US - Livestock - To Amend Labeling Regulations under the Federal Meat Inspection Act and the Poultry Products Inspection Act Submitted by Animal Welfare Institute The Animal Welfare Institute (AWI) submits this petition for rulemaking in compliance with United Stated Department of Agriculture (USDA) regulation 9 C.F.R. § 392 and the Administrative Procedure Act, 5 U.S.C. § 551 et seq. AWI respectfully requests USDA’s Food Safety and Inspection Service (FSIS) to amend labeling regulations under the Federal Meat Inspection Act (FMIA) and the Poultry Products Inspection Act (PPIA) to require independent third-party certification for the approval of animal welfare and environmental stewardship claims on meat and poultry products. This action is necessary to 1) prevent the misleading and deceptive use of animal welfare and environmental stewardship claims, 2) provide for consistency and transparency in the label approval process, 3) meet consumer expectations for the label approval process, and 4) protect from financial harm those farmers making legitimate use of these value-added claims. Companion dogs; restaurants 65 ILCS 5/11-20-14 IL ST CH 65 § 5/11-20-14 This law provides that a municipality with a population of 1,000,000 or more may, by ordinance, authorize the presence of companion dogs in outdoor areas of restaurants where food is served, if the ordinance provides for adequate controls to ensure compliance with other Illinois health laws. An ordinance enacted under this Section shall provide that: (i) no companion dog shall be present in the interior of any restaurant or in any area where food is prepared; and (ii) the restaurant shall have the right to refuse to serve the owner of a companion dog if the owner fails to exercise reasonable control over the companion dog or the companion dog is otherwise behaving in a manner that compromises or threatens to compromise the health or safety of any person present in the restaurant. Under this law, "companion dog" means a dog other than one who is assisting a person with disability. Statute

US - Assistance animals, housing - Service Animals and Assistance Animals for People with Disabilities in Housing and HUD-Funded Programs FHEO Notice: FHEO-2013-01 This notice explains certain obligations of housing providers under the Fair Housing Act (FHAct), Section 504 of the Rehabilitation Act of 1973 (Section 504), and the Americans with Disabilities Act (ADA) with respect to animals that provide assistance to individuals with disabilities. The Department of Justice's (DOT) amendments to its regulations' for Titles II and III of the ADA limit the definition of "service animal” under the ADA to include only dogs, and further define "service animal" to exclude emotional support animals. This definition, however, does not limit housing providers' obligations to make reasonable accommodations for assistance animals under the FHAct or Section 504. Persons with disabilities may request a reasonable accommodation for any assistance animal, including an emotional support animal, under both the FHAct and Section 504. Administrative
In re Estate of Howard Brand, Late of Essex Junction, Vermont

This Vermont case considers the effectiveness of a clause in a testator’s will that directs his executor to destroy any animals that he owns at the time of his death. The testator, Howard Brand, was believed to have owned four horses and one mule at the time of his death. An unincorporated association entitled, “The Coalition to Save Brand’s Horses” was formed in response to this unusual post-mortem request, and sought to intervene in the lawsuit. In a clear case of first impression in Vermont, the Chittenden County Court held that the clause as set forth in Brand’s last codicil mandating the destruction of his animals is void as contrary to public policy.

Stat. § 173-B:1, 173:B4, 173:B5 NH ST §§ 173-B:1, 173:B4, 173:B5 New Hampshire now considers animal cruelty to be “abuse” under its protection of persons from domestic violence statute. The law now allows a judge to grant the petitioner of a protective order exclusive care, custody, or control of any animal owned, possessed, leased, kept, or held by the victim, the abuser, or a minor child in the household; the law also allows a judge to order the abuser to stay away from the pet in both temporary and final domestic violence protective orders. Lowry v. City of San Diego 818 F.3d 840 (9th Cir. Apr. 1, 2016) 2016 WL 1273183 (9th Cir. Apr. 1, 2016) Plaintiff in this case filed suit against the City of San Diego after she was attacked and bit by one of the police dogs. Lowry alleged that the City’s policy of training its police dogs to “bite and hold” individuals resulted in a violation of her Fourth Amendment rights against unreasonable seizures. The court remanded the case back to the lower court, holding that a reasonable jury could find that the use of the police dog against Lowry was an intrusion on her Fourth Amendment rights. The court maintained that the officers had reason to believe that letting the dog into Lowry’s office “off-lead” had the potential of creating severe harm. The court also noted that Lowry was not attempting to evade or resist arrest and therefore letting the dog “off-lead” may not have been reasonable. Reversed and remanded for further proceedings. Case

Under the Act, the owner of an animal is liable for damages resulting from harm that the animal causes to a person or to property, but the damages awarded can be reduced depending upon the contributory fault or negligence of the plaintiff. In addition, no animal may run at-large under this law. Any person who finds a dog,wild boar, or prescribed animal worrying, injuring or killing livestock on the premises of the owner or possessor of the livestock that person may destroy the dog, wild boar or prescribed animal. US - Marine Mammals - Petition to Designate the Sakhalin Bay-Amur River Stock of Beluga Whales under the MMPA Submitted by Animal Welfare Institute (AWI), Whale and Dolphin Conservation (WDC), Cetacean Society International, and Earth Island Institute Under § 1383 of the Marine Mammal Protection Act (MMPA), 16 U.S.C. § 1361 et seq., the Animal Welfare Institute (AWI), Whale and Dolphin Conservation (WDC), Cetacean Society International, and Earth Island Institute hereby petition the Secretary of the U.S. Department of Commerce, through the U.S. National Marine Fisheries Service (NMFS), to designate Sakhalin Bay-Amur River beluga whales (Delphinapterus leucas) in the Sea of Okhotsk as a “depleted” stock. As described herein, the best scientific information available indicates that these beluga whales constitute a stock that is well below its optimum sustainable population (OSP) and, under the MMPA, qualify for such designation. The evidence also suggests that the stock continues to decline and faces a number of risk factors, providing additional impetus for such designation. Administrative
NJ - Stone Harbor - Chapter 147: Animals (Article V: Feral Cats) Borough of Stone Harbor, New Jersey Code of Ordinances, Article V: Feral Cats, Secs. 147-24 to 147-32

This Borough of Stone Harbor feral cat ordinance sets up a Trap, Neuter and Return (TNR) program outside of the area between 111th Street and the southern end of the Borough, as well as outside of the entire Bird Sanctuary and Stone Harbor Point areas. Under this ordinance, any feral cats found within the area between 111th Street and the southern end of the Borough, the Bird Sanctuary, or the Stone Point area must be captured and transported to the County Animal Shelter for handling in accordance with the interlocal agreement between the Borough and the county applicable to such animals. Caregivers, who are uncompensated volunteers, serve to facilitate the TNR program and their duties, as well as potential penalties for not complying with their duties, are indicated within this ordinance.
