The City of Sioux City, Iowa makes it unlawful to own, transport, or sell any pit bull, with exceptions.  Pit bulls currently and continuously registered, licensed, properly confined and cared for are exempt from the ban, but a failure to maintain its status immediately removes its exemption. The poundmaster is authorized to immediately impound any pit bull that does not fall within one of the exceptions and is mandated to destroy the pit bull within ten calendar days.

WV - Equine Activity Liability - Article 4. Equestrian Activities Responsibility Act. W. Va. Code, § 20-4-1 to 7 WV ST § 20-4-1 to 7 This West Virginia section expressly recognizes the value of equestrian activities to the state. Thus, in order to limit liability to those who provide equine services, the duties of both the horsemen who provide such services and the participants who engage in such activities are stated. Each participant in an equestrian activity expressly assumes the risk of and legal responsibility for any injury, loss or damage to person or property which results from participation in an equestrian activity. Horsemen are required to ensure the safety of the participants and the equipment provided. Statute
Davison v. Berg 243 So.3d 489 (Fla. Dist. Ct. App. Mar. 22, 2018) 44 Fla. L. Weekly D641 (Fla. Dist. Ct. App. Mar. 22, 2018); 2018 WL 1415485 Deborah Davison volunteered at her local Humane Society to help take care of a dog park. Three years later, Rebecca Berg’s dog who was chasing other dogs collided with Davison. Davison suffered a broken leg that required extensive medical care. Davison then filed an action against Berg under a Florida statute that “imposes liability on dog owners for damage their dogs cause to other persons and animals.” The trial court granted final summary judgment in favor of Berg for two reasons. The first reason was that the signs outside of the park sufficiently warned Davison of the risks of injury inside. The second reason was that Davison essentially consented to the risk of potential injuries by being a volunteer for the dog park. On appeal, this court stated that the Florida statute was a strict liability statute that makes an owner the insurer of their dog’s conduct. The only defense to the statute is for an owner to display in a prominent place on his or her premises a sign that includes the words “Bad Dog.” Berg presented evidence that the park had two signs prominently displayed at the entrance to the park with the title “Dog Park Rules.” The two signs listed rules for entrance to the dog park. One of these rules stated that park use is at the dog owner’s risk. Another rule stated that rough play and chasing were not allowed if any dogs or owners were uncomfortable with that behavior. The last rule stated that visitors enter at their own risk. Even though Davison entered the park at her own risk, the purpose of the sign requirement in the statute was to give notice that a bad dog is on the premises. The Court found that the trial court erred in finding that the signs at the dog park were sufficiently equivalent to “Bad Dog” signs to preclude liability under the Florida statute. The trial court also found that by virtue of Davison volunteering at the dog park, she was aware that she could be injured during the course of her work and that she signed a volunteer application form that acknowledged that she could be exposed to “bites, scratches, and other injuries.” Davison had also witnessed a prior collision between a dog and an individual that resulted in a broken leg. After witnessing that, Davison began to warn others at the Humane Society about the dangers of being inside the dog park with dogs chasing each other. The Court held that even though there may be evidence to support the trial court’s conclusion that Davison consented to the risk of injury, “an actual consent or assumption of the risk defense cannot bar liability.” The Court reversed the trial court’s entry of final summary judgment in favor of Berg. People of the State of New York v. Mary Dawn Sitors This action is an appeal from dismissal of criminal charges against a woman accused of acts of cruelty on her horses. The Town Court dismissed the criminal charges, finding that since the Catskill Animal Sanctuary's petition seeking the posting of security to care for the horses was dismissed (which had a lower standard of proof than in a criminal action), this necessarily meant it would be impossible to obtain a criminal conviction under the higher standard. Essentially, the Town Court's decision reflected a determination that one cannot violate New York's state cruelty law unless the animal dies due to lack of sustenance or care. The County Court found this reasoning erroneous; a violation under the law occurs when one fails to provide necessary sustenance, not only those acts or omissions that result in an animal's death. The expression "cruelly ill-treat"" in s 1(1)(a) of the Protection of Animals Act 1911 means to "cause unnecessary suffering" and "applies to a case where a person wilfully causes pain to an animal without justification for so doing". It is sufficient for the prosecution to prove that the animal was caused to suffer unnecessarily, and the prosecution does not have to prove that the defendant knew that his actions were unnecessary.

Code Ann. § 3.2-6200 - 6302 VA ST § 3.2-6200 - 6302 This Virginia section provides that an equine activity sponsor, an equine professional, or any other person shall not be liable for an injury to or death of a participant resulting from the intrinsic dangers of equine activities. Liability is not limited where the equine professional intentionally injures the participant, commits an act or omission that constitutes negligence for the safety of the participant, or knowingly provides faulty equipment or tack that causes injury. The statute seems to imply that a waiver should be executed when a participant engages in equine activities to adequately insulate the equine professional. Statute

MI - Newaygo - Breed - Sec. 6-9. Vicious dogs. (Pit Bull Ordinance) NEWAYGO, MI., CODE OF ORDINANCES § 6-9

In Newaygo, Michigan, it is unlawful to keep, harbor, own, or possess any pit bull dog or other vicious dog. Dogs registered as of the effective date of the ordinance may remain if the owner complies with  certain requirements, such as posting a "Beware of Dog" sign, taking photographs for identification purposes, and keeping the dog on a leash and using a muzzle. A violation may result in a fine or imprisonment. The dog may also be impounded, confined to the premises of the owner, removed from the city, or killed.

While on vacation at a ranch in Wyoming, plaintiff was thrown or fell from a horse that stepped in a large badger hole. Allegedly, the trail guide left the plaintiff and her husband at the scene in order to get help. Worried about potential wildlife attacks, the plaintiff and her husband walked to a nearby residence for assistance. The plaintiff later brought a negligence suit against the ranch for injuries she had sustained during the fall. At trial, the jury verdict stated the plaintiff had assumed the risk and the plaintiff was therefore not entitled to damages. On appeal, the plaintiff challenged a jury instruction and asserted the trial court abused its discretion when it awarded costs to the ranch. The plaintiff did not prevail on either claim.

S D C L § 42-11-1 to 5 SD ST § 42-11-1 to 5 This act stipulates that an equine sponsor, equine professional, doctor of veterinary medicine or any other person, is immune from liability for the death or injury of a participant, which resulted from the inherent risks of equine activities. However, there are exceptions to this rule: a person will be held liable for injuries of an equine activity participant if he or she displays a willful and wanton or intentional disregard for the safety of the participant and if he or she fails to make reasonable and prudent efforts in ensuring the safety of the participant. In addition, a person will also be held liable for the injury of an equine activity participant if he or she is injured on the land or at a facility due to a dangerous latent condition of which was known to the equine sponsor, professional or other person.
