|
Applies to a public place and limited to a blind person led by a guide dog. Those who refuse to permit a guide dog to accompany a blind person shall be guilty of misdemeanor with a maximum $50 fine.
Every totally or partially blind person who has a guide dog shall be entitled to full and equal access to all housing accommodations without being required to pay extra compensation for such guide dog. Person is liable for any damage done to the premises by such guide dog. |

|
A person commits the crime of interference with the rights of a physically or mentally challenged person if the person intentionally prevents or restricts a physically or mentally challenged person from being accompanied or assisted by a certified service animal, without an extra charge for the service animal, in a common carrier, place of public accommodation. Also has a provision for interference with the training of a service animal . Interference with the training of a service animal is a “violation.” |

|
The law states that, “Any person or entity that operates a public place shall not discriminate against individuals with disabilities who use service animals.” Exceptions if the animal place an undue burden or the animal poses a direct health threat, and a special provision for zoos. - intentional interference, harm, or killing service animal (class 6 felony)

If the service animal was killed or disabled, a person is liable:
- to the owner that owns the working or service animal for the replacement and training costs of the service animal and for any veterinary bills.
- to the owner that owns a service animal for the salary of the handler for the period of time that the handler's services are lost to the owner or agency.
- to the owner for the owner's contractual losses with the agency.

The driver of a vehicle approaching a legally blind pedestrian who is using a service animal shall yield the right-of-way and take reasonable precautions to avoid injury to the pedestrian and the service animal. Drivers shall take the same precautions with respect to pedestrians who have a disability other than blindness and their service animals. A driver who violates this subsection is liable for damages for any injury caused to the pedestrian or the service animal. |

Arkansas
|
Every visually handicapped, hearing impaired, or other physically disabled person shall have the right to be accompanied by a service animal in or upon any and all public ways, public places, and other public accommodations and housing accommodations prescribed shall not be required to pay any extra fee or charge for the service animal. |
Any person who kills or injures any service animal described in this section or any search and rescue dog shall make restitution to the owner of the animal. |

California
|
Every individual with a disability has the right to be accompanied by a guide dog, signal dog, or service dog, without being required to pay an extra charge. However, the individual shall be liable for any damage done to the premises or facilities by his or her dog.
It is a denial of equal access to housing accommodations to refuse to lease housing to an individual who uses an assistance dog.
Any person who denies or interferes with admittance to or enjoyment of the public facilities is liable for each offense for the actual damages and any amount as may be determined by a jury/court up to a maximum of three times the amount of actual damages but in no case less than one thousand dollars ($1,000), and attorney's fees as may be determined by the court.
Assistance dogs may be transported in a schoolbus when accompanied by disabled pupils enrolled in a public or private school or by disabled teachers.
Special provisions for zoos. |
It is unlawful and constitutes an infraction for any person to permit any dog to cause injury to or the death of any guide, signal, or service dog, while the service dog is in discharge of its duties. The defendant shall be ordered to make restitution to the disabled person who has custody or ownership of the service dog for any veterinary bills and replacement costs of the dog if it is disabled or killed.
Any person who intentionally causes injury to or the death of any service dog while the dog is in discharge of its duties, is guilty of a misd., punishable by up to 1 yr. jail and/or fine up to $5,000. The defendant shall be ordered to make restitution to the disabled person who has custody or ownership of the dog for any veterinary bills and replacement costs of the dog if it is disabled or killed.

A totally or partially blind pedestrian using a guide dog, shall have the right-of-way, and the driver of any vehicle approaching this pedestrian, who fails to yield the right-of-way, or to take all reasonably necessary precautions to avoid injury to this blind pedestrian, is guilty of a misd., punishable by 6 mo. jail or fine of $500 – 1,000.

Colorado
|
A person with a disability, including but not limited to a blind, visually impaired, deaf, hard of hearing, or otherwise physically disabled person, has the right to be accompanied by an assistance dog specially trained for that person without being required to pay an extra charge in public places.
An employer shall not refuse to permit an employee with a disability who is accompanied by an assistance dog to keep the employee's assistance dog with the employee at all times in the place of employment. |
Interference (beat, harass, intimidate, entice, distract, or otherwise interfere) with a guide dog is a class 3 misd.
Also, use of a blaze orange leash on a dog is a class 1 petty misd. |
A driver who approaches a person with an obvious disability (incl. use of a service dog) must come to a full stop to avoid accident (or face a class A traffic offense). |

|
Any blind, deaf or mobility impaired person or any person training a dog as a guide dog may travel on a train or on any other mode of public transportation, and may enter any other place of public accommodation without extra charge provided such dog shall be in the direct custody of such person and shall be wearing a harness or an orange-colored leash and collar.
A person who denies the rights of a person using a guide dog faces Class C misd.
Can also be a “discriminatory practice” which results in $25- 100 fine/30 days jail. |

|
An individual with a disability has the right to be accompanied by a service animal in all areas of a public accommodation that the public or customers are normally permitted to occupy.
- Documentation that the service animal is trained is not a precondition; place may ask if an animal is a service animal or what tasks the animal has been trained to perform.
- May not impose a deposit or surcharge for service, even if a deposit is routinely required for pets.
- An individual with a disability is liable for damage caused by a service animal if it is the regular policy for pet damages.
An individual with a disability who has a service animal entitled to full and equal access to all housing accommodations; such a person may not be required to pay extra compensation for the animal.

A person who, with reckless disregard, interferes with, or permits dog under her immediate control to interfere with, the use of a service animal by obstructing, intimidating, or otherwise jeopardizing the safety of the service animal or its user commits a misdemeanor of the second degree for the first offense and a misdemeanor of the first degree for each subsequent offense.
A person who, with reckless disregard, injures or kills, or permits a dog that he or she owns or is in the immediate control of to injure or kill, a service animal commits a misd. of the first degree.
A person who intentionally injures or kills, or permits a dog that he or she owns or is in the immediate control of to injure or kill, a service animal commits a felony of the third degree.
Person who is convicted of a violation of this section must make full restitution for all damages that arise out of or are related to the offense, including incidental and consequential damages. |
Whenever a pedestrian is in the process of crossing a public street or highway and the pedestrian is mobility-impaired using a guide dog or service animal, the driver shall bring his or her vehicle to a full stop before arriving at such intersection and, before proceeding, shall take such precautions as may be necessary to avoid injuring such pedestrian. |

Illinois
|
Under Guide Dog Access Act, neither the person nor the dog shall be denied the right of entry and use of facilities of any public place of accommodation if such dog is wearing a harness and such person presents credentials for inspection issued by a training school.
Applies to guide, signal, service dogs for physically handicapped and those prone to seizure.
Violation is a Class C misd.
Also separate White Cane Law that makes it a Class A misdemeanor to interfere with blind, hearing impaired, or person subject to epilepsy or seizure-disorder who uses service dog. |
Under Assistance Animal Damages Act can recover economic and non-economic for theft or unprovoked attack on the assistance animal.
Also, criminal penalty for interference/malicious injury to assistance animal. Results in Class A misd. if animal is not killed or totally disabled; Class 4 felony if animal is killed or disabled.
Also, a person may not willfully and maliciously permit a dog owned, harbored, or controlled by the person to cause injury to or death of a guide/hearing/support dog while the dog is in discharge of its duties. |
Place of public accommodation that refuses access because a person is accompanied by a guide dog commits a Class C infraction. Trainers of guide dogs are also entitled to public access under this law.
A person renting or leasing real property may not refuse to accept a person with a disability due to the fact that person uses a guide dog. |
A person who knowingly or intentionally:
- interferes with the actions of a service animal
- strikes, torments, injures, or otherwise mistreats a service animal
while the service animal is engaged in assisting an impaired person commits a Class A misdemeanor.
The action becomes a Class D felony if it results in:
- serious permanent disfigurement;
- unconsciousness;
- permanent or protracted loss or impairment of the function of a bodily member or organ; or
- death of the service animal.

|

Kansas
|
Every legally blind person shall have the right to be accompanied by a guide dog (the same applies to a hearing assistance dog, service dog, and professional therapy dog). Any person firm or corp. that interferes with this right is guilty of a misd. |
In 2006, inflicting harm, disability, or death on an assistance animal changed from a misd. to a nonperson felony. The penalty is a mandatory 30 days in jail (up to 1 year) during which the offender has a psych. evaluation. Also has fine of $500 – 5,000. |

The state has a procedure for verification of an assistance dog. (39-1111). If a question arises as to the qualifications of the dog, the person may produce a letter or identification card. Upon production, the person shall be allowed access.
It is a class A nonperson misd. for a person to misrepresent a right to be accompanied by an assistance dog.
The definitions include assistance dog, guide dog, service dog, hearing assistance dog, and professional therapy dog. |

|
Any person or denies full and equal accommodation to a person using an assistance dog shall be punished by a fine of not less than $250.
A person who willfully or maliciously interferes with an assistance dog can be fined not more than $1,000 and/or face 30 days in jail.

The driver of a vehicle approaching a deaf or blind person using a properly identified signal/guide dog shall take all necessary precautions to avoid injury to that person and the dog. A driver who fails to take such precautions is liable in damages for any injury caused to that person or dog. The failure of such a person to use a signal/guide dog does not constitute nor is it evidence of contributory negligence.

A person who fits a dog with a harness of the type commonly used by blind persons in order to represent that the dog is a guide dog commits a civil violation for which a fine of not more than $500.

Maryland
|
A person may not deny or interfere with the admittance of a service dog that accompanies a blind, visually impaired, deaf, hard of hearing, or mobility impaired person. Violation is a misdemeanor subject to a fine of up to $500.
Service animal trainers are also protected by law. |

If a person with a “dog guide” applies and the application is granted for a dog license, the license is issued without the payment of any fee and the clerk shall inscribe across the face of the license in red ink the words "dog guide". Massachusetts
|
Any blind person, or deaf or hearing handicapped person, or other physically handicapped person accompanied by a dog guide, shall be entitled to any and all accommodations, advantages, facilities and privileges of all public conveyances, public amusements and places of public accommodation, within the commonwealth, to which persons not accompanied by dogs are entitled without additional charge.
Such deprivation of rights shall be punished by a fine of up to $300 and damages of not less than $100. |
A person who uses an assistance animal, may bring an action for economic and non-economic damages against a person who steals or attacks the assistance animal. If resulted in the death of the animal or the animal is not returned or if injuries sustained prevent the assistance animal from returning to service, the measure of economic damages shall include the veterinary medical expenses and the replacement cost of an equally trained assistance animal, without regard to age/experience of the animal injured. |
The driver of every vehicle approaching the place where pedestrian using guide dog is crossing or attempting to cross shall bring vehicle to a full stop, and take such precautions as may be necessary to avoid injuring such pedestrian. Fine of $100 – 500. Failure to use guide dog or cane not contributory negligence. |
A person who owns an animal shall restrain and control such animal on a leash when in proximity to a guide dog that is on a public or private way. Violation is $100 – 500. |

Michigan
|
An owner or proprietor of a place of public accommodation who refuses to permit a person with a disability who is using a guide, leader, hearing, or service dog is guilty of a misd. if that dog is wearing a blaze orange harness, leash, or collar or service dog backpack and the person leading the dog has a picture identification card certifying training. |
Leader Dog Provision under the cruelty laws. The penalty for willful and malicious interference with guide dogs used by individuals defined by statute as blind, deaf, or physically limited is a misd. with a penalty of 90 days jail and/or a $500 fine. |
A driver who approaches a pedestrian using a guide dog without taking all necessary precautions to avoid accident or injury is liable for any injuries. |
A dog is not subject to licensing fees if it is used as a guide dog, hearing dog, or service dog for a physically disabled person.
A person, except a person who is deaf, audibly impaired, or otherwise physically limited shall not use or be in possession of a dog that is wearing a blaze orange leash and collar or harness in any public place. Violation is a misd. with a fine of not more than $10. |

|
A person who denies or interferes with admittance to or enjoyment of the public facilities or housing accommodations, or otherwise interferes with the rights of a totally or partially blind or otherwise disabled person is guilty of a misd.

Under cruelty law - No person shall intentionally and without justification cause bodily harm to a service animal while it is providing service or while it is in the custody of the person it serves. Penalty is a gross misd. unless there is death or great bodily harm to the companion animal, which increases penalty to up to 4 yr. jail and/or $10,000 fine. |
Any person operating a motor vehicle in this state shall bring such motor vehicle to a stop and give the right-of-way at any intersection of any street, avenue, alley or other public highway to a blind pedestrian who is using a guide dog. |

|
Anyone who denies or interferes with admittance to or enjoyment of the public facilities or otherwise interferes with a person using a guide/hearing dog shall be guilty of a misdemeanor with a of $100.00 or 60 days jail or both |
A person who willfully interferes with a guide/hearing/service dog or maliciously beats, harasses, injures, etc. faces a 90 day/ $500 misd. |
A totally or partially blind pedestrian or deaf person using a dog shall have all the rights and privileges of other pedestrians. The failure of a totally or partially blind person or deaf person to carry such a cane or to use such a guide dog or hearing ear dog on a blaze orange leash is not negligence per se. |

|
Every person with a visual, aural or physical disability shall have the right to be accompanied by a guide dog, hearing dog, or service dog without being required to pay an extra charge for dog; person shall be liable for any damage done by dog.
Any person who denies or interferes with admittance/enjoyment of public facilities or otherwise interferes with the rights of blind/deaf/physically disabled person guilty of a class B misd.

Any person who knowingly, intentionally, or recklessly causes substantial physical injury to or the death of a service dog is guilty of a class A misd.
Any person who knowingly or intentionally fails to exercise sufficient control over an animal to prevent the animal from causing the substantial physical injury to or death of a service dog, or inability to function as a service dog as a result of the animal's attacking, chasing, or harassing the service dog is guilty of a class A misd. If the other animal temporarily interferes with service dog’s function – class B misd.
Any person who harasses or chases a dog known to be a service dog is guilty of a class B misd.
An owner of a service dog or a person with a disability who uses a service dog may file a cause of action to recover civil damages. |
The driver of a vehicle approaching a person with a visual, aural or physical disability using a guide dog, hearing dog or service dog shall yield to such pedestrian, and any driver who fails to take such precautions shall be liable in damages for any injury caused such pedestrian and any injury caused to the pedestrian's guide dog, hearing dog or service dog.

Any person who knowingly impersonates a person with a disability for the purpose of receiving the accommodations regarding service dogs is guilty of a class C misd. and shall also be civilly liable for the amount of any actual damages resulting from such impersonation. Any second or subsequent violation is a class B misd. |

Any person who denies or interferes with admittance to or enjoyment of the public facilities or otherwise interferes with person using service dog is guilty of a misd. |

A driver must come to a full stop and take such precautions before proceeding as may be necessary to avoid accident or injury to such blind person using a guide dog. A driver or pedestrian who fails to take such precautions is liable for any injury caused. Failure to use guide dog/cane not contributory negligence. Also a misd. with $25 fine. |

Nebraska
|
|
Violence on a service dog (intentionally injures, harasses, or threatens or attempts to injure or harass) or interference (intentionally acts/attempts to impede, threaten, interfere) with a service dog is a Class III misd. |
A driver commits the offense of failing to observe a blind person if he or she fails to give special consideration to the user of a cane or guide dog. It is a Class III misd. |
No license tax shall be charged upon a showing by the owner that the dog is a graduate of a recognized training school for dog guides, hearing aid dogs, or service dogs.
Unlawful use of a guide dog is a Class III misd. |

Nevada
|
A landlord may not refuse to rent to a person with a disability solely because a service animal will be residing with the prospective tenant who has a disability.
It is an unlawful employment practice for an employer, directly or indirectly, to refuse to permit an employee with a disability to keep his service animal with him at all times in his place of employment.
It is unlawful for a place of public accommodation to refuse admittance or service to a person with a disability because he is accompanied by a service animal. A person who violates this section is civilly liable for actual damages, punitive damages up to $750, and attorney fees.
Similar provision for public transportation.

Interference with a service animal is a gross misd.
To wilfully and maliciously beat a service animal is a category E felony.
To willfully and maliciously kill a service animal is a category D felony.
In addition to any other penalty, the court shall order a person convicted to pay restitution for any veterinary bills or for the replacement cost of the service animal if it was killed or disabled or has become mentally or physically unable to perform its duties. The restitution must cover all costs for aides, assistance, transportation and other hardships incurred during the absence, and until the replacement, of the service animal.
It is also a misd. with same restitution order to allow a dog or other animal to cause injury or death to a service animal. Person who injures the service animal or allows her animal to injure the service animal is also civilly liable with actual damages, punitive damages up to $750, and attorney fees. |
Any pedestrian who approaches a blind person using a service animal shall immediately come to a full stop and take such precautions before proceeding as may be necessary to avoid accident or injury to the blind person. Failure to do so is a misd.
Under another provision, any driver of a vehicle who approaches or encounters such a blind person using a guide dog shall yield the right-of-way, come to a full stop, if necessary, and take precautions before proceeding to avoid accident or injury to the blind person. Violation is a misd. of up to 6 mo. jail and/or fine of $100 – 500. |
A person convicted of fraudulently misrepresenting an animal as a service animal is guilty of a misd. and shall be punished by a fine of not more than $500. |

Every totally or partially blind person shall have the right to be accompanied in such facilities by a guide dog, without being required to pay an extra charge for the guide dog; such person shall be liable for any damage done to the premises by such dog.
It is lawful for any hearing ear dog, guide dog, or service dog to accompany his deaf or hearing impaired, blind or visually impaired, or mobility impaired master into any public facility, housing accommodation, or place of public accommodation to which the general public is invited
Any person violating any provision of this chapter shall be guilty of a misd. |
Any person who purposely tortures, beats, kicks, strikes, mutilates, injures, or disables a service dog, or who purposely causes the death of a service dog shall be guilty of a class A misd. |
The driver of a vehicle approaching a deaf or hearing impaired person using a properly identified hearing ear dog shall take all necessary precautions to avoid injury to that person, and any driver who fails to take such precautions shall be liable in damages for any injury caused to that person.

In cases of emergency, it shall be the policy of the state that service animals shall not be separated from the persons they serve. Every effort shall be made to keep service animals and the persons they serve together.
A hearing ear shall have a leash and harness colored international orange.
A guide dog shall have a leash and harness designed specifically for this purpose.
A service dog shall have a leash colored blue and yellow.
It is unlawful for any person to fit a dog with a collar, leash, or harness of the type which represents that the dog is a hearing ear dog, guide dog, or service dog, if in fact said dog is not and to misrepresent the physical status of said person.

Any person with a disability accompanied by a service or guide dog is entitled, with his dog, to the full and equal enjoyment, advantages, facilities and privileges of all public facilities.
Unless it can be clearly shown that a person's disability would prevent such person from performing a particular job, it is an unlawful employment practice to deny to an otherwise qualified person with a disability the opportunity to obtain or maintain employment, or to advance in position in his job, solely because such person is a person with a disability or because such person is accompanied by a service or guide dog.
A person with a disability who has a service or guide dog, shall be entitled to full and equal access to all housing accommodations and shall not be required to pay extra compensation for such service or guide dog.

A person convicted under this section may be ordered to pay restitution, including the cost of veterinary bills and replacement and training costs of a qualified assistance animal, if such costs are incurred as a result of the violation. |

A disabled person whose guide, hearing or service dog is injured due to the negligence of the owner of another dog may recover damages including veterinarian fees, the cost of retraining or replacing the guide, hearing or service dog, and lost wages or damages due to loss of mobility incurred while retraining or replacement is taking place.
Under another provision, it is unlawful for the owner or custodian of any dog to fail to exercise due diligence in handling his or her dog if the handling results in harm to another dog that is a guide, hearing or service dog.
The owner of a dog who, through any act or omission, negligently permits his or her dog to bite a person, service dog, guide dog or hearing dog causing physical injury shall be subject to a civil penalty not to exceed $400 in addition to any other applicable penalties.

|
A deaf/blind person shall have the right to have a dog guide/hearing dog in any place of public accommodation or on any mode of transportation so long as the deaf/blind person or trainer controls the behavior of the dog. Violation is a Class C misdemeanor.
A landlord may not refuse to rent a dwelling unit to a deaf/blind person on the basis of the person's use or possession of a dog guide/hearing dog.
A deaf or blind person shall have a cause of action to recover compensatory damages or $200, whichever is greater, from any landlord who refuses to rent a dwelling unit, or who charges additional rent, on the basis of the person's use or possession of a dog guide/hearing dog. The court may award reasonable attorney fees to the prevailing party in an action under this section.
A landlord shall not refuse to rent a dwelling unit to a physically impaired person on the basis of the person's use or possession of an assistance animal. |
A physically impaired person who uses/owns an assistance animal may bring an action for economic and noneconomic damages against any person who steals or, without provocation, attacks the assistance animal. The physically impaired person or owner may also bring an action for such damages against the owner of any animal that, without provocation, attacks an assistance animal.
If the theft of or unprovoked attack on an assistance animal results in the death of the animal or the animal is not returned or if injuries prevent the animal from returning to service as an assistance animal, the measure of economic damages shall include the replacement value of an equally trained assistance animal. Physically impaired person/owner may recover any other costs and expenses, including costs of temporary replacement assistance services.

No license fee shall be required to be paid for any dog kept by a blind person who uses it as a guide. A license shall be issued for such dog upon the blind person's filing of an affidavit with the county showing that the dog qualifies for exemption. |

|
State policy declares that individuals who use guide or support animals should be employed to fullest capabilities. Also right to be free from discrimination in employment, housing, and public accommodation.
A person is guilty of a summary offense if he or she denies use of public accommodation to person using guide, signal, or service dog. |
A person commits a misd. of the second degree if he willfully and maliciously harasses, annoys, injures (or attempts to do those ) a dog guide for an individual who is blind/deaf/physically limited. Any person convicted of violating these provisions shall be sentenced to pay a fine of not less than $500.
A person commits a felony of the third degree if he willfully and maliciously kills, maims, mutilates, tortures or disfigures a dog guide/hearing dog/service dog. That person, in addition to any other applicable penalty, liable for veterinary costs in treating the dog and, if necessary, the cost of obtaining and training a replacement dog. Also, a fine of not less than $1,000 and/or 2yrs. jail. The court may also order a presentence mental evaluation. A subsequent conviction is a felony of the third degree.

The privilege of access and transportation provided to personal assistance animals is extended to family therapy pets that on are the way to actively participating in a program. |
If any dog kills, wounds, or worries, or assists in killing, wounding, or worrying, any seeing-eye dog under harness or engaged in the act of guiding its owner, the owner or keeper of the dog shall be liable to the person for double all damages sustained, to be recovered in a civil action, with costs of suit. If after this damage is done by that dog, the owner or keeper of the dog shall pay to the party aggrieved treble damages, to be recovered in the same manner, and an order shall be made by the court before whom the second recovery is made, for killing the dog.

It is unlawful for a person with reckless disregard to allow his dog that is not contained by a fence, a leash, or another containment system to interfere with the use of a guide dog/service animal by obstructing, intimidating, or otherwise jeopardizing the safety of the guide dog or service animal or its user.
A person who violates this is guilty of a misdemeanor triable in magistrate's court and, upon conviction, is subject to the maximum fines and terms of imprisonment in magistrate's court.
It is unlawful for a person with reckless disregard to injure, disable, or cause the death of a guide dog or service animal. It is unlawful for a person with reckless disregard to allow his dog to injure, disable, or cause the death of a guide dog or service animal.
Violation of this is a misd. with a fine of up to $2,500 and/or 6 mo. jail.
It is unlawful for a person to wrongfully obtain or exert unauthorized control over a guide dog or service animal with the intent to deprive the guide dog or service animal user of his guide dog or service animal. Violation is a misd. with a fine up to $2,000 and/or 1 year jail.
Full restitution for damages including incidental and consequential expenses include: replacement costs; medical expenses of the guide dog; re-training; lost wages. |
Driver of a vehicle approaching a partially or totally blind pedestrian using a white cane or assistance dog shall take all necessary precautions to avoid injury. Failure to do so makes driver liable for any injury. |

No proprietor, employee, or other person in charge in any place of public accommodation shall refuse to permit a blind, physically disabled, deaf or hard of hearing to enter or make use of the place by reason that the person is being led or accompanied by a guide dog provided that the dog is on a harness and leash; the person must also present training credentials. Violation is a Class C misd. |
If a person's guide dog is killed or sustains injuries that result in death or permanent disability caused by the unlawful and intentional, or negligent, act of another or the animal of another, then the trier of fact may find the actor liable for economic damages including both the cost of the guide dog as well as the cost of any specialized training the guide dog received.
A person who intentionally or knowingly unlawfully injures the guide dog of another, permanently depriving the owner of use of the guide dog's services commits theft of that animal. In determining the value of the guide dog, the court shall consider the value of the guide dog as both the cost of the dog as well as the cost of any specialized training the guide dog received.

A state employee who is a person with a disability is entitled to a leave of absence without a deduction in salary for the purpose of attending a training program to acquaint the employee with an assistance dog to be used by the employee.
No common carrier or other public conveyance or mode of transportation may refuse a person with a disability solely because of the person's disability, nor may he/she be required to pay an additional fare because of his/her use of an assistance animal.
No person with a disability may be denied admittance to any public because of the use an assistance animal.
An offense under this subsection is a misdemeanor punishable by a fine of not less than $300 or more than $1,000. |
A person may not assault, harass, interfere with, kill, or injure in any way, or attempt to assault, harass, interfere with, kill, or injure in any way, an assistance animal.
A person commits an offense if the person intentionally, knowingly, or recklessly attacks, injures, or kills an assistance animal, or permits an animal owned or in the custody of the actor to attack, injure, or kill an assistance animal and, as a result, the assistance animal is attacked, injured, or killed.
An offense under this section is a Class A misd. if the actor or an animal owned by/in custody of the actor attacks an assistance animal.
Offense is a “state jail felony” if the actor or animal owned/kept injures an assistance animal.
Felony of the third degree if the actor or an animal owned kills an assistance animal.
(A court shall order a defendant convicted of an offense here to make restitution to the owner of the assistance animal for replacement, re-training, and veterinary bills.)

The driver of a vehicle approaching an intersection or crosswalk where a pedestrian guided by an assistance animal is crossing or attempting to cross shall take necessary precautions to avoid injuring or endangering the pedestrian. The driver shall bring the vehicle to a full stop if injury or danger can be avoided only by that action. A person who violates this section commits a Class C misdemeanor. Failure to use an assistance animal/cane is not contributory negligence. |
A person who uses an assistance animal with a harness or leash of the type commonly used by persons with disabilities who use trained animals, in order to represent that his or her animal is a specially trained assistance animal, is guilty of a misdemeanor and on conviction shall be punished by a fine of not more than $200. |

Any person with a disability who has rights infringed can go to court to:
- enjoin the abridgement of rights;
- seek affirmative equitable relief as is appropriate
- and seek compensatory damages with reas. attorney fee to prevailing party. Compensatory damages shall not include damages for pain and suffering.

Whenever a totally or partially blind pedestrian crossing a highway is guided by a dog guide, the driver of every vehicle approaching the intersection shall bring his vehicle to a full stop before arriving at such intersection. Any person violating any provision of this section shall be guilty of a Class 3 misd.
The failure of such totally or partially blind or otherwise incapacitated person to be guided by a guide dog shall not be held to constitute to be evidence of contributory negligence.

Any person who, with reckless disregard, allows his or her dog to injure, disable, or cause the death of a dog guide or service animal is guilty of a gross misd.
Any person who intentionally injures, disables, or causes the death of a dog guide or service animal is guilty of a class C felony.
Any person who wrongfully obtains or exerts unauthorized control over a dog guide or service animal with the intent to deprive the dog guide or service animal user of his or her dog guide or service animal is guilty of theft in the first degree.
Violation includes full restitution for all damages, including incidental and consequential expenses.
A person who negligently or maliciously kills or injures a dog guide/service animal is liable for a penalty of $1,000 in addition to other remedies/penalties, civil or criminal.
A user or owner of a dog guide or service animal, whose animal is negligently or maliciously injured or killed, is entitled to recover reasonable attorneys' fees and costs incurred in pursuing any civil remedy

No head tax may be levied against any guide or support dog especially trained for the purpose of serving as a guide, leader, listener or support for a blind person, deaf person or a person who is physically or mentally disabled because of any neurological, muscular, skeletal or psychological disorder that causes weakness or inability to perform any function. |

No person may refuse to permit entrance into, or use of, any public place of accommodation to person with a disability or to service animal trainer because of service animal.
A person may exclude a service animal from a public place of accommodation or amusement if accommodation of the service animal would result in a fundamental alteration in the nature of the accommodations, amusement, goods, or services provided or would jeopardize the safe operation of the public place. If a service animal must be separated from the person whom the service animal is accompanying, it is the responsibility of that person to arrange for the care and supervision of the service animal during the period of separation. |

An operator of a vehicle shall stop the vehicle before approaching closer than 10 feet to a pedestrian who is using a service animal and shall take such precautions as may be necessary to avoid accident or injury to the pedestrian. The fact that the pedestrian may be violating any of the laws applicable to pedestrians does not relieve the operator of a vehicle from the duties imposed by this subsection. The failure of such totally or partially blind pedestrian to carry such cane or walking stick or to use a service animal be evidence of any negligence. |

Wyoming

Any blind, visually impaired, deaf, hearing impaired person or other person with a disability may be accompanied by a service dog in any of the places listed of this section without paying an extra charge for the service dog. Also, person shall not be discriminated against in the leasing of residential property because the person has a service dog, but is liable for any damage done to the premises by the dog. |
Any person who knowingly, willfully and without lawful cause or justification inflicts, or permits or directs any animal under his control or ownership to inflict, serious bodily harm, permanent disability or death upon any service dog is guilty of a misd. with jail up to 6 months and/or fine up to $750. A court shall order restitution that includes related veterinary or medical bills, replacement or re-training of the dog, and any other expense reasonably incurred as a result of the offense |
The driver of a vehicle approaching a blind, partially blind, deaf, or hearing impaired pedestrian using a cane or guide dog shall take all necessary precautions to avoid injury. Any driver who fails to do so is liable for any injury. |
