State v. Wright 393 P.3d 1192 (Or.App.,2017) 284 Or.App. 641, 2017 WL 1245397 (2017) Defendant was convicted of four counts of aggravated animal abuse in the first degree after he drowned all six cats that lived with him in a water-filled trash can. On appeal, defendant challenged the exclusion of evidence that he had an intellectual disability and that he had a character for gentleness toward animals. Defendant asserts such evidence would have shown he did not act with the requisite malicious intent that the state was was required to prove. It would have been relevant in demonstrating his mental state when committing the offenses, according to defendant. The appellate court found that the lower court did not err with regard to excluding defendant's reference to an intellectual disability. The testimony at trial describing his "intellectual disability" was more of a general reference and not relevant to his mental state. On the issue of character evidence of defendant's gentleness toward animals, the appellate assumed the lower court erred because the state conceded it was harmless error in its brief. In agreeing with the state that the error was harmless, the court found any further evidence would have been cumulative because other testimony spoke to defendant's gentle character toward animals. The matter was remanded for resentencing due to errors in sentencing. Case
TN - Endangered Species - Nongame and Endangered or Threatened Wildlife Species Conservation Act of 1974 T. C. A. § 70-8-101 to 112 TN ST § 70-8-101 to 112 These Tennessee statutes comprise the Tennessee Nongame and Endangered or Threatened Wildlife Species Conservation Act of 1974 and includes the legislative intent, definitions, and factors relevant to endangered species investigations. By statute, it is unlawful for any person to take, attempt to take, possess, transport, export, process, sell or offer for sale or ship nongame wildlife, or for any common or contract carrier knowingly to transport or receive for shipment nongame wildlife. Violation constitutes a Class B misdemeanor and incurs warrantless searches and seizure of the wildlife taken and the instrumentalities used in the taking. Statute
NH - Licenses - Chapter 466. Dogs and Cats. N.H. Rev. Stat. § 466:30-a NH ST § 466:30-a This New Hampshire law provides that it is unlawful for any dog to run at large. "At large" is defined as "off the premises of the owner or keeper and not under the control of any person by means of personal presence and attention as will reasonably control the conduct of such dog, unless accompanied by the owner or custodian." Any authorized person may seize such at large dogs. Statute

Defendant appealed a conviction for cruelty to animals after several dogs that appeared malnourished and emaciated with no visible food or water nearby were found on Defendant’s property by a police officer and an Animal Control officer.  The Court of Appeals of Texas, Houston, 14th District confirmed the conviction, finding that Defendant waived any error with respect to her motion to suppress evidence by affirmatively stating at trial that Defendant had “no objection” to the admission of evidence. Finally, the Court’s denial of Defendant’s request to show evidence of Defendant’s past practice and routine of caring for stray animals and nursing them to health did not deprive Defendant of a complete defense.

Liberty Humane Soc., Inc. v. Jacobs Not Reported in A.2d, 2008 WL 2491961 (N.J.Super.A.D.) This case concerns the authority of the Department of Health to revoke certifications of animal control officers who willfully contravened the state law on impounding dogs.   The court found that “[s] ince the Department acknowledged that it is charged with revoking certifications of animal control off icers when those officers pose ‘ a threat to the health and safety’ of the community, it should follow that allegations of officers willfully and illegally taking a dog from its owner and falsifying records to claim it a stray so as to expose it to adoption by another or euthanasia calls for the Department to take action. It would be both arbitrary and capricious for the Department to ignore its duty to determine if revocation of certification is required. Case
Central Park Sightseeing LLC v. New Yorkers for Clean, Livable & Safe Streets, Inc. 157 A.D.3d 28, 66 N.Y.S.3d 477 (N.Y. App. Div. 2017) 2017 N.Y. Slip Op. 08619, 2017 WL 6043994 (N.Y. App. Div. Dec. 7, 2017) This New York cases balances animal right protestors' First Amendment rights against the government's interest in preserving public safety and flow of traffic on public streets. Plaintiff here is a business that operates horse-drawn carriage rides in Central Park. Defendant is an animal rights organization that protests the horse-and-carriage industry, often demonstrating where carriage operators drop off and pick up customers. At issue, is the manner in which defendants conduct their protests in the designated horse-drawn carriage zones. Plaintiff's claim defendants harass and threaten customers and drivers, and create a public safety issue by chasing after carriages. The court granted a preliminary injunction that enjoined defendants from things like physically blocking or impeding persons from riding or disembarking from carriages, physically touching associated persons or horses, yelling or shouting at persons or horses, obstructing the progress of a carriage ride, and handing literature to a person situated within a horse carriage. The court found the plaintiffs also established a likelihood of success on an action for public nuisance and a showing of a "special injury" aimed at plaintiff's business. Finding the injunction was content-neutral, this reviewing court then considered whether the challenged portions of the injunction burden speech no more than is necessary to assert the significant government interest. The court agreed with defendant that the "floating buffer zone" of the original order would be difficult for a protestor to assess and would burden speech more than is necessary. Thus, this court modified the order to prohibit any person from knowingly approaching within nine feet of a person in the loading/unloading carriage zone (a “conversational distance," said the court). The court also noted that the First Amendment does not require that protestors be allowed to interrupt the flow of traffic or endanger the public in the delivery of speech. The court also limited language in the original order that extended the reach of the injunction to “anyone else who becomes aware of this [d]ecision and [o]rder.” The court changed to this to defendants and “those acting in concert with the named parties” The order from the Supreme Court, New York County was modified as specified in this decision. OR - Cruelty - Arrest warrants in cruelty matters (Chapter 133) O. R. S. § 133.375 - 381 OR ST § 133.375 - 381 This set of Oregon laws relates to the arrest of those found violating the state's cruelty laws. Under the section, any person violating ORS 167.315 to 167.333, 167.340, 167.355, 167.365 or 167.428 may be arrested and held without warrant, in the same manner as in the case of persons found breaking the peace. Further, any peace officer who cares or provides for an animal pursuant to this section and any person into whose care an animal is delivered by a peace officer acting under this section shall be immune from civil or criminal liability based upon an allegation that such care was negligently provided. MO - Rabies - Chapter 322. Protection Against Rabies V. A. M. S. 322.090 - 322.145 MO ST 322.090 - 322.145 This chapter concerns laws preventing the transmission and control of rabies and other zoonotic diseases. Section 322.140 provides that if a county does not adopt rules and regulations pursuant to sections 322.090 to 322.130, whenever an animal bites or otherwise possibly transmits rabies or any zoonotic disease, the incident shall be immediately reported to the county health department. It also provides that the owner of an owner that bites is responsible for the costs associated with rabies testing and/or treatment. Further, the owner of an animal that bites or otherwise possibly transmitted rabies or any zoonotic disease shall be liable to an injured party for all damages done by the animal. Statute

The court affirmed a conviction for stealing a dog by holding that it was a "thing of value" despite the traditional common law rule to the contrary and even though it was not taxable property.

Maryland Court of Appeals held that animal-cruelty statute did not apply to researchers because there are certain normal human activities to which the infliction of pain to an animal is purely incidental and unavoidable.
