RI - Lien - § 34-48-1. Lien on animals for their keep--Transfer of abandoned animals This Rhode Island law states that when an agreement has been made between the owner of any animals regarding the price of keeping, the animals shall be subject to a lien for the price of the keeping in favor of the person keeping the animals. The person may detain the animals until the debt is paid and, if not paid within 30 days, he or she may sell the animals at public auction after giving written notice to the owner of the time and place of the sale at least six days before the sale. Additionally, a kennel, as defined in § 4-19-2, or a veterinary hospital which boards or grooms animals for nonmedical purposes, may transfer any abandoned animal in its custody to a Rhode Island licensed nonprofit animal rescue, animal shelter, society for the prevention of cruelty to animals, or adoption organization as defined.
SC - Lien, boarding - § 29-15-60. Animal boarding facilities; liens upon animals for boarding expenses. This South Carolina law states that the owner of an animal boarding facility, at the end of an agreed upon term of boarding, shall have a lien upon any animal which is left for upkeep until the cost has been paid by the owner of the animal. The owner of the animal shall also be responsible for payment of the cost of care for the animal after notice of the lien. If the owner of the animal has not paid the cost after actual notice of the lien within ten days of such notice, the animal boarding facility owner may sell the animal after having advertised the time and place of the sale at least seven days before the sale is to be held.
TN - Liens, Veterinary - § 63-12-134. Liens and incumbrances. This statute specifically allow vets to hold an animal until a bill is paid for treatment, board or care of an animal.
Town of Plainville v. Almost Home Animal Rescue & Shelter, Inc. This is an appeal by the town of Plainville following the lower court's granting of defendant's motion to strike both counts of the plaintiffs' complaint. The complaint raised one count of negligence per se for defendant's failure to provide care for animals at its rescue facility. Count two centered on unjust enrichment for defendant's failure to reimburse the town for expenditures in caring for the seized animals. The facts arose in 2015 after plaintiff received numerous complaints that defendant's animal rescue was neglecting its animals. Upon visiting the rescue facility, the plaintiff observed that the conditions were unsanitary and the many animals unhealthy and in need of medical care. The plaintiff then seized 25 animals from defendant and provided care for the animals at the town's expense. Soon thereafter, plaintiffs commenced an action to determine the legal status of the animals and requiring the defendant to reimburse the town for care expenses. Prior to a trial on this matter, the parties reached a stipulation agreement that provided for adoption of the impounded animals by a third party, but contained no provision addressing reimbursement by the defendant to the town. Because there was no hearing on the merits of plaintiff's petition as to whether defendant had neglected or abused the animals for reimbursement under the anti-cruelty law, the court had no authority to order the defendant to reimburse the plaintiffs. Plaintiff then filed the instant action and the lower court held that each count failed to state a claim upon which relief can be granted. Specifically, the court held that, with respect to count one on negligence per se under § 53–247, the statute does not impose such liability on one who violates the law. Further, unjust enrichment is only available is there is no adequate remedy at law, and another law, § 22–329a (h), provides the exclusive remedy for the damages sought by the town. On appeal here, this court held that the court properly determined that the plaintiffs were not among the intended beneficiaries of § 53–247 and that that determination alone was sufficient to strike count one. The court found "absolutely no language in the statute, however, that discusses costs regarding the care of animals subjected to acts of abuse or neglect or whether violators of § 53–247 have any obligation to compensate a municipality or other party." Thus, plaintiffs could not rely upon § 53–247 as a basis for maintaining a negligence per se case against the defendant. As to count two, the court rejected plaintiffs' unjust enrichment claim. Because the right of recovery for unjust enrichment is equitable in nature, if a statute exists that provides a remedy at law, the equitable solution is unavailable. The court found that Section 22–329a provides a remedy for a municipality seeking to recover costs expended in caring for animals seized as a result of abuse and neglect. The stipulation agreement signed and agreed to by the parties contained no provision for reimbursement and settled the matter before there was an adjudication that the animals were abused or neglected. As a result, the judgment was affirmed.
TX - Lien, veterinary - § 70.010. Liens for Veterinary Care Charges for Large Animals This Texas law relates to veterinary liens for large animals, defined as livestock or a cow, horse, mule, ass, sheep, goat, llama, alpaca, farm elk, or hog. The term does not include a common household pet such as a cat or dog. A licensed veterinarian has a lien on a large animal and the proceeds from the disposition of the large animal to secure the cost of veterinary care the veterinarian provided to the large animal. The lien attaches on the 20th day after the veterinarian first provided care to the large animal and attaches regardless of whether the veterinarian retains possession of the animal.
UT - Abandonment - § 58-28-601. Animal abandonment This Utah statute provides that any animal abandoned at a veterinarian's office for a period of ten days may be sold or placed in the custody of the nearest humane society or county dog pound after giving notice to the owner. If no humane society or dog pound is located in the county, the animal may be disposed of in a humane manner.
UT - Lien - § 38-2-1. Lien on livestock--For feed and care Every ranchman, farmer, agistor, herder of cattle, tavern keeper or livery stable keeper to whom any domestic animals shall be entrusted for the purpose of feeding, herding or pasturing shall have a lien upon such animals for the amount that may be due him for such feeding, herding or pasturing, and is authorized to retain possession of such animals until such amount is paid.
VA - Liens - § 43–32 Lien of keeper of livery stable, marina, etc. Every keeper of a livery stable, hangar, tie-down, or marina, and every person pasturing or keeping any horses or other animals, boats, aircrafts, or harness, will have a lien for the amount that would be due for towing, storage, recovery, keeping, supporting, and care. The lien will be removed once the amount is paid.
VT - Lien - § 2075. Lien for keeping or pasturing animals A person to whom charges are due for pasturing, boarding, or keeping domestic animals placed with the consent of the owner thereof in his or her care, if the charges become due while such animals remain in his or her possession, may retain the same until such charges are paid. After 30 days when the charges are due, he or she may sell the animals in the manner provided for the sale of property under a lien for repairs, if such charges remain unpaid.
WA - Lien, cruelty - 60.56.025. Lien created for care of animal seized by law enforcement officer This Washington law states that if a law enforcement officer authorizes removal of an animal pursuant to chapter 16.52 RCW, the person or entity receiving the animal and aiding in its care or restoration to health shall have a lien upon the animal for the cost of feeding, pasturing, and caring otherwise for the animal.
