Under a statute that allowed an officer to impound animals without a warrant if exigent circumstances exist, fifteen unconfined cats, who were roaming around a vehicle, were impounded. At a hearing to ratify the impoundment, the court found a large number of unconfined cats that obstructed the defendant's view for driving constituted exigent circumstances under SDCL 40-1-5. After a motion was granted to transfer ownership of the cats to a local humane society for adoption, the defendant appealed. The appeals court affirmed the lower court’s decision.

ME - Transport - § 2087. Transporting dogs in open vehicle regulated 29-A M. R. S. A. § 2087 ME ST T. 29-A § 2087 This Maine law regulates the transporting of dogs in open vehicles (like pick-up trucks or convertibles). Under the law, a person driving an open vehicle may not transport a dog in the open portion of that vehicle on a public way unless the dog is protected in a manner that prevents the dog from falling or jumping or being thrown from the vehicle. The law excludes transportation of a dog by a farmer engaged in agricultural activities involving the dog or a hunting dog that is between transported between hunting sites by a licensed hunter. State v. Peabody 343 Ga. App. 362, 807 S.E.2d 107 (2017) 2017 WL 4801538 (Ga. Ct. App. Oct. 25, 2017) This Georgia case involves a former police lieutenant who was indicted on two counts of aggravated cruelty to animals after he left his K-9 named Inka locked in his police vehicle while he attended to tasks inside his home. The dog died after being left inside the vehicle, which had all doors and windows closed with no A/C or ventilation running. The state appeals the trial court's grant of defendant's motion to quash the indictment. Specifically, the state argues that OCGA § 17-7-52 (a law that requires at least a 20-day notice prior to presentment of a proposed indictment to a grand jury when a peace officer is charged with a crime that occurred in the performance of his or her duties) is inapplicable. The state did not send defendant a copy of the proposed indictment before it presented the case to the grand jury. The state contends defendant "stepped aside" from his police-related duties and was therefore not afforded the protections of OCGA § 17-7-52. This court disagreed with that assessment. Since Peabody was responsible for the care and housing of Inka as her K-9 handler, leaving her unattended, albeit in an illegal manner, was still in performance of his police duties. As such, Peabody was entitled to the procedural protections of the statute according to the appellate court. The trial court's motion to quash his indictment was affirmed. Case

St. Ann. § 43 OK ST T. 4 § 43 This Oklahoma statute provides that the board of county commissioners of any county with a population of two hundred thousand (200,000) or more may regulate or prohibit the running at large of dogs and may impound and dispose of such dogs. The board of county commissioners may also regulate and provide for taxing the owners and harborers of dogs, and authorize the humane killing or disposal of dogs, found at large, contrary to any ordinance regulating the same. Any person, firm or corporation who violates any rule or regulation made by such board of county commissioners under the authority of this act shall be guilty of a misdemeanor and shall be punished as provided by the laws of this state. Hargrove v. State 253 Ga. 450 (1984) 253 Ga. 450 (1984)

Defendants were convicted by the Mitchell Superior Court, Robert Culpepper, Jr., Senior Judge, of dogfighting and gambling and two of the defendants were convicted of commercial gambling, and they appealed. The Supreme Court, Clarke, J., held that: (1) the statute prohibiting dogfighting is not unconstitutionally vague, and does not violate equal protection; (2) penalty provided for violating the dogfighting statute does not amount to cruel and unusual punishment; (3) evidence was sufficient to support convictions; (4) dogfighting is not as a matter of law a lesser included offense of commercial gambling; and (5) dogfighting was not as a matter of fact a lesser included offense of commercial gambling.

The Migratory Bird Treaty Act ("MBTA"), 16 U.S.C. §§ 703-712 (2000), extends protection to all birds covered by four migratory bird treaties, which, in relevant part, define migratory birds to include the family Anatidae (which includes the mute swan).  Under the authority, delegated by Congress the Secretary of the Interior has published lists of protected migratory birds.  The instant case arose when appellant Joyce Hill filed a law suit pro se in District Court claiming that the Secretary's regulation violated the MBTA in excluding mute swans from the List of Migratory Birds promulgated at 50 C.F.R. § 10.13 (2000). The District Court rejected Hill's claim and granted summary judgment in favor of the Secretary.  In reversing the the District Court's decision, the court found that the Secretary pointed to nothing in the statute, applicable treaties, or administrative record that justified the exclusion of mute swans from the List of Migratory Birds.  It also ordered the Secretary's List of Migratory Birds, codified at 50 C.F.R. § 10.13, insofar as the list excludes mute swans, to be vacated.  This case more or less set the stage for the revisions to the MBTA in 2004 by Congress's passing of the MBTRA.

State v. Avery State v. Avery, 44 N.H. 392 (1862)

The Defedant was convicted of the charge of cruelty to animals for the beating of his own horse.  The Defendant appealed this descision to the Supreme Court of New Hampshire on two grounds.  First, the lower court failed to instructe the jury that intoxication was a defense to the charge.  Second, the lower court instructed the jury that the beating of an animal for training may at some point become malicious and illegal under that statute.  The Court held the lower court was not in error and affirmed the decision.

State v. Troyer (Unpublished) 1997 WL 760954(Ohio App. 9 Dist.,1997) (unpublished) Defendant was convicted of killing a non-game bird (owl) while defending his collection of exotic and native birds.  The court finds that defendant rightfully engaged in conduct to defend his property against depredation by owls.  The court carefully notes the owl is an abundant species in Ohio, and that the burden on the property owner would be greater if the species at issue were endangered or threatened, like an eagle.
