U.S. v. Bryant 716 F.2d 1091 (C.A. Tenn., 1983)

Ricky Bryant appeals convictions on one misdemeanor and two felony counts of purchasing illegally obtained fox pelts, violations of the Lacey Act Amendments of 1981, 16 U.S.C. § 3371-3378 (1981).  The court held that the North Carolina regulation, which unambiguously prohibited the hunting of foxes without authorization and expressly stated that dealing in untagged pelts is illegal, withstood the void for vagueness test as prosecuted under the Lacey Act.  The court further dismissed challenges based on an entrapment defense and arguments that the Lacey Act constitutes an unconstitutional delegation to the States of legislative power reserved to Congress.

Center for Biological Diversity v. Chertoff Slip Copy, 2009 WL 839042 (N.D.Cal.)

Plaintiff, the Center for Biological Diversity, brought an action against Defendant, the United States Coast Guard, alleging that Defendant violated the ESA by failing to consult with the NMFS to ensure that Defendant’s activities in the Santa Barbara Channel and other shipping lanes off the California Coast would not harm the continued existence of threatened and/or endangered species after Defendant amended Traffic Separation Schemes (“TSS”) and a number of blue whales were subsequently struck by ships and killed.   On the parties’ cross motions for summary judgment, the United States District Court , N.D. California dismissed Plaintiff’s claims pertaining to Defendant’s implementation of or actions under the TSS in the approaches to Los Angeles – Long Beach and granted Defendant’s motion for summary judgment and denied Plaintiff’s motion for summary judgment with respect to Defendant’s alleged violations of the ESA arising out of Defendant’s implementation of or actions under the TSS in the Santa Barbara Channel.

Hernandez-Gotay v. United States 985 F.3d 71 (1st Cir. Jan. 14, 2021) 2021 WL 128466 Plaintiffs filed suit to enjoin the enforcement and challenge the constitutionality of Section 12616 of the Agriculture Improvement Act of 2018 (“Section 12616”), which bans the “sponsor[ship]” and “exhibit[ion]” of cockfighting matches in Puerto Rico. The district court upheld Section 12616 as a valid exercise of Congress's Commerce Clause power. On appeal here, the court first determined whether the plaintiffs had sufficient standing to challenge the law. It concluded that plaintiff Ángel Manuel Ortiz-Díaz, the owner of two cockfighting venues and a breeder and owner of more than 200 gamecocks, has standing to challenge Section 12616. Ortiz faces a credible threat of prosecution under Section 12616 because he regularly sponsors and exhibits cockfighting matches. Finding standing, the court considered plaintiffs' claim that Congress exceeded its authority under the Commerce Clause in enacting Section 12616. The court found that cockfighting is an activity that substantially affects interstate commerce and Congress passing Section 12616 was a legitimate exercise of Commerce Clause power. Finally, plaintiffs contend that Section 12616 infringes on their First Amendment freedoms of speech and association. In rejecting this argument, the court held that plaintiffs failed to identify the necessary "expressive element" in cockfighting activities that would render it subject to First Amendment protections and, even if they made such a showing, Section 12616 is a permissible restraint on such speech. Finally, nothing in Section 12616 infringes on the associational right to assemble since it does not prevent individuals from gathering to express their views on cockfighting. State v. Devon D. 90 A.3d 383 (Conn.App, 2014) 150 Conn.App. 514 (2014) The defendant, Devon D., appeals from the judgments of conviction, rendered after a jury trial, of eleven offenses, in three separate files with three different docket numbers, pursuant to three separate informations, involving three different victims. Devon asserted that the prosecution as to the charges concerning C1 should have been separated from the charges as to C2 and C3, and that the evidence from C1’s case should not have been cross-admissible as to C2 and C3, an argument the Connecticut Appellate Court accepted as justifying reversal. Devon also argued on appeal that “the court improperly permitted the state to have a dog sit near C1 while she testified to provide comfort and support to her.” The appellate court concluded that the trial court had abused its discretion in permitting the use of the dog to comfort and emotionally support C1 while she testified without requiring the state to prove that this special procedure was necessary for this witness. At trial, defense counsel specifically told the trial court he was not making a confrontation clause claim as to the presence of the dog, and the appellate court therefore considered such a claim waived. Despite the absence of statutory authority for permitting a facility dog, the appellate court did conclude that the trial court had “inherent general discretionary authority” to permit such a dog, but also determined that this discretion was abused under the facts of the case. The judgments are reversed and the cases are remanded for new trials. Case

There were four areas of significant change to the AWA in the 1970 amendments: (1) the definition of "animal" was expanded to include warm-blooded animals generally, (2) more human entities were brought under the regulatory provisions of the Act: animal exhibitors (i.e., circuses, zoos and roadside shows), and wholesale pet dealers, (3) the lab door of research facilities was opened more, requiring that certain humane standards be maintained at all times, (4) the Secretary's enforcement powers were strengthened and protection for government inspectors was provided from individuals who interfered with enforcement actions under the Act.
