AU - Wildlife Protection- Queensland Nature Conservation Act 1992 The object of this Act is the conservation of nature.The conservation of nature is to be achieved by an integrated and comprehensive conservation strategy for the whole of Queensland that involves, among other things, the following— (a) Gathering of information and community education; (b) Dedication and declaration of protected areas; (c) Management of protected areas;(d) Protection of native wildlife and its habitat; (e) Use of protected wildlife and areas to be ecologically sustainable; (f) Recognition of interest of Aborigines and Torres Strait Islanders in nature and their cooperative involvement in its conservation; and (g) Cooperative involvement of land-holders.This Act is to be administered, as far as practicable, in consultation with, and having regard to the views and interests of, land-holders and interested groups and persons, including Aborigines and Torres Strait Islanders. A camel is not to be regarded as a wild animal by the common law as a camel 'is, in all countries, a domestic animal, an animal that has become trained to the uses of man, and a fortiori accustomed to association with man.' Whether an animal is to be regarded as wild or domestic is a question of law, and is to be judged according to the genus or class of which it belongs, not the characteristics of the individual animal.

AZ - Leash Laws - Article 6. Animal Control. A. R. S. § 11-1012 AZ ST § 11-1012 This Arizona laws provides generally that no female dog in her breeding season or vicious dog may be allowed to go at large. It further delineates the state's leash requirements for dogs, including during times of rabies quarantines, in state parks, and at public schools. Exceptions under the law include the training of livestock dogs and hunting dogs, among others. Statute

Plaintiffs brought suit against a ranch after their car struck two of the ranch's horses on the highway.  The trial court dismissed holding no duty of care was breached by the ranch because Iowa no longer had a statute prohibiting animals from roaming.  The Supreme Court of Iowa reversed reasoning that a duty of ordinary care still exists.

Silver v. United States 726 A.2d 191 (D.C. App. 1999)

Appellants were each convicted of cruelty to animals, in violation of D.C. Code Ann. §   22-801 (1996), and of engaging in animal fighting, in violation of §   22-810. On appeal, both appellants contended that the evidence was insufficient to support convictions of animal cruelty, and of animal fighting. The appellate court found that the proof was sufficient. Each appellant also contended that his convictions merged because animal cruelty was a lesser-included offense of animal fighting. The appellate court found that each crime required proof of an element that the other did not. Appellants' convictions did not merge.

The Center for Biological Diversity and eighteen other nonprofit organizations appealed the district court's summary judgment in favor of the United States Fish and Wildlife Service.  The Center claimed the Secretary of the Interior violated the Endangered Species Act by making an erroneous, arbitrary, and capricious determination that listing the Northern Goshawk (a short-winged, long-tailed hawk that lives in forested regions of higher latitude in the northern hemisphere and is often considered an indicator species) in the contiguous United States west of the 100th meridian as a threatened or endangered species was not warranted.  In the absence of evidence that the goshawk is endangered or likely to become endangered in the foreseeable future, the court found the FWS's decision was not arbitrary or capricious and affirmed the summary disposition.

Friends of Animals v. Bernhardt 961 F.3d 1197 (D.C. Cir. 2020) Appellants consisting of conversation organizations and a safari guide challenged a series of actions of the U.S. Fish and Wildlife Service (“FWS”) governing imports of sport-hunted animal trophies from Africa. The Appellants challenged certain findings that the Service made allowing animal trophies to be imported. The Court had reviewed a similar set of findings in another case and concluded that they were legislative rules illegally issued without notice and comment. FWS subsequently withdrew all its findings that were issued without notice and comment including the ones that were challenged by the Appellants in a subsequent memorandum. The Appellants still desired to contest the withdrawn findings. The Appellants alleged that it was illegal for the FWS to abandon its prior findings without engaging in APA informal rulemaking and that it was illegal for the FWS to announce its intent to the make the necessary findings through informal adjudications in the future. The Appellant’s claims fell into three categories: (1) challenges to the 2017 Zimbabwe findings that sport-hunting of elephants would enhance the survival of the species; (2) challenges to the memorandum by the FWS withdrawing their prior findings; and (3) challenges to the memorandum’s announcement that the FWS intends to making findings on a case-by-case basis when considering individual permit applications. The Court found that since the FWS had withdrew the 2017 findings, they no longer caused the appellants any injury which made any challenges to them moot. The Appellants attempted to argue that the flaws in the 2017 Zimbabwe elephant finding were capable of repetition yet would evade review. The Court rejected this argument. As for the second challenges regarding the memorandum’s withdrawal of its prior findings, the Court found that the withdrawal caused no injury to the Appellants. The Court rejected the challenges to the memorandum’s announcement that the FWS intended to make findings on a case-by-case basis. Ultimately the Court affirmed the district court’s judgment. Case
OR - Animal Racing - Chapter 462. Racing. O.R.S. § 462.010 - 990 OR ST §§ 462.010 - 990 Oregon created a Racing Commission that has the authority license, regulate, and supervise all race meets within the state and shall cause the race tracks that hold races to be inspected at least once each fiscal year. A race meet is not to be held unless a license is obtained from the Oregon Racing Commission. All employees of the race track as well as any public training facility or kennel for greyhounds involved in racing are also required to obtain a license from the Commission prior to engaging in their duties. The Commission may require each applicant to obtain a recommendation in writing of the board of county commissioners of the county in the event a race meet is to be held outside of a city and of the governing body of such city if the race meet is to be held within a city. The Commission is tasked with determining the number and classes of race meets to be held in any fiscal year and the total number of racing dates to be granted to a licensee, not to exceed 350 days in any metropolitan area in any fiscal year. The Commission is entitled to require chemical testing of the urine, blood, saliva, or other bodily substances of animals participating in races. Animals are prohibited from participating in races if they have been administered a drug that is prohibited by the Commission, prohibited drugs have been detected in the animal's system, and the animal has been stimulated or depressed in any way by a mechanical device not sanctioned by the Commission. MD - Prince George's County - Breed - § 3-185.01 Pit Bull Terriers. PRINCE GEORGE'S COUNTY, MD., §§ 3-101, 3-116.01, 3-185.01 (1997)

Prince George's County, Maryland prohibits owning or keeping a Pit Bull Terrier with exceptions. If the person owned the dog prior to November 1, 1996, then s/he may continue to keep it if s/he complies with certain conditions, such as registering it with the Administrator of Animal Control and keeping an ID tag on the dog and keeping the dog inside or on a secure leash. Show dogs are allowed into the county on a temporary basis. Dogs that have been trained for security, search and rescue, or for police or fire services are exempt.  A violation of this ordinance may result in a fine of up to $1,000 or be sentenced to up to 6 months in prison. In addition, if a Pit Bull injures or kills a person or a domestic animal without provocation, then it will be destroyed.
