De Leon v. Vornado Montehiedra Acquisition L.P. 166 F. Supp. 3d 171 (D.P.R. 2016) 2016 WL 814825 (D.P.R. 2016) The defendant in this case sought to dismiss plaintiff’s case, stating that the plaintiff claim did not have proper constitutional standing under the Americans with Disabilities Act (ADA). The court denied defendant’s request and held that plaintiff did present sufficient evidence to establish standing under the ADA. In order to establish standing, the plaintiff needed to prove three elements: (1) actual or threatened injury, (2) causal connection between the injury and the challenged conduct, and (3) that a favorable court decision can redress the injury. The court determined that plaintiff did satisfy all three elements by showing that plaintiff’s disabled daughter was not allowed in defendant’s shopping mall with her service dog after the mall security guard was not properly informed of protocol regarding service dogs. Ultimately, the security guard mistakenly believed that the service dog needed documentation in order to enter the mall; however, the dog was properly identified as a certified service dog and should have been allowed into the mall. Defendant's motion to dismiss was denied. Case
Crossroads Apartments Associates v. LeBoo 152 Misc.2d 830 (N.Y. 1991) Landlord brought an eviction proceeding against tenant with a history of mental illness for possession of a cat in his rental unit in violation of a no pets policy. Tenant alleged that he needed the cat to alleviate his "intense feelings of loneliness, anxiety, and depression, which are daily manifestations of his mental illness." The court held that in order to prove that the pet is necessary for the tenant to use and enjoy the dwelling, he must prove "that he has an emotional and psychological dependence on the cat which requires him to keep the cat in the apartment." The court denied the housing authority's motion for summary judgment, stating that there was a triable issue of fact as to whether the cat was necessary for the tenant to use and enjoy the dwelling. Douglas Furbee, et al. v. Gregory L. Wilson, et. al. 144 N.E.3d 801 (Ind. Ct. App. 2020) Shelly Linder lived in an apartment complex with a no-pet policy. Linder asked if she could have an emotional-support animal and provided a letter from a licensed family and marriage therapist, which stated that Linder had a disability and required an emotional-support animal to help alleviate her symptoms. The letter did not identify a specific disability and the landlord subsequently requested more information from Linder. Linder did not provide any additional information and instead brought her cat into her apartment as her emotional-support animal. The landlord charged Linder a fine after discovering the cat on the premises and gave her seven days in which to remove the cat. Linder failed to comply which led to Linder’s eviction. The Indiana Civil Rights Commission filed a complaint against the landlord on behalf of Linder in Delaware Circuit Court alleging that the landlord failed to accommodate her request for an emotional-support animal in turn violating the Indiana Fair Housing Act. The trial court denied summary judgment for the landlord and this appeal followed. The landlord conceded that Linder was disabled and requested a reasonable accommodation, however, the landlord argued that it was not given enough information from which to “meaningfully” review Linder’s request. The Delaware Court of Appeals agreed that the Landlord did not have sufficient information to meaningfully review Linder’s request and because Linder did not inform the Landlord about her disability and her need for the cat, she was acting in bad faith. The Court ultimately reversed and remanded the case to the trial court. Case
Kennedy House, Inc. v. Philadelphia Commission on Human Relations 143 A.3d 476 (Pa. Commw. Ct. July 11, 2016) 2016 WL 3667992 (Pa. Commw. Ct. July 11, 2016)

In this case, Kennedy House appealed the lower court’s decision in finding that it had violated Section 9–1108 of the Philadelphia Fair Practice Ordinance when it denied Jan Rubin’s request for a housing accommodation in the form of a waiver of its no-dog policy. Rubin applied for a housing accommodation at Kennedy House because she suffered from multiple physical aliments. In a meeting with Kennedy House, Rubin did state that her dog was not a trained service animal that helped with her physical and mobility issues but rather helped with reminding her to take medication and getting out of bed. The lower court determined that Rubin had satisfied her burden of proving that her dog was necessary in helping with her medical issues. After reviewing the lower court’s decision, the Commonwealth Court held that the lower court had erred in its decisions. Ultimately, the court found that because Ms. Rubin's physician described a disability related to her mobility, and there was no evidence establishing a nexus between her mobility-related needs and the requested assistance animal, Ms. Rubin did not meet her burden necessary for Kennedy House to waive its no-dog policy. As a result, the court reversed the lower court’s decision.

A kennel worker who was bitten by a dog while the dog was in the care of the kennel sued the owner of the dog under a theory of strict liability under a statute and under the common law. The court found that the dog owner was not liable to the kennel worker because under the "veterinarian's rule," the kennel owner had assumed the risk of being bitten by the dog.

Fry v. Napoleon Community Schools 137 S.Ct. 743 (U.S., 2017) 2017 WL 685533 (U.S., 2017)

The Individuals with Disabilities Education Act (IDEA) offers federal funds to States in exchange for “free appropriate public education” (FAPE) to children with certain disabilities. The Act also establishes formal administrative procedures for resolving disputes between parents and schools. When trained service dog, Wonder, attempted to join Plaintiff E.F. in kindergarten, officials at Ezra Eby Elementary School refused. Plaintiff E.F. is a child with severe cerebral palsy; Wonder assists her with various daily life activities. E.F.'s parents, Plaintiffs Stacy and Brent Fry, removed E.F. from the school and filed a complaint with the Department of Education's Office for Civil Rights (OCR). The Plaintiffs claimed that the exclusion of E.F.'s service dog violated her rights under Title II of the Americans with Disabilities Act (ADA) and § 504 of the Rehabilitation Act. OCR agreed, and school officials invited E.F. to return to the school. Yet, the Plaintiffs filed suit in federal court against the Defendants, Ezra Eby's local and regional school districts, and the principal, (collectively, the school districts). In the federal suit, Plaintiffs alleged that the Defendants violated Title II and § 504 and sought declaratory and monetary relief. The Defendant school districts filed a motion to dismiss. The United States District Court for the Eastern District of Michigan granted the motion. The Plaintiffs appealed to the United States Court of Appeals for the Sixth Circuit where the District Court's motion to dismiss was affirmed. Certiorari was granted. The Supreme Court of the United States vacated and remanded. The Supreme Court held that, on remand, the Appeals Court should: (1) establish whether (or to what extent) the plaintiff parents invoked the IDEA's dispute resolution process before bringing this suit; and (2) decide whether Plaintiffs' actions reveal that the gravamen of their complaint is indeed the denial of FAPE. The court reasoned that Exhaustion of the IDEA's administrative procedures is unnecessary where the gravamen of the Plaintiffs' suit is something other than the denial of the IDEA's core guarantee of a FAPE.

Chavez v. Aber 122 F. Supp. 3d 581 (W.D. Tex. 2015) 2015 WL 4724807 (W.D. Tex., 2015) Plaintiffs sought damages stemming from Defendants' refusal to accommodate Plaintiffs’ minor son's mental health disabilities by allowing Plaintiffs to keep a mixed-breed pit bull as an emotional support animal in their rented duplex. Plaintiffs asserted (1) housing discrimination under the Federal Housing Act (“FHA”), (2) unlawful retaliation under the FHA, (3) discrimination under the Texas Fair Housing Act (“TFHA”), and (4) unlawful retaliation under § 92.331 of the Texas Property Code. Defendants filed the Motion, seeking dismissal of the Complaint pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6). The court found Plaintiffs had adequately pleaded all claims and denied the Defendant’s motion to dismiss. Case
Storms v. Fred Meyer Stores, Inc. 120 P.3d 126 (Wash.App. Div. 1,2005) 129 Wash.App. 820; 31 NDLR P 98 (Wash.App. Div. 1,2005)

This Washington discrimination case was brought by a dog owner (Storms) with psychiatric conditions against a store and its managers who refused to allow her to stay in store with her alleged service dog. The dog was trained to  put herself between Storms and other people so as to keep an open area around Storms and alleviate her anxiety (a symptom of her post-traumatic stress syndrome). The appellate court found that there was sufficient evidence to establish a prima facie case of discrimination against Fred Meyer for refusing to allow her to shop accompanied by her dog. Testimony showed that Brandy had been specifically trained to help Storms with her particular disability by placing herself in between Storms and others in a way that alleviated her anxiety, which was further corroborated by testimony that Brandy engaged in such behavior. Thus, evidence showed that the defendants' violated RCW 49.60.215 by not allowing Storms to do her own shopping within the store because she was accompanied by a service animal.

Labor Commission v. FCS Community Management --- P.3d ----, 2024 WL 370160 (Utah App., 2024) 2024 UT App 14 This case concerns the Utah Anti-discrimination and Labor Division's (UALD) determination that a homeowner's association's three-month delay in responding to a member's request for reasonable accommodation to keep chickens on their property as assistance animals for a child with anxiety and PTSD violated the Utah Fair Housing Act. The trial court found that this three month delay was a constructive denial of the request, because under the Utah Fair Housing Act a housing provider must participate in an interactive process to evaluate and discuss the request for accommodation, and no such interactive dialogue or interactive process took place. On appeal, the court found that the three month delay in responding to the request was not unreasonably long, especially considering that the HOA had to review the status of chickens as support animals, chicken waste runoff, and possibility of rodent complaints during this time. The court of appeals also found that the members were not harmed by the HOA's alleged delay, since they were still allowed to keep the chickens at this time. The court of appeals then reversed the trial court's holding granting the members damages, fees, and other relief. Case
Labor Commission, Antidiscrimination and Labor Division v. FCS Community Management --- P.3d ----, 2024 WL 1203693 (Utah App., 2024) 2024 UT App 39 This is an appeal of a complaint filed by the Utah Anti-discrimination and Labor Division (ULAD) seeking review of the determination that an HOA violated members' request for reasonable accommodation by denying homeowner's the ability to keep chickens on their property. The chickens were intended to be assistance animals for the homeowner's daughter, who has anxiety and PTSD. The district court found that the HOA constructively denied the homeowner's request for reasonable accommodation by delaying their response to the request for three months. This court reversed the decision of the lower court, finding that there was no constructive denial of the request since the HOA allowed the homeowners to keep the chickens during the interim period, did not punish them for keeping the chickens, and ultimately granted the request to keep the chickens.
