comfort and support against the City's claims that the chickens pose a threat to public health, is a triable issue of fact. Indeed, the court observed that the City's citation of documentation from the CDC only lists the "potential dangers" chickens can pose to public health without sufficient evidence to supports its claim that the chickens will burden the City financially and administratively. In contrast, Whiteaker claims a disability and has provided evidence of his disability. Likewise, as to the remaining elements of necessity and equal opportunity for a reasonable accommodation claim, the court again cites Whiteaker's evidentiary support for his claim of disability and need for the chickens to alleviate those symptoms against the fact the City has not presented any testimony, affidavits, or "evidence of any kind" to support its claim. Thus, the court denied the motion for summary judgment.
Majors v. Housing Authority of the County of DeKalb Georgia 652 F.2d 454 (5th Cir. 1981)

Tenant had a history of mental illness and kept a dog in her apartment despite a "no pets" policy. The housing authority refused to waive the "no pets" policy and brought an eviction proceeding. Tenant filed a complaint in federal district court alleging violation of Section 504 of the Rehabilitation Act for failure to waive the "no pets" policy as a reasonable accommodation for her disability. The district court granted the housing authority's motion for summary judgment and the tenant appealed. The court of appeals held that the housing authority deprived the tenant of the benefits of the housing program by enforcing the no pets rule, reasoning that waiving the no pets rule would allow the tenant to fully enjoy the benefits of the program and would place no undue burdens on the housing authority.

American Soc. for Prevention of Cruelty to Animals v. Feld Entertainment, Inc. 659 F.3d 13 (C.A.D.C., 2011)

The Court of Appeals, D.C. Circuit, affirmed the lower court's finding that plaintiffs lack standing to sue Ringling Brothers and Barnum & Bailey Circus for violation of the Endangered Species Act. Specifically, plaintiffs allege that the use of two training methods for controlling elephants, bullhooks and chaining, constitute a "taking" under the Act. Here, the court found no clear error by the district court as to former employee Tom Rider's standing to sue where Rider's testimony did not prove an injury-in-fact. As to API's standing, the court held that API did not meet either informational standing or standing under a Havens test.

Faulkner v. Watt 661 F.2d 809 (9th Cir. 1981)

Reaffirms that purpose of the Taylor Grazing Act (TGA) is to stabilize the livestock industry and protect the rights of sheep and cattle growers from interference and that the Secretary of the Interior may reasonably classify lands under the TGA as suitable for agriculture.

O'Neill v. Louisville/Jefferson County Metro Government 662 F.3d 723 (C.A.6 (Ky.), 2011)

Dog owners sued city-county government and director of city animal-control agency under § 1983 for violations of Fourteenth Amendment after a warrantless search of home and seizure of their dogs. The Court of Appeals held that the owners did not need a breeder's license because their home was not a “Class A kennel.” It also held that the initial entry into owners' home by undercover animal-control officers was not a Fourth Amendment search because it did not infringe on owners' expectation of privacy. However, the consent-once-removed doctrine did not allow uniformed animal-control officers to enter home without a warrant.

Farm Sanctuary v. United States Dep't of Agric. 664 F. Supp. 3d 334 (W.D.N.Y. 2023) Several non-profit organizations, including Farm Sanctuary and Animal Legal Defense Fund, filed a lawsuit against the United States Department of Agriculture (USDA) and Food Safety and Inspection Service (FSIS) challenging their actions related to the slaughtering of pigs under the Administrative Procedure Act. The plaintiffs alleged three causes of action related to the humane treatment, handling, and disposition of downed pigs, violation of the Humane Methods of Slaughter Act, and arbitrary and capricious denial of a Petition for Rulemaking. The plaintiffs in this case filed two causes of action against the defendants. The first cause of action claimed a violation of the Humane Methods of Slaughter Act (HMSA) and the Administrative Procedure Act (APA) for failing to investigate and report on downed pigs to Congress. Specifically, the plaintiffs submitted a petition to ban the slaughter of non-ambulatory pigs, which was denied by the defendants who claimed that their existing regulations and inspection procedures are sufficient in ensuring humane treatment and preventing diseased animals from entering the food supply. The plaintiffs requested the court to issue a declaration finding the violation and to compel the defendants to conduct an investigation and report to Congress. The second cause of action alleged a violation of the HMSA and APA for failing to assess the need for regulations regarding the humane treatment of downed pigs and to promulgate such regulations. The plaintiffs requested similar relief as in the first cause of action. The Court granted the Plaintiffs' Motion to Complete the Administrative Record, denied Plaintiffs' Motion for Judicial Notice, granted Defendants' Motion for Summary Judgment, and denied Plaintiffs' Motion for Summary Judgment. On appeal, the defendants argued that the plaintiffs have not demonstrated standing at the summary judgment stage, despite a previous ruling during the motion to dismiss stage. Article III standing requires plaintiffs to show (1) an injury-in-fact, (2) a causal connection between the injury and the defendant's actions, and (3) the likelihood that the injury can be remedied. The defendants argued that the plaintiffs lacked standing to pursue both causes of action because they had not been injured by the defendants' alleged failures, and any relief ordered by the court would not redress their injuries. Regarding the informational injury, the court found that the plaintiffs had not demonstrated that it was sufficiently concrete to meet the requirements of Article III. The court also stated that seeking to ensure compliance with regulatory law was not sufficient grounds for standing. The potential availability of a report through the Freedom of Information Act was considered too attenuated to establish a concrete informational injury. Regarding the organizational injury, the court referred to a recent Second Circuit decision that rejected an expansive concept of organizational injury for standing purposes. The plaintiffs claimed that they had been forced to spend resources investigating and reporting on downed pigs, which they argue was the responsibility of the USDA. However, the court ruled that the plaintiffs had voluntarily chosen to engage in these activities and had not been required to do so by the USDA. The court explained that an organization must show an involuntary material burden on its established core activities, and the challenged law or regulation must impose a cost that adversely affects the organization's regular activities pursued in its organizational mission. Expenditures or activities undertaken by the organization's own initiative, without being reasonably necessary to continue established core activities, were insufficient to establish injury for standing purposes. The court found that the plaintiffs had not shown a perceptible impairment to their activities caused by the defendants' actions, and the expenditures incurred by the plaintiffs were not reasonably necessary to continue their established core activities. Therefore, the plaintiffs did not establish an injury in fact for standing purposes based on organizational injury. Even assuming the plaintiffs had standing, they failed to establish that defendants violated the HMSA and the APA by failing to investigate and report to Congress on downed pigs. The defendants argue that they complied with Congress's mandates and that some obligations are not judicially reviewable, to which the court agreed. The plaintiffs in this case alleged that the defendants violated the FMSA by failing to investigate and report on downed pigs as required by Section 1907(a). However, the court found that Section 1907 does not mandate that the Secretary investigate each and every species of livestock, and the plaintiffs failed to provide evidence supporting that reading of the statute. The court also found that the plaintiffs' challenge to the sufficiency of the reports was not enough to succeed on an APA claim because they did not establish that the defendants failed to take a discrete agency action that they were required to take. As a result, the defendants are entitled to summary judgment on the first cause of action. Additionally, defendants argued that they are entitled to summary judgment because the relevant statute does not require them to regulate the slaughter of downed pigs, and therefore, the decision is discretionary. The plaintiffs did not provide a response to this argument, and their failure to advocate for their second cause of action is likely due to the absence of any statutory requirement that Defendants ban the slaughter of downed pigs. The court examined the relevant statute, which provides that the Secretary shall promulgate regulations to provide for the humane treatment of non-ambulatory livestock if necessary. The court concluded that the statute grants discretion to the Secretary to determine whether to promulgate such regulations and that agency decisions not to take enforcement action are unreviewable. Thus, the court concluded that the defendants' actions were not arbitrary or capricious. For the foregoing reasons, Plaintiffs’ Motion to Complete the Administrative Record was granted; Plaintiffs’ Motion for Judicial Notice and their Motion for Summary Judgment were denied; and Defendants’ Motion for Summary Judgment was granted.
Greater Yellowstone Coalition, Inc. v. Servheen 665 F.3d 1015 (C.A.9 (Mont.), 2011)

Coalition sued for a review of a United States Fish and Wildlife Service’s (FWS) final rule to remove grizzly bears from the Endangered Species Act (ESA) threatened species list. The Court of Appeals held that there was no rational connection between data that showed a relationship between pine seed shortages, increased bear mortality, and decreased female reproductive success and FWS’ conclusion that whitebark pine declines were not likely to threaten grizzly bears. FWS could reasonably conclude that National Forest Plans and National Park Compendia (Plans) provided adequate regulatory mechanisms to protect grizzlies as recovered species. The portion of the District Court's ruling vacating the Final Rule was affirmed.

Animal Welfare Institute v. Martin 665 F.Supp.2d 19 (D.Me., 2009)

Plaintiffs in this case filed motions for a preliminary injunction and a temporary restraining order to halt the commencement of the early coyote and fox trapping season in the state of Maine. Plaintiffs claim that the Maine Department of Inland Fisheries and Wildlife (DIFW)Commissioner had violated the ESA by allowing trapping activities that “take” Canada lynx, a threatened species. The DIFW stated that the Court has already addressed a motion for preliminary injunction and an emergency motion for temporary restraining order, with no change to circumstances. In denying Plaintiffs' Motion for Preliminary Injunction and TRO, the Court found that Plaintiffs had not sustained their burden to justify the extraordinary remedy of an injunction. Further, the Court found that the circumstances that led the Court to deny the Plaintiffs' emergency motion for a temporary restraining order have not changed.

Edwards v. Shanley 666 F.3d 1289 (C.A.11 (Fla.))

Automobile driver fled scene of a traffic stop and sustained serious injuries when he was attacked by a police dog, which was allowed to continue for 5 - 7 minutes. Plaintiff brought § 1983 action, alleging that the use of the police dog constituted excessive force, and that the other officer failed to intervene and stop the attack, both of which violated plaintiff’s Fourth Amendment rights. The Court of Appeals held that the use of the police dog to help track and initially subdue the driver was constitutional, but permitting the dog to continue to attack the driver constituted excessive force.

Friends of Animals v. Salazar 670 F.Supp.2d 7 (D.D.C., 2009)

Friends of Animals (“FOA”) filed a Complaint against the U.S. Fish and Wildlife Service under the ESA and APA seeking declaratory and injunctive relief. At issue is the petition FOA filed with the FWS in January 2008 to list thirteen species of foreign macaws, parrots and cockatoos as threatened or endangered due to the caged pet bird trade. In July 2009, FWS placed on public inspection at the Federal Register its 90-Day Finding for the Thirteen Species and also moved to dismiss FOA's lawsuit as moot. While the Court held that FOA's substantive claims must be dismissed, it considered FOA's argument that an award of fees and costs is appropriate here because its suit served as the “catalyst” for FWS's subsequent remedial actions. The Court allowed FOA to file a motion for fees and costs and defendants to respond to such motion.

Animal Protection Institute of America, Inc. v. Hodel 671 F.Supp. 695 (D.Nev.,1987)

In this case, animal protection groups sued the Secretary of the Interior to enjoin or restrain him from allowing the adoptions of wild horses and burros under circumstances where the defendants know the horses are being adopted for commercial slaughter or exploitation. Defendants opposed the motion and and argued that the Secretary has duly promulgated regulations permitting adoptions of such animals and provided that the animals are humanely cared for during the one year period provided for in 16 U.S.C. § 1333(c). This Court granted plaintiffs' motion, enjoining the Secretary from transferring the titles of wild free-roaming horses and burros to individuals who have, prior to the expiration of the one year “probationary period” expressed to the Secretary an intent to use said animals for commercial purposes.

Alliance for the Wild Rockies v. Salazar 672 F.3d 1170 (9th Cir. 2012) Environmental organizations challenged constitutionality of Section 1713 of the 2011 Appropriations Act ordering Secretary of Interior to reissue a final rule removing a distinct gray wolf population in the northern Rocky Mountains from protections of Endangered Species Act (ESA). The Court of Appeals held that the statute did not violate the separation of powers doctrine, and reasoned that Congress amended, rather than repealed, ESA as to delisting of gray wolf by directing Secretary to reissue rule without regard to any other statute or regulation.
