Several wildlife organizations filed suit to challenge the FWS's Final Rule delisting the gray wolf Northern Rocky Mountain distinct population segment.  The case was put on hold pending the outcome of several other legal battles regarding the wolf's status on the Endangered Species List, during which gray wolf protections were reinstated.  Then, after Congress passed the 2011 fiscal year budget which contained a provision requiring the FWS to delist the Northern Rocky Mountain DPS, the court dismissed the case for lack of jurisdiction.

Birmingham Humane Society v. Dickson 661 So.2d 759 (Ala.,1994)

The owner of a lost dog found the dog in an animal shelter and asked for its return. The shelter gave it back but sterilized it first despite the owner's wishes that it not be sterilized. The court held the shelter owed a duty to give the dog back without sterilizing it and affirmed a finding of negligence.

Bozzi v. City of Jersey City 258 A.3d 1048 (N.J., 2021) 248 N.J. 274 (N.J., 2021) This New Jersey case considers whether owning a dog creates an objectively reasonable expectation of privacy such that the owner's personal information in the dog licensing record might be exempt from disclosure under the New Jersey Open Public Records Act (OPRA). Plaintiff Ernest Bozzi, a licensed home improvement contractor, submitted a request to the City of Jersey City (Jersey City) for dog license records to solicit customers for his invisible fencing business. He sought only the names and addresses of dog owners. Jersey City denied his request, objecting on the ground that such a disclosure would violate the dog owners’ reasonable expectation of privacy and that such a disclosure would place dog owners and non-dog owners a risk for theft (e.g., non-dog owners might be singled out for robbery or burglary). The lower court found no privacy interest in disclosing the names to comply with plaintiff's request and the Appellate Division affirmed that order. Upon Jersey City's petition for certification, the New Jersey Supreme Court affirmed that ruling, finding that owning a dog is "substantially a public endeavor in which people do not have a reasonable expectation of privacy." In arguments on appeal, Jersey City contended that disclosure for the purpose of commercial solicitation was protected by the privacy exception of OPRA. The Supreme Court noted that OPRA was designed to promote transparency in the operation of government. In looking at the state legislature's continuing process of amending OPRA, the Court found legislative history that declined against recommendations to withhold addresses or phone numbers in exceptions to the Act. Thus, the Court found that Jersey City has failed to present a colorable claim that disclosure of dog license records would encroach on dog owners' reasonable expectations of privacy. In looking at the OPRA privacy clauses, the Court concluded that owning a dog is "inherently, a public endeavor." In fact, dog owners continually expose themselves through social media, vet visits, public dog parks, bumper stickers, and the like, which militates against the activity being a private activity. While there are other aspects of dog licensing that may expose dog owners to a risk, like disclosure that a dog is a service animal or identifying the particular breed of the dog and exposing an owner to possible theft, the release of names and addresses does not rise to that concern. Scotland - Animal Welfare - 2003 Proposal 2003 Proposal, Protection of Animals (Scotland) Act 1912 For historical purposes only. Law has been repealed and/or replaced. The Scottish Executive (SE) issued a consultation paper on 21st March 2003 on proposals to amend the Protection of Animals (Scotland) Act 1912. These proposals were aimed at addressing the specific problem of the lack of statutory powers available to local authorities to remove neglected farm livestock, which are suffering or at risk of suffering, to a place of safely. The responses from a number of organisations to that paper have shown a clear desire for a much wider reform of our existing animal welfare legislation. Ministers now wish to consider expanding the proposed amendment to the Protection of Animals (Scotland) Act 1912 and to introduce wider legislation aimed at consolidating and updating much of the existing animal welfare legislation in Scotland. The purpose of any new legislation will be to prevent cruelty to any animal and to set out the obligations of people to promote the welfare of all animals (including domestic pets) for which they are either permanently or temporarily responsible. This will include owning, managing, or in any way keeping any animal, including buying, selling and transporting. Statute

FL - Miami-Dade County - Chapter 5 - ANIMALS AND FOWL. Sec. 5-1 - 5-25

This comprises Miami-Dade County, Florida's animal-related ordinances. Among the ordinances of note include a voluntary registration program for cats, minimum standards of care for kennels and pet dealers, and requirements for the humane trapping of dogs and cats. Most importantly, the county has a controversial breed specific ban on pit bull dogs that has been in place since 1990. Veterinary offices, kennels, commercial breeders, commercial animal establishments, pet shops, and dog grooming businesses are required to post conspicuous signs that inform residents of the ban.

Plaintiffs Center for Biological Diversity, Sierra Nevada Forest Protection Campaign, Sierra Club, John Muir Project, Natural Resources Defense Council and Defenders of Wildlife move for an award of attorney fees and costs pursuant to § 11(g)(4) of the Endangered Species Act (ESA), 16 USC § 1540(g)(4), in connection with their efforts to have the California spotted owl listed as endangered. The Court denied the Center's motion

for attorney fees because they failed to realize the goals of their lawsuit.

PetConnect Rescue, Inc. v. Salinas Not Reported in Fed. Supp., 2020 WL 2832468 (S.D. Cal. June 1, 2020) No. 20-CV-00527-H-KSC (S.D. Cal. June 1, 2020) PetConnect Rescue, Inc., Lucky Pup Dog Rescue.com and Sarah Gonzalez (“Plaintiffs”) alleged that the Defendants fraudulently represented dogs that the Defendants sold as rescue animals in order to circumvent California law prohibiting the sale of non-rescue dogs in pet stores. On April 6, 2020, Plaintiffs filed an amended complaint against the Defendants alleging trademark infringement and dilution under the Lanham Act, unfair business practices under California’s Unfair Competition Law (“UCL”) and violations of California’s Consumer Legal Remedies Act (“CLRA”), fraud, and accounting. Several Defendant filed motions to dismiss and to strike sections of the amended complaint. The United States District Court for the Southern District of California found that Plaintiff PetConnect alleged a cognizable injury in fact in that the Defendants’ use of an infringing mark harmed Plaintiff PetConnect Rescue’s reputation and caused consumer confusion. The Defendants’ Pet Connect Rescue, Inc. brokered the sale of dogs from puppy mills rather than rescue dogs which affected Plaintiff PetConnect’s reputation. The Court also found that Plaintiff PetConnect Rescue raised a claim within the Lanham Act’s zone of interests because the Lanham Act’s protections extended to non-profit organizations’ use of marks, even when those marks do not accompany a sale. The Court refused to dismiss Plaintiffs claims regarding trademark infringement. The Court also refused to dismiss the Plaintiff’s claims under the Lanham Act because the matter of whether Plaintiff’s mark was distinct and had acquired a secondary meaning was a matter more appropriate when the evidentiary record becomes further developed. As for the Unfair Competition claim, the Court found that the Plaintiffs had alleged sufficient facts to state a UCL violation. The Court subsequently rejected the Defendants’ motions to strike thirty-four lines or phrases from the amended complaint because Plaintiff’s use of the terms “puppy mill,” and the allegations that Defendants operate “fake” entities that “induce” purchases, reflected Plaintiff’s allegations of fraud and misrepresentation. The Court found that the Plaintiffs’ references were pertinent to the Plaintiff’s allegations. The Court ultimately denied each of the Defendant’s motions to dismiss and strike. Case
LA - Initiatives - Ballot Issue 1 (right to hunt) Ballot Issue 1 (2004) This Louisiana ballot measure amended the state constitution after it was resoundingly approved in November of 2004 (by 81% of voters). The measure was initiated by the state legislature in Senate Bill 2 and was sent to the electors of the state for a vote. The measure on the official ballot stated that citizens were to vote FOR or AGAINST to amend the Constitution of Louisiana with the following proposition: "To guarantee the right of every citizen to hunt, fish and trap, subject to regulation, restriction, or prohibition as provided by law.
