Lamare v. North Country Animal League 743 A.2d 598 (Vt. 1999)

Owners of a licensed dog that escaped while not wearing its tags filed an action against a local animal shelter that ultimately released the dog to others for adoption.  The court held that the town's actions fully complied with its animal control ordinance and that its ordinance provided ample notice to plaintiffs consistent with state law and due process requirements.

IN - Cattle Slaughter - DELHI AGRICULTURAL CATTLE PRESERVATION ACT, 1994 The Act, specific to the National Capital Region of Delhi, prohibits the slaughter of agricultural cattle such as cows, calves, bulls and bullocks. The Act bans the transport of cattle from Delhi to places outside Delhi for the purpose of slaughter. Persons who wish to export cattle must apply for a permit and submit an undertaking that the cattle shall not be slaughtered. The burden of proof is on the person who is accused under the Act of the slaughter, transport, export, sale, purchase or possession of flesh of agricultural cattle. Statute
State v. Amos 17 N.E.3d 9 (2017) 2014 -Ohio- 3097 After witnessing the 73 year old defendant-appellant emerge from area by the veterinary's dumpster holding an empty, wire cage animal trap, an employee of the clinic followed the defendant-appellant's car and obtained the vehicle's license plate number. Upon returning to the dumpster, the employee found a kitten with matted eyes that seemed unhealthy. The defendant-appellant was charged with one count of animal abandonment in violation of R.C. 959.01 and was found guilty. Defendant-appellant appealed her conviction and sentence on the grounds that the court erred in finding beyond a reasonable doubt that she was a keeper or, if she was a keeper, the court erred in determining that she abandoned the animal. The Ohio Court of Appeals held that once the defendant captured the animal in a cage, she assumed the responsibility that she would treat the animal humanely and could therefore be considered a “keeper.” Since Amos captured the animal and released it in another location without taking steps to make sure the animal would be found, the Ohio Court of Appeals also held that a reasonable person could have found beyond a reasonable doubt that the defendant-appellant had “abandoned” the animal. RI - Impound - § 4-13-15. Collaring of dogs--Impoundment and disposition of uncollared dogs Gen. Laws, 1956, § 4-13-15 RI ST § 4-13-15 This Rhode Island statute provides that every owner of a dog must collar his or her dog around its neck and distinctly marked with its owner's name and its registered number. Interestingly, it states that "any person" may cause any dog not so collared to be impounded in the public pound of the town or city where the dog is found. Further, if the dog is not claimed by its owner within a period of five days after the impoundment, the dog may be disposed of or destroyed. This statute also provides additional specific provisions for the towns of Glocester, West Warwick, and Exeter. Statute

Equine Activity Liability N.C.G.S.A. § 99E-1 to 99E-9 NC ST § 99E-1 to 99E-9 This act stipulates that an equine sponsor or equine professional, or any other person, including corporations and partnerships, are immune from liability for the death or injury of a participant, which resulted from the inherent risks of equine activities. New provisions added in 2013 now also protect a farm animal activity sponsor, a farm animal professional, or any other person engaged in a farm animal activity, including a corporation or partnership, shall not be liable for an injury to or the death of a participant resulting from the inherent risks of farm animal activities. However, there are exceptions to this rule: a person, corporation, or partnership will be held liable for injuries of an equine activity participant if he or she displays a willful and wanton or intentional disregard for the safety of the participant and if he or she fails to make reasonable and prudent efforts in ensuring the safety of the participant. COMMONWEALTH v. MASSINI 188 A.2d 816 (Pa.Super 1963) 200 Pa.Super. 257 (Pa.Super 1963)

In this Pennsylvania case, defendant was prosecuted for killing a cat that belonged to his neighbor. The section under which he was prosecuted prohibited the killing of a 'domestic animal of another person.' However, a cat was not one of the animals defined as a ‘domestic animal’ by the Act. Using rules of statutory interpretation, the court found that the omission of 'cat' from the listed species of the penal code provision was intentional by the legislature, and thus the defendant's sentence was discharged.

Dogs and cats are allowed in outdoor dining areas provided the dogs or cats are physically restrained and do not pass through the indoor area of the food establishment. All live animals, including pet cats and dogs, are not permitted to come into physical contact with any serving food, serving dishes, tableware, linens, utensils, or other food service items. Employees of a food establishment who prepare or handle food must not physically contact any live animals. Administrative
WI - Breeder - Chapter ATCP 16. Dog Sellers and Dog Facility Operators. WI ADC s ATCP 16.01 - 30 Wis. Adm. Code s ATCP 16.1 to 30 This set of administrative regulations from Wisconsin covers the conditions under which dogs must be kept by dog breeders (defined as any person who sells at least 25 dogs from more than 3 litters) and dog dealers. Dog sellers and dog facility operators are required to be licensed under the section. Per ATCP 16.18, a person licensed under this chapter may not transfer a dog to the buyer unless the dog is at least 7 weeks old, the dog is accompanied by its dam, or the department approves the transfer in writing.
