Steagald v. Eason 797 S.E.2d 838 (2017) 300 Ga. 717, 2017 WL 875038 (Ga., 2017)

In this case, Gary and Lori Steagald sued the Eason family, alleging that the Easons failed to keep their dog properly restrained and were therefore liable under OCGA § 51-2-7. Lori Steagald suffered injuries after the Easons dog attacked her while she was visiting the Easons home. The Easons filed a motion for summary judgment on the basis that they had no reason to know that the dog was vicious or dangerous and therefore were not liable under the statute. Both the trial court and Court of Appeals affirmed the motion for summary judgment. On appeal, the Supreme Court of Georgia reversed the lower court’s decision. Ultimately, the Supreme Court of Georgia found that the Eason family was liable under the statute because they did have reason to believe that the dog could potentially be vicious or dangerous. The Court focused on the fact that the dog had previously “growled and snapped” at the Easons while being fed. The Court held that although the dog had never bit anyone prior to Lori Steagald, it was reasonable to assume that the dog could potentially bite and injure someone given the fact that it had a history of snapping and growling. As a result, the Court reversed the Easons motion for summary judgment and determined that the question of whether or not the Easons are liable under the statute is a question for the jury.

It is unlawful for any person to "[h]unt or conduct hunts for a fee when the person is not physically present in the same location as the wildlife being hunted within West Virginia." This is an action for negligently injuring and killing a dog by the driver of a streetcar. The Supreme Court of Tennessee affirmed a verdict for $200 after defendant train killed plaintiff’s dog. The Court reasoned that since large amounts of money are now invested in dogs, and since they are regarded as companions to many in society, they now have "a distinct and well established status in the eyes of the law." Thus, the owner of a dog has property rights in that dog to maintain an action at law. The Supreme Court of Tennessee found that the defendant company was guilty of negligence in the killing of Dew's dog, that his death could have been prevented by the exercise of proper care and diligence.

St. Ann. § 5-103 to 107 OK ST T. 2 § 5-103 to 107 This article is known as the “Oklahoma Farm Animal, Crop, and Research Facilities Protection Act." A person commits an offense if, without the consent of the owner, the person acquires or otherwise exercises control over an animal facility, an animal from an animal facility, or other property from an animal facility with the intent to deprive the owner of such facility, animal, or property and to disrupt or damage the enterprise conducted at the animal facility. The Defendant had been convicted in the county of Berks upon an indictment for maliciously, wilfully, and wickedly killing a Horse; and upon a motion in arrest of Judgment, it came on to be argued, whether the offence, so laid, was indictable? The court affirmed the trial court's conviction of defendant for killing a horse.

Lewis v. Chovan Slip Copy, 2006 WL 1681400 (Ohio App. 10 Dist.) 2006-Ohio-3100

This Ohio case raises the issue of whether an employee of a pet grooming establishment is a "keeper" under state law, thereby preventing the application of strict liability for injury. The employee was bitten by dog while attempting to assist the establishment's owner and another employee in giving the dog a bath. She then brought an action against dog's owners asserting, among other things, that the owners were strictly liable for her injuries. The court relied on its previous definition of the word "keeper" in the context of R.C. 955.28(B) as "one having physical charge or care of the dogs." Based upon this precedent, the court found that a person who is responsible for exercising physical control over a dog is a "keeper" even if that control is only temporary.
