WA - Initiatives - Initiative Measure No. 1130 (AN ACT Relating to the prevention of farm animal cruelty) Initiative Measure No. 1130 (2011) This measure would prohibit confining egg-laying hens, as defined, in stacked cages or cages that prevent hens from turning around freely, lying down, standing up, or fully extending their wings. It would also prohibit selling eggs produced by hens thus confined. Violations would be a gross misdemeanor. The measure would not apply to medical research, veterinary treatment, transportation, certain temporary confinements, exhibitions, or during humane slaughter. The measure would take effect on January 1, 2018. Due to changes in signature requirements announced by the Washington Secretary of State to avoid duplication or error, the initiative did not receive an adequate number of signatures to appear on the ballot. U.S. v. CITGO Petroleum Corp. 801 F.3d 477 (5th Cir. 2015) 2015 WL 5201185 (5th Cir., 2015) CITGO was convicted of multiple violations of the Clean Air Act and its regulations, and the Migratory Bird Treaty Act of 1918 (“MBTA”). CITGO urged the 5th Circuit to reverse the Clean Air Act convictions because the district court erroneously instructed the jury about the scope of a regulation concerning “oil-water separators.” CITGO also contended that the MBTA convictions were infirm because the district court misinterpreted the statute as covering unintentional bird kills. The 5th Circuit agreed with both contentions, holding that CITGO's equalization tanks and air floatation device were not oil-water separators under the Clean Air Act's regulations and that “taking” migratory birds involved only “conduct intentionally directed at birds, such as hunting and trapping, not commercial activity that unintentionally and indirectly caused migratory bird deaths. The district court’s decision was reversed and remanded with instructions. Case

In this negligence action, a cat owner brought suit against veterinarian and veterinary clinic after she was bitten by her own cat while the cat was receiving treatment by the veterinarian. At issue, is whether the veterinarian owed a duty to the cat owner to exercise reasonable care in preventing the cat from harming the owner while the cat was being treated.  In review of the lower court’s grant of motion for summary judgment, the Court of Appeals held that substantial issues of material fact existed to preclude the grant of summary judgment. However, this was overturned on appeal at the Supreme Court. ( See , Branks v. Kern (On Appeal)   359 S.E.2d 780 (N.C.,1987)).

US - Birds - Part 15. Wild Bird Conservation Act 69 FR 4557 50 CFR 15.1 to .53 The regulations in this part implement the Wild Bird Conservation Act of 1992, Pub.L. 102-440, 16 U.S.C. 4901-4916. Exotic bird means any live or dead member of the Class Aves that is not indigenous to the 50 States or the District of Columbia. This Act prohibits the importation of exotic birds into the U.S. except by permit. Permits authorizing the importation of exotic birds will be issued under the regulations for the following purposes only: scientific research; zoological breeding or display programs; cooperative breeding programs designed to promote the conservation and maintenance of the species in the wild; or personally owned pets accompanying persons returning to the United States after being out of the country for more than 1 year. The regulations further provide that no individual may import more than two exotic birds as pets in any year. Administrative

IA - Restaurant - Inspection standards for food establishments. Iowa Admin. Code 481-31.1(137F) This Iowa regulation was amended in 2020 by adding subsection 31.1(14) to allow "pet dogs" on exterior premises of a food establishment, including outdoor patio and outdoor dining areas, provided the food establishment meets all of the listed requirements. These requirements include: having a separate outdoor entrance; not allowing food preparation in the outdoor area or storage of reusable customer utensils; mandating that food or water dishes provided to dogs are single-use and disposable or come from the pet owners themselves; prohibiting contact between employees and the dogs; making sure the outdoor area is kept clean; ensuring that the area is immediately cleaned and sanitized if body fluids are excreted; making sure the outdoor area is not fully enclosed; requiring the removal of disruptive pet dogs; and posting of rules at the entrance. These rules include the leashing of dogs at all times, the prohibiting of dogs in the interior of the food establishment and on furniture, and the requirement to notify employees if the dog deposits any body fluid. Dangerous dogs--Requirements for restraint West's RCWA 16.08.090 WA ST 16.08.090 This Washington statute outlines the state and local provisions related to dangerous or potentially dangerous dogs. It first provides that it is unlawful for an owner of a dangerous dog to permit the dog to be outside the proper enclosure unless the dog is muzzled and restrained by a substantial chain or leash and under physical restraint of a responsible person. Potentially dangerous dogs shall be regulated only by local, municipal, and county ordinances and nothing in this section limits restrictions local jurisdictions may place on owners of potentially dangerous dogs.
