These two consolidated California appeals address the measure of damages for the wrongful injury to a companion animal. Both respondents filed motions in limine concerning the issue of damages in the cases and, in both case, the trial court limited the measure of damages to the market value of the dogs. On appeal, the appellants argued that the measure of damages should go beyond market value to cover the reasonable costs of the pets' treatment. The appellate court found the recent case of Kimes v. Grosser (2011) 195 Cal.App.4th 1556 (decided after these appeals were filed) persuasive (where the court held that a plaintiff can recover reasonable and necessary costs where a pet is wrongfully injured). The court reasoned that otherwise, the injured animal's owner would bear the burden of all the costs of treatment, regardless of the wrongdoer's conduct. Moreover, this ruling reflects a basic principle of tort law - to make a plaintiff whole again - and accords with the different way animals, as property, are treated in the criminal arena. Thus, the court agreed with Kimes that allowing a pet owner to recover reasonable and necessary costs related to the treatment of an animal wrongfully injured is an appropriate measure of damages.

A.C.A. § 14-54-1102 AR ST § 14-54-1102 This Arkansas statute provides that municipal corporations have the power to prevent the running at large of dogs and the injuries and annoyances associated with them. Further, this statute allows municipalities to authorize the destruction or impoundment of dogs if found in violation of ordinance. However, prior to destroying the dog, the municipality shall give the dog's owner at least five (5) days' notice of the date of the proposed destruction of the dog by certified mail if the dog carries the owner's address. App. 1 Cir. 9/19/23); 2023 WL 6119352 (La.App. 1 Cir., 2023) Plaintiff-appellee, People for the Ethical Treatment of Animals (PETA), began this case by issuing eight public records requests to defendant-appellant Louisiana State University (LSU). PETA made these records seeking veterinary care and disposition records for birds used in LSU’s laboratories. For the first seven of these requests, LSU did not produce the records, so PETA filed a petition for a writ of mandamus, declaratory judgment, and injunctive relief pursuant to the Public Records Law. LSU denied PETA’s allegations and did not produce the records, so PETA made an eighth records request, which LSU responded to with an assertion that the requested records were exempt from disclosure. After a hearing, the trial court issued an oral ruling in favor of PETA and granted some of the records that PETA requested. LSU appealed. On appeal, the court considered whether the records sought by PETA were covered under the Public Records Law. The court first found that LSU qualifies as a research facility under the Animal Welfare Act, and needs to comply with federal law and maintain and produce records relating to research animals, so long as the records being sought would not be unduly burdensome to produce. The court held that the portions of the judgment ordering LSU to produce veterinary daily observation reports, veterinary daily health check records, and other veterinary records were affirmed. However, some of the information sought, including private communications between LSU employees, trapping records, and some videographic records, were considered unduly burdensome to compel LSU to produce. The court also amended a portion of one of the requests to make it more specific and narrow the documentation that LSU would need to produce. Accordingly, the court affirmed in part, reversed in part, amended in part, and reversed in part. Case

Plaintiffs filed claim against the United States Fish and Wildlife Service (“FWS”) alleging arbitrary and capricious agency action under the Administrative Procedure Act (“APA”) and failure to perform a nondiscretionary act under the Endangered Species Act (“ESA”).   The United States District Court, D. Oregon, granted Defendants’ motion to dismiss and denied Plaintiffs’ request for leave to amend, and Plaintiffs’ motion for summary judgment, finding   that it lacked subject matter jurisdiction over Plaintiffs’ APA and ESA claims, and that it remains without jurisdiction to mandate action by the agency if rulemaking has not been initiated by the FWS at its discretion, regardless of whether a determination resulting from a five year review suggests a listing status should be changed or should remain the same.

Fuller v. Vines 36 F3d 65 (9th Cir. 1994)

Motion for leave to amend § 1983 civil rights complaint to add claims that police officer violated Fourth Amendment by shooting pet dog and by pointing gun at one plaintiff was denied and the United States District Court for the Northern District of California entered summary judgment in favor of police officers and city. Plaintiffs appealed. The Court of Appeals held that: (1) killing of pet dog stated Fourth Amendment violation, but (2) no seizure of plaintiff occurred when police pointed gun.

The owner or keeper of the dog shall be liable to the city or county where the dog is impounded for the costs and expenses of keeping the dog, if the dog is later adjudicated potentially dangerous or vicious.
