Defendant was a commercial fisherman and conditionally pled guilty to unlawfully acquiring and transporting halibut with market value of more than $350 and knowingly intending to sell illegally taken halibut in violation of Lacey Act after he exceeded the catch limits set by the Pacific Halibut Act. Defendant argued that the Lacey Act criminalized the same civil conduct regulated by the Halibut Act, thereby superseding that federal statute. The court disagreed, finding that the purpose of the Lacey Act was to strengthen existing wildlife laws where the underlying law did not specify exclusive control. |

Vilsack | 75 F.Supp.3d 83(D.D.C. 2014) | With the increase of sales over the Internet, the Department of Agriculture, through the Animal and Plant Health Inspection Service (“APHIS”), issued a new rule that redefined “retail pet store” to include online pet stores. Several breeders argued that the agency exceeded its statutory authority in issuing the new rule. The Secretary for the Department of Agriculture moved for summary judgment. Since APHIS acted within its authority in promulgating the rule and otherwise complied with the requirements of the Administrative Procedures Act, the Court granted summary judgment for the agency. | Case | |

Before January 1, 2017, an animal shelter shall establish a written veterinary care protocol for dogs and cats that is consistent with guidelines set forth in the most recent Association of Shelter Veterinarians' Guidelines for Standards of Care in Animal Shelters. That same date, an animal shelter must post on the animal shelter's Web site or in a conspicuous location within the animal shelter's facility a written protocol for reclaiming animals from the animal shelter that includes the minimum holding period for stray animals, the hours of operation, the fees for reclaiming an animal, and the documentation/identification required for reclaiming.
