AZ - Pet Sales - Title 44. Trade and Commerce. Chapter 11. Regulations Concerning Particular Businesses. A. R. S. 44-1799 - 1799.11 AZ ST 44-1799 - 1799.11 This Arizona statutory section comprises the state's pet shop laws. The section requires that retail pet sellers provide purchasers a notice of rights that includes a statement of good health signed by a veterinarian. Purchasers have fifteen days to return unhealthy or diseased dogs and receive a refund or compensation for reasonable veterinary expenses. Statute
Minter-Smith v. Florida 864 So. 2d 1141 (Fla. 2003)

Defendant was convicted of unlawfully owning, possessing, keeping or training a dog or dogs with intent that such dog engage in dogfighting and he appealed. The Court of Criminal Appeals held that: (1) statute under which appellant was convicted was not unconstitutionally vague; (2) testimony of investigator was sufficient for jury to conclude that defendant was in violation of the statute that was not unconstitutional on ground that it was ex post facto as applied to defendant; (3) evidence as to poor conditions of dogs and their vicious propensities was relevant to issue of defendant's intent to fight the dogs; and (4) evidence gained by police officer pursuant to search warrant was not inadmissible. Affirmed.

Portillo v. Aiassa 32 Cal.Rptr.2d 755 (1994)

In this California case, the plaintiff delivered beer to Race Street Liquors.   As he was leaving the store, he was attacked by a German shepherd   owned by the tenant.   The jury found appellant-landlord did not have actual knowledge of the dog's dangerous propensities prior to renewing the commercial lease.   However, the jury found that he would have learned of the dog's dangerous propensities if he had exercised reasonable care in the inspection of his property and that he was negligent in failing to eliminate this dangerous condition.

State v. Peabody 343 Ga. App. 362, 807 S.E.2d 107 (2017) 2017 WL 4801538 (Ga. Ct. App. Oct. 25, 2017) This Georgia case involves a former police lieutenant who was indicted on two counts of aggravated cruelty to animals after he left his K-9 named Inka locked in his police vehicle while he attended to tasks inside his home. The dog died after being left inside the vehicle, which had all doors and windows closed with no A/C or ventilation running. The state appeals the trial court's grant of defendant's motion to quash the indictment. Specifically, the state argues that OCGA § 17-7-52 (a law that requires at least a 20-day notice prior to presentment of a proposed indictment to a grand jury when a peace officer is charged with a crime that occurred in the performance of his or her duties) is inapplicable. The state did not send defendant a copy of the proposed indictment before it presented the case to the grand jury. The state contends defendant "stepped aside" from his police-related duties and was therefore not afforded the protections of OCGA § 17-7-52. This court disagreed with that assessment. Since Peabody was responsible for the care and housing of Inka as her K-9 handler, leaving her unattended, albeit in an illegal manner, was still in performance of his police duties. As such, Peabody was entitled to the procedural protections of the statute according to the appellate court. The trial court's motion to quash his indictment was affirmed. Case
US - Wildlife - Disposal of Forfeited or Abandoned Property 1981 WL 150053 (F.R.)

The Service proposes regulations to dispose of property forfeited or abandoned to the United States under the provisions of 50 CFR Part 12. This property, which includes wildlife, plants, vehicles, vessels, aircraft, cargo, guns, nets, traps, and other equipment, would be separated into two types for disposal. All property, except wildlife and plants, would be disposed of under existing Service procedures, which are based on current Federal Property Management Regulations and Interior Property Management Regulations. Wildlife and plants, however, would be disposed of at the discretion of the Director by one of the following means: return to the wild, use by the Service or transfer to another government agency for official use, donation or loan, sale, or destruction.

This action would enable the Service to insure that wildlife and plants are disposed of in accordance with the conservation aims of the statute under which they were obtained while establishing an orderly, cost efficient disposal procedure. This procedure is needed both to eliminate unnecessary expense and overcrowding at government storage facilities and to provide a uniform means of satisfying the variety of possible uses of wildlife and plants which are ready for disposal.

R (on the application of Patterson) v. RSPCA EWHC 4531 The defendants had been convicted of a number of counts of animal cruelty in 2011, to include unnecessary suffering pursuant to Section 4, and participation in a blood sport under Section 8 of the Animal Welfare Act 2006. Mr Patterson was found to have breached an attached disqualification order under Section 34 of the Animal Welfare Act 2006, on which this appeal is based. The order covered all types of animals for a period of five years. This prohibited him from owning, keeping, participating in the keeping of, or being a party to an arrangement under which he would be entitled to control or influence the way in which animals are kept. A number of animals were found and seized at the home. The appeal was allowed on the basis that Mr Patterson was not entitled to control or influence the way in which the animals were kept by his wife on the facts. Case
Soucek v. Banham 524 N.W.2d 478 (Minn. App., 1994)

Dog owner brought action for damages against city and police officers that shot his dog, seeking punitive damages.  The court observed that under Minnesota law dogs are personal property, and thus, the proper measure of compensatory damages for destroying an animal is the fair market value of the animal.  The court further held Soucek cannot recover punitive damages for the loss of his pet because he only suffered property damage. Compensatory damages for the loss of Soucek's pet are limited to the fair market value of the animal.

Anderson v. Evans 371 F.3d 475 (9th Cir. 2004)

Advocacy groups challenged governments approval of quota for whale hunting by the Makah Indian Tribe.  The Court of Appeals held that in granting the quota, the government violated the NEPA by failing to prepare an impact statement, and, that the MMPA applied to the tribe's whale hunt.  REVERSED.

UK - Dangerous - Dangerous Wild Animals Act 1976 ("DWAA") 1976 c. 38

The Dangerous Wild Animals Act ("DWAA") was originally enacted in 1976 and amended in 2010. The act ensures that individuals who keep wild animals do so in a way that minimizes the risk to the public. In particular, the act provides that no person may keep any dangerous wild animal except under the authority of a licence granted by a local authority. The local authority that holds the licence may enter the premises where the animal is being kept at all reasonable times to determine whether an offence has been committed in violation of the act. Zoos, circuses, and pet shops are exempt from the act. The act has an accompanying Schedule that specifies the kinds of dangerous wild animals for which a person must obtain a licence under the act.
