Pupil's right of refusal; animal dissection 24 P.S. § 15-1523 PA ST 24 P.S. § 15-1523 This Pennsylvania law states that public or nonpublic school pupils from kindergarten through grade twelve may refuse to dissect, vivisect, incubate, capture or otherwise harm or destroy animals or any parts thereof as part of their course of instruction. Schools must notify pupils and their parents/guardians of the right to decline participation. A pupil who chooses to refrain from participation or observation shall be offered an alternative education project. No pupil shall be discriminated against based on his or her decision to exercise rights under this law. Statute

Coyote getters West's RCWA 9.41.185 WA ST 9.41.185 This Washington law provides that the use of "coyote getters" is not a violation of law when their use is authorized by the state department of agriculture and/or the state department of fish and wildlife in cooperative programs with the United States Fish and Wildlife Service. Nuisances and injunction 3 P.S. § 551 PA ST 3 P.S. § 551 This Pennsylvania statute provides that the owners or operators of licensed dog training areas shall not be subject to any action for nuisance, and no court in this Commonwealth shall enjoin the use or operation of training areas on the basis of noise or noise pollution, provided that the owners were and remain in compliance with any applicable noise control laws or ordinances at the time the permit for establishment of the training areas was authorized. This was an action of trespass, brought by appellant against appellee, for the alleged wrongful killing, by the latter, of appellant's dog. Plaintiff sought recovery for his dog that was shot and killed when it entered into defendant/neighbor’s backyard. The Court held that the plaintiff could recover at least nominal damages, regardless of the fact that the animal had no actual market value.

Towers-Hammon v Burnett [2007] QDC 282

The respondent pleaded guilty to bashing several cats with an iron bar causing four deaths. The dead cats, along with one severely beaten but still alive kitten, were placed in a bag and disposed of in a charity clothing bin. On appeal, it was held that the trial judge failed to have sufficient regard to the callous nature of the respondent's actions and the respondent was sentenced to three months' imprisonment.

US - Bears - Endangered and Threatened Wildlife and Plants; Reexamination of Regulatory Mechanisms in Relation to the 1998 Flori FR Doc. 04-690 Filed 1-13-04

The Fish and Wildlife Service reexamined the regulatory mechanisms in relation to the 1998 finding for a petition to list the Florida black bear (Ursus americanus floridanus), under the Endangered Species Act.  Pursuant to a court order, the Service reexamined only one factor, the inadequacy of existing regulatory mechanisms in effect at the time of our previous 1998 12-month finding.  Pursuant to that order, the Service reexamined the existing finding considering the laws, regulations, and policies that directly or indirectly provide protection to the bear or its habitats. Based on this review, the FWS concluded that the existing regulatory mechanisms applicable in 1998 are not inadequate and do not warrant listing the Florida black bear.
