Condominium resident filed a complaint alleging the housing authority violated the Federal Fair Housing Amendments Act by failing to waive the "no pets" as a reasonable accommodation for his handicap. The court held that where the primary handicap is mental or emotional in nature, an animal "must be peculiarly suited to ameliorate the unique problems of the mentally disabled," and granted the housing authority's motion for summary judgment on the issue of the housing authority's failure to make a reasonable accommodation under the FHA. |

In addition, Sec. 26-55-6 replaced 26-55-2 in 2012 (the rule on quadruped importation). Sec. 22-55-6 now divides animals into Categories 1 - 4 based on the dangerousness of the animal to people, whether it is an endangered or threatened species, and even the risk it poses to and the native environment. The rule then states that no person except certain entities like zoos, museums, USDA licensed exhibitors, and research facilities may possess Category One Wild Animals. In this Pennsylvania case, defendant was prosecuted for killing a cat that belonged to his neighbor. The section under which he was prosecuted prohibited the killing of a 'domestic animal of another person.' However, a cat was not one of the animals defined as a ‘domestic animal’ by the Act. Using rules of statutory interpretation, the court found that the omission of 'cat' from the listed species of the penal code provision was intentional by the legislature, and thus the defendant's sentence was discharged. |
