United States Department of Agriculture 517 F.Supp.2d 8 (D.D.C.,2007) 2007 WL 1020786 (D.D.C.,2007) Creekstone Farms Premium Beef (Creekstone) sought to independently test their slaughtered cows so they could more safely provide meat to consumers. Creekstone requested testing kits from the USDA, the same kits that USDA inspectors use to test for BSE. The district court ruled that Creekstone could perform the tests. Case
Creekstone Farms Premium Beef, L.L.C. v. Department of Agriculture 539 F.3d 492 (D.C.Cir., 2008) 2008 WL 3980533 (C.A.D.C.) Plaintiff, a supplier of beef products, brought an action against Defendant, the United States Department of Agriculture (USDA), after the USDA denied Plaintiff’s request to purchase Bovine Spongiform Encephalopathy (BSE) testing kits.   The United States Court of Appeals, District of Columbia Circuit found that the USDA has authority under the Virus Serum Toxin Act (VSTA) to regulate the use of biological products, the USDA’s interpretation of VSTA allowing the USDA to deny an import permit based on the product’s intended use was not inconsistent with the regulation and was therefore entitled to deference by the Court, the USDA’s interpretation of the word “treatment” as including diagnostic activities was entitled to deference, and that   BSE testing is a diagnostic activity for purposes of VSTA. Crime Victims’ Rights: Critical Concepts for Animal Rights Douglas E. Beloof 7 Animal L. 19 (2001)

This essay is written by a legal advocate in a socio-legal movement, the crime victims' rights movement, to legal advocates in the animal rights movement. It addresses three issues from the perspective of an outsider to the animal rights movement. First, the essay addresses the problems in the relationship between rights philosophy and successful legal rights advocacy; second, the essay reviews two animal rights legal advocate strategies of incrementalism and the common law coup; finally, the essay concludes with three practical suggestions for the animal rights movement about joining a part of the victims' rights movement to reach mutually identified goals.

Criscuolo v. Grant County 540 F.Appx. 562 (9th Cir. 2013) The plaintiff’s dog was shot by a police officer while eyewitnesses claim that right before he fired, the dog was stationary or retreating at a distance of 10-20 feet from the officer and his police K9. The pet owner filed suit against both the individual police officer and the municipality, who both claimed immunity, which was granted at the trial court. On appeal, the court upheld the dismissal of the municipality based on the fact that official policy did “not authorize unconstitutional conduct or give officers unbridled discretion to shoot any animal they encounter, even if it is not threatening.” However, the appellate court reversed the trial court’s decision in regards to the officer’s immunity, holding that viewing the circumstances in the light most favorable to the plaintiff, the killing was not necessarily reasonable to protect the officer’s safety or the safety of his police K9. Crisman v. Hallows 999 P.2d 1249 (Utah App.,2000) 393 Utah Adv. Rep. 9, 2000 UT App 104 (2000)

Plaintiff dog owners appeal the trial court's entry of summary judgment in favor of defendant Ted Hallows. Hallows. a Division of Wildlife Resources employee, shot the dogs after they got loose from plaintiffs' backyard. While the factual accounts of the shooting differed, Hallows asserted that he shot the dogs within the scope of his employment and was therefore protected under the Governmental Immunity Act. On appeal, the court first found that plaintiffs may maintain an action against Hallows for conduct outside the scope of his employment and this claim was not barred by their admitted failure to comply with the Immunity Act's notice of claim and statute of limitations requirements. Further, as to plaintiffs' claims that Hallows was not acting within his scope of employment when the shooting occurred, there was sufficient evidence to raise a genuine issue of material fact.

CRITICAL ANIMAL STUDIES AND ANIMAL LAW Maneesha Deckha 18 Animal L. 207 (2012)

Law is anthropocentric. With the limited exception of its treatment of the corporation, law is a system of rules that privileges the concept of the human and ascribes reality through a human perspective. Appreciating this, it is truly impressive that animal issues in the law have become so prominent throughout the legal education system. With this increased exposure to posthumanist critiques of the legal system and its status for and treatment of animals, an increasing number of those involved in legal education are rethinking the law’s species-based hierarchy that places humans at the apex. This flourishing interest in animal law is paralleled by growth in the field of Critical Animal Studies (CAS). However, these two disciplines have developed independently of each other. Acknowledging this, animal law scholarship is currently poised to incorporate the insights of CAS. Integrating such insight into the analysis of animal issues in the law will rectify the speciesist and otherwise exclusionary formulations of the socially constructed differences between various species, which have so far been unquestioned assumptions. CAS offers an understanding of these socially constructed differences and advances a common mission between issues identified as animal injustices and those identified as human injustices. CAS stresses the interconnection between human and animal issues, not simply parallels. This important synthesis can subvert the confinement of animal issues in the legal sphere and is key to extending these essential issues into a more diverse community.

Critical Habitat and the Challenge of Regulating Small Harms Dave Owen 64 Fla. L. Rev. 141 (2012)

This Article investigates how the U.S. Fish and Wildlife Service, the National Marine Fisheries Service, and the courts are implementing the Endangered Species Act's prohibition on “adverse modification” of “critical habitat.” That prohibition appears to be one of environmental law's most ambitious mandates, but its actual meaning and effect are contested. Using a database of over 4,000 “biological opinions,” interviews with agency staff, and a review of judicial decisions considering the adverse modification prohibition, this Article assesses the extent to which the Fish and Wildlife Service, the National Marine Fisheries Service, and the courts are relying on the adverse modification prohibition to provide habitat protection.

Critical Habitat Summary for Boulder Darter and Spotfin Chub Krista M. Cotter Animal Legal & Historical Center

This final rule is a collaborative effort between the FWS and the states of Tennessee and Alabama and Conservation Fisheries, Inc. to reintroduce the boulder darter (Etheostoma wapiti), an endangered fish, and the spotfin chub (Cyprinella (=Hybopsis) monacha), a threatened fish to its historical habitat in Lauderdale County Alabama and Lawrence County, Tennessee. This rule provides for Non-essential Experimental Populations (NEP) within the designated area and it establishes limited allowable legal takings in that area. Additionally, this rule also changes the scientific name of the spotfin chub from Cyprinella (=Hybopsis) monacha to Erimonax monachus, to reflect a recent change in the scientific literature.

Critical Habitat Summary for Buena Vista Lake Shrew Krista M. Cotter Animal Legal & Historical Center

Final rule by the FWS designating a critical habitat for the Buena Vista Lake Shrew, consisting of 84 acres, in accordance with the 1973 Endangered Species Act. The shrew was listed as endangered through a final rule that was published in the Federal Register on March 6, 2002 (67 FR 10101). The designation of the critical habitat for the shrew was made pursuant to a judicial order from the United States District Court for the Eastern District of California. The order arose from Kern County Farm Bureau v. Badgley, U.S. Dist, LEXIS 24125, 2002.

Critical Habitat Summary for Five River Mussel Species Krista M. Cotter Animal Legal & Historical Center

The FWS has designated designate 13 river and stream segments in the Tennessee Cumberland River Basins, for a total of approximately 885 river as critical habitat for five endangered mussels: Cumberland elktoe (Alasmidonta atropurpurea), oyster mussel (Epioblasma capsaeformis), Cumberlandian combshell (Epioblasma brevidens), purple bean (Villosa perpurpurea), and rough rabbitsfoot (Quadrula cylindrica strigillata). All five mussels belong to the Unionidae family.
