In this Michigan case, a mother sued as next friend for injuries suffered by her daughter after the daughter was attacked by defendant's domestic cat. The lower court directed a verdict in favor of the cat's owner and the mother then appealed. The Court of Appeals held that evidence warranted submission to the jury on questions of strict liability and negligence. If an owner has knowledge that her cat has bitten children before and that it was suffering from a disease that makes the cat extra sensitive, then a prima facie case has been made that the cat was dangerous, posing more than the normal risk of harm from cats.

Goldman v. Critter Control of New Jersey 185 A.3d 946 (N.J. App. Div. 2018) 454 N.J. Super. 418 (2018) Plaintiff, Stuart Goldman, was the former chief humane law enforcement officer for the Monmouth County Society for the Prevention of Cruelty to Animals. Plaintiff alleged that in May of 2015, he learned from a resident of Matawan that Critter Control of New Jersey had trapped a female adult raccoon and removed it from the roof of a house. A few days later, baby raccoons were found in the gutters of that same house. Those baby raccoons allegedly went without sustenance for a week. Plaintiff filed a complaint against Critter Control for violation of New Jersey law. The case was dismissed with prejudice and the court stated that the statute only provided for organizations to seek a civil remedy under the New Jersey statute and that Plaintiff had brought his complaint in his individual capacity and, therefore, lacked standing. Plaintiff had also filed a second case in which the he alleged that Simplicity Farms was mistreating horses. This was ultimately dismissed by the trial court. Plaintiff appealed both cases which were ultimately consolidated on appeal. Plaintiff contended on appeal that he had standing to sue in the name on Monmouth SPCA as a qui tam action and that the court erred by not granting his motion for reconsideration to allow him to amend the complaint with the proper caption. Plaintiff also contended that his complaint against Simplicity Farms should not have been dismissed. Plaintiff argued that the N.J.S.A. 4:22-26 authorized qui tam suits because it provided that “any person in the name of the New Jersey [SPCA] or county SPCA can sue for civil penalties.” Based on the legislative history and the amendments to the PCAA, the Court concluded that the PCAA did not authorize qui tam lawsuits as the Plaintiff contended. The Court found no misapplication of discretion by the trial court denying Plaintiff’s motions to amend his complaints because the amendments would have been futile in light of his lack of standing. Gill Terrace Ret. Apartments, Inc. v. Johnson 2017 VT 88, 177 A.3d 1087 (Vt. 2017) 2017 VT 88 (Vt. Oct. 6, 2017), 2017 WL 4453007 (Vt. Oct. 6, 2017) This is an appeal of a trial court's ruling in favor of a landlord finding that the tenant violated two material terms of her residential rental agreement. One of the material violations involved the keeping of a pet in violation of a no-pets policy. The facts show that the dog, "Dutchess," initially came to the tenant's apartment in 2009 with the tenant's son. While the dog never attacked another person or pet, it did display aggressive behavior, including lunging, baring her teeth, and rearing up on her hind legs. Other tenants expressed fear of Dutchess. After the son moved out in 2013, the dog stayed, and, in 2014, the landlord sent tenant a letter indicating the keeping of the dog was a violation of the lease. Two months after that notice, an informal meeting was held and tenant then claimed the dog as a reasonable accommodation for her disability. The landlord's attorney sent paperwork to effectuate this request, which the tenant said she never received. Months later, the landlord served the tenant with an eviction action to which tenant responded with a request to keep her dog as a reasonable accommodation. The request to keep a pet as a reasonable accommodation was granted shortly thereafter by landlord; however, the landlord did not approve of Dutchess as the specific animal due to concerns of behavior and hostility toward other residents. At an eviction hearing in June of 2016, the landlord's request to terminate the tenant's lease was granted by the court, which concluded that the reasonable accommodation for an assistance animal did not extend to Dutchess. On appeal, the Vermont Supreme Court noted that a request for an assistance animal as a reasonable accommodation may be denied if "the specific assistance animal in question poses a direct threat to the health or safety of others." While there was no dispute in this case that the tenant has a disability-related need for an ESA, there was credible evidence that supported the lower court's decision that Dutchess posed a threat and/or would cause substantial physical damage to the property. This included testimony from other tenants and tenant's own statements that she might not be able to control Dutchess. The court stated: "[l]ike the trial court, we acknowledge tenant's attachment to Dutchess and her need for an emotional support animal, but the court properly weighed the evidence regarding Dutchess's aggressive behavior against landlord's concerns for the safety and wellbeing of the other residents." The court concluded that the lower court did not err in affirming landlord's denial of tenant's reasonable accommodation request. Case

OK - Breeder - Oklahoma Statutes Annotated. Title 4. Animals. Chapter 1A. Commercial Pet Breeders Act of 2012 4 Okl.St.Ann. § 30.1 - 30.16 OK ST T. 4 § 30.1 - 30.16 This section comprises Oklahoma's Commercial Pet Breeders Act of 2012, now called the Commercial Pet Breeders and Animal Shelter Licensing Act. The law is now administered under the State Board of Agriculture. The high end of possible penalties for violations under the new act was increased to $10,000. The law requires a commercial breeders' directory be kept. The Board must post on its website the directory of commercial pet breeders who have been denied licensing, or whose licenses have been revoked. Statute
WILCOX v. BUTT'S DRUG STORES, Inc. 35 P.2d 978 (N.M. 1934) 38 N.M. 502, 94 A.L.R. 726 (N.M. 1934)

In Wilcox v. Butt’s Drug Stores , plaintiff came into pharmacy to purchase her usual laxative for her show dogs when pharmacist recommended a different brand that ended up killing one of the dogs. The New Mexico Supreme Court held that although sentimental value was not appropriate when calculating the dog’s value, it found recovery not to be limited to market value. Factors such as breed, special qualities, and purchase price were looked at to determine value.

City of Cleveland v. Lupica 2004 WL 2340639 (Ohio, 2004)

Defendant plead no contest to failure to confine and insure her dog after her pit bull attacked a mail carrier.  The trial court's decision to have the dog turned over to the city and destroyed was reversed.  The Court of Appeals found Defendant's no contest plea was not entered knowingly, intelligently or voluntarily.

Plaintiff sued dog owners for injuries from a dog attack.  The jury ruled in favor of plaintiff for medical expenses, and plaintiff sought a new trial as to damages only.  The court held that a new trial on damages was appropriate because the jury's failure to award damages for pain and suffering was against the manifest weight of evidence as defendant's liability was established by the viciousness of the dog repeatedly biting plaintiff about the head and face, which was out of proportion to the unintentional act of plaintiff falling onto the sleeping dog.  Unintentional or accidental acts can
constitute provocation, but not if the dog responds with a vicious attack, as it did here, that is out of all proportion to the unintentional acts involved.

Karnail Singh and others v. State of Haryana CRR-533-2013 High Court of Punjab & Haryana At Chandigarh The fact of the case arose in 2004 and related the transportation of cows from one province to another in violation of restrictions on the export of cows for meat slaughter. An opinion on that case was given in 2013, then a revised petition was submitted to this court, and several years later this opinion was given. Much of the 100 pages did not deal with the events of the case, but with the jurisprudence of animal rights. The ultimate holding of the judge directed a state agency to enforce a number of very specific standards for the transportation of animals. The Punjab and Haryana High Court declared, in this exceptional judgment, that animals and birds have legal rights, just as humans. It further declared citizens as the “guardians of [the] animal kingdom” with a duty to ensure their welfare and protection. Justice Rajiv Sharma, in his order, said, “All the animals have honour and dignity. Every specie[s] has an inherent right to live and is required to be protected by law. The rights and privacy of animals are to be respected and protected from unlawful attacks. The Corporations, Hindu idols, holy scriptures, rivers have been declared legal entities, and thus, in order to protect and promote greater welfare of animals including avian and aquatic, animals are required to be conferred with the status of legal entity/legal person. The animals should be healthy, comfortable, well nourished, safe, able to express innate behaviour without pain, fear and distress. They are entitled to justice. The animals cannot be treated as objects or property.” Case
TN - Breeder -Part 7. Commercial Breeder Act T. C. A. § 44-17-701 - 715 (expired June 30, 2014) TN ST § 44-17-701 - 715 (Expired June 30, 2014). In 2009, Tennessee enacted its Commercial Breeder Act. The act defines a commercial breeder as means any person who possesses or maintains, under the person’s immediate control, twenty (20) or more unsterilized adult female dogs or cats in this state for the purpose of selling the offspring as companion animals. Commercial breeders must maintain and display licenses to operate in accordance with the act. Further, the act requires commercial breeders to keep on file at all times the number of dogs and cats in their possession and how many were sold during the reporting period. Inspections may occur under the act, but are not mandatory. Statute
