Plaintiff Stennette was providing in-home nursing care while she was bitten multiple times by Defendant Miller's dog. Stennette appeals from the trial court's grant of summary judgment to Miller in Stennette's personal injury action. This Court affirmed that decision because Stennette failed to provide adequate evidence showing triable issues on whether the dog had a vicious propensity and whether Miller knew of that propensity. However, the Court reversed the grant of summary judgment as to Miller on Stennette's claim that Miller negligently performed a voluntarily-undertaken duty to keep the dog away from her when she was at the house, because the evidence created genuine issues of material fact as to this claim.

CO - Emergency - § 25-3.5-203. Emergency medical service providers--certification C. R. S. A. § 25-3.5-203 CO ST § 25-3.5-203 This law concerns emergency medical service providers. An emergency medical service provider may provide preveterinary emergency care to dogs and cats to the extent the provider has received commensurate training and is authorized by the employer to provide the care. Requirements governing the circumstances under which emergency medical service providers may provide preveterinary emergency care to dogs and cats may be specified in the employer's policies governing the provision of care. “Preveterinary emergency care” means the immediate medical stabilization of a dog or cat by an emergency medical service provider, in an emergency to which the emergency medical service provider is responding, through means including oxygen, fluids, medications, or bandaging, with the intent of enabling the dog or cat to be treated by a veterinarian. “Preveterinary emergency care” does not include care provided in response to an emergency call made solely for the purpose of tending to an injured dog or cat, unless a person's life could be in danger attempting to save the life of a dog or cat. VA - Property - § 3.2-6585. Dogs and cats deemed personal property; rights relating thereto Va. Code Ann. § 3.2-6585 VA ST § 3.2-6585 This Virginia statute provides that all dogs and cats shall be deemed personal property and may be the subject of larceny and malicious or unlawful trespass. It further grants authority to animal control officers to seize a stolen dog or cat pending court action. Statute
MI - Melvindale - Breed - DIVISION 5. - PIT BULL TERRIERS MELVINDALE, MI., CODE OF ORDINANCES §§ 4-136 - 4-148 (2006)

In Melvindale, Michigan, there is a ban on owning or keeping pit bull dogs, with an exception for dogs licensed as of April 1990. Such dogs are allowed, as long as the owner complies with certain requirements, such as confinement or leash and muzzle, $100,000 liability insurance, and an ID number tattoo. A violation may result in a misdemeanor conviction punishable by a fine of up to $100 and imprisonment of up to 30 days.

Owner's dog was killed by a negligently driven car.  The owner sued to recover damages for loss of companionship.  The court held that dogs are personal property and damages for sentimental value, mental suffering, and emotional distress are not recoverable.

The plaintiffs charge in that the Secretary of the Interior, in contravention of statutory duty, has failed to conduct the nondiscretionary, five-year status reviews of species listed as endangered or threatened in the Federal Register. Plaintiff seeks an order declaring that Defendants have violated the Endangered Species Act and that the failure to conduct the status reviews constitutes agency action “unlawfully withheld” in violation of the Administrative Procedure Act. Defendants argue that their failure to conduct the mandatory status reviews is not an agency action that is reviewable under the APA. Defendants therefore assert that the Court lacks subject matter jurisdiction over Plaintiff's suit to compel agency action to the extent that it arises under the APA. Although not addressed by Defendants and although there is little authority on the issue, Defendants' failure to comply with a mandatory duty falls within the first category of actions reviewable under the APA as an agency action, or inaction, “made reviewable by statute” because the ESA explicitly “provides a private right of action." Defendants assert that budgetary and resource constraints precluded the Secretary from fulfilling the obligation imposed by Congress. However, the court stated that defendants ". . . should take up such constraints with Congress rather than let mandatory deadlines expire with inaction."

This Louisiana case concerns an action for personal injuries sustained by an animal control officer who was mauled about the head and neck by defendants' dog while investigating a complaint of an attack by the dog from the previous day. The dog's owners argued on appeal that the trial court failed to apply the Professional Rescuer's Doctrine, sometimes referred to as the “fireman's rule." Because under the facts here, where the dog had previously escaped after being confined in the house and the defendants failed to properly lock the house and/or restrain the dog, the court did not find that Ms. Gonzales' recovery for injuries was barred by the Professional Rescuer's Doctrine. The court held that based upon the record before this court, there was no error on the part of the trial court that warranted reversal of the plaintiff's motion for a partial summary judgment as to the liability of the dog's owners.
