Western Watersheds Project v. Michael 353 F.Supp.3d 1176 (D. Wyo. 2018) Wyoming enacted statutes that imposed civil and criminal penalties for data collection on private land or when private land was crossed to reach public land without landowner permission. The pair of statutes (one criminal and one civil) prohibited individuals from entering “open land for the purpose of collecting resource data” without permission from the owner. The criminal statute imposed penalties that were stricter than Wyoming’s general trespass provision. The Plaintiffs, who were advocacy organizations, filed suit to challenge the statutes alleging that the statutes violated the Free Speech and Petition Clauses of the First Amendment, the Equal Protection Clause of the Fourteenth Amendment and that the statutes were preempted by federal law. The District Court found for the Plaintiffs on the free speech, petition, and equal protection claims, but did not feel that the Plaintiffs stated a preemption claim. Wyoming then amended the statutes and the Plaintiffs amended their complaint re-alleging free speech and equal protection claims. The district court found for the defendants on a motion to dismiss. The Plaintiffs then appealed. Both Plaintiffs and Defendants had filed cross motions for summary judgment. The Court granted the Plaintiffs’ Motion for Summary Judgment and denied Defendants’’ Motion for Summary Judgment. The Court ultimately found that the Wyoming statutes were facially unconstitutional and in violation of the First Amendment to the Constitution. The State of Wyoming was permanently enjoined from enforcing the statutes. Case

DC - Animal Control - Subchapter III. Release of Animals. DC CODE § 8-1831.01 DC ST § 8-1831.01 This D.C. law states that no animal shall be released from custody of animal protection except for the purposes of adoption, redemption by the owner of the animal, or other suitable placement in the best interest of the animal. No animals shall be knowingly released from any entity charged with animal protection for the purposes of research, experimentation, testing, or medical instruction or demonstration. The court affirmed a judgment of sentence entered following defendant's conditional plea of guilty to smuggling and to violating the Lacey Act. The court held that the district court properly denied defendant's Speedy Trial Act motion where defendant incorrectly computed the number of excludable days. Therefore, the court concluded that more than 120 non-excludable days did not elapse between the indictment and the trial.

WA - Equine Activity Liability - Chapter 4.24. Special Rights of Action and Special Immunities. West's RCWA 4.24.530 - 540 WA ST 4.24.530 - 540 This Washington section provides that an equine activity sponsor or an equine professional shall not be liable for an injury to or the death of a participant engaged in an equine activity, nor may he or she maintain an action against or recover from an equine activity sponsor or an equine professional for an injury to or the death while engaged in an equine activity. Liability is not limited by this statute where the equine professional knowingly provided faulty tack or equipment, failed to make reasonable and prudent efforts to determine the ability of the participant to engage safely in the equine activity, owns or otherwise is in lawful possession of the land or facilities upon which the participant sustained injuries because of a known, dangerous latent condition, or if he or she commits an act or omission that constitutes willful or wanton disregard for the safety of the participant or intentionally injures the participant. Prior to California's Force Fed Birds law—which bans the sale of products that are the result of force feeding birds to enlarge their livers beyond normal size—coming into effect, two non-California entities produced foie gras that was sold at a California restaurant. When the law came into effect, all three entities sought to enjoin the state of California from enforcing the law; they argued the law was unconstitutionally vague and violated the Commerce Clause of the U.S. Constitution. The district court, however, denied their motion for preliminary injunction. On appeal, the 9th Circuit affirmed the lower court’s decision to deny the preliminary injunction.

American Soc. for Prevention of Cruelty to Animals v. Feld Entertainment, Inc. 677 F.Supp.2d 55, 2009 WL 5159752 (D.D.C., 2009)

This opinion represents the nine-year culmination of litigation brought by plaintiff Tom Rider and Animal Protection Institute (API) against Defendant Feld Entertainment, Inc. (“FEI”) - the operator of Ringling Bros. and Barnum & Bailey traveling circus. Plaintiffs alleged that defendant's use of bullhooks and prolonged periods of chaining with respect to its circus elephants violates the Endangered Species Act, 16 U.S.C. § 1531, et seq. This Court held that plaintiffs failed to establish standing under Article III of the United States Constitution and entered judgment in favor of defendants. Since the Court concluded that plaintiffs lack standing, it did not reach the merits of plaintiffs' allegations that FEI “takes” its elephants in violation of Section 9 of the ESA.
