Large Carnivores V.A.M.S. 578.600 - 578.625 MO ST 578.600 - 578.625 The “Large Carnivore Act” pertains to large cats and bears that are nonnative to Missouri and held in captivity. The Act prohibits ownership, possession, breeding, and transportation of large carnivores (with exceptions). The Act creates civil and criminal liability for persons who own or possess a large carnivore. Violations may result in misdemeanor or felony convictions, community service work, the loss of privileges to own or possess any animal, and forfeiture of a large carnivore. Statute

Virginia Viilo sued the City of Milwaukee and two of its police officers under 42 U.S.C. § 1983 after an officer shot and killed her dog 'Bubba.' The district court denied the defendants' motion for summary judgment on the basis of qualified immunity and the defendants took an interlocutory appeal challenging this denial. The court found that defendants' interjection of factual disputes deprived the court of jurisdiction. The court further held that it is a violation of the Fourth Amendment for a police officer to shoot and kill a companion dog that poses no imminent danger while the dog’s owner is present and trying to assert custody over her pet.

The National Marine Fisheries Service (NMFS) authorized several states to kill California sea lions under section 120 of the Marine Mammal Protection Act (MMPA), which allows the intentional lethal taking of individually identifiable pinnipeds. Plaintiffs filed action for declaratory and injunctive relief against Defendants. The Court held that NMFS 1) did not adequately explain its finding that sea lions were having a “significant negative impact” on the decline or recovery of listed salmonid populations; and 2) NMFS did not adequately explain why a California sea lion predation rate of 1 percent would have a significant negative impact on the decline or recovery of these salmonid populations. Therefore, the agency's action was “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.” under the Administrative Procedure Act.

Code Ann., § 27-3-28 GA ST § 27-3-28 This Georgia states that except as otherwise provided in this Code, any person may lawfully possess native wildlife which have been accidentally killed by a motor vehicle. However, the person taking possession of a bear accidentally killed by a motor vehicle shall notify a law enforcement officer within 48 hours after taking possession of the bear; and this Code section shall not authorize any person to take possession of any animal of a species designated as a protected species under Article 5 of this chapter or under federal law. OH - Emergency - 4765.52 Provision of emergency medical services to dog or cat R.C. § 4765.52 OH ST § 4765.52 This Ohio statute specifies the emergency treatment that a medical technician or first responder could provide, prior to a dog or cat being transferred to a veterinarian for further treatment. The statute also highlights the immunities that medical responders, directors, and emergency medical service organizations have under the statute, unless they engage in an act or omission while providing medical services to a dog or cat, that constitutes willful or wanton misconduct. The statute also makes clear that a veterinarian who acts in good faith is not liable for any act or omission that occurred prior to the veterinarian providing services to the cat or dog. Statute

It first provides that any person may lawfully kill a dog if necessary to protect that person, another person or a domesticated animal during the course of a sudden, unprovoked assault. A person who owns or keeps a dangerous dog commits a civil violation for which the court shall adjudge a fine of not less than $250 and not more than $1,000. The dog may be ordered to be muzzled, or euthanized if it has killed, maimed or inflicted serious bodily injury upon a person or has a history of a prior assault. Notably, if a dog whose owner refuses or neglects to comply with the order wounds any person by a sudden assault or wounds or kills any domestic animal, the owner shall pay the person injured treble damages and costs to be recovered by a civil action. JACQUELINE CONRAD, Plaintiff–Appellant, v. SUSAN CATAPANO and JIM CATAPANO, Defendants–Respondents Not Reported in A.3d 2013 WL 673463 (N.J.Super.A.D.,2013)

Plaintiff was injured by defendants' dog after being knocked to the ground. The plaintiff had her dog over to defendants' house for a "doggie play date" and the dogs were running off-leash in the fenced yard.The lower court granted defendants' motion for summary judgment on plaintiff's claims of negligence and absolute liability, finding that the defendants had not prior knowledge of the dog's propensity to run into people. The Court found that there were genuine issues of material fact as to defendants' prior knowledge of the dog's proclivities to become "hyper" in the presence of other dogs. Thus, the decision to grant summary judgment was reversed and the matter remanded for trial. Notably, the Court did state that it shared "the motion judge's observation that plaintiff may well be comparatively at fault here for choosing to stand in the backyard while the three unleashed dogs ran around."

TX - Initiatives - Proposition 6, Right to hunt, fish and harvest wildlife Proposition 6 (2015)

This proposed constitutional amendment recognizes the right of the people to hunt, fish, and harvest wildlife subject to laws that promote wildlife conservation. It was a legislative referendum originally proposed as Senate Joint Resolution 22 (attached below). The measure passed in November 2015 with 82% of the vote.

Animal research and production facilities protection 720 I.L.C.S. 5/48-2 IL ST CH 720 § 5/48-2 This new law replaces the Illinois' Animal Research and Production Facilities Protection Act, which was repealed in 2013. Under the new law, it is unlawful for any person to release, steal, or injure an animal held at a facility; to damage or vandalize any property; to obtain access to an animal facility by false pretenses for the purpose of performing unauthorized acts; to enter into an animal facility with an intent to destroy, alter, duplicate, or obtain unauthorized possession of records; or to enter or remain on an animal facility with the intent to commit a prohibited act. Violation of any of these acts is a felony, with classification based on the amount of property damage. Statute
