Penal Code § 597 CA PENAL § 597 This statutes states that anyone who maliciously and intentionally maims, mutilates, tortures, or wounds a living animal, or maliciously and intentionally kills an animal, is guilty of an offense punishable by imprisonment in the state prison, or by a fine of not more than twenty thousand dollars ($ 20,000), or by both the fine and imprisonment, or, alternatively, by imprisonment in a county jail for not more than one year, or by a fine of not more than twenty thousand dollars ($ 20,000), or by both the fine and imprisonment. Importation, Introduction, and Transplantation of Wildlife MCA 87-5-701 to 87-5-725 MT ST 87-5-701 to 87-5-725 These Montana statutes control the importation, introduction, and transplantation of exotic wildlife into the state. The importation of any wildlife is prohibited unless the species poses no threat of harm to native wildlife and plants or to agricultural production and that the introduction has significant public benefits. SD - Exotic Pets - Chapter 12:68:18 Nondomestic Animal Control ARSD 12:68:18:01 - 09 SD ADC 12:68:18:01 to :09 Any person desiring to import nondomestic mammals into South Dakota for release to the wild to become free roaming nondomestic mammals must obtain an entry permit and obtain a certificate of veterinary inspection issued by a licensed veterinarian in the state of origin. Also, a permit is required to possess in South Dakota any nondomestic mammal, or any of its hybrids, of those of the order Carnivora, all nondomestic members of the Felidae, Canidae, Ursidae, Mustelidae, and Hyaenidae families; of the order Artiodactyla, all nondomestic members; of the order Perissodactyla, all nondomestic members of the order Tapiridae and Rhinocerotidae; of the order Proboscidea, African and Asian elephants; and of the order Primates. State Agencies § 22-344-32 - § 22-344-94 This Connecticut regulation lists the animals of which the exhibition, sale or offer for sale by a pet shop is prohibited. The condition in which commercial kennel facilities, pet shops, grooming facilities, training facilities, and animal shelters must be kept are described including sanitation, health requirements, ventilation, and other structural requirements. ANIMAL LEGAL DEFENSE FUND, a California corporation, CHIMPANZEE COLLABORATORY, SARAH BAECKLER, AMAZING ANIMAL ACTORS, INC., a Ca Plaintiffs assert in their complaint that defendants, individuals and companies who use non-human primates in television and movie productions, engage in physical and psychological abuse of chimpanzees. According to plaintiffs, the abuse has been going on for years and includes violent beatings with sticks and other implements. Plaintiffs raise their first cause of action under the federal Endangered Species Act, contending that defendant's harassment, beating, and brutalization of the chimpanzees constitutes a "taking" under the ESA. Plaintiffs also raise causes of action under California law for specific recovery of property (e.g., the primates), conversion, violations under the California Business Code, and violations under the cruelty provisions of the California Penal Code. WA - Exotic Pet - Chapter 16.30. Dangerous Wild Animals West's RCWA 16.30.005 - 900 WA ST 16.30.005 - 900 This Washington chapter passed in 2007 regulates the keeping of dangerous wild animals. By definition, a potentially dangerous wild animal includes, among others, lions, tigers, captive-bred cougars, jaguars, cheetahs, leopards, wolves, (but excluding wolf-hybrids), bears, hyenas, non-human primates, elephants, rhinoceroses, certain reptiles, and venomous snakes. A person shall not own, possess, keep, harbor, bring into the state, or have custody or control of a potentially dangerous wild animal. A person in legal possession of a potentially dangerous wild animal prior to July 22, 2007, and who is the legal possessor of the animal may keep possession of the animal for the remainder of the animal's life. People ex rel. Nonhuman Rights Project, Inc. v. Lavery 2014 WL 6802767 (N.Y. App. Div. Dec. 4, 2014) 2014 N.Y. Slip Op. 08531 This case is an appeal from a Supreme Court judgment denying petitioner's application for an order to show cause to commence a CPLR article 70 proceeding. At issue is the legal status of a chimpanzee named Tommy who is being kept on respondents' property. Petitioners filed a habeas corpus proceeding pursuant to CPLR article 70 on the ground that Tommy was being unlawfully detained by respondents. They offered support via affidavits of experts that chimpanzee have the requisite characteristics sufficient for a court to consider them "persons" to obtain personal autonomy and freedom from unlawful detention. The Court of Appeals here is presented with the novel question on whether a chimpanzee is a legal person entitled to the rights and protections afforded by the writ of habeas corpus. In rejecting this designation, the Court relied on the fact that chimpanzees cannot bear any legal responsibilities or social duties. As such, the Court found it "inappropriate to confer upon chimpanzees the legal rights . . . that have been afforded to human beings." Case
CT - Exotic Animals - Sec. 26-54-1. Wildlife pen specifications CT ADC § 26-54-1, CT ADC § 26-55-6 Regs. Conn. State Agencies § 26-54-1; Regs. Conn. State Agencies § 26-55-6 Connecticut regulation 26-54-1 gives the wildlife pen specifications for any bird or quadruped possessed under the provisions of section 26-54 or 26-55 of the General Statutes. In addition, Sec. 26-55-6 replaced 26-55-2 in 2012 (the rule on quadruped importation). Sec. 22-55-6 now divides animals into Categories 1 - 4 based on the dangerousness of the animal to people, whether it is an endangered or threatened species, and even the risk it poses to and the native environment. The rule then states that no person except certain entities like zoos, museums, USDA licensed exhibitors, and research facilities may possess Category One Wild Animals. Section 182.5 provides a list of native species listed as endangered, threatened, or of special concern. AFADA habeas corpus Cecilia EXPTE. NRO. P-72.254/15 “Abogados y Funcionarios de defensa Animal” (AFADA) brought a writ of habeas corpus on behalf of Cecilia, a 30 year old chimpanzee that lived in the Mendoza Zoo alleging that the chimpanzee had been illegitimately and arbitrarily deprived of her right to ambulatory freedom and right to have a dignified life on the part of authorities of the Zoo of the City of Mendoza, Argentina. The court granted habeas corpus to Cecilia, ruling that Cecilia was a living being with rights and instructing defendants to immediately free her and to relocate her to the Great Ape Project Sanctuary in Brazil. Until this moment, only humans illegally detained had been granted this writ. Case
