May 19, 2011) REPEALED: This Maine statute outlines the requirements that apply to wolf hybrid kennels. A person who operates a wolf hybrid kennel must register with the department. The offspring of a wolf hybrid must be permanently identified prior to transferring ownership or care of the animal. Failure to comply with the provisions of this section results in a civil violation with a forfeiture not to exceed $1,000. (For other exotic pet laws in Maine, see Chapter 730-A. FL - Cruelty, Humane Slaughter - Consolidated Cruelty Statutes/Humane Slaughter Laws West's F. S. A. § 828.01 - 828.43; West's F. S. A. § 768.139 FL ST 828.01 - 828.43; FL ST § 768.139; FL ST § 843.19 This section comprises the Florida anti-cruelty laws. Under this section, the word "animal" includes every living dumb creature. The misdemeanor violation of animal cruelty (section 828.12) occurs when a person unnecessarily overloads, overdrives, torments, deprives of necessary sustenance or shelter, or unnecessarily mutilates, or kills any animal, or carries in or upon any vehicle, any animal in a cruel or inhumane manner. A person who intentionally commits an act to any animal, or a person who owns or has the custody or control of any animal and fails to act, which results in the cruel death, or excessive or repeated infliction of unnecessary pain or suffering is guilty of a felony of the third degree. Psychiatric or psychological counseling are also mandatory for convicted offenders. The section also criminalizes animal abandonment and neglect as well as animal fighting. Statute
Cavallini v. Pet City and Supply 848 A.2d 1002 (Pa. 2004) 2004 PA Super 141

Appellant, Pet City and Supplies, Inc. appealed from the judgment in the amount of $1,638.52 entered in favor of Appellee, Christopher A. Cavallini following a bench trial. The trial court determined that Cavallini was entitled to damages due to Pet City's violations of the Dog Purchaser Protection provisions of the Unfair Trade Practices and Consumer Protection Law (UTPCPL). Cavallini purchased a Yorkshire terrier puppy from Pet City that was represented as a pure bred. After several attempts, Pet City failed to supply Cavallini with the requisite registration papers. On appeal, Pet City contended that the trial court erred as a matter of law by determining a private action can be brought under the Dog provisions of the UTPCPL, and erred as a matter of law by imposing a civil penalty against Pet City under the UPTCPL. In finding that the statute does provide a private cause of action, the court looked to the purpose of the statute rather than the plain language. However, the court found the inclusion of a civil penalty in the part that allows a private action was inconsistent with the statute.

Case
Davison v. Berg 243 So.3d 489 (Fla. Dist. Ct. App. Mar. 22, 2018) 44 Fla. L. Weekly D641 (Fla. Dist. Ct. App. Mar. 22, 2018); 2018 WL 1415485 Deborah Davison volunteered at her local Humane Society to help take care of a dog park. Three years later, Rebecca Berg’s dog who was chasing other dogs collided with Davison. Davison suffered a broken leg that required extensive medical care. Davison then filed an action against Berg under a Florida statute that “imposes liability on dog owners for damage their dogs cause to other persons and animals.” The trial court granted final summary judgment in favor of Berg for two reasons. The first reason was that the signs outside of the park sufficiently warned Davison of the risks of injury inside. The second reason was that Davison essentially consented to the risk of potential injuries by being a volunteer for the dog park. On appeal, this court stated that the Florida statute was a strict liability statute that makes an owner the insurer of their dog’s conduct. The only defense to the statute is for an owner to display in a prominent place on his or her premises a sign that includes the words “Bad Dog.” Berg presented evidence that the park had two signs prominently displayed at the entrance to the park with the title “Dog Park Rules.” The two signs listed rules for entrance to the dog park. One of these rules stated that park use is at the dog owner’s risk. Another rule stated that rough play and chasing were not allowed if any dogs or owners were uncomfortable with that behavior. The last rule stated that visitors enter at their own risk. Even though Davison entered the park at her own risk, the purpose of the sign requirement in the statute was to give notice that a bad dog is on the premises. The Court found that the trial court erred in finding that the signs at the dog park were sufficiently equivalent to “Bad Dog” signs to preclude liability under the Florida statute. The trial court also found that by virtue of Davison volunteering at the dog park, she was aware that she could be injured during the course of her work and that she signed a volunteer application form that acknowledged that she could be exposed to “bites, scratches, and other injuries.” Davison had also witnessed a prior collision between a dog and an individual that resulted in a broken leg. After witnessing that, Davison began to warn others at the Humane Society about the dangers of being inside the dog park with dogs chasing each other. The Court held that even though there may be evidence to support the trial court’s conclusion that Davison consented to the risk of injury, “an actual consent or assumption of the risk defense cannot bar liability.” The Court reversed the trial court’s entry of final summary judgment in favor of Berg. Friends of Animals v. Ashe 808 F.3d 900 (D.C. Cir. 2015) 2015 WL 9286948 (D.C. Cir. Dec. 22, 2015) Friends of Animals, a non-profit animal advocacy organization, filed suit against the U.S. Fish & Wildlife Service ("the Service") in 2013, after the Service issued no initial or final determinations for 39 species of sturgeon the organization petitioned as endangered or threatened. The Endangered Species Act (ESA) requires that the Service must make a determination within 90 days for an initial determination or 12 months for a final determination after a petition is received from an interested party. However, there is also a provision in the ESA that the plaintiff must give the Service 60-days notice before filing suit. The District Court held that Friends of Animals did not give the Service adequate notice before filing suit and dismissed the complaint. On appeal, this court agreed, finding that Friends of Animals "did not wait until after the issuance of the positive initial determinations to provide 60 days' notice of the allegedly overdue final determinations." In dicta, the Court noted that "[t]he Service's approach may not be the most efficient," but the deadlines are mandatory in the statutes. Thus, its suit to compel the final determination on the listings was barred and the judgment of the District Court was affirmed. Case

A. § 35-42-115 CO ST § 18-9-204.5; CO ST § 35-42-115 This Colorado statute defines a "dangerous dog" as one that has inflicted bodily or serious bodily injury upon or has caused the death of a person or domestic animal; or has demonstrated tendencies that would cause a reasonable person to believe that the dog may inflict injury upon or cause the death of any person or domestic animal; or has engaged in or been trained for animal fighting as described by statute. Owners found guilty under the provisions will be subject to misdemeanor penalties if their dogs cause bodily injury or felonies if their dogs cause the death of a person. Section 35-42-115 mandates that the bureau create a a statewide dangerous dog registry consisting of a database of information concerning microchip types and placement by veterinarians and licensed shelters in dangerous dogs. In this New York case, a bicyclist was injured after allegedly being chased and attacked by defendant's two dogs. The plaintiff-bicyclist sued to recover damages for his injuries. The Supreme Court , Putnam County, granted a defense motion for summary judgment, and the bicyclist appealed. The Supreme Court, Appellate Division, held that a genuine issues of material fact existed as to whether defendants had constructive notice of the dogs' proclivity to chase bicyclists on the roadway and as to whether those actions put others at risk of harm.
