In this North Dakota case, the defendant appeals from a criminal judgment finding she violated the Cass County Animal Control Ordinance after her neighbors reported her barking dogs. In her first appeal ground, Brown contended that the Ordinance constituted an unconstitutional delegation of power. The court disagreed, finding that Cass County adopted a home rule charter and thus had the power to create criminal penalties for violations of ordinances. Brown next argued that the legislature “has statutorily prohibited the county from attempting to regulate dogs as public nuisances.” Since the state has defined certain “dog activities” that constitute a public nuisance, the county is precluded from declaring any other dog-related activity a public nuisance according to defendant. The court found that this broad interpretation would preclude action by the county if the state has exercised any authority and would virtually eliminate the county's authority granted by home-rule authority. The court also rejected Brown’s argument that the Ordinance is unconstitutionally vague. The Ordinance provides that an animal that “barks ... in an excessive or continuous manner” is a public nuisance. The court held that its holding in   Kilkenny, 2007 ND 44, ¶¶ 20-25, 729 N.W.2d 120, is controlling here, where the words excessive, continuous, or untimely have a common understanding and are not vague.

Respondents filed suit challenging the new regulation under the ESA that limited the jurisdiction to the U.S. and the high seas.  While the case, was remanded the central issue to this case was whether respondents had standing to challenge the ruling.

An animal control employee lost her job due to the city’s decision to outsource the department to another city. Plaintiff sued the city on eleven counts, but lost due to the district court’s grant of the city’s motion for summary judgment. On appeal, the plaintiff lost on her First Amendment, American Disability Act, Utah Protection of Public Employees Act, and breach of contract claims.

The plaintiffs, In Defense of Animals and Patricia Haight brought suit against the defendants, Michael Berens, the principal research investigator of the study in question, and the Barrow Neurological Institute, St. Joseph’s Hospital and Medical Center, Catholic Healthcare West Arizona, and Catholic Healthcare West, his employers, under the False Claims Act.  In 1997, defendant Michael Berens, Ph.D., submitted a grant application to the NIH in which he sought federal funding for a project to develop a canine model to study glioma, a form of human brain cancer, and attempted to create a process for implanting gliomas in the brains of beagles. The plaintiffs brought suit against Dr. Berens under the False Claims Act asserting that he had lied in his grant application in order to obtain NIH funding. The district court granted summary judgment to the defendants, holding that the plaintiffs failed to produce sufficient evidence from which a reasonable jury could find that the challenged grant application statements were objectively false.   In response, the plaintiffs filed a notice to appeal 51 days later, relying on a circuit court precedent allowing plaintiffs 60 days to file a notice of appeal in these types of cases.   However, an intervening Supreme Court decision declared that plaintiffs have only 30 days to file a notice to appeal in this type of case.   This case was amended and superseded by US ex rel Haight v. Catholic Healthcare West , 602 F.3d 949 (9th Cir., 2010).

TN - Domestic Violence - Part 6 Domestic Abuse T. C. A. § 36-3-601 - 606 Under Tennessee's Domestic Abuse Act, the definition section states that "abuse" includes inflicting, or attempting to inflict, physical injury on any animal owned, possessed, leased, kept, or held by an adult or minor. Section 606(9) allows the court to direct the care, custody, or control of any animal owned, possessed, leased, kept, or held by either party or a minor residing in the household. Further, in no instance shall the animal be placed in the care, custody, or control of the respondent, but shall instead be placed in the care, custody or control of the petitioner or in an appropriate animal foster situation. NH - Dog Bite - Chapter 466. Dogs and Cats. N.H. Rev. Stat. § 466:31 to 31-a NH ST § 466:31 to 31-a Under this section, a dog is considered to be a nuisance, a menace, or vicious to persons or to property if it is "at large," if it barks for sustained periods, if it chases cars continuously, or if it growls, snaps at or bites persons. If a dog bites a person and breaks the skin, the animal control officer must inform the victim whether the dog was vaccinated against rabies within 24 hours. Statute

Defendant Flores appeals his conviction under Penal Code section 399 for allowing a " mischievous animal" owned by him to cause serious injury to another person. In this case, defendant's pit bull dog, "Blue,"attacked defendant's almost 90-year old neighbor on his own property causing deep injuries to his leg. Blue had been previously involved in three other incidents where he either tried to attack other dogs or acted aggressively toward other humans. As a result of these incidents, Sonoma County officials issued defendant a issued a potentially dangerous animal warning. On appeal, defendant argued that there was insufficient evidence that he acted without ordinary care in keeping his dog and that the victim-neighbor did not suffer a serious injury as defined by statute. The court found both of these arguments without merit. While defendant suggested that he acted with "ordinary care" by keeping the dog tethered and chained outside on the day of the incident, the court found the evidence showed Blue had broken free in the past and had "massive strength." Further, even though the potentially dangerous dog designation by the county did not mandate that Blue be kept inside or in a secure enclosure, the ordinance language provides this requirement. Leaving a dog with a history of unprovoked attacks chained next to a public sidewalk in a residential neighborhood supported the jury's conclusion that defendant did not act as reasonably careful person would in the same situation. As to the serious bodily injury claim, the court noted that although the law does not define the term, there was substantial medical evidence to support the jury's determination. Affirmed.
