Southall v. Gabel 277 N.E.2d 230 (Ohio App. 1971) 28 Ohio App.2d 295 (1971)

This case resulted from the alleged negligent transport of a horse that resulted in a drastic change in the horse's temperament (to a "killer horse"), which ultimately led to its destruction by its owner.  Before trial, defendant demurred to plaintiff's petition on the ground that the action was barred under R.C. s 2305.11, the act being 'malpractice' and therefore required to be brought within one year after the termination of treatment.  The Court of Appeals held that the trial court's decision overruling the demurrer to plaintiff's petition was correct, 'the petitioner is based on negligence for the transporting rather than malpractice.'  Further, the Court held that until the Supreme Court speaks, veterinarians are not included in the definition of malpractice (reversed and remanded - See , 293 N.E.2d 891 (Ohio, Mun.,1972).

Specific powers enumerated West's RCWA 35.27.370 WA ST 35.27.370 This Washington statute provides that the council of said town shall have power to pass ordinances not in conflict with the Constitution and laws of this state, or of the United States. Specifically, the council may regulate, restrain, or prohibit the running at large of any and all domestic animals within the city limits, or any part or parts thereof, and to regulate the keeping of such animals within any part of the city; to establish, maintain and regulate a common pound for estrays, and to appoint a poundkeeper, who shall be paid out of the fines and fees imposed on, and collected from, the owners of any impounded stock. WV - Charleston - Chapter 10: Animals (Article IV. Urban Deer Management) Code of the City of Charleston, West Virginia § 10-171

This Charleston, West Virginia ordinance allows a person to hunt deer within city limits, but only upon certain conditions. For instance, a person must obtain a permit from the city, must hunt only with a bow and arrow, and must hunt only on certain tracts of land—amongst other things—in order to be compliant with these provisions. A violation of this ordinance is a misdemeanor and may result in fines ranging from $10 to $500, imprisonment for up to 30 days, or both. Additionally, a violation may suspend or revoke a person's hunting permit.

Bone v. Vill. Club, Inc. 223 F.Supp. 3d 1203 (M.D. Fla. 2016) This case dealt with a woman's request to have her emotional-support dog live with her before purchasing land in a mobile home community, known as Brookhaven. Prior to purchasing her lot, the plaintiff allegedly received permission from the president of Brookhaven's board of directors to keep her dog, even though the plaintiff was purchasing a lot in the "no pet" section of Brookhaven. The plaintiff provided the president of the board with the documentation requested, and the president told plaintiff she had been approved by the board to have her dog. Approximately one year after plaintiff purchased her lot, Brookhaven's attorney sent a letter requesting that plaintiff remove her dog, citing Brookhaven's policies disallowing her dog. After several letters sent back and forth between plaintiff's attorney and Brookhaven's attorney concerning requirements of the Fair Housing Act and the party's respective actions, both parties cross-moved for summary judgement. The court held that 1) genuine issue of material fact existed as to whether tenant had an actual disability; 2) landlord was not prejudiced by tenant's untimely disclosure of expert report; 3) genuine issue of material fact existed as to whether landlord constructively denied tenant an accommodation; and 4) genuine issue of material fact existed as to whether landlord retaliated against tenant for requesting a disability accommodation. Re Wildlife Protection Association of Australia Inc. and Minister for the Environment, Heritage and the Arts [2004] AATA 1383

The Minister for the Environment approved plans for the 'harvesting' of Kangaroos in South Australia, Western Australia and Queensland. The Tribunal found that the killing of joeys, where the mother was also killed, was sanctioned by the Model Code relating to kangaroos and that any licences issued under the plans authorised those killings. The Tribunal found that the likelihood of compliance with the code, which stipulated the manner of killing of kangaroos, would be in the range of 95-99%. The Tribunal approved each of the plans but made a recommendation that future plans should involve a greater element of public consultation.

NM - Wildlife - Article 15. Predatory Wild Animals and Rodent Pests NMSA 1978, § 77-15-1 to 77-15-14 NM ST §§ 77-15-1 to 77-15-14 The New Mexico County Predatory Control Act deals with predatory wild animals and rodent pests. On federal lands, the federal government pays for rodent pest repression. On public federal or state lands, the state and federal cooperative funds pay for rodent pest repression. On private land, rodent pest repression is based on voluntary cooperation of owners, but if the owner fails, after written notice, to destroy the prairie dogs, the state rodent inspector is authorized to enter the lands and destroy the prairie dogs at the expense of the owner. Any person who interferes with the rodent inspector is guilty of a misdemeanor punishable by a fine of $100 to $500. Statute
TX - Assault, sexual of animal - § 21.09. Bestiality V. T. C. A., Penal Code § 21.09 TX PENAL § 21.09 This law represents Texas' prohibition on bestiality, which was enacted in 2017. A person commits this offense if he or she engages in listed contact with an animal. Additionally, a person violates this law if he or she: possesses or provides an animal for such purpose; organizes, promotes or participates in such conduct; permits such conduct at premises under his or her control; engages in conduct listed described in the presence of a child younger than 18 years of age; or advertises, offers, or accepts the offer of an animal with the intent that the animal be used in this state for conduct described. Violation is a state jail felony unless the conduct is done in the presence of a child younger than 18 or the conduct results in serious bodily injury or death of the animal; the offense is a felony of the second degree in those cases. In Pine Bluffs, Arkansas, it is unlawful to keep any pit bull dog except as provided in section 54-3, with exceptions for pit bulls owned by local, state or federal agencies, used by law enforcement, or as a service animal by a handicapped or disabled person. Pit bulls must be registered, be vaccinated for rabies, be sterilized, and the owner must be at least 21 years old and keep liability insurance of $100,000. The dog must be properly confined with warning signs, and a leash and muzzle must be used.
