Booth v. State of Arizona 83 P.3d 61 (Ariz. 2004)

Motorist struck an elk lying on the side of the interstate highway and sued the state for negligence.  The Court held that the state could be held liable for negligence and that the jury finding that the state breached its duty to keep the highway safe was supported by the evidence.

Commonwealth v. Stefanowicz --- A.3d ---- 2024 WL 1918371, 2024 PA Super 90 (May 2, 2024) Appellant Stefanowicz appeals from the judgment entered in the Tioga County Court of Common Pleas in Pennsylvania. Appellant and his wife co-owned a deer farm ("Awesome Whitetails") where they are legally licensed to operate and sell trophy bucks which are kept in a fenced-in enclosure on their property. Appellant's neighbor, Ms. Smith, owned two German Shepherd dogs, which Appellant testified frequently entered his property and had previously harassed the animals he raises there. Appellant and his wife submitted a complaint to the state dog warden who then warned Smith of the statewide requirements on confining dogs. The warden also advised Appellant of the legal right to kill a dog that is “in the act of pursuing or wounding or killing” Appellant's animals. In fall of 2020, Smith's dogs entered Appellant's property and were chasing the deer from outside the fence. This deer began to panic, causing one to get stuck in the fence where one of the dogs then stared biting it. Appellant tried to yell at the dogs to no avail, so he then shot and killed the dogs. Appellant testified that one deer had a bloody gash, two more had bloody faces, and one deer died of a broken neck. Ultimately, Smith was sent a citation for failing to confine the dogs and Appellant was charged with two counts of Aggravated Cruelty to Animals and convicted of one of those counts. On appeal, Appellant raises several issues. The first two issues challenge the sufficiency of the evidence for the Aggravated Cruelty conviction. The court found sufficient evidence for the conviction as Appellant acted in an intentional manner to kill the dogs. Next, Appellant asserts that the verdict was against the weight of the evidence because of his legal defense. In Pennsylvania, it is legal to kill certain dogs in the act of pursuing or wounding "domestic animals" (which includes farm-raised deer). The trial judge here gave an instruction on the defense, but added that "under the laws of this Commonwealth, harassing an animal through a fence without any contact does not constitute pursuing, wounding, or killing an animal." Here, the jury heard that instruction and found the defense inapplicable for one dog. There was testimony from Appellant that he saw one of the two dogs biting a deer caught in the fence, not both dogs. Since the jury was free to evaluate the testimony and infer guilt, the reviewing court will not disturb the lower court's determination. After disposing of the remaining issues related to jury selection and ineffective assistance of counsel, the court affirmed Appellant's sentence.
Conservation Force, Inc. v. Manning 301 F.3d 985 (9th Cir. 2002)

This case questions whether Arizona's 10% cap on nonresident hunting of bull elk throughout the state and of antlered deer north of the Colorado River substantially affects commerce such that the dormant Commerce Clause applies to the regulation.  The Court that Arizona's cap on nonresident hunting substantially affects and discriminates against interstate commerce and therefore is subject to strict scrutiny under the dormant Commerce Clause. The case was remanded to determine the extent of Arizona's legitimate interests in regulating hunting to conserve its population of game and maintain recreational opportunities for its citizens. 

Hill v. Missouri Department of Conservation 550 S.W.3d 463 (Mo.2018) This case concerns the regulatory authority of the Missouri Conservation Commission ("Commission"), which has authority over the control, management, restoration, conservation, and regulation of the bird, fish, game, forestry and all wildlife resources of the state. The respondents in this case operate different selective breeding and private hunting facilities that rely on captive bred deer and elk (“cervids”). Respondent Hill co-owns the Oak Creek Whitetail Ranch which is a large hunting preserve and white-tailed deer breeding operation. Respondent Broadway owns a hunting preserve which offers three-day guided hunts of a variety of animals, including elk. Broadway also has a deer breeding operation. Respondent Grace owns a breeding facility for white-tailed deer, sika, and red deer. The respondents cannot operate their hunting preserves and captive breeding facilities without permits from the Missouri Department of Conservation, which all respondents have. Cervids can be infected with a fatal neurodegenerative disease known as chronic wasting disease (CWD). The first detection of the disease in Missouri was at Heartland Wildlife Ranches, which was eventually purchased by Respondent Broadway and renamed Winter Quarters Wildlife Ranch. Due to this, the Missouri Conservation Commission set up surveillance within 25 miles of the facility. From 2010 to 2013 the Commission found 10 free-ranging deer infected with CWD out of the 14,000 tested in the surveillance zone. Over the next three years the Commission detected CWD in 14 free-ranging deer, several of which were found near closed or currently operating captive cervid facilities. Attempting to eradicate CWD, the Commission proposed a series of regulatory amendments that were to take effect in January of 2015. The amendments were aimed at the captive cervid industry. The regulations relevant to this case banned the importation of cervids, imposed more rigorous fencing requirements, and imposed more rigorous recordkeeping and veterinary inspection requirements. Respondents brought an action suing the Appellants (the Missouri Conservation Commission) to prevent these regulations from going into effect. At trial, the circuit court declared that the regulations were invalid and enjoined the Commission from enforcing them. On appeal, the Commission raised three arguments. First, the Commission contends that the circuit court erred because Respondents’ cervids are “game” and “wildlife resources of the state” and, therefore, can be regulated by the Commission under the Missouri Constitution. Second, the Commission contends that the circuit court erred because the Commission’s authority to promulgate the regulations does not implicate or infringe on the Respondents’ rights to farm. Third, the Commission contends that the circuit court erred by enjoining the Commission’s enforcement of the new regulations against all people in Missouri, rather than only against the Respondents. The Respondents contend that captive cervids are not wildlife or game even though they are wild by nature because they are too domesticated and, therefore, akin to livestock. The Court rejects this contention and looks at the plain meaning of the terms “game” and “wildlife” and concludes that both terms plainly include all species that are wild by nature. The terms are not ambiguous. The Court points out that it would be unreasonable to hold that the Commission has constitutional authority to regulate individual cervids that are born free and still free-roaming but take away that authority when an individual cervid is considered domesticated. “The Court will not give a law a construction which would render it unreasonable when it is susceptible to a reasonable one.” Furthermore, historically, the term “game” was broad enough to embrace all kinds of deer whether tame or wild. Captive cervids are therefore considered “game” and “wildlife” and the Commission has authority under the Missouri Constitution to regulate Respondents’ captive cervids. Respondent’ second contention is that they own the captive cervids and, therefore, the cervids are not resources of the state. The Court rejects this contention. The Commission has always regulated deer and elk owned by private parties. The Court holds that the phrase “resources of the state” unambiguously refers to resources within the entire geographical boundaries of the state. Therefore, Respondents’ cervids are considered resources of the state. The Court agrees with the Commission’s second contention that the regulations did not infringe on Respondents’ right to farm. Respondents failed to show that they are engaged in farming and ranching practices and, therefore, cannot invoke the guarantee of the Missouri Constitution. The Court did not reach the Commission’s third contention. Ultimately the Court reversed the circuit court’s judgment in favor of Respondents and entered judgment in favor of Appellants on both counts.
Humane Soc. of U.S. v. Lujan 768 F.Supp. 360 (D.D.C.,1991)

This case was brought the Humane Society of the United States and various coalitions of homeowner/citizens against the United States Secretary of the Interior and the Director of the Fish and Wildlife Service to prevent the implementation of defendants' decision to permit limited public deer hunting on a national wildlife refuge in Fairfax County, Virginia. On cross motions for final judgment on the record, the District Court held that the suit under Endangered Species Act was precluded by failure to give proper presuit notice. The court stated that the ESA clearly states that “written notice” of the violation must be given to the Secretary and to the violator as a condition precedent to suit. The court also found that the FWS's decision took account of relevant factors and thus was not arbitrary or capricious.

Indiana Dept. of Natural Resources v. Whitetail Bluff, LLC 25 N.E.3d 218 (Ind. Ct. App. 2015) Appellee established a business that allowed for "high fence" hunting, which refers to hunting wild animals on property that is enclosed by a fence, of privately-owned whitetail deer. The pivotal question in this appeals case was whether the Indiana Department of Natural Resources (IDNR) was correct in asserting that the current statutory scheme prohibited this practice, and therefore allowed the agency to promulgate rules effectuating that prohibition. The Indiana Court of Appeals held that IDNR did not have the power to regulate fish and wildlife that were legally owned or held in captivity under a license. The IDNR therefore went beyond its express powers conferred upon it by the General Assembly when it promulgated rules that prohibited "high fence" hunting. The lower court's grant of summary judgment to the appellee was affirmed.
Lac Courte Oreilles Band of Lake Superior Chippewa Indians v. State of Wisconsin 740 F.Supp. 1400 (W.D.Wis. 1990)

Action was brought to determine Indian tribe members' rights related to off-reservation hunting of white-tailed deer, fisher and other furbearing animals, and small game within the area of the state ceded to the United States by the plaintiff tribes.  The Court held that Indians and non-Indians were each entitled to one half of game harvest within each harvesting area rather than as a whole territory to accommodate the longer Indian hunting season.  With regard to hunting on private land in the ceded area, the Court held that plaintiffs' members have no more rights than non-Indian hunters to hunt or to trap on private lands, as tribal members who are hunting or trapping on private lands are still subject to state hunting and trapping regulations.  The Court also held that the state could properly prohibit Indians from hunting deer during the summer and at night due to the safety risk to humans.

Leger v. Louisiana Dept. of Wildlife and Fisheries 306 So.2d 391 (La.App. 1975)

Alex Leger instituted this action against the Louisiana Wildlife and Fisheries Commission and Burton Angelle, in his capacity as Commissioner of the Louisiana Department of Wildlife and Fisheries, to recover damages for the loss of his 1973 sweet potato crop.  Leger's primary contention was that, since the State of Louisiana is the owner of all wild quadrupeds according to statute, it is legally responsible for damages done to his potato crop.  The court held that the statutory  language compels the conclusion that the state's ownership is in a sovereign, and not a proprietary, capacity.  Thus, the nature of the ownership is as a trustee and the management duties are carried out under police power authority.  The court found nothing in the cited statutes or in the law which indicates that the state has a duty to harbor wild birds or wild quadrupeds, to control their movements or to prevent them from damaging privately owned property.

McBride v. Orr 466 A.2d 952 (N.H., 1983)

In this New Hampshire case, defendant animal control officer killed plaintiff’s dog believing that it was in pursuit of a deer. Defendant claimed immunity pursuant to a state statute. The Court reversed and remanded for a determination of damages for the plaintiff. The Court went on to state that the purpose of the statute was not to authorize defendant’s killing of plaintiff’s dog when the dog was no longer pursuing the deer.

New Mexico State Game Commission v. Udall 410 F.2d 1197 (C.A.N.M. 1969)

The State of New Mexico filed an suit to prevent the U.S. Secretary of the Interior from killing deer in the Carlsbad Caverns National Park that were overbrowsing vegetation and posing a threat to the park's ecology without first having obtained the necessary state permit.  The Court held that the Secretary has the authority to kill the deer to protect the park property, and it is immaterial that the United States does not have exclusive jurisdiction over the lands within Carlsbad Caverns National Park as it has constitutional authority in the form of supervisory powers to manage national parks.  To New Mexico and the other states involved in an amicus capacity in the suit, the real concern was over the federal encroachment into state management of fish and game, particularly in those states where much of the land is under federal control.

Oak Creek Whitetail Ranch, L.L.C. v. Lange 326 S.W.3d 549 (Mo.App. E.D., 2010)

A Missouri statute places liability on a dog owner where such dog kills or maims a sheep or "other domestic animal" of another. On December 10, 2006, three dogs of Defendant Glendon Lange entered Oak Creek’s deer breeding farm and killed 21 of Oak Creek's "breeder deer." The Missouri Court of Appeals, Eastern District, disagreed with the trial court, finding that "domestic" should have been interpreted by the "plain meaning" of the word, which therefore includes Oak Creek’s breeder deer.

State v. Cleve 980 P.2d 23 (N.M. 1999)

Defendant was convicted of two counts of cruelty to animals, two counts of unlawful hunting, and negligent use of firearm. On appeal, the Supreme Court held that "any animal," within meaning of animal cruelty statute, applied only to domesticated animals and wild animals previously reduced to captivity, and thus, the animal cruelty statute did not apply to defendant's conduct in snaring two deer.  The court also held that even if the Legislature had intended to protect wild animals in Section 30-18-1, New Mexico's laws governing hunting and fishing preempt the application of Section 30-18-1 to the taking of deer by Cleve in this case.

State v. Cloutier 2003 ME 7 (Sup.Ct. Maine Jan. 21, 2003)

Defendant appealed from his conviction for "driving deer" under Maine statute § 7458(10) (among other convictions), contending that the statute was unconstitutionally vague.  The Court rejected defendant's argument, finding the version at issue here plainly tells people that if they participate in a group hunt and they organize or plan the hunt so that several people move in a coordinated fashion toward other members of the hunting party who by predesign are standing or moving toward the first group, in a planned effort to flush out the deer, they are hunting illegally.  With regard to the entrapment defense for the illegal transporting of deer, the Court found that although another hunter may have created the opportunity for Cloutier to commit the illegal transportation violation, "more is required for the entrapment defense than providing the opportunity to commit the crime." 

State v. Kuenzi 796 N.W.2d 222 (WI. App,, 2011)

Defendants Rory and Robby Kuenzi charged a herd of 30 to 40 deer with their snowmobiles, cruelly killing four by running them over, dragging them, and leaving one tied to a tree to die. The two men were charged with a Class I felony under Wisconsin § 951.02, which prohibits any person from “treat[ing] any animal ... in a cruel manner.” The Court concluded that the definition of “animal” included non-captive wild animals and rejected the defendants’ argument that they were engaged in “hunting.” The court reinstated the charges against the men.

State v. Long 991 P.2d 102 (Wash.App. Div. 2,2000)

Defendant shot and killed two hunting dogs, estimated to be worth $5,000 to $8,000 each, who were chasing deer across his property. The defendant was later convicted by the jury under the first degree malicious mischief felony for “knowingly and maliciously ... [causing] physical damage to the property of another in an amount exceeding one thousand five hundred dollars.”  On appeal, the court upheld the jury’s conviction because the defendant had no right to kill the dogs chasing deer across his property and because the prosecution was allowed to charge under the first degree malicious mischief felony for “knowingly and maliciously ... [causing] physical damage to the property of another in an amount exceeding one thousand five hundred dollars.”

State v. Reber 171 P.3d 406 (Utah 2007)

In this Utah case, the State sought review of the court of appeals' decision vacating the convictions of defendants. Reber was convicted of aiding or assisting in the wanton destruction of protected wildlife in violation of state law for killing a mule deer without a license or permit. On appeal, defendant contended that the state had no jurisdiction because he was an Indian hunting in Indian country. However, the court held that the State has jurisdiction over these defendants because the State has jurisdiction over crimes committed in Indian country when a non-Indian commits a victimless crime. Defendants are not Indians, as that term has been defined by federal law, and the crimes in these cases were victimless.

State v. Shook (Unpublished) 2002 WL 31894726

Defendant Shook (a non-tribal member) shot and killed a whitetail buck on private property within the exterior boundaries of the Flathead Indian Reservation. Under Wildlife and Parks Commission hunting regulations, big game hunting privileges on Indian Reservations are limited to tribal members only, thereby closing the hunting season to non-tribal members.  On appeal, Shook contended that the regulation was a violation of equal protection because it discriminated based on race.  The court disagreed, finding the classification was political rather than racial because it was established through treaty with the federal government and recognized the unique federal obligation toward Indians.  Thus, the court found the regulation was an "entirely rational" means to preserve wildlife populations for hunting by Indians. 

State v. Vander Houwen 177 P.3d 93 (Wash., 2008)

The owner of severely damaged orchards was convicted for shooting some of the responsible animals after repeated requests for state remedies were unsuccessful. The damage to defendant's orchard (with estimated losses of over $200,000 for future cherry production) occurred in 1998 and 1999, when herds of elk repeatedly came through inadequate fencing constructed by the State. The Supreme Court held that when a property owner charged with unlawful hunting or waste of wildlife presents sufficient evidence that he exercised his constitutional right to protect his property from destructive game, the burden shifts to the State to disprove this justification. In this case, the defendant was denied jury instructions regarding his constitutional right to reasonably protect his property.

State v. West Slip Copy, 2007 WL 2963990 (Table) (Iowa App.)

In this Iowa case, the defendant, West, shot his neighbor's dogs after the dogs were seen running the perimeter of his deer-pen, agitating 15 of his deer in the process. Defendant was subsequently convicted of two counts of animal abuse charges and fifth degree criminal mischief.  On appeal, West argued that the section 351.27 (a provision that allows a person to kill a dog caught in the act of worrying livestock) provides an absolute defense to the charges of animal abuse and that he had the right under the facts and this statute to summarily kill Piatak's dogs because they were worrying and chasing his deer. He also contended that the statute has no additional “reasonableness” requirement, and the trial court was incorrect to graft the “reasonably acting” standard from the animal abuse law. The appellate court agreed, finding that section 351.27 provides an absolute defense to a charge of animal abuse under section 717B.2.

U.S. v. Gardner 244 F.3d 784 (10th Cir. 2001)

Defendant first argues that the district court lacked jurisdiction because the government failed to plead and prove two essential jurisdictional elements for a 16 U.S.C. § 3372(a)(1) violation--namely, that Mr. Gardner was not an Indian and that the crime affected interstate commerce.  The court found the non- Indian status of the defendant is not an essential element of jurisdiction for a 16 U.S.C. § 3372 violation.  It is only necessary to plead and prove an interstate commerce nexus where § 3372(a)(2) is implicated.  The Court reverses because the jury instructions did not sufficiently instruct the jury as to how it should consider uncorroborated accomplice testimony.

Unified Sportsmen of Pennsylvania ex rel. their members v. Pennsylvania Game Com'n 03 A.2d 117 (Pa.Cmwlth., 2006)

A Pennsylvania association consisting of hunters and outdoorsmen and members of the association filed a complaint/request for writ of mandamus against the Pennsylvania Game Commission, Department of Conservation and Natural Resources (DCNR), and various state officials, seeking an order directing Commission and DCNR to provide the data and information on which the Commission relied in setting "harvest" figures for Pennsylvania's deer population. Before this Court in our original jurisdiction are the preliminary objections of the Pennsylvania Game Commission , the Pennsylvania Department of Conservation and Natural Resources, and certain Commonwealth officers (collectively, Respondents). The court first found that the Sportsmen indeed have standing, conferred both by statute and under the under the traditional substantial-direct-immediate test. However, Respondent Game Commission's demurrer was sustained, primarily because the court agreed that due to the ambiguous nature of Sportsmen's pleading, it is not possible to discern a legal theory to support the relief requested. Further, the court sustained Respondent's claim that the DCNR, its Secretary, and the state's Governor were not proper parties to association's suit. Despite these procedural defects, the court did not dismiss the Sportsmen's action, and instead allowed them to amend their complaint within 30 days of this order.

United States v. Kilpatrick 347 F.Supp.2d 693 (D. Neb. 2004)

Two hunters were convicted of violating the Lacey Act after they hunted on a federal wildlife refuge, killed a deer and transported the carcass out-of-state.  The trial court imposed sentences of probation and fines.  The District Court affirmed the conviction and sentences holding they were reasonable.
