This action was brought by Dale C. Bedford, appellant, on an amended complaint on two counts seeking special damages in the amount of $750, unspecified general damages, and $50,000 in punitive damages against E.E. Jorden, a Billings, Montana veterinarian and his partnership. The first count of complaint alleges that the defendant, Dr. Jorden, willfully or by gross negligence broke, or allowed to be broken a wing of a parrot belonging to the appellant, Bedford. The second count alleges that Dr. Jorden and his business willfully, wantonly or maliciously failed to provide adequate care for the parrot. The court found that the interrogatories and depositions of all witnesses, including the appellant, indicate that there was no evidence produced that would establish a prima facie case of negligence, let alone intentional cruelty or inhumanity to animals.

These sections replace former HRS § 128-1. In terms of animal-related provisions, the definition for "evacuation" includes mention of animals. In the section on sheltering, the law states that "[c]ounty emergency management agencies shall be responsible for identifying and operating locations and facilities suitable for sheltering" both the public and pet animals. In this New York case, a bicyclist was injured after allegedly being chased and attacked by defendant's two dogs. The plaintiff-bicyclist sued to recover damages for his injuries. The Supreme Court , Putnam County, granted a defense motion for summary judgment, and the bicyclist appealed. The Supreme Court, Appellate Division, held that a genuine issues of material fact existed as to whether defendants had constructive notice of the dogs' proclivity to chase bicyclists on the roadway and as to whether those actions put others at risk of harm.

US - Eagles - Eagle Transportation Permits for American Indians and Public Institutions 1999 WL 719395 (F.R.)

This final rule revises the general eagle permit restrictions applicable to American Indians and public institutions. This final regulation provides for the issuance of eagle permits for transportation of lawfully possessed eagle parts into or out of the United States only when the eagle parts have a religious purpose, or when a public institution transports eagle parts for scientific or exhibition purposes. In these cases, we will require that the eagle parts be returned to the country of origin. We make this revision to address concerns expressed by American Indians and public institutions who have sought our permission to allow international travel of lawfully possessed eagle parts or items containing eagle parts. We have carefully considered the needs of science and education, the religious protections guaranteed by the United States Constitution, and the recommendations made by those responding to the proposed rule providing for Eagle Transportation Permits for American Indians and Public Institutions published Thursday, June 16, 1994 (Federal Register (59 FR 30892)).

Louisiana dog owners sued motorist for mental anguish and property damage  after their dog was hit and killed by defendant's car. The lower court awarded damages to each of the dog owners in the total amount of $10,000. The Court upheld that the damages award of $10,000 because the dog was killed as a result of motorist's negligence, the owners were nearby and immediately arrived at scene to find their beloved dog dead, the dog was extremely valuable to owners, who had a close family-like relationship with dog for approximately 12 years, and the loss caused the owners to suffer psychic trauma.

Ivory Education Institute v. Department of Fish and Wildlife 28 Cal. App. 5th 975 (Ct. App. 2018), as modified (Nov. 5, 2018), review denied (Jan. 16, 2019) 239 Cal. Rptr. 3d 606 (Ct. App. 2018) The Legislature passed Assembly Bill 96 which took effect July 1, 2016 as Fish & Game Code section 2022. The bill imposed new restrictions on the sale and importation of ivory and rhinoceros horn. The Ivory Education (the Institute) sued the California Department of Fish and Wildlife (the Department) in order to block implementation of the law. The institute alleged that the statute was unconstitutional on multiple grounds including vagueness, federal preemption, the takings clause, and the commerce clause. The trial court entered judgment for the Department and the intervenor defendants (the Natural Resources Defense Council, the Center for Biological Diversity, the Humane Society of the United States, the International Fund for Animal Welfare, and the Wildlife Conservation Society). The Institute appealed and abandoned all other issues raised and limited its challenge to the void-for-vagueness doctrine. "The Institute contend[ed] that section 2022 [was] unconstitutionally vague for two reasons: 1) while it allows for the sale or import of ivory insofar as it is allowed by federal law, differences in what federal law allows make it nearly impossible to tell what would qualify for the exemption provided by section 2022(c)(c); and 2) there are no guidelines by which to determine the permissible volume of ivory in either musical instruments or antiques." The Court of Appeals stated that a statute is not vague if its meaning can be determined by looking at other sources of information. Those who wish to comply with section 2022 have a duty to locate and examine statutes or whatever else necessary to determine the scope of the exemption provision. "Section 2022 has a single purpose—to prevent the sale or importation of ivory and rhinoceros horn. Both of those terms are defined. The Institute has 'not demonstrated that attempts to give substance and meaning' to the three disputed exceptions 'would be fruitless.'" As for the Institute's second contention, the Court of Appeals stated that because musical instruments and antiques are tangible objects that occupy a verifiable amount of three-dimensional space, the percentage of any such object that has ivory in it can be readily determined. The Court of Appeals held that the statute was not vague. The Court affirmed the holding of the trial court. Case
