Ramapo v. Hi-Tor Animal Care Center, Inc. Judgment 10050423 (2010) This court was asked to determine whether a dog shoul be declared dangerous pursuant to section 108 (24) (a) of the Agriculture and Markets Law. The case is unusual in one aspect as the respondent is an animal shelter and the alleged victim is an animal control officer from another township. The Justice Court found the shelter dog was not 'Dangerous' pursuant to Agriculture and Markets Law. Interestingly, the court found the reasonable person standard in the statute to be problematic and in need of legislative amendment restoring in appropriate language the consideration of evidence of vicious propensity. Amons v. District of Columbia 231 F. Supp 2d. 109 (D.D.C. 2002) 2002 WL 31455095 (D.D.C.)

Plaintiff filed a Section 1983 action against D.C. police officers alleging, inter alia , intentional infliction of emotional distress for the unprovoked shooting of his dog inside his home.  The court found that the officers lacked probable cause for the warrantless entry into his home to make the arrest, the arresting officer made "an egregiously unlawful arrest," and the officers were unreasonable in shooting plaintiff's dog without provocation.

Defendant Flores appeals his conviction under Penal Code section 399 for allowing a " mischievous animal" owned by him to cause serious injury to another person. In this case, defendant's pit bull dog, "Blue,"attacked defendant's almost 90-year old neighbor on his own property causing deep injuries to his leg. Blue had been previously involved in three other incidents where he either tried to attack other dogs or acted aggressively toward other humans. As a result of these incidents, Sonoma County officials issued defendant a issued a potentially dangerous animal warning. On appeal, defendant argued that there was insufficient evidence that he acted without ordinary care in keeping his dog and that the victim-neighbor did not suffer a serious injury as defined by statute. The court found both of these arguments without merit. While defendant suggested that he acted with "ordinary care" by keeping the dog tethered and chained outside on the day of the incident, the court found the evidence showed Blue had broken free in the past and had "massive strength." Further, even though the potentially dangerous dog designation by the county did not mandate that Blue be kept inside or in a secure enclosure, the ordinance language provides this requirement. Leaving a dog with a history of unprovoked attacks chained next to a public sidewalk in a residential neighborhood supported the jury's conclusion that defendant did not act as reasonably careful person would in the same situation. As to the serious bodily injury claim, the court noted that although the law does not define the term, there was substantial medical evidence to support the jury's determination. Affirmed.

IN - Cattle Slaughter - SIKKIM PREVENTION OF COW SLAUGHTER ACT, 2017 17 of 2017 This law, specific to the North Eastern state of Sikkim, prohibits the slaughter of cows and their female progeny. 'Cows' under this Act refer to milking cows, dry cows, heifers and calves. Cows may not be slaughtered unless a certificate in writing is obtained from the Competent Authority. Persons slaughtering cows without obtaining a certificate shall be imprisoned and fined. Statute
IL - Police dog - Act 83. Police Service Dog Protection Act 510 I.L.C.S. 83/1 - 83/15 IL ST CH 510 § 83/1 - 83/15 This 2019 set of laws is known as the Police Service Dog Protection Act. It requires that the law enforcement agency or handler of the police dog shall be required to have every police dog receive, at minimum, an annual medical examination by a licensed veterinarian. Further, a vehicle transporting a police dog must be equipped with a heat sensor monitoring device that provides a visual and audible notification if the interior temperature reaches 85 degrees F as well as a safety mechanism to reduce the interior temperature. Holt v. City of Sauk Rapids 559 N.W.2d 444 1997 Minn. App. LEXIS 203 Sauk Rapids, Minnesota passed a city ordinance limiting the number of dogs that could be kept in a residential home. The appellants were dog owners, breeders, and Ms. Holt, who also rescued Newfoundland dogs help find new homes for them. The lower court held that the ordinances were unconstitutional, but the city appealed and on appeal the court reversed the finding. Minnesota law granted the municipality the authority to regulate public and private property, including regulating the keeping of dogs on residential property. City Hall received many complaints concerning dogs, so the Sauk Rapids ordinance was introduced by the mayor to address issues with dog odor and noise. Because limiting the number of dogs can reduce odor and noise, the court found that there was a rational relationship between the ordinance and reducing the problems associated with the dogs. The dog owners failed to show that the ordinance was unreasonable. The constitutionality was upheld because the ordinance was rationally related to the health, safety, and general welfare of the community as affected by dogs. Case
Canada - P.E.I. Statutes. Dog Act R.S.P.E.I. 1988, c. D-13 s.1 - 21

This set of laws comprises the Prince Edward Island (PEI) Dog Act. The Act provides that no owner of a dog shall allow his dog to run at large; any dog found at large shall be deemed to have been allowed to be at large by its owner. In addition, the owner of livestock or any enforcement officer authorized by the owner of livestock, may kill a dog that is killing or injuring the owner's livestock, except where the livestock is on property held under lease, license or permit by the owner of the dog. This Act also outlines licensing requirements for dogs as well as impoundment procedures.
