Apr. 1, 2016) | Plaintiff filed suit against two police officers and the District of Columbia after the officers shot and killed her dog while executing a warrant to search her home. She brought a § 1983 claim, alleging that the officers seized her property in violation of the Fourth Amendment. The Court of Appeals reversed the District Court’s ruling for summary judgment, holding that a jury could find in favor of the plaintiff based on her witness testimony that the dog was lying down when it was first shot. Additionally, the court maintained summary judgment for the second police officer, McLeod, who shot and killed the dog after it bit Officer Pezzat and charged forward. | Case | |

This Ohio case examined the propriety of a county dog warden killing a dog that had killed a sheep nine hours before such seizure. The Court of Appeals held that dog warden was not authorized to destroy or otherwise dispose of a duly licensed dog found and seized by such warden upon the premises of its owner following a complaint made to the warden by the owner of sheep that the dog had killed certain of his sheep approximately nine hours before such seizure. |

The applicants claimed that the aerial shooting constituted cruelty as the goats, once wounded, would die a slow death. An injunction was granted to the applicants pending final hearing of the substantive action against the aerial shooting. |

Methods - Prohibiting animals (FDA Food Code 6-501.115) | WA ADC 246-215-06570 | WAC 246-215-06570 | This Washington regulation generally prohibits live animals on the premises of a food establishment. However, subsection (4) now allows dogs to be present in the outdoor area of such premises if certain conditions are met. These include the permit holder (the food establishment) possessing an approved plan allowing dogs in its outdoor premises. Dogs must be on a leash and under control of their handlers. Dogs must not go through the interior of the food establishment and must not go on tables, chairs, or other fixtures. If the food establishment provides containers for food or drink for the dogs, those containers must not be washed in the food establishment. Food employees must not have contact with the dogs and the area musts be maintained so that it is clean of animal waste.
