PH - Cruelty - THE ANIMAL WELFARE ACT OF 1998 REPUBLIC ACT NO. 8485

It is the purpose of this Act to protect and promote the welfare of all animals in the Philippines by supervising and regulating the establishment and operations of all facilities utilized for breeding, maintaining, keeping, treating or training of all animals either as objects of trade or as household pets. For purposes of this Act, pet animal shall include birds.

US - Endangered - Petition to List the Northwest Atlantic DPS of the Thorny Skate Submitted by the Animal Welfare Institute (AWI) The Animal Welfare Institute and Defenders of Wildlife (Petitioners) hereby petition the Secretary of Commerce, the Administrator of the National Oceanic and Atmospheric Administration, and the Assistant Administrator for Fisheries of the National Oceanic and Atmospheric Administration, to list the Northwest Atlantic population of thorny skate (Amblyraja radiata) as an endangered or threatened Distinct Population Segment (DPS), pursuant to the Endangered Species Act (ESA) (16 U.S.C. § 1531–44). In the alternative, Petitioners request NMFS to list a U.S. DPS of the thorny skate as a threatened or endangered species. In addition, Petitioners seek the designation of critical habitat concurrently with any listing of the thorny skate, as authorized by statute. Administrative

In this California case, plaintiff sued a veterinarian for giving his exotic pet (a Serval cat), a flea treatment known to be toxic to cats. The veterinary malpractice action focused on defendant’s negligence in failing to exercise a reasonable level of knowledge and skill ordinarily possessed by others practicing veterinary medicine. In fact, plaintiff contended that it is well known in the field and indicated by the manufacturer of Spotton, that the drug should not be used on felines. Plaintiff prayed for damages in the amount of $25,000, which included lost wages, the commercial value of the cat, and loss of companionship, among other things.

Western Watersheds Project v. Dyer 2009 WL 484438 (D.Idaho)

The plaintiff, Western Watersheds Project (WWP), is an environmental group that brought this lawsuit to ban livestock grazing in certain areas of the Jarbidge Field Office (1.4 million acres of public land managed by the Bureau of Land Management in Idaho and northern Nevada). WWP alleges that continued grazing destroys what little habitat remains for imperiled species like the sage grouse, pygmy rabbit, and slickspot peppergrass (deemed “sensitive species” by the BLM).  After ten days of evidentiary hearings, the court found that three sensitive species in the JFO are in serious decline and that livestock grazing is an important factor in that decline. However, the court found that a ban on grazing was not required by law at this point since the Court was "confident" in the BLM's ability to modify the 2009 season in accordance with the Court's interpretation of the existing RMP.

IN - Animal Testing - THE BREEDING OF AND EXPERIMENTS ON ANIMALS (CONTROL AND SUPERVISION) RULES, 1998 1843. G.S.R. 1074(E), dated 15th December, 1998 The Rules, drafted under the powers conferred by section (1)(1-A) and (2) of Section 17 of the Prevention of Cruelty to Animals Act, 1960, regulate the breeding and testing of animals in laboratories. It sets up an 'Institutional Animal Ethics Committee' that ensures the performance of experiments of animals in an establishment in a humane manner. The Rules specify the conditions that breeders are allowed to raise these animals in for testing, and the manner in which these animals must be treated in establishments where they are used for testing. The purposes of this Act are to promote the responsible care and use of animals; provide standards for the care and use of animals that--achieve a reasonable balance between the welfare of animals and the interests of persons whose livelihood is dependent on animals; and to allow for the effect of advancements in scientific knowledge about animal biology and changes in community expectations about practices involving animals; to protect animals from unjustifiable, unnecessary or unreasonable pain; to ensure the use of animals for scientific purposes is accountable, open and responsible. People v. Chenault 227 Cal. App. 4th 1503, review filed (Aug. 25, 2014) 175 Cal. Rptr. 3d 1 (Cal.App.Dist.4, 2014), review filed (Aug. 25, 2014) Darrell Chenault was convicted on 13 counts of lewd acts on a child under 14 years of age and sentenced to 75 years to life in prison. On appeal he contended that the trial court abused its discretion by allowing a support dog to be present during the testimony of two child witnesses without individualized showings of necessity, and that the presence of the dog was inherently prejudicial and violated his federal constitutional rights to a fair trial and to confront the witnesses against him. The appellate court concluded that a trial court has authority under Evidence Code section 765 to allow the presence of a therapy or support dog during a witness’s testimony.” The court did “not believe that the presence of a support dog is inherently more prejudicial than the presence of a support person,” citing the New York case of Tohom. Chinault argued that “individualized showings of necessity” should have been required for F. and C. before the support dog could be present in the courtroom. The appellate court concluded however that “a case-specific finding that an individual witness needs the presence of a support dog is not required by the federal Constitution,” for which Tohom was again cited. Based on the court's review of the record, the appellate court concluded that the trial court made implicit findings that the presence of Asta, the support dog, would assist or enable F. and C. to testify completely and truthfully without undue harassment or embarrassment. The court also took measures to reduce any possible prejudice to Chenault by setting forth logistics for the entry, positioning, and departure of the support dog, along with F. and C., during jury recesses so the dog was as unobtrusive and least disruptive as reasonably possible. FL - Palm Beach County - Chapter 4: Animals (§ 4-24: Animal Care) Code of Laws and Ordinances Relating to Palm Beach County Government § 4-24

This Palm Beach County, Florida ordinance prohibits the act of humane slaughter, as defined by §§ F.S.A. 828.22 and/or 828.23, within earshot or view of the public. A violation of this provision constitutes a civil infraction and is punishable by a fine not to exceed $500.
