Carter v. Metro North Assocs. 680 N.Y.S.2d 239, 240 (N.Y.App.Div.1998) 255 A.D.2d 251 (N.Y.App.Div.1998) In this case, a tenant sued her landlord for injuries sustained when the tenant was bitten on the face by a pit bull owned by another tenant. The court held that before a pet owner, or the landlord of the building in which the pet lives, may be held strictly liable for an injury inflicted by the animal, the plaintiff must establish both (1) that the animal had vicious propensities and (2) that the defendant knew or should have known of the animal's propensities. In this case, there was no evidence that the pit bull had vicious propensities, nor did any of the evidence support a finding that the landlord had, or should have had, knowledge of any such propensities. The appellate court found the lower court erred when it took "judicial notice of the vicious nature of the breed as a whole." The court noted that there are alternate opinions and evidence that preclude taking judicial notice that pit bulls are inherently vicious as a breed. The trial court order was reversed, judgment for plaintiff vacated, and complaint dismissed. Case

In re Estate of Howard Brand, Late of Essex Junction, Vermont

This Vermont case considers the effectiveness of a clause in a testator’s will that directs his executor to destroy any animals that he owns at the time of his death. The testator, Howard Brand, was believed to have owned four horses and one mule at the time of his death. An unincorporated association entitled, “The Coalition to Save Brand’s Horses” was formed in response to this unusual post-mortem request, and sought to intervene in the lawsuit. In a clear case of first impression in Vermont, the Chittenden County Court held that the clause as set forth in Brand’s last codicil mandating the destruction of his animals is void as contrary to public policy.

If a food establishment owner allows it, patrons may bring their pet dogs to an outdoor dining area if requirements are met. Like other states, there must be an outdoor entrance, employees must wash hands if they touch the dogs, dogs must be leashed and under control, pet waste must be properly dealt with, and "food and water provided to pet dogs shall only be in single-use disposable containers." This last provision is interesting because it considers the needs of the canine customers. Statute

Under the Act, the owner of an animal is liable for damages resulting from harm that the animal causes to a person or to property, but the damages awarded can be reduced depending upon the contributory fault or negligence of the plaintiff. In addition, no animal may run at-large under this law. Any person who finds a dog,wild boar, or prescribed animal worrying, injuring or killing livestock on the premises of the owner or possessor of the livestock that person may destroy the dog, wild boar or prescribed animal. This Borough of Stone Harbor feral cat ordinance sets up a Trap, Neuter and Return (TNR) program outside of the area between 111th Street and the southern end of the Borough, as well as outside of the entire Bird Sanctuary and Stone Harbor Point areas. Under this ordinance, any feral cats found within the area between 111th Street and the southern end of the Borough, the Bird Sanctuary, or the Stone Point area must be captured and transported to the County Animal Shelter for handling in accordance with the interlocal agreement between the Borough and the county applicable to such animals. Caregivers, who are uncompensated volunteers, serve to facilitate the TNR program and their duties, as well as potential penalties for not complying with their duties, are indicated within this ordinance.

Sales or other transfers of dogs or cats at public places MD Code, Business Regulation, § 19-105 MD BUS REG § 19-105 This 2016 law states that a person may not offer for sale, sell, offer to transfer, transfer, barter, trade, or auction a dog or cat at any public place, including a street, parking lot, carnival, swap meet, or fair, among others. The act does not apply to an animal welfare organization or animal control unit displaying dogs or cats for adoption or a prearranged sale of a dog by a dog breeder if not a recurring event. Violation results in a $500 civil penalty for a first violation, a $1,000 civil penalty for a second violation, and a civil penalty for a $1,500 for a third or subsequent violation. Statute
