Included are general anti-cruelty laws for any animal (including domestic and wild animals), exhibitions of fighting animals, provisions for protection of animals riding in motor vehicles, restrictions related to docking the tail of a horse, provisions for the use of animals in science classes or fairs, laws against maiming or willfully interfering with police dogs or horses, laws related to the willful interference with organizations or projects involving animals, and provisions related to dogs riding in pick-up trucks. Paula Brosnahan 6 Animal L. 185 (2000) New Zealand's Animal Welfare Act has been touted as a world first in great ape protection, and that may be true. However, it has also been depicted as an act conferring basic legal rights on great apes, and that is an exaggeration. Challenging the legal status of great apes in any jurisdiction requires sound, factual propositions. Therefore, the background and breadth of New Zealand's protections must be understood before proponents of change employ them as precedent. New England Anti-Vivisection Society v. United States Fish and Wildlife Service and Yerkes National Primate Research Center 208 F. Supp. 3d 142 (D.D.C. 2016) 2016 WL 4919871 (D.D.C., 2016) New England Anti-Vivisection Society (NEAVS), a non-profit organization that dedicates itself to animal-welfare, brought suit against the United States Fish and Wildlife Service (FWS) for issuing an export permit to Yerkes National Primate Research Center (Yerkes). NEAVS filed suit against FWS arguing that FWS had violated the Endangered Species Act, the Administrative Procedure Act, the National Environmental Policy Act, and the Convention on International Trade in Endangered Species. NEAVS argued that FWS had violated the acts by allowing Yerkes to export chimpanzees in exchange for making a financial donation that would be put towards a program to help with “habitat destruction and disease, which face wild chimpanzees in East Africa.” The court reviewed the case and determined that it did not have subject-matter jurisdiction to address the claims made by NEAVS. The court found that NEAVS was not able to establish standing under Article III of the Constitution because NEAVS had not “suffered an injury in fact.” Ultimately, the court held that NEAVS was unable to show that it had a “concrete and particularized injury in fact that is actual or imminent” and that is “traceable” to FWS’ actions. As a result, the court granted summary judgment in favor of FWS. Case
NE - Exotic Wildlife - 008 Keeping Wildlife in Captivity 163 NE ADC Ch. 4, § 008 Neb. Admin. R. & Regs. Tit. 163, Ch. 4, § 008 This Nebraska regulation lists species that are unlawful to keep unless a person is issued a Captive Wildlife Permit, a Controlled Shooting Area Permit, a Rehabilitation Permit or a Scientific Collectors Permit, issued by the Nebraska Game and Parks Commission or under a captive cervine permit issued by the Nebraska Department of Agriculture. Captive Wildlife Permits shall not be issued for wild birds or wild mammals which have been taken or removed from the wild. Provisions for public auctions that deal in captive wild bird or mammals are described in 008.004. Importation and exportation of wildlife are also detailed in this rule. Administrative
NE - Exotic pets - Chapter 37. Game and Parks. Article 4. Permits and Licenses. (B) Special Permits and Licenses. Neb. Rev. St. § 37-477 to 37-482 NE ST § 37-477 to 37-482 This set of Nebraska laws provides that no person shall keep in captivity any wild bird or mammal that is either in need of conservation or listed as an endangered or threatened species. Further, no person shall keep in captivity in this state any wolf, any skunk, or any member of the families Felidae (except the domestic cat) and Ursidae (the bear family). Any person legally holding in captivity, on March 1, 1986, any such animal subject to the prohibition shall be allowed to keep the animal for the duration of its life. Included are the definitions used in the Act, the legislative intent behind the Act, and the duty of the commission that oversees the Act. Violation of the Act constitutes a Class II misdemeanor. ND - Wildlife, possession/rehabilitation - Article 48.1-09. Nontraditional Livestock. N.D. Admin. Code § 48.1-09-01-01 - 48.1-09-06-01 NDAC 48.1-09-01-01 - 48.1-09-06-01 This section of North Dakota regulations concerns non-traditional livestock: any nondomestic species held in confinement or which is physically altered to limit movement and facilitate capture. The regulations describe three categories of animals: category 1 - those species generally considered domestic, or not inherently dangerous (such as turkeys, geese, ranch mink, and ducks); category 2 - certain protected species or those species that may pose health risks to humans or animals or may be environmentally hazardous (such as all deer, zebras, and nondomestic cats not listed in category 3); and category 3 - those species determined by the board to pose special concerns, including species which are inherently dangerous or environmentally hazardous (such as nondomestic swine, big cats, bears, wolves, venomous reptiles, primates, and non-domestic sheep and goats). Additionally, a person may not keep a skunk or raccoon in captivity. There are specific licensing requirements for category 2 and 3 species. The owner shall obtain a license from the board before acquiring animals classified as nontraditional livestock category 2 and category 3 species. A license or permit may not be granted by the board until it is satisfied that the provisions for housing and caring for such nontraditional livestock and for protecting the public are proper and adequate and in accordance with the standards prescribed by the board. ND - Livestock - State Board of Animal Health NDCC 36-01-00.1 - 36 ND ST 36-01-00.1 - ND ST 36-01-36 This Chapter of North Dakota laws deals with the state board of animal health, state veterinarian, and special provisions for keeping certain non-traditional livestock. Section 36-01-08.2 states that any person who keeps a mountain lion, wolf, or wolf hybrid in captivity must obtain an identification number from the state board. Section 36-01-08.4 also provides that a person may not keep a skunk or raccoon in captivity, and that the state board must adopt rules concerning the keeping of a primate, wolf, or wolf-hybrid in captivity. The remainder of the chapter deals primary with infectious disease control in livestock, although section 36-01-31 contains a ban on the keeping of a live venomous reptile. Statute

Housing, handling, health, and importation ND ADC 48.1-09-06-01 NDAC 48.1-09-06-01 This North Dakota regulation provides specific rules for Category 3 species of non-traditional livestock. These species include: wild suidae (hogs and pigs); large felids (cats) and hybrids; bears; wolves and wolf-hybrids; venomous reptiles; primates, and nondomestic sheep/goats and their hybrids.
