It is unlawful to keep, harbor, own or possess any pit bull dog in Juneau, Wisconsin, with an exception for pit bulls registered on the day the ordinance became effective. Such dogs may be kept within the city subject to certain requirements, such as proper confinement, the use of a leash and muzzle, the posting of "Beware of Dog" signs, and the maintenance of $50,000 liability insurance for personal injury caused by a pit bull.

Turner v Cole [2005] TASSC 72

RSPCA officers found a horse belonging to the applicant on the applicant's property and, after preparing the horse for transport, had to euthanise the animal when it collapsed. The applicant was convicted of failing to feed a horse which led to its serious disablement and eventual euthanisation. The applicant was unsuccessful on all issues on appeal and was liable for a fine of $4000 and prevention from owning 20 or more horses for five years.

Hament v. Baker 2014 VT 39, 97 A.3d 461 (Vt. 2014) 2014 VT 39 The custody of an eleven year old German wirehaired pointer was the central issue in this Vermont divorce case. While both parties testified to their strong emotional ties to the dog and to the care that each spouse provided, the Superior Court awarded custody to the husband. The wife appealed the Superior Court’s decision arguing that the court erred in refusing a joint arrangement, that the court’s finding was not supported by the evidence, and that this finding provided an arbitrary basis for award. On appeal, the Supreme Court of Vermont held that the family court division could consider factors not set out in 15 V.S.A. § 751(b); specifically, the welfare of the animal and the emotional connection between the animal and each spouse. The court found that both parties were afforded an opportunity to put on evidence regarding both factors without restriction in the Superior Court. The Supreme Court of Vermont also held that the Superior Court was correct in its statement that the family division could not enforce a visitation or shared custody order for companion animals. Unlike child custody matters, the court said, there is no legislative authority for the court to play a continuing role in the supervision of the parties with respect to the care and sharing of a companion animal. The Superior Court’s decision of awarding custody to the husband was therefore affirmed. Case
Theis v. Yuba County Sheriff's Department Slip Copy, 2019 WL 3006261 (E.D. Cal. July 10, 2019) The Plaintiffs allege that their cat, named Pizza, was unlawfully euthanized at Yuba County Animal Care Services shelter in Olivehurst, California on or about February 9, 2018. Pizza went missing on or about February 9, 2018 and Plaintiffs found out later that same day that a neighbor had found the cat and brought it to the Yuba County animal shelter. The Plaintiffs attempted to contact the shelter, but it had already closed for the evening. The next morning around 9:30 a.m., the Plaintiffs arrived at the shelter and learned that Pizza had been euthanized as early as 5:00 p.m. the night before. Defendant Barnhill, the shelter’s supervising officer, informed the Plaintiff’s that Pizza had been injured, however, the neighbor who brought the cat to the shelter without knowing it was the Plaintiffs’ described Pizza as looking healthy. The Plaintiffs contend that Pizza’s euthanization falls within an ongoing pattern and practice of abuse and failure to follow state and federal law. Plaintiffs filed their original complaint on October 1, 2018. The Defendants removed the case to federal court. Plaintiff’s asserted four claims in their First Amended Complaint: (1) the failure to perform mandatory duties in violation of California Government Code section 815.6, (2) petition for a writ of mandate under California Code of Civil Procedure section 1085, (3) violation of the plaintiff’s Fourteenth Amendment substantive due process rights under 42 U.S.C. section 1983, (4) negligence under California common law. The Defendants moved to dismiss Plaintiff’s First Amended Complaint and alleged that the Plaintiff’s did not plead facts sufficient to show that Barnhill engaged in unlawful conduct or to establish a substantive or procedural due process violation. The Court, however, granted the Plaintiffs leave to amend their complaint as to the section 1983 claim. The Court declined to assert supplemental jurisdiction over the state law claims, which were the Plaintiff’s first, second, and fourth claims since the Plaintiff’s had conceded that their federal claim by requesting to amend their complaint. As a result, the Court reviewed remaining claims to determine whether they may be included in any amended complaint or whether leave to amend would be futile. The Court determined that granting Plaintiff’s leave to file a second amended complaint would not be futile on all of their claims except for the petition for writ of mandate claim. California’s Civil Procedure Code section 1085 does not apply to federal courts and, therefore, the Plaintiff’s leave to amend this claim would be futile. Ultimately, the Court ordered Plaintiff’s third cause of action for violations of their Fourteenth Amendment substantive and procedural due process rights be dismissed with leave to amend, the Plaintiff’s state law claims in their first, second, and fourth causes of action be dismissed with leave to amend to the extent consistent with the order, and denied the Defendant's motions to strike Plaintiffs' punitive damages claim. Plaintiffs were required to file a second amended complaint within 21 days of the date the order was filed if they wished to amend their complaint. Case
Pometti, Hugo c/ Provincia de Mendoza s/ acción de amparo Id SAIJ: FA17190000 This is an action of protection or "accion de amparo” filed by Hugo Edgardo Pometti against the Province of Mendoza in The Court of Associated Judicial Management No. 2 of Mendoza. The Petitioner sought to stop the transfer of the chimpanzee Cecilia to the sanctuary located in Brazil and to keep her in the Zoo of Mendoza in order to preserve the natural and cultural heritage and the biological diversity. The petitioner also requested a precautionary action to not transfer the chimpanzee until decision on the the action of amparo was issued. Case
TX - Domestic Violence - § 85.021-.022 Protective Orders V.T.C.A., Family Code § 85.021 -.022 TX FAMILY § 85.021 - 022 In a protective order in Texas, the court may prohibit a party from removing a pet, companion animal, or assistance animal, as defined by Section 121.002, Human Resources Code, from the possession of a person named in the order. Furthermore, in a protective order, the court may prohibit the person found to have committed family violence from harming, threatening, or interfering with the care, custody, or control of a pet, companion animal, or assistance animal that is possessed by or is in the actual or constructive care of a person protected by an order or by a member of the family or household of a person protected by an order. In Irondale, Alabama, it is unlawful to keep, harbor, own or possess any pit bull dog. However, pit bull dogs registered on the date of publication may be kept within the city subject to certain requirements. These requirements include proper confinement, the use of a leash and muzzle, the posting of “Beware of Dog” signs, the taking of identification photographs, and the maintenance of liability insurance ($50,000). Failure to comply may result in the seizure of the dog, a fine up to $500 and/or imprisonment up to 30 days. The city also bans Presa Canario dogs.

Texas Attorney General Opinion clarifying a new provision in Chapter 822 of the Texas Health & Safety Code that requires all dangerous wild animals to be registered in the county in which they're located.  Otherwise, possession of these animals is unlawful.

England - Farming - The Use of Closed Circuit Television in Slaughterhouses (England) Regulations 2018 2018 No. 556 These Regulations introduce requirements on operators of slaughterhouses in England to install and operate a closed circuit television (CCTV) system in all areas where live animals are present. CCTV footage and associated data must be retained for a period of 90 days. Inspectors are given powers to require compliance with these Regulations. This includes powers of inspection and seizure where an inspector has entered premises for the purposes of executing and enforcing the 2015 Welfare of Animals at the Time of Killing (England) Regulations, and powers to issue enforcement notices. Sentencia T-095, 2016 Sentencia T-095/16 In this decision, the court drew a line between the concept of animal welfare and the concept of animal rights. The court continues to see animal protection from a moral perspective when it states animals do not necessarily have rights, even though they should be treated with respect and should not be abused. The Plaintiff brought an action of ‘tutela’ (Constitutional mechanism that is preferential and summary, created for the sole purpose of protection of fundamental rights) against ‘la Personería Local of Fontibón’, the local Mayor’s office of Fontibon, the District Secretary of Health, the Zoonosis Center and the Distril Secretary of the environment of Bogota. The Plaintiff argued that these governmental entities had violated his fundamental right to petition and the right to animal welfare of twenty five dogs, when the authorities ordered the confiscation the canines that were located in the District Ecological Park of the Wetland of Capellanía and who were cared for by volunteers. The Plaintiff argued that the Defendants did not respond to his request to provide funds to build a shelter and provide food and veterinary assistance of the dogs or funds to relocate them. The Plaintiff sought a response from governmental authorities on the petition and to provide the funds to save the animals, thereby avoiding the Zoonosis Center to assume their care, who would euthanize the sick animals that were not adopted after five days of being up for adoption. The lower court denied the protection of the fundamental right to petition, as it found that the authorities responded to the petition of the Plaintiff in a clear and timely matter by denying the request to fund the Plaintiff to relocate the dogs or build a shelter for them. In regards to the right to animal welfare, the lower court considered it was a legal rather than a constitutional issue, therefore the action of ‘tutela’ was not the appropriate mechanism as its purpose is to guarantee the protection of fundamental rights. The court held that there was a constitutional duty of animal protection that derives from the duty to protect the environment. However, this duty to guarantee the well-being of animals as sentient beings is not absolute and may be subject to exceptions. The court determines that the mandate to protect the environment, which includes sentient beings, does not translate into a right to animal welfare, and for that reason such duty is not enforceable through an action of tutela. The duty to protect animals presumes an obligation to care and prohibits maltreatment and cruelty against animals, unless these actions come from one of the limits stipulated in the constitution. The court affirmed the lower court decision to deny the protection to the right to petition and declared the inadmissibility of the action of tutela for the protection of animal welfare. Case
