Mitchell v. Snider 41 N.Y.S.3d 450 (N.Y. Civ. Ct. 2016) 51 Misc. 3d 1229(A); 2016 WL 3191291 This is a case of an unmarried, co-habitating couple that jointly bought a dog and now dispute who should have the dog after the relationship has terminated. Mitchell brought this replevin action against his girlfriend, Snider, to recover possession of Django, their black lab. This court recognized the traditional way to treat such a case is to consider which party has superior possessory right to the dog. However, modern courts have started to recognize a special category of property in pets and have used a 'best for all concerned' analysis to decide who gets the animal. In this case, the court grants judgment for Snider in part because she had been solely responsible for the dog's care for the previous 20 months. No money was awarded to Mitchell because the expenses he paid were an expression of the parties' mutual love and desire to care for the dog. Case
ME - Hunting - Title 12. Conservation. 12 M. R. S. A. § 10654 ME ST T. 12 § 10654 This law reflects Maine's hunter harassment provision. The law splits the conduct into two possible offenses. First, a person may not intentionally or knowingly interfere with the lawful hunting, fishing or trapping of a wild animal, wild bird or fish. Second, a person may not intentionally or knowingly disturb or attempt to disturb a wild animal, wild bird or fish with the intent to interfere with the hunting, fishing or trapping of a wild animal, wild bird or fish. A person who violates either section commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged. Statute

In this New York case, the parent of child injured by a dog brought an action seeking to have the dog declared a “dangerous dog” under the relevant law. The Court conducted a trial of the “dangerous dog” petition filed and rendered an oral decision that declared the respondents' Chesapeake Bay Retriever “Nellie” to be a dangerous dog under New York Agricultural and Markets Law § 121. The parties contested the appropriateness of a finding of “negligence” and “strict liability” and the entry of judgment. The District Court held that the court would not resolve issue of negligence because the issue was not properly joined for disposition; however, the owners were strictly liable for child's unreimbursed medical expenses.

Plaintiffs, Ami Moore and Doggie Do Right-911, Inc., aver that defendants PETA, Diane Opresnik, John Keene, and Mary DePaolo defamed them and placed them in a false light by stating that the plaintiff dog trainer placed a shock device on a dog's genitals and allegedly shocked it. Prior to this action, the claim against PETA was settled and dismissed. The defamation claims against Opresnik, Keene, and DePaolo, persisted. In dismissing the remaining claims, the court found that there was no positive factual statement of criminal animal cruelty to support a defamation per se claim. Further, another claim fell outside the statute of limitations period and was also inadequately supported by specific allegations.

A. § 509.233 FL ST § 509.233 Florida was one of the first states to enact a law on dogs in restaurants in 2006. The law allows a local unit of government to adopt an ordinance that acts as an exemption to the state's Food and Drug Administration Food Code. Once the local exemption is passed, a restaurant can apply for a permit to allow dogs in the outdoor dining spaces. Certain things must be included in the ordinance such as a requirement that staff wash after touching pets, a rule that patrons keep dogs on leashes and under control, a prohibition against dogs on chairs, tables, or other furnishings, signs that list the rules for employees and patrons, and a clean-up station in the outdoor dining area. There are also reporting requirements by the local governments to the State of Florida under the law. The city or county must also have a system in place to document and respond to complaints. IL - Exotic pets - 5/48-10. Dangerous animals 720 I.L.C.S. 5/48-10 IL ST CH 720 § 5/48-10 This Illinois law states that no person shall have a right of property in, keep, harbor, care for, act as custodian of or maintain in his or her possession any dangerous animal or primate except at a properly maintained zoological park, federally licensed exhibit, circus, college or university, scientific institution, research laboratory, veterinary hospital, hound running area, or animal refuge in an escape-proof enclosure. A "dangerous animal" is defined as a lion, tiger, leopard, ocelot, jaguar, cheetah, margay, mountain lion, lynx, bobcat, jaguarundi, bear, hyena, wolf or coyote.This Section does not prohibit a person who had lawful possession of a primate before January 1, 2011, from continuing to possess that primate if the person registers the animal by providing written notification to the local animal control administrator on or before April 1, 2011. State v. Gerard 832 N.W.2d 314 (Minn.App.,2013) 2013 WL 3155477 (Minn.App.,2013)

This case considers whether the trial court erred when it dismissed the felony count of unjustifiably killing an animal based on lack of probable cause. The incident stems from the killing of the neighbors' cat with a shotgun by defendant-respondent. At trial, he filed a motion to dismiss for lack of probable cause that was accompanied by a notarized affidavit of the responding police deputy stating the shooting of the cat was "justified." The trial court dismissed the complaint finding insufficient evidence that respondent had unjustifiably killed the cat. On appeal, the court found the district court's reliance on the deputy's lay opinion was improper. The court found it was within the jury's province to determine whether respondent's actions were justified or unjustified based on the evidence at trial.

In this appeal, the Humane Society of the United States (HSUS) challenged a series of actions by the Fish and Wildlife Service to allow hunting on some of America's national wildlife refuges. The District Court held that HSUS failed to satisfy the Supreme Court's requirements for associational standing because the 'recreational' interest of Society members was not germane to the group's self-described mission of insuring the humane treatment of animals and other wildlife. The Court of Appeals reversed the district court's finding that the Humane Society had no standing to challenge the hunt openings, and remanded the action to allow HSUS to pursue its challenge to the introduction of hunting. This Court did affirm the district court's finding on the merits that the Wildlife Service complied with NEPA when it permitted hunting at the Chincoteague preserve. Affirmed in part and reversed in part.

Woudenberg v. U.S. Dept. of Agriculture 794 F.3d 595 (6th Cir., 2015) 2015 WL 4503212 (6th Cir., 2015) According to Department of Agriculture regulations promulgated under the federal Animal Welfare Act (with certain exceptions not applicable here), persons who were in the business of buying and selling dogs and cats (i.e. class B dealers) may not obtain dogs or cats from an individual donor “who did not breed and raise them on his or her premises.” Another provision required a dealer in such a case to “obtain [ ] a certification that the animals were born and raised on that person's premises.” The question in this case was whether there was a violation when the dealer obtained the required certification, but the certification was false. The regulatory language was clear that a dealer violated the law by obtaining a dog or cat from an individual donor who did not breed or raise it on the donor's premises and it was still a violation even when the dealer in good faith obtained certifications that the animals had been so bred and raised. The certification requirement was an enforcement mechanism for the prohibition, not an exception. The Department of Agriculture therefore properly entered a cease-and-desist order against the petitioner. Case
