Lujan v. Defenders of Wildlife 504 U.S. 555 (1992)

Respondents filed suit challenging the new regulation under the ESA that limited the jurisdiction to the U.S. and the high seas.  While the case, was remanded the central issue to this case was whether respondents had standing to challenge the ruling.

VA - Trusts - § 64.2-726. Trust for care of animal VA Code Ann. § 64.2-726 VA ST § 64.2-726 This Virginia pet trust law becomes effective July 1, 2006. The law provides that a trust may be created to provide for the care of an animal alive during the settlor's lifetime. The trust terminates upon the death of the animal or, if the trust was created to provide for the care of more than one animal alive during the settlor's lifetime, upon the death of the last surviving animal. While plaintiff’s complaint and demand focus on the threats and alleged actions of trespass by defendants, the Common Pleas Court’s decision focuses instead on the defendant’s request for injunctive relief based on a nuisance violation. Specifically, defendants apparently alleged that plaintiff’s keeping of over one hundred roosters constituted a private nuisance. Relying on a case of similar facts, the court held that plaintiffs’ keeping of over one hundred roosters for the purpose of cockfighting constituted a private nuisance.

Barrington v. Colbert CO/1273/97

A net was placed over one opening of a land drain and a terrier dog sent into the other entrance with the objective of prompting a fox to run into the net. Magistrates acquitted the defendants of doing an act causing unnecessary suffering to the fox contrary to the Protection of Animals Act 1911, s 1(1)(a). The Divisional Court dismissed the prosecutor's appeal, holding that, applying Rowley v Murphy [1964] 2 QB 43, the fox was not a "captive animal" within the meaning of s 15(c) of the 1911 Act, mere confinement not being sufficient, and was therefore outside the protection of that Act.

Argentina - Wildlife - Decreto 666, 1997 Decreto 666, 1997 This “Decreto” regulates Law No. 22,421, relating to the law for conservation of wildlife, emphasizing the management powers of the national enforcement authority, through the Secretariat of Natural Resources and Sustainable Development. This regulatory decree also regulates the practice of hunting and creates the National Registry of Hunters. The National Registry of Hunters deals in: sport hunting, commercial hunting, hunting with scientific or educational purposes, and hunting for control of harmful species. Other topics that Decreto 666 regulates include: sanctuaries, breeding stations for wildlife, import, export and interprovincial trade of wildlife and byproducts. In the latter, it is mandatory to register in the corresponding registry of the Ministry of Environment and Sustainable Development and to keep books that record the movement of such animals and products. It is also mandatory to supply the reports that are required and to facilitate access at all times of the authorized officials for inspection and control. The law created the Advisory Commission for Wildlife and its Habitat to propose solutions to problems relating to the sustainable use of wild fauna. The Ministry of Environment and Sustainable Development is the authority of enforcement with national scope. Its responsibility is to classify the wild fauna species, to set the corresponding tariffs for the registry of sport hunting, among other responsibilities. The National Service of health and agro-food quality (SENASA) is in charge of the sanitary control of wildlife subject to national and international trade. Statute

In these Minneapolis, Minnesota ordinances, a stable or assembly/transfer facility is used exclusively for the purposes of keeping horses used in a licensed horse and carriage livery service. Any horse kept in a stable or an assembly/transfer facility must be registered with the Department of Licenses and Consumer Services and must meet the standards of a veterinary examination and certification. Requirements for the construction and operations of a stable or assembly/transfer facility are also provided, as are the provisions for the operations of a horse and carriage livery service.

People v. Tinsdale 10 Abbott's Prac. Rept. (New) 374 (N.Y. 1868)

This case represents one of the first prosecutions by Mr. Bergh of the ASPCA under the new New York anti-cruelty law. That this case dealt with the issue of overloading a horse car is appropriate as it was one of the most visible examples of animal abuse of the time. Colombia - Cruelty - LEY 05, 1972 Ley 05 de 1972 This statute creates and regulates the creation of the Boards for Animal Defense. These boards, once legally constituted, become legal persons, with their main goal to raise awareness and educate the community about respect towards animals and animal protection through educational programs. Ley 5, 1972, establishes the creation of these boards as mandatory in all the municipalities in the country, as well as fines and arrests for those who are found responsible for committing cruel acts towards animals. At the same time, it establishes that the police have a duty to assist the Animal Defense Boards in the fulfillment of their goals. These boards are integrated by the Mayor or his/her delegate; the Parish Priest or his slender; the Municipal Representative or his/her delegate; a representative of the Secretary of Agriculture and Livestock of the respective Department; and a delegate chosen by the directives of the local schools. With the creation of these boards, the law seeks to promote educational campaigns that “tend to awaken the spirit of love towards animals that are useful to humans and to avoid cruel acts and unjustified mistreatment and abandonment of such animals."
