This Rhode Island statute provides that violations of Sec. 4-19-16, relating to the mandatory spay/neuter agreement from a licensed releasing agency. Violations of the written agreement executed pursuant to § 4-19-16 by an adopting party are punishable by a fine of fifty dollars ($50.00) for the first offense, one hundred fifty dollars ($150) for the second offense and four hundred dollars ($400) for the third and subsequent offenses. Second and subsequent offenses may constitute grounds for seizure and forfeiture of the dog or cat. |

Take Me Home Rescue v. Luri |
Defendant Luri appeals an injunction against her to return a foster dog that she failed to have spayed in accordance with an agreement between her and Take Me Home pet rescue organization. In finding that the trial court did not err in issuing the injunction, the court found that Take Me Home had a reasonable likelihood for success on the merits of its breach of contract claim because the original agreement was amended by a separate oral agreement that the dog would be spayed after recovering from a bout of mange. Further, in assessing the balance of harms, the court found that it favored Take Me Home. While Luri can either spay the dog or adopt a new one, the organization's "entire existence depends on its ability to place pets that it obtains from shelters in adoptive homes."

UT - Sterilization - Animal Welfare Act. Part 2. Animal Shelter Pet Sterilization Act |
Under this Utah act, a shelter may not transfer an unsterilized animal for adoption unless the shelter has a written agreement in which the recipient agrees to have the animal sterilized and gives the shelter a sterilization deposit. If a recipient fails to comply with the agreement, the animal may be seized and impounded, and the recipient forfeits the deposit. A first violation may result in a civil penalty of $250. |

This Virginia statute provides that the governing bodies of counties, cities, and towns of the Commonwealth are hereby authorized to adopt, in their discretion, ordinances which parallel statutory sections dealing with licensing of dogs, taxation, impoundment, and regulation of dangerous dogs. It also provides that nothing in this section shall be construed so as to prevent or restrict any local governing body from adopting local animal control ordinances which are more stringent than the relevant state statutory sections. It further outlines how ordinances may impose civil penalties for violations of the above. |
