The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:
PROHIBITION OF CEPACE ACTION IN ALL
THE NATIONAL TERRITORY
ARTICLE 1 . Intentional hunt or capture. Total hunting or intentional capture is prohibited through networks, other fishing gears or by the system of forced roaming, from any of the cetacean species listed as Annex I to this Law, throughout the national territory, including the territorial sea, the exclusive economic zone and its internal waters. ARTICLE 2 . Infruits. Offences to this Act shall be punished by fines of one million pesos ($ 1,000,000). In the event of recidivism, fines may be increased to double the above-mentioned violation value. For the Orca species (Orcinus orca), Law No. 25.052. ARTICLE 3 . Implementing Authority. The authority for the implementation of this law shall be the Secretariat for Sustainable Development and Environmental Policy of the Ministry of Social Development and the Environment of the Nation, or which thereafter replaces it. ARTICLE 4 . Faculty of the Application Authority. The enforcement authority shall have the power and shall implement the mechanisms to implement the provisions of article 1:
(a) Seek measures to minimize, mitigate and reduce by-catch of cetaceans listed in Annex I;
(b) It shall set exceptions to article 1 of the present law when they have scientific, educational objectives or are intended for the conservation of the species included in this rule.
ARTICLE 5° . National jurisdiction. This law shall be governed by the places subject to exclusive jurisdiction of the Nation and in the provinces that accede to the regime of the Nation and shall conclude the necessary agreements with the authority of application. ARTICLE 6 . Regulation. The Executive Power, within sixty (60) days, shall regulate this law. ARTICLE 7 Contact the Executive.
