United States v. Daniels 377 F.2d 255 (6th Cir. 1967)

Defendant sought review of a decision from a United States district court, which during a second trial convicted defendant of armed robbery. Armed with a gun defendant went to the teller's window and handed the teller a cloth bag with a note saying that it was a holdup. Two photographs were admitted into evidence that showed agents in the relative positions of defendant and the savings and loan employees at the time of the robbery. The court found no prejudicial effect in the admission of the photographs especially in light of the positive identification of defendant by the teller in the courtroom.

However, subsection (4) now allows dogs to be present in the outdoor area of such premises if certain conditions are met. These include the permit holder (the food establishment) possessing an approved plan allowing dogs in its outdoor premises. Dogs must be on a leash and under control of their handlers. Dogs must not go through the interior of the food establishment and must not go on tables, chairs, or other fixtures. If the food establishment provides containers for food or drink for the dogs, those containers must not be washed in the food establishment. Food employees must not have contact with the dogs and the area musts be maintained so that it is clean of animal waste. Adequate signage must notify patrons of the facility's decision to allow dogs. After the USDA went to the defendant’s house to perform a prelicense inspection for an Animal Welfare Act permit for a rabbit, the USDA discovered the defendant also kept a Bengal cat, a Jungle cat and a Bobcat on the premises; the USDA then notified the Connecticut Department of Environmental Protection (DEP) about the three cats. After the defendant’s attempt to sell the three cats, the DEP confiscated them and placed them in the care of an expert; the DEP also charged the defendant with three misdemeanor violations of General Statutes section 26-40a. After trial and appellate court determinations, the Connecticut Supreme Court found the three cats to be included on the list of prohibited felidae in General Statutes section 26-40a and found General Statutes section 26-40a did not violate Due Process.

Plaintiff environmental advocacy organization sued the Bureau of Land Management (BLM) for revisions to nationwide grazing regulations for federal lands, arguing that the revisions violated the Endangered Species Act (ESA), the National Environmental Policy Act (NEPA), and the Federal Land Policy and Management Act (FLPMA). The Court of Appeals held that BLM violated NEPA by failing to take a “hard look” at the environmental consequences of the proposed changes, and violated the ESA by failing to consult with Fish and Wildlife Service (FWS) before approving the revisions. Opinion Amended and Superseded on Denial of Rehearing en banc by: Western Watersheds Project v. Kraayenbrink, 632 F.3d 472 (9th Cir., 2010).

U.S. v. Gregory (Unpublished Opinion) 933 F.2d 1016 (1991)

Defendant challenged the search of his residence in a drug raid in which his dog was shot.  The court held that the shooting of Gregory's dog was done excusably by an officer who reacted quickly in a potentially dangerous situation to a perceived attack by an animal reasonably believed to be an attack dog. The shooting of the dog did not render the search unreasonable.
